AN. ORDINANCE accepting the recommendation of the Planning
Commission and rezoning property at South 17th
Avenue and Stewart Street from Planned Development
Zone to R-2, Two-Family Zone.
WHEREAS, pursuant to due and legal notice, the City Council
of the City of Yakima held a hearing on the 26th day of
November, 1985, on the recommendation of the Planning Commission
that real property situate at South 17th Avenue and Stewart
Street in the City of Yakima, Washington, the legal description
of which is set out hereinbelow, be rezoned from Planned
Development Zone to R-2, Two-Family Zone, and
WHEREAS, as a result of its hearing, the City Council
hereby makes its following findings and conclusions:
FINDINGS:
1. The City Planning Commission initiated this rezone
from Planned Development Zone to R-2, Two-Family Zone for
property located in the vicinity of South 17th Avenue and
Stewart Street. The initiation was at the request of Mr. Tim
Monahan who stated his plans are to construct a duplex on each
of the three vacant lots for which the rezone is sought.
2. The property is included in a larger area which was
zoned as a Planned Development Zone on May 17, 1976, pursuant to
an application for a multiple-family development. A portion of
that larger area was rezoned from Planned Development Zone to R-
2, Two-family zone, on September 30, 1980; however, the property
for which this rezone is sought remains zoned as a Planned
Development according to the rezone action of May 17, 1976, and
is undeveloped.
3. The Urban Area Plan indicates this property to be best
suited for urban residential development. The neighborhood area
All is classified as being of moderate density residential (5-12
DU/NRA) which would accommodate improvements allowed in an R-2,
two-family zone.
4. The proposed rezone is compatible with the Urban
Area Plan and with the surrounding neighborhood, and duplex
development is compatible with surrounding residential land
uses.

5. The City Planning Commission recommended that the
• property be zoned as R-2, Two-Family Zone.
CONCLUSIONS:
1. The proposed rezone is in conformance with the Yakima
Urban Area Comprehensive Plan.
2. The recommendation of the Planning Commission to rezone
the property should be affirmed, and the rezone should be
granted, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission
of the City of Yakima that the following described real property
situatein the vicinity of South 17th Avenue and Stewart Street
in the City' of Yakima, Washington, and more particularly
described as follows, to wit:
The south half of Lot 6, and the south half of the east
half of Lot 7, Allan's Acre Tracts, according to the
official plat thereof recorded in Volume "B" of Plats,
Page 103, records of Yakima County, Washington.
be rezoned from Planned Development Zone to R-2, Two-
Family Zone be, and the same is hereby, approved and said real
property is hereby rezoned to R-2, Two-Family Zone.
Section 2. The above change in zoning shall be included
and depicted on the next regularly amended Use District Map
prepared by and for the City.
Section 3. The City Clerk is hereby authorized and
directed to file with the Yakima County Auditor a certified copy
of this ordinance.
Section 4. This ordinance shall be in full force and
effect thirty days after its passage, approval and publication
as provided by law and by the City Charter.
