WHEREAS, on November 19, 2001, Yakima County Superior Court Judge C. James Lust affirmed the approval of the South 72nd Avenue Annexation by the Washington State Boundary Review Board for Yakima County; and WHEREAS, the City Council finds that it would be in the best interests of the City to adjust the effective date of Ordinance 2001 -46 so that the annexation will be effective closer to the beginning of January 2002 based upon administrative considerations, now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA, WASHINGTON: Section 1. Section 1 of Ordinance No. 2001 -46 (passed on September 18, 2001) is hereby amended to read as follows: The area shown as the South 72 Avenue Annexation on the attached Exhibit "A," and legally described in the attached Exhibit "B," both of which exhibits are incorporated by reference herein, is annexed to the City of Yakima, Washington, effective January 4, 2002. Section 2. The City Clerk is hereby authorized and directed to file a certified copy of this ordinance with the County Auditor of Yakima County and with the Board of County Commissioners of Yakima County, Washington. Section 3. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law.
