AN ORDINANCE authorizing and directing the City's outside legal counsel, Lyon
Weigand & Gustafson PS, to institute and prosecute legal
proceedings for the condemnation and acquisition of certain real
property for the Kiwanis Park Development; providing for the
condemnation and taking of such real property and declaring the
condemnation and taking thereof to be necessary for a _public use
required by the public interests; directing that compensation for such
taking be paid from Fund Number 331 Parks Capital Improvement
Funds of the City of Yakima.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The law firm of Lyon Weigand & Gustafson PS is hereby authorized and
directed to institute and prosecute actions in the Superior Court of the State of Washington, in
and for Yakima County, for the condemnation and acquisition of certain real property which is
described on Exhibit "A" attached hereto, for the Kiwanis Park Development, in the City of
Yakima, Washington.
Section 2. The acquisition of said real property for the purposes herein mentioned is
required for the interests of the public and of the City of Yakima, and the uses and purposes
herein mentioned do constitute a public use of said property, and said real property is necessary
for the use and purposes mentioned herein.
Section 3. The compensation for said real property to be taken shall be payable from
Fund Number 331 Parks Capital Improvement Funds of the City of Yakima.
Section 4. This ordinance shall be in full force and effect thirty (30) days after its
passage, approval and publication as provided by law and by the City Charter.

A tract of land lying in Section 20, Township 13 North, Range 19,
E.W.M., and more particularly described as follows: Beginning at an
iron pin 112.7 feet North of the SE corner of the NE 1/4 of the NW 1/4
of the SW 1/4 of Section 20; Thence N 89° 49' W 230 feet to the true
point of beginning of tract herein described; thence N 89° 49' W 50
feet; Thence North 250 feet; thence S 89° 08' E 50 feet; thence S 250
feet to the true point of beginning of the tract herein described (Also
known as the E 1/2 of the S 250.feet of Tract 4 of Subdivision. No. 2,
unrecorded plat of Sumach Park).

the NW 1/4 of the SW 1/4 of Section 20, Township 13 N., Range 19
E.W.M.; running thence N 89° 49' W 230 feet to the true point of
beginning of the lands to be described; thence N 89° 49' W 100 feet;
thence N 551.7 feet; thence S 89° 49' E 100 feet; thence S 550.03 feet
to the point of beginning; EXCEPTING the S 335 feet thereof;
EXCEPTING THEREFROM the following: right of way for county road
along the N line of said premises; and EXCEPT the W 5 feet for road
as disclosed by deed recorded under Auditor's File NO. 1067211.

SUMMARY EXPLANATION: Three parcels of real estate remain to be acquired for the Kiwanis
Park development project. The City has exhausted all efforts to reach a negotiated purchase price
for these three remaining parcels, leaving condemnation as the only remaining method to
complete the acquisition process.
