HomeMy WebLinkAbout2001-027 land use and zoning • re crea- -ea 9/ M ORDINANCE NO. 2001- 2.7 AN ORDINANCE concerning land use and zoning, and amending the conditions precedent established by Ordinance 98 -52, which provided that three parcels located at 3300 W. Nob Hill Boulevard, 1102 S. 32nd Avenue, and 1101 S. 34th Avenue would, subject to certain conditions, be rezoned from Professional Business (B-1) to Local Business (B-2) and which amended the zoning map of the Yakima Urban Area accordingly. WHEREAS, Ordinance 98-52 provided, subject to certain conditions precedent, for rezone of three City -owned parcels located at 3300 W. Nob Hill Boulevard, 1102 S. 32nd Avenue, and 1101 S. 34th Avenue (the Subject Property) from Professional Business (B -1) to Local Business (B-2); and WHEREAS, the rezone of the Subject Property provided by Ordinance 98-52 was intended to make the City-owned property marketable while preserving the interests of neighbors; and WHEREAS, Section 5A of Ordinance 98-52 required, as a condition precedent to the rezone from Professional Business (B -1) to Local Business (B-2), that the owner ' establish restrictive covenants including a restrictive covenant that required "Reciprocal access easements for shared access from Nob Hill Boulevard for all three lots and secondary shared access from South 32 and South 34th Avenues "; and WHEREAS, the Subject Property is the subject of a purchase and sale agreement between the City of Yakima and Craig Schultz Construction, Inc., which agreement is conditioned on approval of certain proposed land uses; and WHEREAS, during the course of Class (3) land use review, including an appeal by Terry M. Kleppin, of the proposed uses immediately west of South 32nd Avenue along the south side of West Nob Hill Boulevard, including portions of the Subject Property of Ordinance 98-52, neighbors and parties interested in purchasing the Subject Property have expressed preferences that the requirement of reciprocal access easement provided by Section 5A of Ordinance 98-52 be eliminated; and WHEREAS, the reciprocal access easement requirement was intended to benefit parties who have expressed preferences that it be eliminated; and WHEREAS, it is in the best interests of the City and the neighbors and parties interested in purchasing and developing the Subject Property that the requirement of Amendment to Nob Hill Rezone (UAZO RZ #9 -98, UAZO EC #22 -98) Page 1 of 2 reciprocal access easement provided by Section 5A of Ordinance 98-52 be eliminated; and BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA, WASHINGTON: Section 1. Ordinance 98-52 is amended to eliminate the requirement of reciprocal access easement provided by Section 5A. No other portion of Ordinance 98-52 is changed by this amendment. Section 2. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. Section 3. Subject to the foregoing provisions and conditions, this ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter, and this action shall be final and conclusive unless within 21 days from the date this ordinance is passed by the City Council an aggrieved party commences proceedings for review pursuant to the provisions of Chapter 36.70C RCW. Nob Hill Boulevard, 1102 S. 32" Avenue, and 1101 S. 34 Avenue from Professional Business (B -1) to Local Business (B -2) and amending the zoning map of the Yakima Urban Area accordingly. WHEREAS, the City of Yakima (hereafter referred to as the "Applicant ") has requested amendment of the Official Yakima Urban Area Zoning Map to rezone three parcels of land at 3300 W. Nob Hill Boulevard (Yakima County Assessor's Parcel #181327- 41490), 1102 S. 32 Avenue (Yakima County Assessor's Parcel #181327 - 41489), and 1101 S. 34 Avenue (Yakima County Assessor's Parcel #181327 - 41491) in Yakima, Washington (referred to below collectively as "the Subject Property ") from Professional Business (B -1) to Local Business (B -2) (see Department of Community and Economic Development file UAZO RZ #9 -98 and UAZO EC #22 -98); and WHEREAS, on August 13, 1998, the City of Yakima Hearing Examiner conducted a duly convened open record public hearing regarding the requested rezone, and after considering the contents of the file and evidence received at the public hearing, issued his Examiner's Recommendation, Examiner No. IU98 -2 -22, dated August 27, 1998; and WHEREAS, the Hearing Examiner recommended approval of the requested rezone subject to several conditions stated on pages 7 -8 of his Recommendation; and WHEREAS, the City Council considered the requested rezone and the Hearing Examiner's Recommendation at its regular public meeting on October 6, 1998; and WHEREAS, after considering the Hearing Examiner's Recommendation, the contents of the file, and the statements of interested persons, the City Council finds with respect to the requested rezone that, subject to the conditions recommended by the Hearing Examiner as stated on pages 7 -8 of his Recommendation: 1. The Subject Property is suitable for uses permitted in the Local Business (B -2) zoning district; 2. There exists a public need for the requested rezone; 3. Circumstances have changed since the existing zoning was established which now make the requested rezone appropriate; and 4. The requested rezone is consistent with and complies with: a. The requirements and considerations set forth in chapter 15.23 of the Yakima Municipal Code; b. The goals