ORDINANCE NO. 2001- 59
AN ORDINANCE relating to regulation of electrical construction and installation,
and repealing all existing sections of chapter 11.16 of the
Yakima Municipal Code and enacting new sections, to comprise
chapter 11.16 of the Yakima Municipal Code.
WHEREAS, chapter 19.28 and 19.29 RCW establish the National Electrical Code,
as adopted and maintained by the state Department of Labor and Industries in chapter
296 -46 WAC, and any other duly adopted rules or regulations, to govern electrical
installation and construction in the state of Washington; and
WHEREAS, it is in the best interest of the City of Yakima to enact the following
provisions of the Yakima Municipal Code regarding electrical installation and
construction, now therefore:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA,
WASHINGTON:
1 Section 1. Sections 11.16.010, 11.16.020, and 11.16.030, of the Yakima Municipal Code
2 are repealed.
3 Section 2. NEW SECTION. A new section is added to the Yakima Municipal Code
4 to read as follows:
5 11.16.010 Electrical Installation and Construction Regulated by State Law
6 Pursuant to chapters 19.28 and 19.29 RCW, the National Electrical Code, as
7 adopted and maintained by the state Department of Labor and Industries in
8 chapter 296 -46 WAC, and any other duly adopted rules or regulations, shall
9 govern electrical installations and construction in the City of Yakima.
10 Section 3. NEW SECTION. A new section is added to the Yakima Municipal Code
11 to read as follows:
12 11.16.020 Enforcement
13 Pursuant to chapters 19.28 and 19.29 RCW, the state Department of Labor and
14 Industries is responsible for enforcement of chapters 19.28 and 19.29 RCW,
15 chapter 296 -46 WAC, and any other duly adopted rules or regulations.
16 Section 4. NEW SECTION. A new section is added to the Yakima Municipal Code
17 to read as follows:
18 11.16.030 Authority to Disconnect Utilities.
19 The Administrative Authority and / or an authorized representative of the
20 Washington State Department of Labor and Industries shall have the authority to
21 disconnect an electrical system to a building, structure or equipment in case of

22 emergency where such disconnection is necessary to eliminate an immediate •
23 hazard to life or property, or in case of an illegal service connection.
Section 5. Severability: If any section, subsection, paragraph, sentence, clause or
phrase of this ordinance, or any provision of the Yakima Municipal Code established by
this ordinance, is declared invalid or unconstitutional for any reason, such decision
shall not affect the validity of the remaining portions of this ordinance, or other
provisions of the Yakima Municipal Code established by this ordinance.
Section 6. This ordinance shall be in full force and effect 30 days after its passage,
approval, and publication as provided by law and by the City Charter.
PASSED BY THE CITY COUNCIL at a regular meeting and signed and
approved this 6th day of November, 2001.

SUMMARY EXPLANATION:
During the FY 2001 budget process, the Department of Community & Economic
Development's recommendation to City Council was for plan review, permitting and
inspections conducted by L &I be transferred to the City of Yakima. A memorandum has been
written addressing the four - bullet points mentioned in the September 6, 2001 report. (See
Attached Memorandum)
Under state law (Chapters 19.28 and 19.29 RCW) the National Electrical Code, as adopted
and maintained by the State Department of Labor and Industries (L &I) in Chapter 296-46
RCW, and any other duly adopted rules or regulations, shall govern electrical installations and
construction in the City of Yakima.
Presently before the City Council are proposed local amendments to the National Electrical
Code.

STAFF RECOMMENDATION: A). Request the City of Yakima Council approval of the
local amendments to the 1996 National Electrical Code. B). Request the City of Yakima
Council have the electrical inspection and plan review responsibilities remain with the
Washington State Department of Labor & Industries (L &I) and not be transferred to the City as
requested in the FY2001 Policy Issue at this time.

Since August of 2000, the Council's Community and Economic Development Committee, a
group of professionals from the community and staff, have been meeting to update the local
amendments to several of the construction codes used in the City of Yakima.
There was a Council Study Session held on February 13, 2001, with Council provided
direction concerning modifications to some of the local amendments. On May 15, 2001 the
City Council approved the local amendments to the Uniform Building Code and Uniform
Mechanical Code.
Through this process, it was the intent of all parties involved to only have local amendments
that were needed because of climatic weather conditions or conditions unique to the local
area. Several of the local amendments for these Construction Codes have been eliminated
because they were redundant, unnecessary or already addressed.
At the request of LBI, staff drafted an amendment giving authority to L&l to have electrical
service disconnected to eliminate an immediate hazard to life or property, or in case of an
' illegal service connection.

Re: Electrical Inspection and Plan Review 2001 Policy Issue
The Department of Community & Economic Development recommends the electrical inspection
and plan review responsibilities remain with the Washington State Department of Labor & _,
Industries (L &I) and not be transferred to the City as recommended in November 2000.
We discussed the processes with L&.I to address City concerns and both agencies agreed to
cooperate. Items discussed included:
• Final electrical inspections:
• Illegal residential conversions:
• Components for a complete Certificate of Occupancy, and;
• Owner /operator doing their own electrical work.
The Department of Labor & Industries inspectors will sign all green tag stickers located on the
electrical panels when the electrical permitted work has been finaled. L&.I agreed to provide L&.I
electrical permits and inspection records on a daily basis. Hence. the City of Yakima will provide
a copy of all permits issued each day to L&I Electrical Division for their review in order to verify
whether an electrical permit would be required. L &I also indicated they would investigate all
illegal conversions discovered by City staff. The Code Administration Division and L &I will
cooperate more between agencies regarding illegal, dangerous or questionable electrical
installations. In addition, L &I staff will provide. the Code Administration staff, definitions when
an owner /operator can do electrical work without an electrical journeyman license.
In the future, City of Yakima Code Administration and Planning Division staff will try to schedule
a monthly joint inspectors meeting with L &I inspection staff. The Code Administration and
Planning Division staff will be sharing with L &I inspection staff zoning, building, and code
compliance regulations as they apply to the City and electrical installations.
In closing, it is important to note that the electrical inspection and plan review policy issue was
intended to control the illegal conversions, abate dangerous buildings and address other code
related issues. As long as this can be accomplished with the cooperation of L &I, the original
recommendation to transfer electrical plan review, permitting and inspections to the City of
Yakima would not be necessary.
