HomeMy WebLinkAbout2001-058 Unpaved Streets Speed Limits ORDINANCE NO. 2001 — 58 AN ORDINANCE relating to speed limits for unpaved streets within the city limits of Yakima; and amending Section 9.50.370 of the City of Yakima Municipal Code. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 9.50.370 of the City of Yakima Municipal Code is hereby amended to read as follows: "9.50.370 Speed limits. In accordance with Section 9.50.360, and when properly signposted, speed limits during the time specified over and along the streets designated are: A. Fifteen miles per hour: 1. On all city alleys at all times not otherwise designated or officially signposted; B. Twenty miles per hour on all unpaved streets and the following streets: 1. 6th Avenue from Spruce Street to Division Street, 2. Cornell Avenue from Division Street to Nob Hill Boulevard, 3. 12th Avenue from Arlington Street to Nob Hill Boulevard, 4. 15th Avenue from Nob Hill Boulevard to Prasch Avenue, 5. 37th Avenue from Richey Road to Summitview Avenue, 6. 37th Avenue from Summitview Avenue to Tieton Drive, 7. 38th Avenue from Tieton Drive to Nob Hill Boulevard, 8. 44th Avenue from Walnut Street to south city limits, 9. Item A: Speed Limit Recommendations for Certain Annexed Streets are occasioned by the recent Congdon Orchard Annexation, and a previous annexation of Ahtanum Road vicinity; Item B: Speed Limit Reductions for Unpaved Streets follows up on Council direction from June 19. 2001 at which time staff was directed to study the possibility of reducing the posted speed limit on unpaved streets. ORDINANCE NO. 2001 -58 City of Yakima, Washington Department of Public Works Streets and Traffic Division Council Meeting of November 6, 2001 Staff Report Item B: Speed Limit Reduction for Unpaved Streets Background On June 19, 2001 the Yakima City Council considered the testimony from Mr. Bobby Parker and Mr. Claude McKinley regarding concerns about speeding traffic on South 14 Street, which is an unpaved residential street. At that Council meeting, staff was directed to review the request to lower the speed limit on all unpaved city streets from 25 to 20 miles per hour. As the Council is aware, citizens have complained about vehicle speeds on unpaved streets, as well as other maintenance issues. Yakima Municipal Code 9.50.370 establishes the posted speed limits for streets within the City of Yakima. As stated in YMC 9.50.370C, the speed limit on all city streets is 25 miles per hour unless otherwise designated or officially signposted. Under RCW 46.61.415, local authorities may change a speed limit when, they determine based on a engineering and traffic investigation, that the default limit is greater or less than is reasonable and safe under the conditions found to exist on the roadway. The speed limit on a street may not be reduced under 20 miles per hour. RCW 46.61.415(1)(c). Currently, a total of 12 street sections are listed in the Municipal Code with the posted speed limit of 20 miles per hour. These streets are paved residential streets located in the vicinity of schools, parks or designated bicycle routes. Summary of Findings The relationship of reduced speed on unpaved roads to improved air quality is significant. Staff contacted the Federal Highway Administration regarding research of the relationship of particulate matter (PM10), speed limits . and unpaved streets. ® Research indicated that in beach communities, a speed limit of as low as 10 mph is fairly commonplace for some residential streets. ® A 1998 EPA report on Unpaved Roads (EPA AP -42) describes three options for the reduction of dust emissions from unpaved streets: Vehicle restrictions, such as speed limit or weight reductions; surface improvements, such as paving; and surface treatments, such as watering or chemical treatment. The report states that "it is obvious to anyone who has driven on an unpaved road that visible emissions increase with vehicle speed. Accordingly, speed reduction is a clearly viable control measure.... This control option is most applicable to rural public roads. However, effective enforcement of the new speed limit may prove problematic. ® Paving of streets is the most effective means to reduce dust, but due to high initial cost is often prohibitive. Watering or chemical treatment of unpaved streets is often preferred for industrial areas at a moderate cost, but requires reapplication to maintain an acceptable level of control. • City budgets are not sufficient at this time to begin a program of paving local residential streets. A new funding source will need to be identified for this purpose. Annual maintenance of unpaved streets includes grading in the spring and dust abatement (via contract). A total of 12.9 miles of unpaved streets were treated with dust abatement in 2001. Given the financial realities facing City government, the available reasonable and safe alternative is to reduce the speed limit on unpaved streets to 20 miles per hour. Inventory of Unpaved Streets The City of Yakima contains an estimate of 18.0 miles of unpaved public streets and 25.14 miles of unpaved alleyways (1998 inventory). This inventory does not include the recently annexed areas of Congdon Orchards or the pending 72 Avenue area. Many of the unpaved roads have been acquired by the City of Yakima through annexations since 1991 and are clustered within neighborhood areas. The Yakima Municipal Code regulates the speed limit on all alleys at 15 miles per hour, regardless of their surface condition. For the most part, alleys are not posted with speed limit signs or other regulatory signs. Implementation Costs Based upon the 18.0 miles of unpaved street sections (spread out over 100 different streets) staff estimates a minimum of 150 signs will be necessary to post the change in speed limit for unpaved streets. Since the speed limit would be different than the default of 25 miles per hour, a speed limit sign would be required, at the minimum, of one sign as the driver enters a dead -end street and two signs for a street segment which connects to a paved surface at either end. Staff has not determined how many existing sign posts could be used to install these new signs. Installation of a new sign and sign post averages $100, including labor. Therefore, signing of the revised speed limit for unpaved streets is estimated at $15,000. This cost is not currently in the Street Division budget. Success of the program to lower speed limits on unpaved streets may depend upon voluntary compliance of drivers and police enforcement. Police resources are limited in their ability to patrol these low volume residential streets, when other needs of the city are evident. Recommendation Staff supports the citizen request to reduce posted speed limit on unpaved streets from 25 to 20 miles per hour. As previously stated, there is a direct relationship between travel speeds and dust emissions on unpaved streets. Improving air quality alone is probably sufficient reason to support this recommendation. To defray the cost of signing all unpaved streets, staff recommends a phased approach over a three year period. Alternately, additional budget needs to be devoted to the signing of these residential streets. No state or federal grants would be anticipated since these streets are not classified arterials.