and policies of the Yakima Urban Area Comprehensive Plan; c. The intent of the Yakima Urban Area Zoning Ordinance; and d. Other applicable land use controls; and • • NOB HILL REZONE (UAZO RZ #9 -98, UAZO EC #22 -98) Page 1 of 3 • WHEREAS, it is in the best interests of the City and its people to adopt the Hearing Examiner's findings and conclusions, and recommendation and, subject to the conditions recommended by the Hearing Examiner as stated on pages 7 -8 of his Recommendation, to approve the requested rezone; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA, WASHINGTON: Section 1. The Yakima City Council adopts and incorporates by reference the findings, conclusions and recommendations of the Hearing Examiner's Recommendation, Examiner No. IU98 -2 -26, City Nos. UAZO RZ #9 -98 and_EC #22 -98, issued August 27, 1998. Section 2. The Official Yakima Urban Area Zoning Map within the City of Yakima is amended to rezone the Subject Property from Professional Business (B -1) to Local Business (B -2) in the vicinity of 3300 W. Nob Hill Boulevard, 1102 S. 32°' Avenue, and 1101 S. 34 Avenue in Yakima, Washington, and legally.described as: Lots 1, 2, and 3 H.L. Smith Addition as recorded in Volume "Y" of Plats, page 47, records of Yakima County, Washington. Section 3. Subject to the conditions stated in Section 5 below, the City Council finds formally that 1. The above - described Subject Property is suitable for uses permitted in the Local Business (B -2) zoning district; 2. There exists a public need for the requested rezone; 3. Circumstances have changed since the existing zoning was established which now make the requested rezone appropriate; and 4. The requested rezone is consistent with and complies with: a. The requirements and considerations set forth in Chapter 15.23 Yakima Municipal Code; b. The goals and policies of the Yakima Urban Area Comprehensive Plan; c. The intent of the Yakima Urban Area Zoning Ordinance; and • d. Other applicable land use controls. • Section 4. Subject to the conditions stated in Section 5 below, the requested rezone is granted and the Official Yakima Urban Area Zoning Map within the City of Yakima is amended accordingly to rezone the Subject Property from Professional Business (B -1) to Local Business (B-2). Section 5. Conditions•Precedent: The rezone provided herein shall not become effective unless and until the Applicant records restrictive covenants that require: A. Reciprocal access easements for shared access from Nob Hill Boulevard for all three lots and secondary shared access from South 32`th and South 34 Avenues. B. Construction of a six- foot -high, view- obscuring fence (site screening Standard C under the Urban Area Zoning Ordinance) along the south property line of all lots prior to issuance of a building permit for any lot. The City expressly reserves its rights as owner to require NOB HILL REZONE (UAZO RZ #9 -98, UAZO EC #22 -98) Page 2 of 3 additional site screening or to otherwise elaborate on this condition by appropriate means, including a subsequent restrictive covenant, as a condition on any sale of the property. C. Construction and /or repair as necessary of sidewalk on the east side of South 34 Avenue prior to issuance or as a condition of a building permit for that lot. . D. Construction and /or repair as necessary of curbs, gutters, and sidewalks for each lot prior to issuance or as a condition of a building permit for that lot: Section 6. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. Section 7. The staff report presented by Bruce Benson recommended approval. No one appeared at the hearing. One letter was received, from Terry and Jan Kleppin, an area property owner. The letter expressed concern about the south boundary line, specifically the need for building setbacks and a 6 foot sound barrier, and types concern about the Hypes oz business that might be permitted to operate here, hours of operation, noise, traffic, and signace. The Examiner inspected the property prior to the 410 ' SUMMARY OF RECOINDATION. The Examiner recommends approval of'the rezone, subject to recording deed restrictions dealing with access and site improvements. . Nob Hill Blvd., (APN 161327-41490), 1102 S. 32' Avenue (APN 161327-414 and 1101 S. 34` Avenue (APN 181327- 4149 The legal descriptions are attached to the application and included by reference. 3. proposed Zone. Local Business (E -2)• 4. Proposed Use. Unknown. 5. Current Zoning and Use. The property is currently vacant and zoned Prefessiona_ Business (B -1). Adjacent properties have the following characteristics: o^a i n Z. ;nc North B -2 Commercial /Residential East E -2 Vacant /Commercial West B -2 Casa Mia Restaurant 1111, R -1 Two - family Residential 6. Project Description. This request was initiated by the Yakima City Council on June 2, 1998, for a non project related rezone of three vacant city owned lots located along the south side of Nob Hill Blvd. The Council was very concerned that this rezone be compatible with other land uses in this area. Staff was therefore specifically directed to recommend conditions of approval that would insure that compatibility could be achieved. The property involved is Lots 1, 2 and 3 of H. L. Smith Addition, a plat recorded in July of 1977. Lot i has 86.01 feet of frontage alone S. 32nd Ave.; Lot 2, 273.15 feet of frontage along Nob Hill Blvd.; and Lot 3, 60.01 feet of frontage along S. 34th Avenue. Originally the Employment Security Office was planned for this site, but neighborhood opposition was considered and the site was chanced to the current location at 3rd Street and Division. After the City acquired this land it was down zoned from B -2, Local Business to B -1, Professional Business in 1979. 