WHEREAS, Jennifer Pearson ( "Applicant ") has requested amendment of the Official Yakima Urban Area Zoning Map to rezone one parcel (approximately 0.4 acre) addressed 3611 Englewood Avenue (Yakima County Assessor's Parcel #181315- 43006) (referred to below as "the Subject Property ") from Multi - Family Residential (R -3) to Professional Business (B -1); and WHEREAS, on April 26, 2000, the City of Yakima Hearing Examiner conducted a duly convened, open- record public hearing regarding the requested rezone (UAZO RZ #2 -99), and after considering the contents of the file and evidence received at the public hearing, issued his Examiner's Recommendation, Examiner No. IU00 -2 -5, dated May 10, 2000; and WHEREAS, the Hearing Examiner recommended that the Subject Property should be rezoned from Multi - Family Residential (R -3) to Professional Business (B -1); and WHEREAS, at its regular public meeting on June 27, 2000, the City Council duly considered the requested rezone and the Hearing Examiner's Recommendation; and WHEREAS, after considering the Hearing Examiner's Recommendation, the contents of the file, and the statements of interested persons, the City Council fords with respect to the requested rezone, that: 1. The Subject Property is suitable to be classified Professional Business (B -1); 2. There exists a public need for the requested rezone; 3. Circumstances have changed since the existing Multi - Family Residential (R -3) zoning was established which now make the requested rezone appropriate; and 4. The requested rezone is consistent with and complies with: a. The requirements and considerations set forth in chapter 15.23 of the Yakima Municipal Code; b. The goals and policies of the Yakima Urban Area Comprehensive Plan; c. The intent of the Yakima Urban Area Zoning Ordinance; d. The Yakima City Council adopts the findings, conclusions and recommendations of the Hearing Examiner's Recommendation, Examiner No. IU00 -2 -5, dated May 10, 2000, and incorporates that Hearing Examiner's Recommendation by reference as part of this ordinance. Section 2. Regarding the Subject Property, which is addressed 3611 Englewood Avenue, and legally described as: THE SOUTH 200 FEET OF THE WEST 100 FEET OF THE SOUTHEAST 1/4 OF THE SOUTHWEST 1/4 OF THE SOUTHEAST 1/4 OF SECTION 15, TOWNSHIP 13 NORTH, RANGE 18 EWM EXCEPT THE SOUTH 20 FEET THEREOF CONVEYED TO YAKIMA COUNTY FOR A ROAD, RECORDED IN VOLUME 66 OF DEEDS, PAGE 75, RECORDS OF YAKIMA COUNTY, WASHINGTON. Subject to the foregoing provisions and conditions, this ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter, and this action shall be final and conclusive unless within 21 days from the date this ordinance is passed by the City Council an aggrieved party commences proceedings for review pursuant to the provisions of Chapter 36.70C RCW. The property is currently zoned Multi - Family Residential (R -3), and has a single family 1 dwelling. The property on the north side of Englewood is zoned B- 1 on all three sides of this parcel. Property to the south, across Englewood, is zoned R -2. 7. Project Description. The staff report is adopted and incorporated by reference. This parcel should have been rezoned when the rest of this area was rezoned to B -1, but the property owner at that time was not interested. He is elderly, his circumstances have changed, and it is now the family's wish to rezone the property. 8. Yakima Urban Area Zoning Ordinance. The criteria for rezones established by YMC 15.23.030(5) are all met, and are fully reviewed in the staff report. 9. State Environmental Policy Act. A Determination of Non - significance was issued and is now final. 10. Public Notice. Public notice of the hearing was provided in accordance with the ordinance. From the foregoing Findings, the Examiner makes the following: CONCLUSIONS 1. The Examiner has jurisdiction. 2. The proposed rezone conforms to the goals and policies • of the Yakima Urban Area Comprehensive Plan and to the intent of the Yakima Urban Area Zoning Ordinance; the property is suitable for uses permitted in the B -1 zoning district; there are no problems with neighborhood compatibility; and a public need does exist for the proposed change. 