HomeMy WebLinkAbout2000-052 Commission of Limited Authority Police Officers ORDINANCE NO. 2000 -52 AN ORDINANCE relating to Administration; authorizing the Chief of Police to commission limited authority police officers and; enacting as new Section, Section 1.48.025 of the City of Yakima Municipal Code. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 1.48.025 of the City of Yakima Municipal Code is hereby enacted as a new section to read as follows: "Police Chief- limited commissions. The Police Chief is, in addition to any other authority granted by law or the City Council, authorized to commission special authority police officers for limited purposes such as, but not limited to, service of warrants at the City Jail by corrections officers or impoundment of hulk or abandoned vehicles by employees of the Code Administration Division. Such limited commissions shall be issued only to persons otherwise employed by the City of Yakima. Such special authority officers shall not carry weapons unless specifically authorized to do so by the Police Chief and shall not, by virtue of their commission, be entitled to any relief or pension benefits under any plan administered under state statute. The Police Chief may revoke any limited commission at will, which revocation shall be effective immediately upon issuance in writing. Any and all limited commissions issued under the authority granted by this section shall be automatically revoked if and when the holder of the commission ceases to be employed by the City" Section 2 This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter. SUBMITTED BY: Don Blesio, Chief of Police CONTACT PERSON/TELEPHONE: Don Blesio, Chief of Police 575 -6211 Gary Belles, Police Lieutenant 576 -6547 SUMMARY EXPLANATION: The proposed ordinance would authorize the Police Chief to commission special authority police officers for limited purposes such as, but not limited to, service of warrants at the City Jail by corrections officers or impoundment of hulk or abandoned vehicles by employees of the Codes Administration Division. Such limited commissions would be issued only to persons otherwise employed by the City of Yakima. Special authority officers would not carry weapons unless specifically authorized to do so by the Police Chief and would not be entitled by virtue of their limited commission to relief or pension benefits under any plan administered under state statute. The Police Chief would have the authority to revoke any limited commission at will and that revocation would be effective immediately upon issuance in writing. Any limited commission issued under the authority granted by the proposed ordinance would be automatically revoked whenever the holder of such a commission ceased to be employed by the City. The proposed ordinance would not alter any other authority the Chief of Police is granted by law or the City Council. Reduction of resources within the Police Department has led to the need for this ordinance. The proposed ordinance will allow more police officers to remain in service to meet urgent and critical needs of Yakima residents by enabling other City personnel to provide services that will no longer require a fully commissioned police officer.