6.1 Testimony. The one letter in the file is summarized above. There was no other testimony at the hearing. 6.2 Suitability of the Property. The subject property is vacant, flat land with access from three streets and surrounded on three sides by contiguous B -2 zoning. Under the existing B -1 zoning many commercial uses are already permitted at this site and, therefore, this rezone to E -2 will only accentuate certain retail commercial uses. 6.3 Aaency Recommendations. The DST comments neither . supported nor opposed this rezone. Agency comments were limited to reports that adequate infrastructure is in place to support a General rezone to local business within this area. The Planning Division recommends approval. 6.4 Compliance with Comprehensive Plan and Zoning Ordinance. This rezone is compatible with Commercial Goal Cl, "Stabilize and revitalize existing commercial facilities in the urban service area," and Goal C2, "Provide convenient shopping locations consistent with the development of the community." Local businesses are already much in evidence along both sides of Nob Hill Blvd. and this land use change request is consistent with and typical of this pattern of development. The major inconsistency of this proposal is that to the south the adjoining zoning is R -1, Single Family Residential. Offsetting this incompatibility issue is 4111 the fact that the adjoining R -1 property is developed with duplexes which are viewed as moderate density residential development, which is considered a compatible land use with local business zoning given appropriate site considerations. 6.5 ,Adequacy of Public Facilities. This property can be readily served by all necessary public utilities. Street access is provided by Nob Hill Blvd., a primary urban arterial; S. 32nd Avenue, a minor urban arterial; and S. 34th Avenue a local collector street. Transit service is provided by Route No. 5, Nob Hill West. West Nob Hill Blvd. is a major arterial street with a current approximate 23,500 ADT (average daily traffic). The traffic count data available for this street indicates a +/- 2% traffic growth rate for the last five years. The best estimate on a current PM peak hour count (based on 1995 data), is 2100 vph (vehicles per hour) i both directions. Using a capacity (ideal flow race) of 1,000 vph, Nob Hill has +/- 50% unused reserve • capacity. Current level of service is B. South 32nd Avenue, both to the north and south of Nob Hill Blvd., is a two -lane classified minor arterial and is currently no: planned to receive any improvements or widening. Current traffic volumes between Tieton and Nob Hill are estimated at 4700 P.DT using an approximate 2% growth rate. This equates to 425 vph during the PM peak hour. . South 34th Avenue, south of Nob Hill, is a north -south neighborhood (local) collector street. The City does not have any current traffic count data on this street. Utilizing a 2% growth rate, pre -1990 traffic counts increase to an estimated current count of 1,100 P.DT. A reciprocal access easement can be imposed on the property, and recorded by the City prior to execution of this rezone and sale of the property. The Planning Division expresses legitimate concern that anew sidewalk needs to be installed along the east side of South' Avenue, and that other curbs, gutters, and sidewalks are in need of repair. The staff report recommends that the sidewalk requires' ) repairs be made upon issuance of a building permit for either lot. This is an issue which can be dealt with in that fashion, or by recording a restrictive covenant requiring this. It simplifies enforcement problems at the time of issuing a building permit, particularly if the permit is for a Class 1 use and does not • generate any significant traffic. Since the City is the owner of the property, it has considerable flexibility in how to impose 4111 these recuiremen *_s. Recording a covenant puts any prospective purchaser on notice and may simplify enforcement in the future. 6.6 Compatibility. This land use change request is compatible with the adjoining B -2, local business zoning and incompatible with adjoining R -1, single family residential zoning. However, because the R -1 land is developed with duplexes, which are considered a moderate density residential land use, this rezone can be considered as compatible given appropriate site considerations. The Planning Division recommends that sitescreening Standard C, consisting of a 6 foot high, view obscuring fence, be required along the south property line of all of the lots, upon issuance of a building permit for any lot. This requirement can also be imposed by deed restriction which can be recorded and run with the land. Since 1986, retail development along Nob Hill has occasioned the use of nearl y all vacant B -2 property in the area. This has created a need /demand for additional B -2 zoned land. Recent developments within the last several years, such as the adjacent Casa Mia Restaurant and Rainford's Auto Wash and Lube (approved and under construction), indicate that there has been a recent change in circumstances within this immediate area that reinforces both the need and compatibility for additional local business type development at this location. The future land use map (Map 1II -3) of the 1997 Comprehensive Plan designates the preferred use of land within particular areas. This map indicates future land use for the subject property as Arterial Commercial which includes B -2 Local • Business zoning in its list of appropriate zoning classifications. 