3. All notice provisions of the ordinance have been complied with. LOCATION: 3611 Englewood Avenue. STAFF CONTACT: Dan Valoff, Associate Planner. (575 -6163) SUMMARY OF RECOMMENDATION The Planning Division recommends approval of this request. FINDINGS BACKGROUND On November 15, 1999 Ms. Jennifer Pearson made application with the City Planning Division for a rezone from R -3 (Multi - Family Residential) to B -1 (Professional Business) located at 3611 Englewood Avenue. The property is currently occupied with a single family dwelling. The applicant has no current plans for developing this property. The narrative supplied by the applicant indicates that the purpose of the rezone is to allow for future B -1 type development. No development plans have been submitted with this rezone request. A similar request for a rezone of 0.89 acres from R -3 to B -1 by Gary Lukehart located at the Northeast corner of North 39th and Englewood was approved by the Hearing Examiner and the City Council in March of 1998. This rezone request is contiguous to the Lukehart rezone. On November 28, 1999 the City Council legislativly rezone the adjoining property to the east from R -3 to B -1. The result of rezoning this property will uniformly zone this block to B -1 between North 37th and 39th Avenues. Filed Hearin Examin 1 EXH # IOC. J. This 0.40 acre parcel is currently occupied with a single family dwelling. Land use and zoning on adjacent properties is as follows: Location Zoning Existing Land use North B -1 Professional office East B -1 Professional office South R -2 Mixed residential West B -1 Single family residential The subject property are bounded by North 37th Avenue, a local access street to the East, Fairbanks Avenue, a local access street to the North and Englewood Avenue, a Collector street to the South. All of these streets are fully developed with asphalt paving, concrete barrier curb, gutter, sidewalks, and street lights. The nearby intersection of North 40th Avenue and Englewood is fully signalized. Englewood Avenue carries an average of 5,050 vehicle trips per day and operated at Level of Service "A ". YAKIMA URBAN AREA COMPREHENSIVE PLAN • The 1997 Yakima Urban Area Comprehensive Plan, Future Land Use Map designates this area as being suitable for high density residential development. • • Objective G1: Encourage the physical development of the Yakima Urban Area in a manner that enhances its image as the cultural and business center. (1997 Plan) URBAN AREA ZONING ORDINANCE STANDARDS The Professional Business Zoning District (B -1) is intended to; 1) Establish and preserve areas for professional offices; and, 2) Provide a buffer between commercial clusters and residential neighborhoods; and, 3) Locate professional offices in areas presently receiving a full range of urban services. Professional offices and, in some areas, a mix of professional offices and Multi - family dwellings are the primary use of the B -1 zoning district. The proposed rezone would be an expansion of properties in this area that were rezoned B -1 zoned properties for professional medical offices of the Medical View West Subdivision platted and rezoned to B -1 in May 1993. If approved the entire block would be zoned B -1 between North 37th and 39th Avenues. The surrounding area has developed with senior housing complexes, and medical offices, over the past 8 years. In reviewing a rezone request the following items need to be taken into consideration by the reviewing officials as stated in UAZO 15.23.030: 2 DOC. J. The B -1 zoning district allows professional office development and Multi- family development up to 12 dwelling units per net residential acre as a Class (1) use . Adjoining land uses in the area consist of a single family dwelling zoned R -3 to the west, a large of condominium development, zoned R -3 to the North, and, a zero-lot line, attached single - family development, zoned R -3 to the East. Testimony at the hearing should be considered in determining whether this proposal is compatible with the surrounding land uses. 2. Comprehensive Plan compliance: The proposed zoning to B -1 is in compliance with the Urban Area Comprehensive Plan as noted in this staff report. 