ORDINANCE NO. 2000- 20
AN ORDINANCE relating to traffic; setting speed limits on sealant coated streets and
roadways, and enacting, as a new section, section 9.50.375 of the
City of Yakima Municipal Code.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Section 9.50.375 of the City of Yakima Municipal
Code is hereby enacted as a new section to read as follows:
"9.50.375 Reduced Speed Limits On City Streets and Roadways
During Sealant Coating Application.
During periods when City streets and roadways are being sealant coated, speed
limits on treated portions of the streets and roadways shall be temporarily re- posted to
a speed limit of twenty miles per hour. Re- posting of the speed limit shall be performed
in a manner conforming to section 9.46.020 of the City of Yakima Municipal Code,
R.C.W. 47.36.060 and all other applicable State and Federal requirements. The twenty
mile per hour speed limit shall become effective when the temporary speed limit signs
are posted on the streets and roadways and shall continue in effect until City personnel
remove the temporary signs, following the appropriate sealant application and curing
period.
The temporary twenty mile per hour speed limit shall be fully enforceable by law
enforcement officers authorized to enforce traffic safety laws within the City of Yakima.
A violation of this section shall be chargeable as an infraction punishable as a violation
of posted speed restrictions in accord with R.C.W. 46.61.400."
Section 2. This ordinance shall be in full force and effect 30 days after
its passage, approval, and publication as provided by law and by the City Charter.

SUMMARY EXPLANATION: The City of Yakima maintains streets and roadways within city
limits. From time to time the City applies a sealant coating to the city streets and roadways as
part of the street and roadway maintenance. In order to preserve public safety on streets and
roadways when sealant is being applied, speed limits on streets and roadways receiving sealant
coating should be reduced to twenty miles per hour. The proposed ordinance will permit speed
• limits in areas where city streets and roadways are being sealant coated to be temporarily posted
to twenty miles per hour by approved signage located in an appropriate manner. The temporary
speed limits shall remain in effect during the sealant coating application and curing periods.
Temporary posted speed limits shall be fully enforceable by law enforcement officers authorized
to enforce traffic laws within the City of Yakima. The economic impact of this enactment should
be minimal, primarily confined to the cost of the necessary temporary signage, together with the
time expended installing and removing said temporary signage.
