AN ORDINANCE concerning land use and zoning, rezoning one parcel
(approximately 1.93 acres) in the vicinity of 5110 Tieton Drive
from Local Business (B -2) to Small Convenience Center (SCC),
and amending the Official Yakima Urban Area Zoning Map
accordingly.
WHEREAS, Timothy E. Monahan, the Owner, by application dated September 25,
2000, requested amendment of the Official Yakima Urban Area Zoning Map to
rezone one parcel (approximately 1.93 acres) in the vicinity of 5110 Tieton Drive
(Yakima County Assessor's Parcel #181328 - 12403), referred to as "Subject Property,"
from Local Business (B -2) to Small Convenience Center (SCC); and
WHEREAS, on January 11, 2001, the City of Yakima Hearing Examiner conducted a
duly convened, open - record public hearing regarding the requested rezone (UAZO
RZ #4 -00, EC #26 -00), and after considering the City of Yakima Planning Division
Staff Report and other documents and evidence which comprise the record, issued
his Examiner's Recommendation, Examiner No. IU01 -2 -2, dated February 15, 2001;
and
WHEREAS, the Hearing Examiner recommended that the Subject Property should
be rezoned from Local Business (B -2) to Small Convenience Center (SCC); and
WHEREAS, at a duly convened, closed - record hearing on March 20, 2001, the City
Council considered the requested rezone, including the City of Yakima Planning
Division Staff Report and other documents and evidence which comprise the record
developed before the Hearing Examiner, the Hearing Examiner's Recommendation,
and the statements of interested persons; and
WHEREAS, after considering the Hearing Examiner's Recommendation, the
contents of the file; and the statements of interested persons, the City Council finds
with respect to the requested rezone that
1. The Subject Property is suitable to be classified Central Business District Support
(CBDS);
2. There exists a public need for the requested rezone;
3. Circumstances have changed since the existing Light Industrial (M -1) zoning was
established which now make the requested rezone appropriate; and
4. The requested rezone is consistent with and complies with:
a. The requirements and considerations set forth in chapter 15.23 of the Yakima
Municipal Code;

b. The goals and policies of the Yakima Urban Area Comprehensive Plan;
c. The intent of the Yakima Urban Area Zoning Ordinance;
d. Other applicable land use controls; and
WHEREAS, it is in the best interests of the City to adopt the Hearing Examiner's
findings and conclusions and recommendation to approve the requested rezone;
now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA,
WASHINGTON:
Section 1. Hearing Examiner's Recommendation Affirmed: The Yakima City
Council adopts the findings, conclusions and recommendations of the Hearing
Examiner's Recommendation, Examiner No. IU00 -2 -22, dated September 29, 2000,
and incorporates that Hearing Examiner's Recommendation by reference as part of
this Ordinance.
Section 2. Subject Property: Regarding the Subject Property, which is legally
described as:
A portion of the SW 1/4 of Section 32, Township 13 North, Range 19
E.W.M. as recorded in Volume "I" page 23, Yakima County
Washington, on December 16, 1937:
BEGINNING at the most Westerly corner of Lot 14 of said Forney
Subdivision; thence South 52 degrees West to the South line of said Lot
8 of Forney Subdivision; thence East along the South line of said Lot 8
to an iron pin at the Southeast corner of Forney Subdivision; thence
North 38 degrees West 43.8 feet; thence North 52 degrees East 100 feet
to the most Southerly corner of Lot 15 of Forney Subdivision; thence
North 38 degrees West along the Southwesterly line of Lots 15 and 14
of said Forney Subdivision 200 feet, more or less, to the point of
beginning.

1. The Subject Property is suitable to be classified Small Convenience Center (SCC);
2. There exists a public need for the requested rezone;

from Local Business (B -2) to Small Convenience Center (SCC).
Section 4. The City Clerk is hereby authorized and directed to file a certified copy
of this ordinance with the Yakima County Auditor.
Section 5. This ordinance shall be in full force and effect 30 days after its passage,
approval, and publication as provided by law and by the City Charter, and this
action shall be final and conclusive unless within 21 days from the date this
ordinance is passed by the City Council an aggrieved party commences proceedings
for review pursuant to the provisions of Chapter 36.70C RCW.

SUMMARY EXPLANATION:
On March 20, 2001 the City Council conducted a "Closed Record" hearing to consider
the Hearing Examiner's recommendation to approve the rezone request by Mr. Tim
Monahan to rezone the property known as "Glenwood Square" from B -2, Local
Business to SCC, Small Convenience Center. The one - parcel rezone is located at
5110 Tieton Drive, Yakima.
The Council voted unanimously to approve the rezone and directed City Legal staff to
prepare the appropriate ordinance.

