AN ORDINANCE concerning rates for residential refuse collection and disposal
service provided by the City of Yakima, and amending Section
4.16.140 of the City of Yakima Municipal Code.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Section 1. Section 4.16.140 of the City of Yakima Municipal Code is
hereby amended to read as follows:

1 4.16.140 Classification of premises—Charges.
2 A. For the purpose of regulating the collection of garbage and refuse in
3 the city of Yakima there are established two classifications: one to be known as the
4 "residential classification," and the other as the "business classification." The
5 residential classification shall include all premises occupied as a single - family
6 housekeeping unit, either in dwelling houses, apartments, or other multiple
7 residences. "Residential unit" as used herein, is defined as a unit in which all
8 persons reside together as a single family, whether in single or multiple dwellings.
9 The business classification shall include all other premises.
10 Provided, property owned by the city may be served by city equipment and
11 crews independently of the classifications and rates established by this chapter;
12 provided further, the rules and regulations established by this chapter pertaining to
13 receptacles and to the preparation, storage, and collection of garbage, refuse and
14 debris shall be applicable to all property within the city, including that owned by
15 the city.
16 B. The collection of all refuse in the business classification be made
17 only by licensed collectors, hereinafter provided for, at rates to be agreed upon
18 between such collector and the business houses served by him.
19 C. The collection of all refuse in the residential classification shall be
20 conducted by the City of Yakima equipment and personnel and financed by garbage
21 and refuse collection fees hereinafter set forth. The City of Yakima shall not collect
22 refuse from apartments or multiple units in excess of four units except upon the
23 request of the owner or operator thereof. The following collection fees and practices
24 shall apply for all garbage collection services conducted by the City of Yakima.
25 1. There following charges are hereby imposed for refuse collection in
26 the residential classification - - - - - : ; - for each single - family dwelling
27 and, except for bin service to multiple unit dwellings, for each residential unit in any
28 multiple unit dwelling:

33 A call -back charge of eight dollars and sixty four cents ($8.64) shall be
34 imposed each time a customer requests refuse collection service at a time other than
35 the regularly scheduled time.
36 2. In addition to the charges imposed by subsection (C)(1) of this section,
37 a separate charge, to be known as the "yard service charge," is imposed on each
38 residential unit that elects to receive yard material collection service from the city
39 during the nine -month period of each year commencing March 1st and ending
40 November 30th. Such service shall utilize one or more 96- gallon carts owned and
41 provided by the city. The yard service charge shall be nine dollars and twenty -six
42 cents ($9.26) per month for one 96- gallon cart, plus four dollars and sixty -three cents
43 ($4.63) per month for each additional 96 -gallon cart, and shall be billed to each
44 residential unit that elects to receive this service at the time and as a part of the
45 billings rendered for other city services applicable for that nine -month period. A
46 call -back charge of seveneight dollars and fifty onesixty -four cents ($7.518.64) shall
47 be imposed each time a customer requests yard material collection service at a time
48 other than the regularly scheduled time.
49 Where yard material collection service is performed for multiple
50 dwellings that are carried under a single account number and street address for
51 water department metered services, the multiple dwellings shall be deemed a single
52 residential unit for the purpose of computing the yard service charge imposed by
53 this section.
54 3. All of the charges for garbage and refuse collection provided in
55 subsections (C)(1) and (C)(2) shall be billed for and paid at the same time and for the
56 same period as billings and payments are made for other city utility services; or, in
57 the event a customer is served by the municipal garbage division but is not served
58 with another city utility, garbage and refuse collection charges shall be billed and
59 paid for according to the schedule which would be applicable to such customer were
60 he so served with another city utility service. Accounts shall become delinquent if
61 not paid within the time specified by Section 7.68.025 for payment of water service
62 charges.
63 4. Garbage and refuse collection charges will be suspended for any
64 customer upon advance notice to the office of the division of utility accounts that a
65 particular premises served will be unoccupied andisuch charges will be resumed on
66 notice to such office to resume service. No such suspension of charges for garbage
67 and refuse collection service will be made for any premises served with any other
68 city utility unless all city utility service to such premises is likewise suspended.
69 Application for resumption of service to a new customer shall be made to
70 the office of the division of utility accounts on forms provided for that purpose
71 which shall contain the name of the customer and the street address and number of
72 units of the premises to be served.