7. .Environmental Review. A Determination of Non - significance was issued by the City and is now final. Future development on these parcels will require additional environmental review whenever development permits reach or exceed local threshold of review levels. 8 Public Notice. In Mr. Lamb's decision of 2/13/01, he approved a Class III application submitted by Schultz Construction, Inc., for property located at the corner of 32" Avenue and West Nob Hill Boulevard. To grant a Class (3), compatibility must be proven. It is my contention that compatibility was not proven. The erection of the six -foot masonry wall and the layout of the convenience store facing Nob Hill Boulevard is not enough to provide compatibility for this surrounding residential (R1) neighborhood.. These provisions will help to reduce the noise level somewhat and are necessary, but I believe the best protection for the area • residents would be limiting the hours of operation. As this is surrounding a residential neighborhood, the hours between 10:00 p.m. and 6:00 am should not be considered as businesslike. Mr. Lamb pointed out in his decision that many convenience stores operate 24 hour pumps with the walk -in portion of the store closed. He also said their hours of operation vary. I would like to point out that most of these convenience stores were grand fathered into the Yakima Urban Area Zoning Ordinance and were not subject to a Class (3) review. This precedent should not be used. Although Mr. Smasne said he doesn't intend to be open 24 hours a day, a Class 3 decision would allow him to do so if he chooses. If a change of ownership occurs, which happens often in this business, they would automatically have the right to stay open 24 hours. I also see an inconsistency in Mr. Lamb's decision dated 12/18/2000 at "The Orchard Shopping Center', in which he limited the hours of the grocery store to 6:00 am to 12 Midnight. Both this area' located at 72 " Avenue and Tieton Drive, and the project at 32n Avenue and Nob Hill have a high concentration of single family homes surrounding it, therefore, I believe the project at 32n and Nob Hill should require more consideration to limit the hours of service. Although I do not object to the project as a whole, I do object to the Class (3) portion of this decision (24 hour operation) and feel it would greatly reduce the quality of life for a quiet residential neighborhood between the hours of 10:00 p.m. and 6:00 am. It is by belief that the Council should amend the decision of the hearing examiner and deny the Class (3) portion of his findings. URBAN AREA ZONING ORDINANCE The B -2 Local Business district is intended to provide areas 4111 for commercial activities outside the Central Business District that meet the retail shopping needs of the community; and accommodate small scale commercial uses requiring high visibility and easy access to major arterials. Use characteristics of this district include small retail sales and service establishments. MASTER APPLICATION. Any project that combines two or more land use requests may be consolidated into one review process called a master application. When combined in this manner each separate request, regardless of normal review procedures, will be considered by the more stringent review procedures established for the highest level of review required. For example, a master application combining several Class (2) reviews together with a single Class (3) review will undergo Class (3) review. In this application the area of possible incompatibility concerns the gas station /convenience store and the applicant's request that its hours of operation be expanded to include the time period from 10:00 pm to 6:00 am and that a drive -up service window be permitted adjacent to a residential zone. Class (3) land uses may be permitted by the hearing examiner if he determines, after holding a public hearing, that any difficulties related to compatibility have been resolved. But for the hours of operation and drive -up service window a gas station /convenience store located within a B -2 zoning district would be classified as a Class (2) land use. CLASS (2) REVIEW. 