HomeMy WebLinkAbout2000-062 Yakima Police Reserve Officers Relief & Pension Plan • a a ORDINANCE NO. 2000- 62 AN ORDINANCE relating to the reserve police department; authorizing the enrollment of reserve police officers under the relief and compensation provisions of the Volunteer Firefighters' and Reserve Officers' Relief and Pension Act; authorizing the participation of reserve police officers in the pension and retirement provisions of the Volunteer Firefighters' and Reserve Officers' Relief and Pension Act; establishing a Reserve Officers' Board of Trustees; electing to count and pay the. actuarial cost of all credit for all service of qualifying reserve officers for purposes of the pension and retirement provisions; amending section 1.48.050 of the City of Yakima Municipal Code; amending sections 1.91.010, 1.91.020, 1.91.030, 1.91.040, 1.91.050, 1.91.060, 1.91.070, and 1.91.080 of the City Of Yakima Municipal Code; and adding new sections 1.91.055 and 1.91.090 to the City of Yakima Municipal Code. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 1.48.050 of the City of Yakima Municipal Code is hereby amended to read as follows: "1.48.050 Reserve police department.. A. Department Created. There is created a department of reserve police, to consist of such members as may be appointed from time to time by the chief of police. B. Duties and Authority. Members of the reserve police department shall assist the police department in its duties as may be determined by the chief of police. No member of the reserve police department shall have the authority to arrest for the commission of any crime other than the authority of a private citizen unless otherwise commissioned by the chief of police who is empowered to commission any such members with the authority of a duly commissioned peace officer to make arrests upon a showing to the satisfaction of the chief of • police by a reserve officer of his qualifications to be so commissioned and upon his giving of the oath of a peace officer before a judge or magistrate. • C. Organization. The reserve police department shall be organized and administered by the chief of police, or by an officer of the police department assigned by the chief of police to that function. Ranks of reserve police officers shall be designated, and appointments made thereto, as the chief of police deems necessary or advisable. • D. Members. (1) Appointment. Members of the reserve police department shall be appointed by the chief of police. No person shall be appointed as a member who has ever been convicted of a felony or of any crime involving moral turpitude, and no person shall be appointed as a member unless he is of good moral Page 1 (lk)ord /police reserve pension pm e • character and otherwise demonstrates attributes necessary to perform the duties of a reserve police officer, all as determined by the chief of police. (2) Tenure. A member's appointment to the reserve police department may be revoked by the chief of police at any time it appears to him that such member is not satisfactorily performing his duties as a reserve police officer, or if such member otherwise conducts himself in a manner so that the chief of police determines that such appoirthuent should be revoked. The revocation of any member's appointment shall also revoke that member's commission to arrest as a peace officer. (3) Status of members. No reserve police officer shall be compensated for his duties as such, nor shall membership in thc reserve police department entitle any member to any relief or pension benefits under any plan administered under state statute. Appointments and revocation of appointments to membership in the reserve police department, and promotions of rank, shall be made solely at the discretion of the chief of police and shall not be subject to approval or review by the civil service commission. E. Rules and Regulations. (1) Badge and Insignia. The city of Yakima shall furnish a uniform, shield, hat badge, insignia of rank and shoulder patch, all of distinctive and uniform design, to reserve police officers. All such badges, insignia and other city -owned property issued an officer shall be surrendered to the chief of police on the termination of membership of that officer. (2) Identification Card. The chief of police shall issue an identification card to each reserve police officer identifying that officer as a member of the reserve police department of the city, which card shall contain a facial photograph of the officer. Any officer whose membership in the reserve police department is terminated shall immediately surrender his identification card to the chief of police. (3) Firearms. A reserve police officer, while on duty in uniform, may carry a firearm at the discretion of the chief of police only after such reserve officer has qualified in a firearms training course under the direction of the chief of police. (4) Administrative rules and regulations. The chief of police may adopt such rules and regulations consistent with the provisions of this section as he deems necessary or convenient to organize and administer a reserve police department and its functions. Insurance and Workman's Compensation Premiums. Sections 1.91.010, 1.91.020, 1.91.030, 1.91.040, 1.91.050, 1.91.060, 1.91.070, and 1.91.080 of the City of Yakima Municipal Code are hereby amended, and new sections 1.91.055 and 1.91.090 are hereby added to the City of Yakima Municipal Code, to read as follows: . "1.91.010 Creation of volunteer firefighters' and reserve officers' relief and pension fund. Pursuant to RCW Chapter 41.24, tThere is created a special fund to be designated the volunteer firefighters' and reserve officers' relief and pension fund, which shall be made up of all monies budgeted for such purposes, all assessments made upon members of the volunteer fire division and members of the reserve police department, and bequests, fees, gifts, emoluments or donations given or paid into same. 1.91.020 Deductions to be made from reimbursement of expenses. The director of finance and budget shall, when making out warrants for the reimbursement of volunteer firefighter and reserve officer expenses, deduct and withhold from said warrants any and all fees and contributions required to be paid by said volunteer firefighters pursuant to the Volunteer Firefighters' and Reserve Officers' Relief and Pension Act, RCW Chapter 41.24 (and any amendments thereto). All amounts so withheld shall be paid and credited to the volunteer firefighters' and reserve officers' relief and pension fund. 1.91.030 City contributions to fund. The director of finance and budget shall pay into the volunteer firefighters' and reserve officers' relief and pension fund all fees and contributions that the city is required to make pursuant to statute, together with any other monies specifically obligated by the city council for said purposes. • 1.91.040 Paying money out of fund. All monies paid out of said fund shall be upon proper vouchers by warrant drawn by the director of finance and budget upon order of the appropriate board of trustees entered upon its records and otherwise in accordance with the provisions of the Volunteer Firefighters' and Reserve Officers' Relief and Pension Act, RCW Chapter 41.24. 