HomeMy WebLinkAbout2002-034 511 Land Ventures Rezone / 1400 S. 1st Street ORDINANCE NO. 2002- 34 AN ORDINANCE concerning land use and zoning, rezoning six parcels (approximately 14 acres) in the vicinity of the 1400 block of South First Street from Heavy Industrial (M -2) to Central Business District Support (CBDS), and amending the Official Yakima Urban Area Zoning Map accordingly. WHEREAS, 511 Land Ventures, LLC, is the Owner of approximately 14 acres of property in the vicinity of the 1400 block of South First Street (Yakima County Assessor's Parcel Nos. 191330- 42440, 42441, 42442, 42443, 42446, and 42448), which property is legally described as follows: Lots 38, 39, 40, 41, 47, 48, _49 & 50, together with any vacated portions of Clark Street accruing thereto. AND, that portion of Lot 37 Tying West of the Westerly right of way line of South First Street (formerly known as State Highway No. 3) as conveyed by deed recorded March 15, 1946 under Auditor's File No. 1118957, records of Yakima County, together with vacated portions of Clark Street accruing thereto. AND, the North 19.0 feet of Lot 42. ALL in St Paul Acre Lots, Recorded in Volume "A" of Plats, Page 15, records of Yakima County, Washington, hereinafter referred to as the "Subject Property "; and WHEREAS, 511 Land Ventures, LLC, by application dated February 10, 2002, requested amendment of the Official Yakima Urban Area Zoning Map to rezone the Subject Property from Heavy Industrial (M -2) to Central Business District Support (CBDS); and WHEREAS, on March 28, 2002, the City of Yakima Hearing Examiner conducted a duly convened, open- record public hearing regarding the requested rezone (UAZO RZ #2 -02, EC #5 -02), and after considering the record issued his Examiner's Recommendation, Examiner No. IUO2 -2 -7, dated April 9, 2002; and WHEREAS, the Hearing Examiner recommended that the Subject Property should be rezoned from Heavy Industrial (M -2) to Central Business District Support (CBDS); and WHEREAS, at a duly convened, closed- record hearing on May 7, 2002, the City Council duly considered the requested rezone, including the documents and other evidence which comprise the record developed before the Hearing Examiner, the Hearing Examiner's Recommendation, and the statements of interested persons; and Page 1 WHEREAS, after considering the Hearing Examiner's Recommendation, the contents of the file, and the statements of interested persons, the City Council finds with respect to the requested rezone that: 1. The Subject Property is suitable to be classified Central Business District Support (CBDS); 2. There exists a public need for the requested rezone; 3. Circumstances have changed since the existing Heavy Industrial (M -2) zoning was established which now make the requested rezone appropriate; and 4. The requested rezone is consistent with and complies with: a. The requirements and considerations set forth in chapter 15.23 of the Yakima Municipal Code; b. The goals and policies of the Yakima Urban Area Comprehensive Plan; c. The intent of the Yakima Urban Area Zoning Ordinance; d. Other applicable land use controls; and WHEREAS, it is in the best interests of the City to adopt the Hearing Examiner's findings and conclusions and recommendation to approve the requested rezone; now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Hearing Examiner's Recommendation Affirmed: The Yakima City Council adopts the findings, conclusions and recommendations of the Hearing Examiner's Recommendation, Examiner No. 1UO2-2-7, dated April 9, 2002, and incorporates that Hearing Examiner's Recommendation by reference as part of this Ordinance. Section 2. Subject Property: Regarding the Subject Property, which is legally described as: Lots 38, 39, 40, 41, 47, 48, 49 & 50, together with any vacated portions of Clark Street accruing thereto. AND, that portion of Lot 37 Tying West of the Westerly right of way line of South First Street (formerly known as State Highway No. 3) as conveyed by deed recorded March 15, 1946 under Auditor's File No. 1118957, records of Yakima County, together with vacated portions of Clark Street accruing thereto. The Subject Property is suitable to be classified Central Business District Support (CBDS); 2. There exists a public need for the requested rezone; 3. Circumstances have changed since the existing Heavy Industrial (M -2) zoning was established which now make the requested rezone appropriate; and 4: The requested rezone is consistent with and complies with: a. The requirements and considerations set forth in Chapter 15.23 Yakima Municipal Code; b. The goals and policies of the Yakima Urban Area Comprehensive Plan; c. The intent of the Yakima Urban Area Zoning Ordinance; and d. Other applicable land use controls. Section 3. Amendment of Official Yakima Urban Area Zoning Map: The Official Yakima Urban Area Zoning Map shall be amended to rezone the Subject Property from Heavy Industrial (M -2) to Central Business District Support (CBDS). Section 4. The City Clerk is hereby authorized and directed to file a certified copy of this ordinance with the Yakima County Auditor. Section 5. