AN ORDINANCE concerning land use and zoning, rezoning one parcel
addressed 3905 Summitview Avenue from Multi - Family
Residential (R -3) to Professional Business (B -1) and
amending the zoning map of the Yakima Urban Area
accordingly.
WHEREAS, Kenneth Keller (hereafter referred to as the "Applicant"). has, by
application fled under Department of Community and Economic
Development file UAZO RZ #7 -98 and UAZO EC #17-98, requested
amendment of the Official Yakima Urban Area Zoning Map to rezone one
parcel of land at 3905 Summitview Avenue in Yakima, Washington (Yakima
County Assessor's Parcel #181322 - 13400) (referred to below as "the Subject
Property") from Multi - Family Residential (R -3) to Professional Business (B -1);
and
WHEREAS, on June 25, 1998, the City of Yakima Hearing Examiner
conducted a duly convened open record public hearing regarding the
requested rezone, and, after considering the contents of the file and evidence
received at the public hearing, issued his Examiner's Recommendation on
July 1, 1998, Examiner No. IU98 -2 -15; and
WHEREAS, the Hearing Examiner recommended approval of the requested
rezone; and
WHEREAS, the City Council considered the requested rezone and the
Hearing Examiner's Recommendation at its regular public meeting on
August 4, 1998; and
WHEREAS, after considering the contents of the file and the statements of
interested persons and the Hearing Examiner's Recommendation, the City
Council finds with respect to the requested rezone that:
1. The Subject Property is suitable for uses permitted in the Professional
Business (B -1) zoning district;
2. There exists a public need for the requested rezone;
3. Circumstances have changed since the existing zoning was established
which make the requested rezone appropriate now; and
4. The requested rezone is consistent with and complies with:
a. The requirements and considerations set forth in chapter 15.23 of the
Yakima Municipal Code;
b. The goals and policies of the Yakima Urban Area Comprehensive Plan;

c. The intent of the Yakima Urban Area Zoning Ordinance; and
d. Other applicable land use controls; and
WHEREAS, it is in the best interests of the City and its people to adopt the
Hearing Examiner's findings and conclusions and recommendation and to
approve the requested rezone; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA,
WASHINGTON:
Section 1. The Yakima City Council adopts and incorporates by reference
the findings and conclusions and recommendations of the Hearing
Examiner's Recommendation, Examiner No IU98 -2 -15, City Nos. UAZO RZ
#7 -98 and UAZO EC #17-98, issued July 1, 1998.
Section 2. The Official Yakima Urban Area Zoning Map within the City of
Yakima is amended to rezone the Subject Property, which is Yakima County
Assessor's Parcel #181322-13400, from Multi - Family Residential (R -3) to
Professional Business (B -1) in the vicinity of 3905 Summitview Avenue in
Yakima, Washington, and legally described as:
Lot 1 and the West 5 ft. of Lot 2, except the south 5 feet thereof,
CRESCENT HILLS HOMES, according to the official plat thereof,
recorded in Volume "J" of Plats, page 29, records of Yakima County,
Washington.
Section 3. The City Council finds formally that:
1. The above - described Subject Property is suitable for uses permitted in
the Professional Business (B -1) zoning district;
2. There exists a public need for the requested rezone;
3. Circumstances have changed since the existing zoning was established
which now make the requested rezone appropriate; and
4. The requested rezone is consistent with and complies with:
a. The requirements and considerations set forth in Chapter 15.23
Yakima Municipal Code;
b. The goals and policies of the Yakima Urban Area Comprehensive
• Plan;
c. The intent of the Yakima Urban Area Zoning Ordinance; and
d. Other applicable land use controls.
Section 4. The requested rezone is granted and the Official Yakima Urban
Area Zoning Map within the City of Yakima is amended accordingly to rezone
the Subject Property from Multi- Family Residential (R -3) to Professional
Business (B -1).
Section 5. The City Clerk is hereby authorized and directed to file with the
Yakima County Auditor a certified copy of this ordinance.

Section 6. Subject to the foregoing provisions and conditions, this
ordinance shall be in full force and effect 30 days after its passage, approval,
and publication as provided by law and by the City Charter, and this action
shall be final and conclusive unless within 21 days from the date this
ordinance is passed by the City Council an aggrieved party commences
proceedings for review pursuant to the provisions of Chapter 36.70C RCW.

SUMMARY EXPLANATION:
On August 4, 1998 the Yakima City Council approved the Hearing Examiner's
recommendation regarding the request for a rezone by Kenneth Keller of property
located at 3905 Summitview Avenue from R- 3,Multi Family Residential to B -1,
Professional Office . The attached ordinance will formally implements this rezone
action. No Development Agreement was required with this rezone action.