4 1/ 0 In the case of Class (2) land uses these are generally considered to be compatible with other permitted land uses throughout an area. Normally these reviews involve notice of application to adjoining property owners and administrative review by the zoning administrator and his staff. The proposal requiring Class (2) review in this application is the drive- through service window associated with Wendy's restaurant. Although restaurants are a permitted Class (1) land use within the B -2 zoning district the inclusion of a drive - through service window, whenever the business directly adjoins a residential zoning district, requires the next highest level of review. This review is required in recognition of the potential impacts of drive -thru uses on the adjoining residential uses and arterial systems. ZONING ORDINANCE DEVELOPMENT STANDARDS. The zoning ordinance sets forth standards for lot size, maximum lot coverage, minimum building setbacks, parking, building height, signage, etc. With but two exceptions, minimum lot coverage and parking, this proposal meets all applicable zoning ordinance standards for development. ADMINISTRATIVE ADJUSTMENTS. The reviewing official is permitted to adjust most of the • development standards set forth within the zoning ordinance. The process of review for these adjustments is normally very similar to Class (2) land use reviews but, in addition, the reviewing official must first determine that the adjustment and /or reduction is consistent with the purpose of this title, the intent and purposes of the standard and accomplishes one or more of the following objectives. 1. Lacking any information to the contrary it is presumed that all signage will conform to the sign standards of the B -2 zoning district. The location of proposed free standing signs is shown on the site plan. Minor adjustments of sign location can be reviewed and approved, after the close of this hearing, under the modification provisions of the zoning ordinance. However, any requests to exceed the permitted sign area or height will require a separate administrative adjustment that will be reviewed under • the same procedures as was required for project approval. In conclusion, the requested adjustments are not considered to be excessive in light of past practice and they do help this project to best fit the land available. The members of this team are drawn from the City's Planning, Engineering, Water, Utilities, Fire, Traffic, and Building Codes Divisions as well as may include representatives from local area utility providers, county and state agencies as needed. The DST meeting for this proposal was held on December 14, 2000 at which time the following comments were submitted. Traffic Engineering This office has reviewed the site plan for the commercial development at 32 Avenue and Nob Hill Boulevard and offers the following comments: 1. Nob Hill Boulevard is a Principal Arterial Street developed with five lanes, including a center left turn lane in this location and sidewalks on both sides of the street. Nob Hill Boulevard carries approximately 22,200 average daily vehicle trips in this area (count includes both directions). The intersection of 32 Avenue and Nob Hill Boulevard is signalized and a portion of the walk to school route for elementary school children who are walking en -route to Nob Hill Elementary School. 2. The proposed 12 foot wide easement along the rear of the property is a very good idea and should extend along the entire development. This is especially important to traffic wishing to flow westward in the development, such as from the convenience store to Wendy's which would otherwise need to make left turns on Nob Hill Boulevard. 3. If parking spaces would be lost in order to create this recommended easement, consideration might be given to using "Future Lot #3" for parking which could benefit all the businesses in the development. City Engineer Based upon our review of this proposal, I have the following recommendations. 1. For the frontage of this site on Nob Hill Blvd. 10 feet of additional right -of -way should be deeded to the City to 410 satisfy the Development Standards for this street classification. 2. There is existing curb, gutter and sidewalk fronting this site in Nob Hill and 32'' Ave. Curb, gutter and five foot wide sidewalk should be installed for this site frontage in 34 Ave. 3. There is existing public sewer in 32 34 and Nob Hill. A separate side sewer must serve each parcel and each structure on the same parcel from a public main. This may necessitate a main extension along the southerly portion of the development. 4. There are existing water mains in Nob Hill and 32 °C available to serve this proposal. There is an existing fire hydrant on site that may need to be relocated. A water main extension Completion of these improvements is a condition . recedent to the rezoning of this property. New easements may be required if new hydrants are installed. 3. Fire hydrants are located at 32' and Nob Hill, 33 and Nob Hill and 34` and Nob Hill. 4. Connection charges for water will be required. 5. Fire flow calculations indicate 3,000 gpm+ available. 6. To determine availability of irrigation water inquiry should be made of the Naches - Cowiche Canal. III Building Codes Due to the topography of the land and proposed structure locations a site plan for grading and excavation will be needed to verify slope, drainage retention on site, and the amount of site work required. The owner of the Bruchi's /Amore Pizza restaurants (Lot #2) has decided to withdraw from this application. After discussing this situation with the developer it was his decision to proceed with the project as proposed. Lot #2 development, as submitted, is a Class (1) permitted land use. Adjustments of both parking and lot coverage were requested and this request will continue to be considered with ultimate approval or denial subject to the hearing examiner's decision. Provided that the replacement land use is also a Class (1) land use and provided that there are no further requests for adjustment this current review will be sufficient for development. Any Class (2) or Class (3) land uses or additional requests for an adjustment