. AN, ORDINANCE accepting the recommendation of the Planning
Commission and rezoning property at the Yakima Air
Terminal from R-4, Suburban Residence Zone and M-4,
• Planned Industrial Zone, to M-3, Airport Zone; and
110 declaring an emergency.

WHEREAS, pursuant to due and legal notice, the City Council
of the City of Yakima held a hearing on the 14th day of January,
1986, on the recommendation of the Planning Commission that real
property situate within the Yakima Air Terminal in the City of
Yakima, Washington, the legal description of which is set out
hereinbelow, be rezoned from R-4, Suburban Residence Zone and
M-4, 'Planned Industrial Zone, to M-3, Airport Zone, and
WHEREAS, as a result of its hearing, the City Council
hereby makes its following findings and conclusions:
FINDINGS:
1. The City Planning Commission initiated a rezone at the .
request of the Yakima Air Terminal Board to rezone property
located within the boundaries of the Airport from R-4, Suburban
Residence Zone and M-4, Planned Industrial Zone to M-3, Airport
Zone. The purpose for the rezone is to have like zoning for all
Air Terminal properties and permit future development of
airport-compatible land uses.
2. The City of Yakima and the Federal Aviation Administra-
tion in the mid-1970's went to considerable effort and expense
to purchase land, relocate residences and remove incompatible
structures (houses)' from properties lying immediately adjacent
to the Airport boundary. The site being requested for rezone
was one of the residential areas purchased and intended for
future airport development. A proposed development for a
hangar/office building requires that the property be rezoned.
-110 3. The proposed rezone would be consistent with the
Yakima Urban Area Comprehensive Plan; • and is ,consistent with
future development plans for the Yakima Air Terminal..'-.
4. The use of the property for purposes_allowed in the
M-3, Airport Zone, would be consistent with surrounding land

uses.

5. The City Planning Commission recommended approval of
the rezone.
CONCLUSIONS:
1. The recomMendation of the Planning Commission to rezone
the property should be affirmed, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission 4IP
of the City of Yakima that the following described real property
situate in the Yakima Air Terminal, in the City of Yakima,
Washington, and more particularly described as follows, to wit:
That part of the southeast quarter of the southeast
quarter of the northwest quarter of Section 35, Town-
ship 13 North, Range 18, E.W.M., lying southwesterly of
the centerline of the Washington Avenue Bypass; EXCEPT
the east 340 feet thereof.
be rezoned from R-4, Suburban Residence Zone and M-4, Planned
Industrial Zone, to M-3, Airport Zone, be, and the same is
hereby, approved and said real property is hereby rezoned to
M-3, Airport Zone.
Section 2. The above change in zoning shall be included
and depicted on the next regularly amended Use District Map
prepared by and for the City.
Section 3. The City Clerk is hereby authorized and
directed to file with the Yakima County Auditor a certified copy
of this ordinance.
Section 4. This ordinance is one to provide for the
immediate preservation of the public peace, property, health,
safety and welfare of the people of the City of Yakima and an
emergency is hereby declared to exist and this ordinance shall
be in full force and effect immediately upon its passage,
approval and publication as provided by law and by the City
Charter.