The Examiner conducted a public hearing on January 11, 2001.
The staff report presented by Dan Valoff recommended approval.
The Catholic Church and commercial neighbors to the north, across
Tieton Drive, expressed concern about parking, but there is no
opposition to this rezone. The Examiner inspected the property
prior to the hearing.
4111 SUMMARY OF RECOMMENDATION. The Examiner recommends approval.
From the view of the site, the matters contained in the
official record, including the staff report, a review of both the
Yakima Urban Area Comprehensive Plan and the Yakima Urban Area
Zoning Ordinance, and from evidence received at the hearing, the
Examiner makes the following:

3. Application. Rezone of a single 1.93 -acre parcel from
B -2, Local Business to SCC, Small Convenience Center.

4. Proposed Zone. SCC, Small Convenience Center.

5. Proposed Use. A multi -use building with retail,
entertainment, professional offices and restaurants, along with
related activities.
6. Current Zoning and Land Use. The site is currently
zoned B -2, Local Business. The subject property was rezoned from
M -1, Light Industrial to B -2 in 1997 subject to conditions. The
site was previously used as a fruit warehouse. As a result of
the rezone to B -2, the applicant developed the Glenwood Square
retail center, which opened for business in October 2000.
Adjoining properties have the following characteristics:

7. Proiect Description. The purpose of this rezone is to

facilitate a broad mix of uses and tenants for Glenwood Square.
This is a true multi -use building with retail, entertainment,
professional offices and restaurants along with the many possible
permitted land uses available in the SCC classification. With
this broad use the hours of operation will be continuous. This
will enable Glenwood Square to serve the needs of the existing
businesses located in the building.
The primary reason for this rezone is to allow a movie
theatre use within the building. The current B -2 zoning does not
allow a movie theatre. At its inception, the movie theatre was
viewed by city staff as a training /lecture room and a meeting
room known as a media center. It has become apparent that the
media room is more like a movie theatre. The applicant has been
using this room to show movies on a regular basis.

Table 4 -1 of the zoning ordinance classifies movie theatres,
auditorium's exhibition halls as a Class (3) use in the SCC
zoning district.
It is also apparent that game rooms as well as electronic
game rooms associated with Tim's Basement area of Glenwood Square
are also not allowed in the B -2 zone but are listed as Class (3)
uses in the SCC zoning district. As such, this rezone
application will serve as a master zoning review application to
review the Class (3) use of the electronic game room and movie
theatre.
8. Yakima Urban Area Zoning Ordinance. The criteria for
rezones established by YCC 15A.23.030.5 are considered below:
8.1 Testimony. Attorney Patrick Shirey of the Lyon
Law Firm represents the Catholic Diocese and appeared with Father
Metha. They support the project but are concerned about the
additional traffic on Tieton Drive and in particular occasional
III overflow parking that occurs on Diocesan property. The current
overflow parking used by Glenwood Square north of Tieton does not
have a clear border with the church daycare parking. There have
also been instances of parking in the median of the driveway
serving the daycare. The church suggested some sort of fence or
berm between the overflow parking lot and the daycare facility,
and better signing.
Joan Davenport, City Traffic Engineer, addressed issues
concerning traffic on Tieton, including accidents due to turning
movements. There simply is no room to create a left turn lane in
Tieton at this location. Level of service standards are
acceptable. Additional reliance on speed enforcement and better
signing were suggestions. The numbers of parking spaces required
on site meet the code.
Mr. Monahan indicated that he has tried to buy the
adjacent Evans warehouse, or the Hendrix property north of Tieton,
for additional parking but has thus far been unsuccessful.

Currently he has a parking agreement with Doug Fields, who owns
the land behind, directly north, of Hendrix Construction.
Mr. Monahan agreed during the hearing to create some
sort of berm or fence barrier between the overflow parking behind
Hendrix and the daycare, and to install a small sign in the
daycare driveway median indicating that parking was prohibited for
Glenwood Square users. He will work out the details of the sign
and its wording with the Diocese.
I indicated to Mr. Monahan that these things should be
done before this recommendation goes to Council for their action.
8.2 Suitability of the Property. The proposed use as
a mixed use retail center and office complex is suitable at this
location along an arterial street located between moderate
density residential uses to the west as well as other commercial
and industrial land uses to the east.
When this was originally proposed for development by
Mr. Monahan, the residential condominium association to the west
had many concerns about this use. They aid not appear at this

hearing, which reflects well on M. Monahan's ability to operate
this property in a way compatible with the residential
neighborhood. Mr. Monahan indicated that the condo association
had recently contacted him concerning a minor fence_ repair and
routine policing of litter. They apparently do not have any
problem , the hours of operation, which was a major c_:ncern at
the first rezone.
8.3 AcTencv Recommendations. All agencies ar: -. : :ity
departments indicate that public services are availably `:o the
site and this rezone would not create any difficulties it
infrastructure..
8.4 Compliance with Comprehensive Plan and Zoning
Ordinance. The comprehensive plan's land use map designates this
property as Neighborhood Commercial. This proposal and associated
uses are consistent with both the plan and the zoning ordinance.