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter, and this action shall be final and conclusive unless within 21 days from the date this ordinance is passed by the City Council an aggrieved party commences proceedings for review pursuant to the provisions of Chapter 36.70C RCW. IUO2 -2 -7 Street, Yakima, WA The Examiner conducted a public hearing on March 28, 2002. The staff report presented by Dan Valoff recommended approval. Del Matthews appeared on behalf of the applicant. Adjacent businessman and property owner Ron Bemis attended the hearing with questions about turning movements on South 1 st Street. There was no opposition. The Examiner inspected the property prior to the hearing. SUMMARY OF DECISION. The Examiner recommends approval. From the view of the site, the matters contained in the official record including the staff report, a review of both the Yakima Urban Area Comprehensive Plan and the Yakima Urban Area Zoning Ordinance, and from evidence received at the hearing, the Examiner makes the following: FINDINGS 1. Vicinity of 1400 block South 1 Street, Yakima, WA. Parcel Numbers 191330- 42440, 42441, 42442, 42443, 42446, and 42448 3. Application. Rezone. 4. Proposed Zone. Central Business District Support (CBDS) . 5. Proposed Use. This is a non - project rezone. Mr. Matthews intends to develop the area for an outdoor and indoor public market, among other uses. 6. Current Zoning and Use. The property is currently zoned Heavy Industrial (M -2) and is vacant. It is the former site of Logan Feed and Seed and Cameron, Inc. 7. Project Description. Del Matthews and his principals own or control this property and the adjacent property to the northwest, including the discount grocery store and other businesses. They are not involved with the casino. This 14 acres is the vacant ground which has recently been cleared, and will probably be redeveloped with a multi -use commercial use center and public market. Mr. Matthews has outlined in a brochure entitled Mercado America Public Market (Exhibit 1) an outline of his proposed project. The project is not under review at this time, This is a straight rezone. Normal review will be conducted by staff with respect to building permits, SEPA, etc. when the project actually materializes. 8. Yakima Urban Area Zoning Ordinance. The criteria for rezones established by YMC 15.23.030(5) are considered below: 8.1 Testimony. All testimony was in favor of the proposal. He also agrees with Mr. Matthews that relocating the driveway to this project as far south as possible from Nob Hill Blvd. is desirable. One correspondent noted the desirability of maintaining heavy industrial zoned ground, suggesting that this rezone should not be approved because of the need to have industrial land available. This is an excellent point. However, this land has been under developed for decades. Many uses are permitted in both the M -2 and CBDS zones which promote economic development. Approving this rezone may allow development of the land consistent with market forces. Both zones permit uses which can generate significant traffic. Traffic issues will have to be dealt with during project review and cannot be permitted to encumber access to adjacent properties. 8.2 Suitability of the Property. The property is well suited for uses permitted in the CBDS zone. 8.3 Agency Recommendations. All departments and agencies indicate that public services are available, with no infrastructure problems. 8.4 Compliance with Comprehensive Plan and Zoning Ordinance. This proposal is consistent with both the comprehensive plan and the Urban Area Zoning ordinance, as reflected in the staff report. 8.5 Adequacy of Public Facilities. Adequate. The staff report contains more information concerning access, including use of Ranch Rite Road, which is a short public street connecting to South 1 Street immediately south of Nob Hill Blvd. If this project develops, installation of another access point well to the south will relieve pressure on Ranch Rite Road, reducing the probability of accidents. 