ORDINANCE NO. 98- 21
AN ORDINANCE relating to City personnel; adopting a classification and compensation plan for
City employees to be effective January 1, 1998; amending Subsections
2.20.110 A, 2.20.110 G, and 2.20.110 I, all of the City of Yakima Municipal
• Code.
BE IT ORDAINED BY THE CITY OF YAKIMA:
WHEREAS, the City Council finds and declares an emergency to exist so as to
authorize the immediate effectiveness of this ordinance in order to adjust the employee salaries to be
effective January 1, 1998, as required by collective bargaining agreements between the City and certain
employee groups and otherwise as authorized during consideration by the Council of the 1998 budget,
now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Subsection 2.20.110 A of the City of Yakima Municipal Code is hereby amended to
read as follows:
"2.20.110 Compensation Plan. A. Pay ranges and pay steps, set out in the schedule
constituting Subsection B through 0 of this section, for the classes allocated to these pay ranges shall be
in full force and effect as of January 1, 1998. The pay rates shall constitute full compensation for those
employees with a work week of forty hours as set out in other sections of this code. Employees whose
work week is less than forty hours shall be paid at the rate which is in the same proportion to the rates
set out herein that their work week bears to forty hours. The hourly rate for those employees of the Fire
Department whose work week exceeds forty hours shall be computed according to the provisions of
Section 2.22.030 of this code.
The performance of employees in the series designated Subsection B through F shall be
evaluated annually in accordance with a management performance evaluation plan. The result of the
performance evaluations shall be the determination by the City Manager of the actual salary of each
employee in the designated positions, and the determination by the City Council of the actual salary of
the City Manager, which actual salaries shall be no less than the minimum nor no greater than the
maximum set out in the pay range applicable to the position, according to the following schedule:"
Section 2. Subsection 2.20.110 G of the City of Yakima Municipal Code is hereby amended to
read as follows:

Section 4. This ordinance is one to provide for the immediate preservation of the public
peace, property, health, safety, and welfare of the people of the City of Yakima and an emergency is
declared to exist and this ordinance shall be in full force and effect immediately after its passage, approval
and publication as provided by law and by the City Charter.

SUMMARY EXPLANATION:
The attached resolution authorizes a two -year Agreement with AFSCME Local 1122 Transit
Uniformed Employees. This contract represents the result of several months of negotiations between
the parties. The settlement package is outlined below:

1998 Budget for Transit Labor Settlement costs.

• Longevity Pay: Permanent part -time employees' longevity pay shall be
prorated on actual hours in a pay status.
• Vacation Accruals: 1/1/98 add an additional step at twenty (20) or more
years of service at an accrual rate of 18.67 hours per month (224 hours per
year) Vacation accruals for permanent part -time employees shall be
prorated based on the total number of hours in a pay status in the previous
month. Accruals shall be adjusted annually.
In addition, other contract language changes were achieved and are reflected in the
1998 -1999 collective bargaining agreement. These changes include, but not limited to,
provisions relating to business leaves, overtime status, retiree life insurance, sick
leave status, bereavement leave, change in work status, work week provisions, trading
work and savings clause. According to the Citv's calculations, the 1998 settlement cost
is estimated to be $65,696. The 1998 budget included an estimate for the settlement,
however the budget was underestimated by $9,400 and a budget appropriation will be
needed for this amount from Transits operating reserves.
As a housekeeping measure, this ordinance also allocates the classification of
Supervising Code Inspector at Pay Range 973 effective July 1, 1998. At the time, the
Council adopted the Management Compensation Study Report and Recommendations in
December, 1997, salary date for this classification was not available for inclusion in the
final report. As you may recall, the Management Compensation Study began in 1995
and at that time this classification was included in the AFSCME Municipal bargaining
unit. Subsequently, on March 20, 1997, the City filed a petition for clarification of an
existing bargaining unit with the Public Employment Relations Commission (PERC) to
exclude several classifications from the AFSCME bargaining unit. PERC scheduled a
unit clarification hearing for September 9, 1997. Immediately before the hearing, the
Examiner requested the parties to try to resolve the issue one last time without going to
formal hearing. Consequently, in lieu of the hearing, the parties negotiated a
settlement which included the exclusion of the Supervising Code Inspector from the
bargaining unit. Time and other competing workload demands did not allow a
compensation survey for this classification to be conducted until recently. The results
of that survey indicate that compensation at Pay Range 973 ($3,840.99 - $4,667.78) to be
appropriate. Other classifications allocated at that pay range include Assistant City
Attorney I, Cable Communications Manager, City Clerk, Court Services Manger,
Purchasing Agent, Supervising Associate Planner, Supervising Traffic Engineer and
Wastewater Treatment Plant Process Control Supervisor.