8.5 Adequacy of Public Facilities. The Comprehensive
Plan's future land use map designates this property as
Neighborhood Commercial. The current and proposed uses are
permitted uses within these designations.
8.6 Compatibility. This property is currently served
by all necessary public utilities. Street access is from Tieton
Drive, an arterial street at this location. Transit service is
provided along Tieton Drive.
After approval of the B -2 rezone and development of
this facility, Mr. Monahan has been operating late night
activities, in violation of the original rezone limit on hours of
operation. This has been of significant concern to staff. This
hearing provided an opportunity to deal with the issue. The
complete lack of any evidence objecting to Mr. Monahan's late
night showing of movies, for instance, suggests that there are no
compatibility concerns. The staff report suggested that hours of
• limitation might be imposed on this rezone. This does not seem
to be necessary. Approving this rezone to SCC will in effect
eliminate the existing 11:00 p.m. restriction.
8.7 Public Need. The proposal is in the best interest
of the community to meet the demand for quality office and retail
space on the west side. The intent of the rezone is to reflect
the use of the property as accurately as possible.
9. Environmental Review. The City issued a Mitigated
Determination of Non - significance in 1997 for the original rezone.
The mitigating measures have been complied with and the MDNS was
readopted for this rezone.
10. Public Notice. Public notice of the hearing was
provided in accordance with the ordinance.
From the foregoing Findings, the Examiner makes the
following:

CONCLUSIONS

1. The Examiner has jurisdiction.
2. The proposed rezone conforms to the goals and policies
of the Yakima Urban Area Comprehensive Plan and to the intent of
the Yakima Urban Area Zoning Ordinance; the property is suitable
for uses permitted in the SCC zone; there are no problems with
neighborhood compatibility; and a public need does exist for the
proposed change.
3. All notice provisions of the ordinance have been
complied with.
Based upon the foregoing Findings and Conclusions, the
Examiner submits to the Yakima City Council the following:

Narrative for SCC Zone
SUPPLEMENTAL WRITTEN NARRATIVE
The rezone to Small Convenience Center classification for Glenwood Square is to facilitate the
broad use and future tenants of the building The SCC zoning was proposed by the City of
Yakima to zone the property as accurately as possible This was addressed in the September
26, 2000 letter accompanying the rezone application
Glenwood Square will be a place where anything can happen, a true multi -use building with
1111 retail, entertainment, professional offices and restaurants along with the many possible permitted
land uses available in the SCC classification. With this broad use the hours of operation will be
continuous This will enable Glenwood Square to serve the needs of the existing businesses
located in the building The intent of this letter is to address and include any use that would
compliment the project. The following list is the possible uses requested from table 4 1 in the
Yakima UAZO amended 12/28/98

SUBJECT Response to Letter from Monahan
In a recent letter to City Council (copy attached), Tim Monahan expressed his frustration with
the restnctions imposed by the Yakima Urban Area Zoning Ordinance as it relates to his new
development (Glenwood Square) on Tieton Drive By all accounts, this project has evolved and
. changed since its inception, and until today the project stands out as an exciting and extremely
innovative retail center.
I have met with Mr. Monahan several times and visited the site of this project and I believe we
have now all agreed on a workable solution to his problem Mr Monahan is in the process of
submitting a request to rezone his development from B -2 (Local Business) to SCC (Small
Convenience Center).
This rezone, if approved, will allow a theater use within the building, which appears to be the
primary issue at hand. The current B -2 zoning does not allow a movie theater use, and although
staff have been very creative within the limits of the code in classifying his proposed
"training /lecture" room as a "meeting hall" it has become more and more apparent that Mr.
Monahan would like to use this room to show mo'v
While his rezone is pending, I have authorized Mr Monahan to test market his intended use of
this space, unless and until we receive any complaints The purpose of this test is to be sure that
there is a market for his intended use, and to provide an opportunity to measure the impact of this
proposed use on the surrounding neighborhood.
In conclusion, I feel that Mr Monahan's frustration was primarily focused on our zoning
ordinance. I believe staff acted in good faith to try to find a solution to the problem as presented
and that we now have agreement on a process (i e rezone application) to test the appropriateness