1.91.050 Volunteer fire fighters' bard of trustees. The volunteer firefighters' and reserve officers' relief and pension fund with • regard to volunteer fire fighters shall be under the management and control of a the volunteer fire fighters' board of trustees consisting of the mayor of the city, the city clerk, the fire chief, a member of the city council, and one member of the fire department to be elected by the members of fire department for a term of one year and annually thereafter. The mayor shall be the chair of the board and the city clerk shall be the secretary - treasurer of the board of trustees. The secretary shall keep a public record of all proceedings, of all disbursements made by the board of trustees and shall make an annual report of its expenses and disbursements with a full list of the beneficiaries of said fund in the city of Yakima, such record to be placed on file in the city of Yakima. The volunteer firefighters' and reserve officers' relief and pension fund with regard to reserve officers shall be under the management and control of a board of trustees consisting of the mayor of the city, the city clerk, the police chief, a member of the city council, and one reserve officer to be elected by the reserve officers for a term, of one year and annually thereafter. The mayor shall be the chair of the board and the city clerk shall be the secretary - treasurer of the board of trustees. The secretary shall keep a public record of all proceedings, of all disbursements made by the board of trustees and shall make an annual report of its expenses and disbursements with a full list of the beneficiaries of said fund in the city of Yakima, such record to be placed on file in the city of Yakima. 1.91.060 Board of trustees -- Meetings -- Rules. The Each board of trustees shall meet on the call of its chair on a regularly monthly meeting day when there is business to come before it - : -- - - - - Each board of trustees It shall make all such rules and regulations as may be necessary to carry out the purpose for which it is created, and shall in all respects proceed in accordance with and be governed by the statute as enacted by the legislature of the state of Washington provisions of RCW Chapter 41.24. 1.91.070 Enrollment under relief and compensation provisions. All volunteer firefighters and reserve officers shall be enrolled pursuant to RCW 41.24.020(1) (and any amendments thereto) and RCW 41.24.450 (and any amendments thereto) under the relief and compensation provisions of the Volunteer Firefighters' and Reserve Officers' Relief and Pension Act for the purpose of providing protection for said firefighters, reserve officers and their families from death or disability arising in the performance of their duties as firefighters or reserve officers. 1.91.080 Inclusion in volunteer firefighter and reserve officer pension provisions. The city of Yakima elects, pursuant to RCW 41.24.020 and RCW 41.24.400, to participate in the pension and retirement provisions of the Volunteer Firefighters' and Reserve Officers' Relief and Pension Act, whereby any qualifying volunteer firefighter or reserve officer may enroll under the pension provisions of said Act to avail himself or herself of the retirement benefits available thereunder. 1.91.090 • Reserve officers — Credit for service. Pursuant to RCW 41.24.410(3), the city of Yakima elects to count and pay the actuarial cost of all credit for all service of qualifying reserve officers. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter. Gary Belles at 576 -6547 SUMMARY EXPLANATION: The proposed ordinance would authorize current officers of the Yakima Police Reserve to be enrolled in the Volunteer Fire Fighters' and Reserve Officers Relief and Pension plan as provided for by RCW and would fund that enrollment. A one-time option to purchase prior service points at the time of initial enrollment is provided for by the RCW, allowing reserve officers to receive credit for past service through the plan. The purchase of prior service points for serving reserve officers with past years of service is included in the ordinance. The pension plan provisions provide a pension upon a reserve officer's retirement based upon his or her years of service. The relief provisions replace Labor and Industries coverage for duty related medical expenses and provide death benefits to spouses and dependents in the event of duty related death. Total cost of the plan is $16,295.50. Costs included are as follows: A. $3,060 funds the year 2000 enrollment for the eighteen current reserve officers. (This is an annual fee of $170 for each officer in the Yakima Police Reserve.) B. $6,380 funds the purchase of prior service points for the period of July 1995 through December of 1999. This will be a one -time cost. There are currently sixteen reserve officers with prior service during this period. Two reserve officers were hired during 2000 and are - not included in this number. C. $6,855.50 funds the purchase of prior service points for the period before July 1995. This will be a one -time cost. Currently ten reserve officers have service prior to July of 1995. Officers of the Yakima Police Reserve donate thousands of hours of service to the City of Yakima annually. In 1999 alone they provided a total of 7,250.5 hours, or an average of 345 hours per reserve officer. It is appropriate to recognize such a level of service through the passage of this ordinance.
