HomeMy WebLinkAbout2000-001 Relating to safety of airport operations at the Yakima Air Terminal and regulating the height of objects in the ORDINANCE NO. 2000-n 1 AN ORDINANCE relating to safe and efficient airport operations at Yakima Air Terminal - McAllister Field, and, with limited exceptions, prohibiting construction of any structures, facilities or improvements within the Building Restriction Line shown on the ,Yakima Air Terminal - McAllister Field Airport Layout Plan approved by the Federal Aviation Administration, and adding a new chapter and section to Title 6 of the Yakima Municipal Code. WHEREAS, the Yakima Air Terminal - McAllister Field ( "the "Airport ") is within the territorial jurisdiction of the City of Yakima, and WHEREAS, by agreement authorized by chapter 14.08 of the Revised Code of Washington, the City of Yakima and Yakima County jointly own and operate the Airport, and WHEREAS, the Airport has been, and may be further, assisted financially by the United States Department of Transportation Federal Aviation Administration ("FAA"), and WHEREAS, FAA financial assistance is conditioned on commiluient by the owners of the Airport, "to restrict the use of land adjacent to or in the immediate vicinity of the airport to activities and purposes compatible with normal airport operations, including landing and takeoff of aircraft," and WHEREAS, the FAA generally applies its regulations to achieve safe airport operations partly by reviewing and approving airport layout plans, and the FAA has specifically reviewed and approved the Airport Layout Plan for the Airport, and WHEREAS, structures and facilities associated with an abandoned and deteriorated fish hatchery near the eastern end of the main runway at the Airport are located within the Building Restriction Line shown on the Airport Layout Plan, and WHEREAS, by letter dated August 14, 1998, the Supervisor of the Washington Section of the FAA stated the FAA's position that "portions of the fish hatchery fall within the runway safety area (RSA), object free area (OFA), primary surface, and building restriction line (BRL) of your primary ILS runway," "poses many safety concerns," and that the abandoned and deteriorated fish hatchery, "does not comply with FAA regulations, standards, grant assurances, and policies," and WHEREAS, by the same letter, the Supervisor of the Washington Section of the FAA also asserted that The airport also has the obligation, to the maximum extent possible, to restrict the use of the fish hatchery property to uses compatible with normal airport operations and to prevent the establishment or creation of any additional hazards," and WHEREAS, the fish hatchery has been abandoned and not used since 1994, and the structures there have deteriorated substantially, and Page 1 of 2 i WHEREAS, the abandoned and deteriorated structures on the fish hatchery property endanger airport operations, and WHEREAS, it is in the best interests of the public health, safety and welfare that all hazards to air navigation at the Airport be minimized and that no new hazards be created, and WHEREAS, it is in the best interest of the City of Yakima to protect the community's investment in the Airport by prohibiting any and all construction work on any structures, facilities or improvements within the building restriction line shown on the Airport Layout Plan approved by the FAA, now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA, WASHINGTON: Section 1. A new chapter and section are added to Title 6 of the Yakima Municipal Code to read as follows: Chapter 6.33 Airport Safety 6.33.010 Construction within Airport Layout Plan Building Restriction Line. Construction of any structures, facilities or improvements within the Building Restriction Line shown on the Yakima Air Terminal - McAllister Field Airport Layout Plan approved by the Federal Aviation Administration ( "FAA ") is prohibited, except that construction of structures, facilities or improvements which directly support air navigation or airport operations and which are specifically approved by the Federal Aviation Administration shall be permitted. The Airport Layout Plan ( "ALP ") most recently approved by the FAA is incorporated herein by reference, and as different ALPs may be subsequently approved by the FAA, the most recently approved ALP shall supercede the previously approved ALP for purposes of this ordinance. Section 2. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter. Kilpatrick, Airport Supervisor Subject: Airport Zoning Issues The Yakima Air Terminal, on behalf of the City of Yakima and Yakima County, accepts Federal funds from thc • Federal Aviation Administration's Airport Improvement Program (AIP) on an annual basis. Upon acceptance of each AIP Grant, the City and County of Yakima are required by the Federal Government to ratify the AIP Application For Federal Assistance (which is submitted to the FAA by thc Airport), ra , to adopt the Standard DOT Title VI Assurances that are attached to the Application. The Assurances contractually bind the City and County to certain standards as mandated by Federal Government. • Appendix 1 of the Assurances outlines certain obligations and conditions that thc "sponsor" (City and County) • must adhere as a condition of accepting the Grant. Assurance No. 20, Ha and Removal and Mitigation states "It (the sponsor) will take appropriate action to assure that such terminal airspace as is required to protect instrument and visual operations to the airport (including established minimum flight altitudes) will be adequately cleared and protected by removing, lowering, relocating, marking, or lighting or otherwise mitigating existing airport hazards and by preventing tjre establishment or creation offuture airport hazards." Assurance No. 21, Compatible Land Use states "11 (the sponsor) will take appropriate action, including the adoption of zoning laws, to the extent reasonable, to restrict the use of land adjacent to or in the immediate vicinity of the airport to activities and purposes compatible with normal airport operations, including landing and takeoff of aircraft. " In order to determine the standards that the sponsor is required to meet in carrying out these assurances, FAA. provides ample documentation. The most pertinent are the FAA Advisory Circulars (AC) and 14 Code of Federal Regulations, Part 139, Airport Certification. As an example AC 150 /5300 -13, Airport Design, establishes dimensional criteria for airport protection surfaces such as: Building Restriction Lines (1500' wide centered on runway centerline); Runway Safety Area (500' wide centered on runway centerline and extending 1000' beyond the end of the runway); Runway Primary Surface (1000' wide centered on runway centerline and extending 200' beyond the end of the runway); etc. The change in zoning requested by the Airport is required to protect these areas by not allowing construction or changes in land use that would compromise the safety of aviation. Such changes, if they are allowed to happen and end up having an adverse affect on aviation safety, would be a direct violation of the City's and County's contractual obligation to the Federal Government. The FAA has enforcement power that can be quite severe. As you are aware, the fish hatchery poses many safety concerns to the Federal Aviation Administration (FAA). Portions of the hatchery fall within the runway safety area (RSA), object free area (OFA), primary surface, and building restriction line (BRL) of your primary ILS runway. BACKGROUND ID Federal Aviation Regulation (FAR) Part 139: The Yakima International Airport is a certificated airport under FAR Part 139. With respect to RSA's, FAR Part 139 states: • a. To the extent practicable, each certificate holder shall provide and maintain for each runway and taxiway which is available for air carrier use- - (1) If the runway or taxiway had a .... (2) If construction, reconstruction, or significant expansion of the runway or taxiway began-on or after January 1, 1988, a safety area which confoiins to the dimensions acceptable to the Administrator at the time construction, reconstruction, or expansion began. b. Each certificate holder shall maintain its safety areas as follows: (1) Each safety area shall be cleared and graded, and have no potentially hazardous ruts, humps, depressions, or other surface variations. (2) Each safety area shall be drained by grading or storm sewers to prevent water accumulation. (3) Each safety area shall be capable under dry conditions of supporting snow • removal equipment, and aircraft rescue and firefighting equipment, and supporting the occasional passage of aircraft without causing major damage to the aircraft. 2 ` (4) No object may be located in any safety area, except for objects that need to be located in a safety area because of their function. These objects shall be constructed, to the extent practical, on frangible mounted structures of the lowest practical height with the frangible point no higher than 3 inches above grade. RSA Design Standards and Policy: The FAA has placed a high priority on developing projects to correct non- standard safety areas. For airport projects receiving Federal grant -in- aid assistance the use of our design standards is mandatory. It is also our policy that if a non - standard safety area exists at a certificated airport, such as Yakima's, declared distances will be required to correct the situation when: (1) Construction, reconstruction, or significant expansion of the runway began after 1/1/88 (which applies to Yakima), and (2) correction of the safety area is not feasible or will occur after 1/1/99. Instrument Approach Procedures: Also, for a runway to have an authorized instrument approach procedure, and to the extent practicable, the airport must meet certain landing surface requirements. This includes meeting the RSA standard. OFA Standard: The fish hatchery is also in the OFA. The OFA requires clearing the area of above ground objects protruding above the runway safety area edge