of standards will require additional land use review(s). • ANALYSIS. This application hinges on compatibility issues first and design issues second. The compatibility issues are as follows: 1. Should the proposed gas station /convenience store be permitted to remain open after 10:00 pm and before 6:00 am? (Class (3) use) 2. Should a gas station /convenience store be permitted at this location? (Class (2) use) 3. Should drive through service windows be permitted adjacent to a residential zone? (Class (30 for Gas Station /Convenience Stores and a Class (2) use for restaurants) The zoning ordinance presumes that varying degrees of incompatibility may exist whenever Class (3) and Class (2) land uses are proposed. The mechanism most often utilized in resolving compatibility issues is site screening. Should the easement running between S 32 and S 34` Avenues be opened and widened to allow for two -way traffic? (Traffic /Public Safety issue) Traffic Engineering has recommended that for traffic and public safety purposes this easement should be opened and widened to allow for two -way traffic. This modification will require that the trash receptacles be moved to other locations and could perhaps also result in modifying building locations. The negative aspect of this change is that two -way traffic located this close to the property boundary will increase traffic noise. If this recommended change is adopted the additional noise factor should be taken into consideration in determining site screening and • buffering requirements. CONCLUSIONS. 1. The hearing examiner has jurisdiction. 2. Adequate public services are in place and readily available to meet all utility and access requirements of this proposal. 3. The Traffic Concurrency review indicates that this development will not exceed the pm peak hour capacity of the City Arterial street system and reserve capacity exists on all impacted streets. The existing wooden fence located between the B -2 and R -1 zoning districts is approximately six feet in height. Thus far the ownership of this fence is undetermined. Presumably the residential property owners on the south own the fence. If this is the case the hearing examiner may need to rule on the issue of whether the existing fence is sufficient to meet the minimum required standard for site screening or will a totally new fence be required prior to development? 12 Craig Schultz Construction. SEPA review resulted in the adoption of a previously issued DNS. 5.Public Notice for this hearing was provided in accordance with zoning ordinance requirements. 6. Several compatibility questions will need to be aired and resolved during the public hearing process. • Should the proposed gas station /convenience store be permitted to remain open after 10:00 pm and before 6:00 am? • Should a gas station /convenience store be permitted at this location? • Should drive through service windows be permitted adjacent to a residential zone? • Should the rear (south) easement be widened and opened to through traffic in spite of the fact that this may increase noise for the adjoining property owners? IIII Topography of the land and structure locations requires a site plan for grading, excavation, slope verification, drainage retention on site, and the amount of site work required. 8. The approval of this master application will have the following public benefits: increased investment, increased tax base with the sale of the property, and increased employment opportunities. RECOMMENDATION. The Division of Environmental Planning recommends that this master application be approved subject to the following conditions. 1. That any proposed signs be installed in compliance with the provisions of Chapter 15.08 of the zoning ordinance. 10. The drive- through service windows shall be operated so as to prevent audible disturbance to adjoining residential properties. 10. Nob Hill & 32 Ave Traffic Engineering has reviewed the site plan for the commercial development at 32nd Avenue and Nob Hill Boulevard and offer the following comments: 1. Nob Hill Boulevard is a Principal Arterial Street developed with five lanes. including a center left turn lane in this location and sidewalks on both sides of the street. Nob Hill Boulevard carries approximately 22?00 average daily vehicle trips in this area (count includes both directions). The intersection of 32 Avenue and Nob Hill Boulevard is signalized and a portion of the walk to school route for elementary school children who are walking en -route to Nob Hill Elementary School. 2. The proposed 12 foot wide easement along the rear of the property is a very good idea and should extend along the entire development. This easement would act as an alley and alternate access for service vehicles. emergency access and patrons. The proposed 12 foot in width does not allow for two way travel, which is desirable and the mid - section is blocked by trash receptacles. Traffic Engineering recommends the • width of the easement be a minimum of 18 feet in order to accommodate two way traffic and the entire length be open and not blocked. This easement will provide traffic to flow between uses in the development without using Nob Hill Boulevard. This is especially important to traffic wishing to flow westward in the development, such as from the convenience store to Wendy's which would otherwise need to make left turns on Nob Hill Boulevard. 