AN ORDINANCE relating to health and sanitation; concerning containers for and
storage of garbage and yard waste for collection by the City of
• Yakima, and amending Section 4.16.140 of the City of Yakima
Municipal Code accordingly.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
1 Section 1. Section 4.16.140 of the City of Yakima Municipal Code is hereby
2 amended to read as follows:
3 4.16.140 Classification of premises — Charges.
4 A. For the purpose of regulating the collection of garbage and refuse in the city
5 of Yakima there are established two classifications: one to be known as the "residential
6 classification," and the other as the "business classification." The residential classification
7 shall include all premises occupied as a single- family housekeeping unit, either in dwelling
8 houses, apartments, or other multiple residences. "Residential unit" as used herein, is
9 defined as a unit in which all persons reside together as a single family, whether in single
10 or multiple dwellings: The business classification shall include all other premises.
11 Provided, property owned by the city may be served by city equipment and crews
12 independently of the classifications and rates established by this chapter; provided further,
13 the rules and regulations established by this chapter pertaining to receptacles and to the
14 preparation, storage, and collection of garbage, refuse and debris shall be applicable to all
15 property within the city, including that owned by the city.
16 B. The collection of all refuse in the business classification shall be made only by
17 licensed collectors, hereinafter provided for, at rates to be agreed upon between such
18 collector and the business houses served by him.
19 C: The collection of all refuse in the residential classification shall be conducted
20 by the City of Yakima equipment and personnel and financed by garbage and refuse
21 collection fees hereinafter set forth. The City of Yakima shall not collect refuse from
22 apartments or multiple units in excess of four units except upon the request of the owner or
23 operator thereof. The following collection fees and practices shall apply for all garbage
24 collection services conducted by the City of Yakima.
25 1. There are hereby imposed for refuse collection in the residential classification
26 the following charges for each single- family dwelling and for each residential unit in any
27 multiple dwelling:
28 Basic charge for one -can residential service at alley or curb $7,29 7.51 per month
29 Extra charge for the second and each
30 additional can at alley or curb $33 3.94 per month
31 Basic charge for one -can residential carry -out service $1.1.1314.55 per month
32 Extra charge for the second and each
33 additional can with carry -out service $4,24 4.37 per month
34 Call -back charge $ 7.51 flat rate

35 "Call -back charge" as used herein means a charge to be imposed when any customer
36 fails to place the garbage can or yard waste container at the appropriate place for
37 collection during the regularly scheduled pickup, resulting in a customer request for
38 collection service or yard service at a time other than the regularly scheduled time.

40 2. A surcharge, in addition to the charges imposed by subsection (C)(1) of this
41 section, is imposed on each residential unit as a charge for service performed by the city for
42 collecting yard material during the nine -month period of each year commencing March 1st
43 and ending November 30th. The surcharge, to be known as the "yard service charge," shall
44 be the amount of eight nine dollars and ninety nine twenty -six cents ($8,399.26) per month,
45 and shall be billed to each residential unit at the time and as a part of the billings rendered
46 for other city services applicable for that nine -month period.