8.6 Compatibility. There are no compatibility problems. This project will facilitate a mixed use commercial development within this area of the city. This property has been under utilized for decades. Approval of this rezone may spur redevelopment. 9. Public Notice. Public notice of the hearing was provided in accordance with the ordinance. From the foregoing Findings, the Examiner makes the following: CONCLUSIONS 1. The Examiner has jurisdiction. 2. The proposed rezone conforms to the goals and policies of the Yakima Urban Area Comprehensive Plan and to the intent of the Yakima Urban Area Zoning Ordinance; the property is suitable for uses permitted in the CBDS District; there are no problems with neighborhood compatibility; and a public need does exist for the proposed change. 3. All notice provisions of the ordinance have been complied with. Based upon the foregoing Findings and Conclusions, the Examiner submits to the Yakima City Council the following: RECOMMENDATION Approve this rezone application, from M -2 to CBDS. Industrial Project Description Del Matthews representing 511 Land Ventures LLC has submitted a rezone application for six parcels totally approximately 14 -acres from M -2, Heavy Industrial to CBDS, Central Business District Support in the vicinity of 1400 South 1s Street. The rezone will initially facilitate a multi- use commercial center, and a public market place. 1997 Yakima Urban Area Comprehensive Plan This rezone is compatible with the following Policies and Objectives of the 1997 Comprehensive: • The 1997 Yakima Urban Area Comprehensive Plan, Future Land Use Map designates this area as being suitable for Industrial development. The Future Land Use to Zoning Map Con- sistency chart provides a guide to the compatibility of land use designations and the zoning districts. The Chart indicates that the Industrial designation is compatible with the CBDS zoning district. • Objective G1.1: Encourage the physical development of the Yakima Urban Area in a manner that enhances its image as the cultural and business center. (1997 Plan) e Policy C8.2: Encourage major commercial, industrial, and multi - family developments to lo- cate within city limits. e Objective C2: Provide convenient shopping locations consistent with the development pattern of the community. Yakima Urban Area Zoning Ordinance Chapter 15.03.030 states that the purpose of the CBDS zoning district is to accommodate whole- sale and retail activities with some high- density residential development. This district is primarily located near the central business district and along the major arterials leading to the central busi- ness district. Like the CBD district, a variety of land uses are permitted. However, the intensity of development is intended to be less than in the CBD district. Ch. 15.23.030 Rezone criteria Recommendations for approval of rezone applications are governed by seven criteria specified in Section 15.23.030 YMC. 1. Testimony at public hearing. To be considered by the Hearing Examiner. UAZO RZ #2 -02; EC # 5 -02 DOC;, 511 Land Ventures LLC — 1400 S. 1 St. 2 INDEX 2. Suitability of property for proposed use. The requested zoning change is suitable with the property in question because the prop- erty is served with all urban services and located along a major arterial street. The prop- erty is now designated Industrial by the Urban Area Comprehensive Plan and is located in an area of the city which is largely a mix of commercial and industrial land uses. 3. Recommendations from interested agencies. All agencies and city departments indicate that public services are available to the site and this rezone would not create any difficulties for infrastructure. 4. Compliance with the Comprehensive Plan. The Comprehensive Plan's future land use map designates this property as suitable for In- dustrial development. The Future Land Use to Zoning Map Consistency chart provides a guide to the compatibility of land use designations and the zoning districts. The Chart in- dicates that the Industrial designation is compatible with the CBDS zoning district. The Yakima Urban Area Comprehensive Plan sets out certain Goals, Objectives and Policies to help direct growth and change. The proposal is in compliance with the Goals, Objectives and Policies of the Comprehensive Plan. 5. Adequacy of public utilities. This property is currently served by all necessary public utilities. Street access is from South 1St Street which is a fully developed Major Arterial. South lSl Street carries an av- erage of 16,100 daily vehicle trips in this location and is developed with 5 lanes. Reserve capacity of the street is generally very good (LOS A). In the future, some restrictions may be imposed regarding left turns at the intersection of Ranch Rite Road and South 1st Street. 