AN ORDINANCE relating to public services, utilities and garbage
• collection; establishing rates for service charges;
adopting rules and regulations; and amending Sections
7.68.251 • 7.68.252 and 7.68.282, and Subsections
7.68.250A, 7.68.255A and 4.16,140C, all of the City of
Yakima Municipal Code. •

Section 1. Subsection 7.68.250D of the City of Yakima MUnicipal Code is hereby amended to read as follows:
"7.68.250 Water Service
A. Commencing January 17, 1986, the dharge for domestic water

Section 2. Section 7.68.251 of the City of Yakina Municipal Code
is hereby amended to read as follows:
"7.68.251 Bulk Rate for Municipal Purposes.
A. Tbe for domestic used by the City of l���znu
for filling swimming pools or wading in the city parks and-
for all city irrigation purposes, and the dharge for all domestic

which by agreement with the city makes playgrounds or recreational
areas avuilable for city pazk and recreation use, shall be as
follows:
1. January 17, 1986:

B. Commencing January 17, 1986, the for water
supplied through fire hydrants, When the water is used by either a
city deparbment or a private person for a public improvement
project authorized by the city, shall be based on a flat rate
charge of'8 cents per 100 cubic feet. No charge shall be made for
water supplied through fire hydrants when the water is used for
fire suppression or for maintenance and .operation puzpoaes by city
departments."

Section 3. Section 7.68.252 of the City of Yakima Municipal Code
is hereby amended to read as follows:
"7.68.252 Irrigation Rate on Domestic Water. Domestic water
may be delivered to consumers during the irrigation season at a
special irrigation rate under the following conditions:
1. In order to secure the irrigation rate, application must
be made to the utility accounts division by the consumer, who will
certify that the domestic water delivered 'under said rate will be
used for irrigation purposes on property not adequately served by
separate irrigation systems.
2. Commencing January 17, 1986, the charge for such water
supplied shall be computed as follows: An amount equal to the
maximum water meter reading taken during the previous
non-irrigation season shall be charged under the regular domestic
water rates. All water used on premises inside the city limits in
excess of such maximum usage during the previous non-irrigation
season shall be charged during the irrigation season at the rate of
twenty-one cents per one hundred cubic feet and all water used on
premises outside the city limits in excess of such maximum usage
during the previous non-irrigation season shall be charged during
the irrigation season at a rate of twenty-four cents per one
hundred cubic feet, provided, the rate for domestic water consumed
by the State of Washington or any agency thereof, or any municipal
corporation of a classification other than that charging the bulk
rate as provided by Subsection A of Section 7.68.251 of this
Chapter, and used exclusively for irrigation purposes on property
owned or occupied by such consumers shall be twenty-one cents per
one hundred cubic feet, regardless of whether the property served
is situated within or without the corporate limits of the City of
Yakima.
3. For the purpose of this section, the irrigaton rate will
commence at the regular water meter reading during the months of
February or March, as the case may be for any particular consumer;
and will terminate at the regular water meter reading during the
months of October or November, as the rase may be for any
particular consumer. In the event an application is made during
the irrigation season for the irrigation rate, the irrigation rate
will commence at the next regular meter reading after the time of
such application.
4. The sewerage service charge provided for in Chapter 7.60
Shall not apply to the indicated consumption of water billed at the
irrigation rate.
5. Consumers who have installed domestic water services
exclusively for irrigation use wil,1 be billed at the irrigation
rate without regard to dates of commencement or termination of
service, subject only to the minimum billings provided for in
Section 7.68.255." •
Section 4. Subsection 7.68.255A of the City of Yakima Municipal
1117 Code is hereby amended to read as follows:
"7.68.255 Minimum Service Charges
•
A. Commencing January 17, 1986, minimum charges for domestic
water supplied for the several sizes of meters shall be as follows:

Section 5. Section 7.68.282 of the City of Yakima Municipal Code
is hereby amended to reas as follows:
"7.68.282 Fire Service Charges. The monthly charge for each
active fire service shall be as follows:

