ORDINANCE NO. 99- 3 9
AN ORDINANCE authorizing and directing the City Attorney and/or Lyon,
Weigand & Gustafson PS to institute and prosecute :legal
proceedings for the condemnation and acquisition of real
property for the Yakima Convention Center Parking Lot
Improvement Project and for the installation of curbs,
gutters, sidewalks, structures, roadways, and public
facilities related thereto; providing for the condemnation
and taking of such real property and declaring the
condemnation and taking thereof to be necessary for a
public use required by the public interests; and directing
that compensation for such taking be paid from Fund
Number 370 Convention Center Capital Fund of the City of
Yakima.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The City Attorney and /or the law firm of Lyon, Weigand &
Gustafson PS and Russell H. Gilbert of that law firm are hereby authorized and
directed to institute and prosecute actions in the Superior Court of the State of
Washington, in and for Yakima County, for the condemnation and acquisition of
certain real property which is described on Exhibit "A" attached hereto, for the
Yakima Convention Center Parking Lot Improvement Project, in the City of
Yakima, Washington, and for the installation of curbs, gutters, sidewalks,
structures, roadways, drainage facilities and public facilities related thereto, all in
accordance with plans for such improvement project as depicted on drawings on
file in the office of the City Engineer, which plans are incorporated herein as if
fully set forth.
Section 2. The acquisition of said real property for the purposes herein
mentioned is required for the interests of the public and of the City of Yakima, and
the uses and purposes herein mentioned do constitute a public use of said
property, and said real property is necessary for the uses and purposes mentioned
herein.

Section 3. The compensation for said real property to be taken shall be
payable from Fund Number 370 Convention Center Capital Fund of the City of
Yakima.
Section 4. This ordinance shall be in full force and effect thirty (30) days
after its passage, approval and publication as provided by law and by the City
Charter.
PASSED BY THE CITY COUNCIL, signed and approved this
day of October, 1999.

SUMMARY EXPLANATION:
At Council direction, staff has prepared an ordinance for the condemnation and
acquisition of 103 and 105 North 8th Street for additional parking at the Yakima Center.
This action will continue the process of adding a necessary parking area for the
expanded Yakima Center similar to that existing parking located adjacent to these
properties. Final compensation for these properties would be payable from the 370
Convention Center Capital Fund.
On January 30, 1998, Russell Gilbert of the law firm of Lyon, Weigand &
Gustafson filed a petition for condemnation on behalf of the City which involved
parcels owned by Mr. Douglas Lemon at 104 and 106 North 9th Street, Yakima,
Washington. That matter was concluded in July 1999. The City of Yakima is now the
property owner of those parcels.
This ordinance would authorize a condemnation proceeding of neighboring
parcels at 105 North 8th Street, owned by the McKinley Family Partnership, and 103
North 8th Street, owned by Arlene Nelson.