elevation. FAR Part 77: FAR Part 77, Objects Affecting Navigable Airspace establishes the standards for determining obstructions to air navigation. The primary surface is a surface longitudinally centered on the runway and extends 200 feet beyond each end of the runway and is 1000 feet wide. The transitional surface extends outward and upward at right angles to the runway centerline and the runway centerline extended at a slope of 7 to 1 from the sides of the primary surface and from the sides of the approach surfaces. Portions of the fish hatchery penetrates both the primary and transitional surfaces, and are therefore obstructions to air navigation. • Grant Assurances: Also, as we have discussed previously, as a condition of receiving Federal funds, sponsors assume certain obligations pertaining to the operation, use, and maintenance of their airport. These obligations are embodied in the application for Federal assistance as sponsor's assurances and become a part of the grant offer, and bind the grant recipient upon acceptance. There are two grant assurances that specifically apply to the fish hatchery property. They are: a. (20) Hazard Removal and Mitigation. It will take appropriate action to assure that such terminal airspace as is required to protect instrument and visual operations to the airport (including established minimum flight altitudes) will be adequately cleared and protected by removing, lowering, relocating, marking, or lighting or otherwise mitigating existing airport hazards and by preventing the establishment or creation of future airport hazards. b. (21) Compatible Land Use. It will take appropriate action, including the 110 adoption of zoning laws, to the extent reasonable, to restrict the use of land adjacent to or in the immediate vicinity of the airport to activities and purposes compatible with normal airport s ,t 3 • operations, including landing and takeoff of aircraft. In addition, if the project is for noise • compatibility program implementation, it will not cause or permit any change in land use, within its jurisdiction, that will reduce its compatibility, with respect to the airport, of the noise compatibility program measures upon which Federal funds have been expended. Avigation and Hazard Easement: It is our understanding that the City of Yakima has an Avigation and Hazard Easement over the fish hatchery property which significantly restricts the use of the property. It is clear that no structures can be constructed which will penetrate the primary, approach, or transitional surfaces. This means that nothing can be constructed at all in the primary surface nor can anything be constructed to penetrate a surface which extends at a, slope of 7 to 1 from the sides of the primary surface and from the sides of the approach surfaces. Given this, there is only a small triangle of land that might be developable and it appears that the airport does have a significant amount of control over the property. It also appears that because the fish hatchery's structures and improvements have been abandoned and have deteriorated, and because much of the land is unimprovable, the value of the property would be minimal. POSITION Given that the fish hatchery does not comply with FAA regulations, standards, grant assurances, and policies and the fact that the fish hatchery is abandoned, the airport has an 0 obligation to take action necessary to meet the RSA and OFA design standards and FAR Part 77 or be prepared to shorten the runway's length to meet the standards by applying declared distances. The airport also has the obligation, to the maximum extent possible, to restrict the use of the fish hatchery property to uses compatible with noiuial airport operations and to prevent the establishment or creation of any additional hazards. Since the city and county own the airport, have zoning authority, and already own an existing Avigation and Hazard Easement, we believe there are already adequate controls in place to allow the city and county to bring the fish hatchery property into compliance with our regulations, . standards, grant assurances, and policies. Skone, Planning Manager - 575 -6184 SUMMARY EXPLANATION: The Yakima Airport Board has requested the City of Yakima take action to prohibit any building or development at the airport that does not comply with Federal Aviation Administration (FAA) regulations. (See Attached Letter of June 24, 1999) The purpose of the requested action is to implement assurances included in each Federal Aviation Administration grant. (See Attached Memorandum of Dec. 8, 1999) The assurances provide that appropriate action will be taken to prevent "...the establishment or creation of future airport hazards." The area of concern is land located between the centerline of the main runway (9/27) and the runway building restriction line (BRL). (See Attached Airport Layout Plan) The City Legal Department has prepared the attached ordinance to protect this area from all development except facilities of the airport.
