HomeMy WebLinkAbout1999-024 PARKING ON PUBLIC RIGHT-OF-WAY; REPEAL CHAPTER 8.66. •f ORDINANCE NO. 99- 24 AN ORDINANCE concerning parking by permit on public right -of -way, and repealing chapter 8.66 of the Yakima Municipal Code. WHEREAS, chapter 8.66 of the Yakima Municipal Code ( "YMC"), enacted in 1957, provides that for $2.50, plus satisfaction of certain other requirements, a property owner may obtain permission to establish parking on public right -of -way between the curb and property line; and WHEREAS, parking between the curb and property line is essentially parking on the planting strip, and is problematic, especially in residential neighborhoods; and WHEREAS, in any event, a fee of only $2.50 is clearly out of date and is inadequate to compensate the public for the effort necessarily expended by City staff to review applications for the permits allowed by chapter 8.66 YMC; and WHEREAS, the City Council finds that it is in the best interest of the City to repeal chapter 8.66 of the Yakima Municipal Code; now therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA, WASHINGTON: Section 1. Chapter 8.66 of the Yakima Municipal Code is repealed in its entirety. Section 2. Severability: If any section, subsection, paragraph, sentence, clause or phrase of this ordinance, or any provision of the Yakima Urban Area Comprehensive Plan established by this ordinance, is declared invalid or unconstitutional for any reason, such decision shall not affect the validity of the remaining portions of this ordinance, or other provisions of the Yakima Urban Area Co mprehensive Plan established by this ordinance. Section 3. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter. Although the number of permits issued under this chapter is very few (5 on record); there is a potential conflict between 8.66YMC and Section 9.50.085 approved by Council in April 1997. Section 9.50.085 prohibits "stopping, standing, or parking within 10 feet of the curb" in areas east of the Burlington Northern Railroad tracks, with the exception that parking permitted under Chapter 8.66 YMC is exempt from this prohibition.