73 5. Collection service may be suspended for nonpayment of accounts, but
74 such suspension shall not relieve the person owing such account from the duty of
75 complying with the provisions of this chapter or other ordinances pertaining to
76 garbage, refuse, or sanitation. Such suspension of service shall render the premises
77 where such collection service is suspended subject to condemnation for lack of
78 sanitary requirements, and the owner or person in charge or in possession of said
79 premises shall be subject to prosecution for maintaining a nuisance thereon, as well
80 as enforcement of all other applicable laws.
81 6. Upon failure to pay such charges and upon delinquency, the amount
82 thereof shall become a lien against the property from which the garbage collection
83 service shall have been rendered. Such lien shall be made effective by filing a notice
84 thereof specifying the charges, the period covered by the charges and giving a legal
85 description of the premises at which the service was rendered. Such lien shall be
86 filed with the same official and within the time and shall be foreclosed within the
87 time and manner prescribed by law for filing and foreclosing liens for labor and
88 material, and shall be superior to encumbrances filed subsequent to the filing of
89 such lien, but shall be subject to all general taxes and local improvement
90 assessments, whether levied prior or subsequent thereto.
91 D. The yard material collection service, for which the yard service charge
92 is imposed by subsection (C)(2) of this section, shall include the weekly collection of
93 yard material from automated/semi-automated plastic 96- gallon carts furnished by
94 the city department of public works during the nine -month period for which the
95 yard service charge is billed to any particular premises. For collection purposes, the
96 total weight of each cart including yard material deposited therein may not exceed
97 two hundred pounds. Yard material larger than four inches in diameter or too long
98 to fit within a 96- gallon cart when covered by its lid shall not be placed in a 96-
99 gallon cart for collection, but may upon proper request, be collected as special haul
100 material.
101 E. In addition to the regulations adopted and charges imposed by
102 subsections C and D of this section, further charges are imposed in the following
103 types of service:
104 1. A charge of enetwo dollars and nineteeny cents ($1.902.19), in
105 addition to the regular monthly charge, shall be made each time an extra can or
106 partial can of refuse or yard material is collected from any particular residential
107 premises;
108 2. A charge of one dollar and fourty oncsixty -two cents ($1.4462), in
109 addition to the surcharge for collecting refuse and yard material, shall be made for
110 each extra container, bag, box or bundle of tree or shrub trimmings, collected from
111 any particular residential premises.
112 3. For a special garbage pickup, actual cost shall be charged to the
113 customer. Actual cost shall include the city's actual cost for labor, equipment rental,
114 and landfill fees. The minimum charge for this service shall be twenty -five dollars.

Section 2. This ordinance shall be in full force and effect 30 days after its
passage, approval, and publication as provided by law and by the City Charter.

SUMMARY EXPLANATION:
The 2002 Refuse Division Budget includes budgeted policy issues to increase residential refuse
rates and to reduce the in lieu of tax paid to the General Fund. At the December 11, 2001 Budget
Wrap -up, City Council approved the policy issues.
A. The attached ordinance contains a revision to Section 7.64.030 of the Municipal Code.
This ordinance provides for the reduction of the In Lieu of Tax on the Refuse Fund from
ten percent to nine percent. This reduction is intended to be revenue neutral to the
General Fund. This one percent reduction will become effective January 18, 2002.
B. The attached ordinance contains revisions to subsections 4.16.140C and 4.16.140E of
the Municipal Code. This ordinance contains a 15% rate adjustment on residential can
service and charges for extra containers. The increase in refuse rates is estimated to
generate an additional $235,000 in revenue for 2002. This amendment will become
effective January 18, 2002.
