HomeMy WebLinkAbout1999-003 land use • • ORDINANCE NO. 99 - 0 3 • AN ORDINANCE conceming land use comprehensive planning and the Yakima Urban Area Comprehensive Plan, and amending Policy T3.10, included under Transportation Goals in the Yakima Urban Area Comprehensive Plan Action Plan, to provide for sidewalks on both sides of residential streets. WHEREAS, consideration of amendments to the Urban Area Comprehensive Plan during 1998 included consideration by the Regional Planning Commission and the City Council of whether sidewalks should be required on both sides of residential streets; and WHEREAS, the City Council enacted Ordinance No. 98 -64 to provide for sidewalks on both sides of residential streets, and at the same time recognized that Policy T3.10, included under Transportation Goals in the Comprehensive Plan Action Plan, should be amended to declare that the policy of the City of Yakima is that sidewalks should be required on both sides of residential streets; and WHEREAS, it is in the best interest of the City that Policy T3.10, included under Transportation Goals in the Comprehensive Plan Action Plan, be amended to declare that the policy of the City of Yakima is that sidewalks should be present on both sides of residential streets; now therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA, WASHINGTON: • fi 1 Section 1. Policy T3.10, which is included under the Transportation Goals in the Action Plan of the Yakima Urban Area Comprehensive Plan is amended to read as follows: 3 Policy T3.10 - Sidewalks should be required on both sides of arterial and commercial 4 collector streets and on both sides of all new, improved, and reconstructed local and 5 residential streets, and on one side of local and residential collector strccts. Section 2. Severability: If any section, subsection, paragraph, sentence, clause or phrase of this ordinance, or any provision of the Yakima Urban Area Comprehensive Plan established by this ordinance, is declared invalid or unconstitutional for any reason, such decision shall not affect the validity of the remaining portions of this ordinance, or other provisions of the Yakima Urban Area Comprehensive Plan established by this ordinance. Section 3. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter. Cook, Director of Community and Economic Development CONTACT PERSON/TELEPHONE: Don Skone, Planning Manager (575 -6184) SUMMARY EXPLANATION: • On November 24, 1998 the Yakima City Council approved implementing legislation for the Growth Management Act and directed a change in the Yakima Urban Area Comprehensive Plan policy related to sidewalks on residential streets. Amending Policy T3.10 related to sidewalks establishes consistency between Council Ordinance 98 -64, adopted on November 24, 1998 and the Comprehensive Plan. This ordinance enacts this motion of the Council.