3. Suitability of property for existing (R -3) uses: The existing character of surrounding land uses along with location near a major arterial would indicate that the subject property is suitable for high density residential development. The Multi- Family Residential District is intended to establish and preserve high density residential development by excluding activities not compatible with residential uses. The R -3 zoning district allows for high density residential development of more than 12 dwelling units per net residential acre in areas receiving a full range of • urban services preferably located in areas near neighborhood shopping centers. Traffic generated by high density residential development should be designed not to pass through lower density residential areas. The urban area has few locations of vacant large tracts of R -3 zoned land. Most of the R -3 zoned property consist of small parcels, less than one acre, which are scattered throughout the urban area. 4. Suitability of property for proposed (B -1) uses: The existing character of the surrounding land uses would indicate that the subject property is suitable for B -1 type development. The property is large enough in size and is suitable for most uses permitted in the B -1 zoning district identified in UAZO Table 4 -1. The B -1 zone is the most limited business zone, with very few uses permitted outright as a Class 1 use. Most commercial and retail uses are not permitted in the B -1 zone. Professional offices and, in some areas, a mix of professional offices and multifamily dwellings are the primary use of the B -1 zoning district. 5. Public facilities: Public infrastructure including sewer, and water are adequate to serve this location. Previous traffic studies completed as part of the environmental analysis for other land use actions in this area indicate that peak hour traffic generation for R -3 and B -1 land uses are about the same. However, B -1 uses typically generate two to three times the total volume of trips as R -3 uses and these vehicle trips are distributed throughout the day. 3 DOC. J. DESIGN SERVICES TEAM COMMENTS A design services team meeting was held on December 1, 1999 to discuss the technical aspects of this proposal. The following is a summary of the comments received: Water /Irrigation - 12 -inch water main in Englewood Ave, fire flow available 3,500 gallons per minute. Customer Services - Domestic water currently serves 3611 Englewood and sanitary sewer is available fro a 8 -inch main in Englewood Avenue. Traffic Engineering - Englewood Avenue carries an average of 5050 vehicle trips per day and operated at Level of Service "A ". No other written comments were received. TRANSPORTATION CAPACITY MANAGEMENT ORDINANCE This project was reviewed under the Transportation Capacity Management Ordinance. On April 3, 2000 the City Traffic Engineer issued a memo stating that non - project rezone was considered as a single tenant office for the transportation concurrency analysis. The conversion of the existing house to an office would be exempt from Concurrency Review pursuant to the March 20, 2000 changes in the Concurrency ordinance. Therefore the proposed rezone and conversion of the house would not have a detrimental impact on the capacity of the arterial street system. If future plans for this site exceed the exempt threshold, concurrency review would be necessary. ENVIRONMENTAL REVIEW A Determination of Nonsignificance (DNS) was issued by the City of Yakima on April 5, 2000. The requested zoning change is suitable with the subject property. The surrounding property is all zoned B -1. There are only two other single family residences on the block and those properties are both zoned B -1. The remainder of the surrounding property is being developed for commercial purposes. Rezoning this property to B -1 will allow uniform development of the block in the future. B. Although the rezone request technically deviates from the Comprehensive Plan, due to the Plan's conformity to the City's zoning, the City had previously proposed changing the subject property to B -1 but the property owner opted to retain the R -3 rating. Changing the zoning to B -1 now would actually meet the original intent of the Comprehensive Plan. C. There are adequate existing public facilities to support the most intensive possible use of the requested zone. As stated, the surrounding property is zoned B -1 and there have been new roads and sewers installed to meet the needs of the changing area. In fact, the requested zone change will provide improved access to adjoining properties and allow for more uniform use of the public services that are in place. D. This change will make the subject property more compatible with the neighboring uses because the adjoining properties are already zoned B -1. The current owner is not planning any development for the property so there will be no immediate change in the land use. E. The public need for this zone change is to make the property conform to the City' s original plan • to make the property B -1 commercial property. By making the property conform with the adjoining properties, the future development of the area will be uniform.