47 Any person billed for such yard service charge who does not utilize any such
48 additional refuse collection service may request such surcharge to be canceled from his
49 billing by notifying the utility accounts office of the city of Yakima; and upon such
50 notification being made the request for such cancellation shall be granted, subject to
51 verification by the city that such additional service is not utilized.
52 Where refuse collection service is performed for multiple dwellings wherein all
53 units are carried under a single account number and street address for water department
54 metered services, the multiple dwelling shall be deemed a single residential unit for the
55 purpose of computing the surcharge imposed by this section.
56 3. All of the charges for garbage and refuse collection provided in subsections
57 (C)(1) and (C)(2) shall be billed for and paid at the same time and for the same period as
58 billings and payments are made for other city utility services; or, in the event a customer is
59 served by the municipal garbage division but is not served with another city utility,
60 garbage and refuse collection charges shall be billed and paid for according to the schedule
61 which would be applicable to such customer were he so served with another city utility
62 service. Accounts shall become delinquent if not paid within the time specified by Section
63 7.68.025 for payment of water service charges.
64 4. Garbage and refuse collection charges will be suspended for any customer
65 upon advance notice to the office of the division of utility accounts that a particular
66 premises served will be unoccupied and such charges will be resumed on notice to such
67 office to resume service. No such suspension of charges for garbage and refuse collection
68 service will be made for any premises served with any other city utility unless all city utility
69 service to such premises is likewise suspended.
70 Application for resumption of service to a new customer shall be made to the office
71 of the division of utility accounts on forms provided for that purpose which shall contain
72 the name of the customer and the street address and number of units of the premises to be
73 served.
74 5. Collection service may be suspended for nonpayment of accounts, but such
75 suspension shall not relieve the person owing such account from the duty of complying
76 with the provisions of this chapter or other ordinances pertaining to garbage, refuse, or
77 sanitation. Such suspension of service shall render the premises where such collection
78 service is suspended subject to condemnation for lack of sanitary requirements, and the
79 owner or person in charge or in possession of said premises shall be subject to prosecution
80 for maintaining a nuisance thereon, as well as enforcement of all other applicable laws.
81 6. Upon failure to pay such charges and upon delinquency, the amount thereof
82 shall become a lien against the property from which the garbage collection service shall
83 have been rendered. Such lien shall be made effective by filing a notice thereof specifying
84 the charges, the period covered by the charges and giving a legal description of the
85 premises at which the service was rendered. Such lien shall be filed with the same official
86 and within the time and shall be foreclosed within the time and manner prescribed by law
87 for filing and foreclosing liens for labor and material, and shall be superior to
88 encumbrances filed subsequent to the filing of such lien, but shall be subject to all general
89 taxes and local improvement assessments, whether levied prior or subsequent thereto.

90 D. The yard service collection, for which the yard service charge is imposed by
91 subsection (C)(2) of this section, shall include the weekly collection of yard material from
92 automated /semi- automated plastic containers furnished by the city department of public
93 works during the nine -month period for which the yard service charge is billed to any
94 particular premises. For collection purposes, the total weight of containers including yard
95 waste deposited therein, may not exceed two hundred pounds. The yard material which
96 will be so collected shall not include trees or large limbs; and tree and shrub trimmings not
97 susceptible to being stored for collection in automated /semi- automated containers. Yard
98 trimmings must not be placed against any building or fence so as to constitute a fire hazard.
99 City service does not include the collection of discarded fruit from trees.
100 E. In addition to the regulations adopted and charges imposed by subsections C
101 and D of this section, further charges are imposed in the following types of service:
102 1. A charge of one dollar and eighty four ninety-cents_($4-41.90), in addition to
103 the regular monthly charge, shall be made each time an extra can or partial can of refuse or
104 yard material is collected from any particular residential premises;
105 2. A charge of one dollar and thirty "even fourty- one - cents_($ - X1.41) , in
106 addition to the surcharge for collecting refuse and yard material, shall be made for each
107 extra container, bag, box or bundle of tree or shrub trimmings, collected from any
108 particular residential premises.
109 3. For a special garbage pickup, actual cost shall be charged to the customer.
110 Actual cost shall include the city's actual cost for labor, equipment rental, and landfill fees.
111 The minimum charge for this service shall be twenty -five dollars.
Section 2. This ordinance shall be in full force and effect 30 days after its .
passage, approval, and publication as provided by law and by the City Charter.

SUMMARY EXPLANATION:
The 2001 Refuse Division Budget includes a budgeted policy issue to increase refuse rates. At
the December 5, 2000 Budget Wrap -up, City Council approved a 3% rate adjustment on
residential can service including charges for extra containers and yard service. The increase in
refuse rates is estimated to generate an additional $54,000 in revenue for 2001.
The attached Ordinance contains revisions to subsections 4.16.140C and 4.16.140E of the
Municipal Code. Amended refuse rates will become effective thirty days after publication.