6. Compatibility of proposed use. Testimony at the hearing should be considered in determining whether this proposal is compatible with the surrounding land uses. 7. Public Need The project as proposed will provided a mixed -use commercial development within this area of the city. Development Services Team comments A design services team meeting was held on March 6, 2002 discuss the technical aspects of this proposal. The following is a summary of the comments received: Traffic Engineering — Information submitted to the DST team indicate that no project is associ- ated with this rezone at this time. Traffic circulation comments are appropriate at the project stage. However, Traffic Engineering staff offers the following preliminary comments for consid- eration. 1. At the time of project, an application for Transportation Concurrency will be required to determine the reserve capacity of the arterial street system. South 1S` Street carries UAZO RZ #2 -02; EC # 5 -02 511 Land Ventures LLC — 1400 S. 1 St. 3 Wk 2. The three -year collision history at the intersection of South 1 Street and Ranch Rite Road is cause for concern. In the three years between 1998 and 2000, a total of 29 collisions were reported at the intersection of South 1" Street and Ranch Rite Road, with a rate of 1.31 collisions per Million Entering Vehicles (MEV). Of those colli- sions, 14 were reported to be rear end collisions and 8 were reported to be broadside collisions. Clearly, a problem exists with the spacing of this intersection in relationship to the major street intersection of Nob Hill Boulevard with South ls Street. Traffic Engineering staff suggests that NO additional commercial traffic be directed to Ranch Rite Road in its present condition. In the future, some restrictions may be imposed re- garding left turns at this intersection. 3. Will the proposed access road be a public street? Will all the development parcels have access on this street? How about adjoining parcels? If adequately developed, this new street would be a much safer location for turning movements from South 1st Street than Ranch Rite Road. 4. Care should be taken to provide safe access from South ls Street in the site develop- ment plans. Intersection clearviews around the new road should be observed without obstruction of signs, landscaping or buildings. Adequate street lighting for the new road is recommended. As previously noted, these comments which relate to the project itself and are offered at this time for consideration only. Water /Irrigation — There are an 8 and 6 -inch water main located in South 1" Street on the south lot of the south lot. There is a 12 -inch main located next to the railroad. There is 5000 gpm of available fireflow at this location. No other written comments were received. The City Traffic Engineer will defer concurrency review at the time a building permit is applied for. State Environmental Policy Act A Determination of Nonsignificance (DNS) was issued by the City of Yakima on March 21, 2002. This determination was based on SEPA guidelines (WAC 197 -11 -355). There was one comment letter received on the environmental review of this rezone proposal during the 20 -day comment period. The requested zoning change is suitable with the property in question because the property is served with all urban services and located along a major arterial street. It is SunValley Enterprise's estimation that this endeavor would not enhance the commercial /retail atmosphere of the current businesses located in this area; not to mention that it would contribute to an already existing traffic flow problem at that sight. Business ventures of the proposed nature (generally) do not contribute to the tax base needed to support additional security, litter control, emergency response, etc. Yakima has open -air markets already in existence. The fairgrounds facility, for example, has been pursuing promotion of these activities and is already set up to handle the upcoming issues such as parking, restroom accommodations, etc. The downtown folks have also been striving to encourage retail sales activities with a farmer's / outdoor market. In closing, Yakima is limited to say the least, in quality commercial /industrial land located inside the city limits. SunValley Enterprises would like to see these fourteen acres of prime, centrally located real estate, be used for development of possible industry which would not only create jobs, but also contribute to the overall enhancement of the city of Yakima. However, Traffic Engineering staff offers the following preliminary comments for consideration: 1. At the time of project, an application for Transportation Concurrency will be required to determine the reserve capacity of the arterial street system.South First Street carries an average of 16,100 daily vehicle trips in this location and is developed with 5 lanes. Reserve capacity of the street is generally very good (LOS A). 