3. I am the owner and resident of a duplex located at 3207 Vincenta St. I just recieved a notice of Application and Hearing concerning property located at 32rd Aye. and Nob Hill. I have reviewed the city's Zoning Ordances and land use policies. I note that my property is designated R1. The property adjacent to my back fence is designated B1. Accordingly this property is for the location of professional offices and or multifamil■ dwellings and is to provide a buffer between commerical clusters and residential neighborhoods. Two existing businesses in the area of question are Cafe Mia and Rainford's Lube and oil. According to the information provided me. both establishments are in a B2 area. A second B2 area is located at the corner of 32nd Ave and Nob Hill. At one time there was a gas station there. Apparently. I must be missing something. At least by my definition. WVendy's. a drive through restaruant open until midnight seven days a week is not a professional office or multifamily dwelling. Likewise, the proposed pizza restaurant and Bruchi's restaurant. open until 10 p.m.( I assume seven days a week) falls short of being a professional building or multifamily dwelling. This brings us to the proposed gas station and convience center that will operate twenty hours per day, seven days a week. According to the site map. this business will extend well beyond the B2 area at 32nd Ave. and Nob Hill into the B 1 area adjacent to my back yard fence. In a letter to you dated October 10. 2000. Mr. Dale Smasne stated in part the "Noise. just the everday part of doing business ". Zoning ordances clearly suggest that business such as this are to be in a B2 area. They do not provide a buffer as outlined in the B1 zoning areas. Before I charge off into unknown territory. I ask for your assistance in case I misunderstand zoning rules and regulations. We estimate 25 total employees both full and part time with an average of 10 per shift. B. This proposal is for commercial use, which will be located among other commercial sites along Nob Hill Blvd. Between 32 and 34 Avenues. Nob Hill Blvd. is a main arterial with numerous restaurants and commercial businesses. Other measures taken to promote compatibility will include downward focused lighting to reduce glare. fencing to provide light and sight screening. late -night deliveries to reduce traffic congestion caused by large delivery trucks. and the assurance to all neighboring sites that Wendy's Management will emphasize litter control and noise control. • C. This proposal is consistent with the City of Yakima's current zoning for this site and also is consistent with uses and zoning for neighboring sites. D. This proposal is very much in the best interest of our community. The site is not currently producing tax revenue for the City of Yakima and this proposal will accomplish that goal. Office of Hearing Examiner Attn: City Council RE: Appeal by Terry Kleppin to Examiner's decision on Service Station/Convenience Store located at 32n and Nob Hill Blvd. Dear City Council Members, I am writing in support of the appeal filed by Terry Kleppin on February 28, 2001 regarding the proposed development on 32" and Nob Hill Blvd. He objects to the decision to allow the owner of this property to determine his own hours of business, requesting that the hours be limited to no longer than 6:00 AM to 10:00 PM daily. We agree that this would substantially reduce what will, inevitably, be a large impact to our neighborhood. His points and • examples are well stated, especially the need to think beyond the current owner to future business owners. Now is the time to set a precedent of what is allowable adjacent to our residential neighborhood. As was stated in our first appeal to Dec. 1, 2000 "Notice of Application and Hearing ", Nob Hill Blvd has become quite a cruising area for local youth. One of our primary concerns for extended hours of operation is that this will encourage large groups of youth to gather in our neighborhood. This could easily increases vandalism and crime, and will certainly increase noise pollution and littering. I hope that the Council will consider these impacts to our quiet neighborhood and deny the Class 3 (24 hour operation) clause of this decision. This will benefit not only the current residents and neighbors, but also generations to come. There are a total of seven duplexes between 32nd and 34th ave. behind the proposed mini -mall. I also support Terry Kleppin's appeal to limit the hours in which the mini -mart can stay open. If one looks at this project, you will see that there are two types of business located next to each other: the north side has retail and the south side has rentals. In order for the rentals to survive successfully, the tenants, "or customers ", must be provided a safe, clean and quiet place to reside. If the landlord fails to provide any of the conditions, "customers" are likely to leave. This means vacancies for the landlord and vacancies lead to a loss of business • Operating the mini -mart past 10:00 p.m. means it will no longer be quiet at night for the tenants. No nne wants to be wakened in the middle of the night because of squealing tires and the slamming of automobile doors. especially when one has to get up early to go to work. Would Mr. Smasne choose to live next to a 24 hour mini -mart over a business that closes at 10:00 p.m.? NOT LIKELY! At the first hearing