The inside diameter of the pipe leading to a fire hydrant shall
determine the service charge. Any fire hydrant installed and maintained
by the city outside the city limits will be billed as a fire service,
Which charge shall be terminated at such time as the responsible
consumer's property is annexed to the city."
Section 6. Subsection 4.16.140 C of the City of Yakima Municipal
Code is hereby amended to read as follows:
"4.16.140 Classification of Premises -- Charges.
C. The collection of all refuse in the residential
classification shall be conducted by the City of Yakima equipment
and personnel and financed by garbage and refuse collection fees
hereinafter set forth. The City of Yakima shall not collect refuse
from apartments or multiple units in excess of four units except
upon the request of the owner or operator thereof. The following
collection fees and practices shall apply for all garbage
'collection services conducted by the City of Yakima:
1. Commencing January 17, 1986, there are hereby imposed for
refuse collection in the residential classification the
following charges for each single family dwelling and for each
residential unit in any multiple dwelling:
Basic charge for one-can residential
service at alley or curb . . . . . . .$4.25 per month
Extra charge for the second and each
additional can at alley or curb $1 . 95 per month
Basic charge for one residential
carry-out service $8 25 per month
Extra charge for the second and each

2. A surdharge, in addition to the dharges imposed by sUbsection
Cl of this section, is hereby imposed muea«h residential unit
as a charge for service paL{bzmed by the City for collecting
yard material during the eight month period 'of each year
commencing April 1 and ending November 30. The surcharge, to `
be known as the 'yard service Charge', shall be the amount of
$5.00 per month, and shall be billed to eadh residential unit
at the time and as a part of the billings rendered for other
City services applicable for that eight month period.
Any person billed for such 'yard service " who does not
utilize Any such additional refuse collection service may
ragoeat such surcharge to be cancelled from his billing by
notifying the utility office of the City of Yakiova;
and upon such notification being made, the request for sudh
cancellation shall be granted, subject to verification by the
City that sudh additional service is not utilized.
Were refuse collection service is performed for mutliple
dwellings wherein all units are carried under a single account �N�^
number and street address for water department metered
services, the multiple dwelling shall be deemed a single
residential unit for the purpose of computing the surdhazge
imposed by this subsection.
3. All of the charges for garbage and refuse collection provided
in subsections C1 and C2 Shall be billed for and paid at the
same time and for the same period as 'billings and payments are
made for other City utility seoicea1 or, in the event a
customer is served by the municipal garbage division but is
not served with another City utility, garbage and refuse
collection Charges obalI be billed and paid for according to

he so served with another City utility service. Accounts
Shall become delinquent if not paid within the time specified
by Section 7.68.025 for payment of water service charges.
4. Garbage and refuse collection charges will be suspended for
. any customer upon advance notice to the office of the division

of utility accounts that a particular premises served will be
unoccupied, and such charges will be resumed on notice to such
office to resume service. No such suspension of charges for
garbage and refuse collection service will be made for any
premises served with any other City utility unless all City
utility service to such premises is likewise suspended.
Application for resumption of service to a new customer shall
be made to the office of the division of utility accounts on
forms provided for that purpose Which shall contain the name
of the customer and the street address and number of units of
the premises to be served.
5. Collection service may be suspended for nonpayment of
accounts, but such suspension shall not relieve the person
owing such account from the duty of complying with the
provisions of this chapter or other ordinances pertaining to
garbage, refuse, or sanitation. Such suspension of service
shall render the premises Where such collection service is
suspended subject to condemnation for lack of sanitary
requirements, and the owner or person in charge or in
possession of said premises shall be subject to prosecution
for maintaining a nuisance thereon.
6. Upon failure to pay such charges and upon delinquency, the
amount thereof shall become a lien against the property from
which the garbage collection service shall have been rendered.
Such lien shall be made effective by filing a notice thereof
specifying the charges, the period covered by the charges and
giving a legal description of the premises at which the
service was rendered. Such lien shall be filed with the same
official and within the time and shall be foreclosed within
the time and manner prescribed by law for filing and
foreclosing liens for labor and material. Such encumbrances
filed subsequent to the filing of such lien, but shall be
subject to all general taxes and local improvement
assessments, whether levied prior or subsequent thereto."
Section 7. This ordinance shall be in full force and effect thirty
days after its passage, appoval and publication as provided by law and
by the City Charter.