2.The three year collision history at the intersection of South First Street and Ranch Rite Road is cause for concern. In the three years between 1998 and 2000, a total of 29 collisions were reported at the intersectionof South First Street and Ranch Rite Road, with a rate of 1.31 collisions per Million Entering Vehicles (MEV). Of those collisions, 14 were reported to be rear end collisions and 8 were reported to be broadside collisions. Clearly, a problem exists with the spacing of this street intersection in relationship to the major street intersection of Nob Hill Boulevard with South First Street. Traffic Engineering staff suggests that NO additional commenrcial traffic be directed to Ranch Rite Road in its present condition. In the future, some restrictions may be imposed regarding left turns at this intersection. 3. Will the proposed access road be a public street? Will all the development parcels have access on this street? How about adjoining parcels? If adequately developed, this new street wuld be a much safer location for turning movements from South First Street than Ranch Rite Road. 4. Care should be taken to provide for safe access from South First Street in the site development plans.lntersection clearviews around the new road should be observed without obstruction of signs, landscaping or buildings. INDEX T PROJEC 1 DESCRIPTION 511 Landventures, LLC has acquired several adjoining pieces of property within Nt the City Of Yakima and plan to develop a project that would cater to and provide goods & services to the Valley's diversified cultures and specifically target the large and growing Hispanic population. The site currently houses seven established businesses as well as being immediately adjacent to six additional `4= businesses (refer to Exhibit 2). The Canned Foods Outlet (Canned Food Warehouse) is the "Flagship" tenant, which services an average of 1,000 customers per day and will be a major source in drawing shoppers to The Mercado America. A plan is being developed to take approximately 14 acres around the Canned Foods Outlet to build The Mercado America Project; which will be a "Public r„ Market Place" based upon a Spanish theme, which would be centered around a Flea/Farmers Market type of atmosphere. In fact, it would be the largest Flea/Farmers Market in Central Washington. The site would be comprised of approximately 38 inside vendors and up to 1500 outside vendor spaces with room for food service vendors; a small children's carnival arcade room; outside concert stage, day space car lot, and monthly retail shops. These facilities would be open to the public year around. The demographics for Yakima and a struggling economy express a huge need in our community for this type of facility. The proposed Mercado America Project ( Mexican Market place) is the first of its kind in the entire Pacific Northwest, and is based on two successful models in San Diego and San Jose, California. The purpose and objectives of The Mercado include: 1. Develop a commercial retail center for new and emerging entrepreneurs with a primary focus on women and minorities. 2. The Mercado America will host a well - established, spacious Mexican restaurant, to add a sense of comfort and elegance to the marketplace. In addition, the site will have "Special Events" facilities, including a stage and Green Belt Area, which will offer the capability of handling "large group" events. These facilities would be capable of handling all of the needs of Musicians and Craft Fairs, as well as most other types of specialty events. The desire is to create a Spanish -style setting with the openness of a Mexican or European marketplace, which will offer shoppers the opportunity to socialize, relax and enjoy the sights and sound of the marketplace. Ample parking spaces will be available for The Mercado America shoppers and the design will incorporate design guidelines provided in the WAC5120 accessibility code for disabled and handicapped individuals. In addition to the pride The Mercado America will bring to the City's Hispanic community, the economic benefits of this development includes the creation of temporary construction jobs, approximately 150 permanent jobs, and additional retail and real estate tax revenue for the City of Yakima.