Mr. Smasne stated that he wanted to be a good neighbor. GOOD NEIGHBORS don't keep other neighbors up with excessive noise in the middle of the night. Allowing Mr. Smasne to operate the mini -mart after 10:00 p.m. has a negative impact on the nearby rental businesses. In order to protect all the rental business and the nearby homes, I feel the mini -mart should not be allowed to operate between 10:00 p.m. and 6:00 a.m.. Mr. Smasne, the applicant, has prepared a list of several options concerning the hours of operation of his gas station /convenience store. Mr. Smasne believes that without a concession from the strict application of the permitted hours of operation (open at 6:00 am and closed at 10:00 pm) his business cannot be competitive with similar operations. The appellants have had the opportunity to review these options and all have agreed to a compromise agreement. (See Attached Compromise Agreement Memorandum) Please note: This compromise agreement would require Council to allow the access way or driveway at the rear of the Convenience Store property to be blocked off. Many residents who testified indicated that the proposed hours of operation would negatively impact their homes, businesses and the area. After the public hearing was closed, Council discussed the testimony and hours of operation. A motion was made about the hours of operation and then a motion to table this matter until April 17, 2001 Council meeting. Staff has been in contact with Mr. Dale Smasne, owner of the convenience store, Mr. Terry Kieppin, Mr. Gordon Chin and Mrs. Jan Woolen by phone. On Thursday April 12, 2001, a meeting of these individuals was held at the City Hall with City staff to try a see if there was a compromise. After two hours of discussion and negotiation, the residents and Mr. Smasne reached a compromise for the hours of operation. The following list would be those items of compromise: • Hours of the convenience store operation would be: 5:00 a.m. to 12:00 p.m. • The wall height between the residential homes and the convenience store along the south side of Mr. Smasne's property line, only, would be increased from 6 feet to 8 feet. • The southwest landscape island would be moved to the south blocking the driveway access way to restrict through traffic from driving between 32 and 34 Street. The rear access of the convenience store would be chained off when the convenience store was closed. • All deliveries would be limited to the hours of 5:00 a.m. to 6:00 p.m. ' Yakima VP 1994 April 13, 2001 o The gas pumps would be allowed to operate on a 24 -hour basis. Gas purchase would be done by credit card at the pump only after the convenience store was closed. Mrs. Woolen called after our meeting on Thursday and indicated she re- thought her position to support a 24 -hour operation for the convenience store. o City staff would contact the refuse hauler to request the garbage pick -up for the new commercial at times during the daytime hours after 8:00 a.m. It is staff s recommendation to approve the compromise as stated above. Nob Hill Boulevard, 1102 S. 32nd Avenue, and 1101 S. 34 Avenue would, subject to certain conditions, be rezoned from Professional Business (B-1) to Local Business (B -2) and which amended the zoning map of the Yakima Urban Area accordingly. WHEREAS, Ordinance 98 -52 provided, subject to certain conditions precedent, for rezone of three City -owned parcels located at 3300 W. Nob Hill Boulevard, 1102 S. 32 Avenue, and 1101 S. 34th Avenue (the Subject Property) from Professional Business (B -1) to Local Business (B -2); and WHEREAS, the rezone of the Subject Property provided by Ordinance 98 -52 was intended to make the City -owned property marketable while preserving the interests of neighbors; and WHEREAS, Section 5A of Ordinance 98 -52 required, as a condition precedent to the rezone from Professional Business (B -1) to Local Business (B-2), that the owner establish restrictive covenants including a restrictive covenant that required "Reciprocal access easements for shared access from Nob Hill Boulevard for all three lots and secondary shared access from South 32nd and South 34th Avenues "; and WHEREAS, the Subject Property is the subject of a purchase and sale agreement between the City of Yakima and Craig Schultz Construction, Inc., which agreement is conditioned on approval of certain proposed land uses; and WHEREAS, during the course of Class (3) land use' review, including an appeal by Terry M. Kleppin, of the proposed uses immediately west of. South 32nd Avenue along the south side of West Nob Hill Boulevard, including portions of the Subject Property of Ordinance 98 -52, neighbors and parties interested in purchasing the Subject Property have expressed preferences that the requirement of reciprocal access easement provided by Section 5A of Ordinance 98-52 be eliminated; and WHEREAS, the reciprocal access easement requirement was intended to benefit parties who have expressed preferences that it be eliminated; and WHEREAS, it is in the best interests of the City and the neighbors and parties interested in purchasing and developing the Subject Property that the requirement of Amendment to Nob Hill Rezone (UAZO RZ #9 -98, UAZO EC #22 -98) Page 1 of 2 0 J • reciprocal access easement provided by Section 5A of Ordinance 98 -52 be eliminated; and BE IT ORDAINED BY THE CITY COTJNCIL OF THE CITY OF YAKIMA, WASHINGTON: Section 1.