Current zoning and Land Use
The site is currently zoned B -2, Local Business. The subject property was rezoned
from M -1, Light Industrial to B -2 in 1997 subject to conditions. The site was previously
used as a fruit warehouse. As a result of the rezone to B -2, the applicant developed
the Glenwood Square retail center, which opened for business in October 2000. Ad-
joining properties have the following characteristics:

Project Description
The applicant states in his narrative that the rezone to SCC for Glenwood Square is to
facilitate the broad use and future tenants of the building. Glenwood Square is a true
multi -use building with retail, entertainment, professional offices and restaurants along
with the many possibie permitted land uses available in the SCC classification. With
this broad use the hours of operation will be continuous. This will enable Glenwood
Square to serve the needs of the exiting businesses located in the building.
The primary reason for this rezone is to allow a "movie theatre" use within the building.
The current B -2 zoning does not allow a movie theatre. At its inception the movie thea-
tre was viewed by city staff as a "training /lecture' room and a meeting room known as a
media center. It has become apparent that the media room is more like a movie thea-
tre The applicant has been using this room to show movies on a regular basis.
Table 4 -1 of the zoning ordinance classifies movie theatres, auditoriums exhibition halls
as a Class (3) use in the SCC zoning district.
It is also apparent that game rooms as well as electronic game rooms associated with
"Tim's Basement" area of Glenwood Square are also not allowed in the B -2 zone but
are listed as Class (3) uses in the SCC zoning district. As such, this rezone application
will serve as a Master zoning review application to review the Class (3) use of the elec-
tronic game room and movie theatre.
1997 Urban Area Comprehensive Plan
This rezone is compatible with the following Policies and Objectives of the 1997 Com-
prehensive:
• The 1997 Yakima Urban Area Comprehensive Plan, Future Land Use Map desig-
nates this area as being suitable for arterial commercial development.
• Objective 01: Encourage the physical development of the Yakima Urban Area in a
manner that enhances its image as the cultural and business center. (1997 Plan)

• Objective S1: Encourage the location of public and semi- public facilities in appro-
priate locations throughout the urban area.
• Objective S2: Require public and semi - public uses to be developed in a manner
that does not detract from surrounding uses.
Yakima Urban Area Zoning Ordinance
Chapter 15.03.030 states that the purpose of the SCC zoning district is to provide areas
for commercial activities outside the central business district that meet the retail shop-
ping and service needs of the community. The SCC zoning district shall also accom-
modate small commercial centers, generally three to ten acres in size, where most of
the commercial uses have located in a coordinated manner around a common parking
lot.
Small convenience centers serve the day -to -day convenience shopping and service
needs of the surrounding neighborhood and should be designed to minimize the unde-
sirable impacts of the center on the neighborhood it serves. Uses in this district should
be retail or personal service establishments dealing directly with the consumer, the pri-
mary occupants usually being a supermarket and drug store.
In review of the uses within Glenwood Square, some of the uses are currently permitted
•
in the B -2 zone, some uses require either a Class (2) or (3) zoning review, and some
uses are not permitted. The zone change request to SCC will allow for a greater variety
of retail, service, and entertainments uses anticipated occupying Glenwood Square.
As part of the 1997 rezone recommendation by planning staff, the hearing examiner
and affirmed by the city council's decision, the hours of operation were not to extend
past 11:00 p.m. The applicant has requested that there be no limits on the hours of op-
erations and that the previous restriction be rescinded.
Ch. 15.23.030 Rezone criteria
Recommendations for approval of rezone applications are governed by seven criteria
specified in Section 15.23.030 YMC.
1. Testimony at public hearing. .
To be considered by the Hearing Examiner.
2. Suitability of property for proposed use.
The proposed use as a mixed use retail center and office complex is suitable at
this location along an arterial street located between moderate density residential
uses to the west as well as other commercial and industrial land uses to the east.

3. Recommendations from interested agencies.
All agencies and city departments indicate that public services are available to 411
the site and this rezone would not create any difficulties for infrastructure.
4. Compliance with the Comprehensive Plan.
The Comprehensive Plan's future land use map designates this property as
Neighborhood Commercial. The current and proposed uses are permitted uses
within these designations.
5. Adequacy of public utilities.
This property is currently served by all necessary public utilities. Street access is
from Tieton Drive, an arterial street at this location. Transit service is provided
along Tieton Drive.
6. Compatibility of proposed use.
This zoning classification change is compatible with the adjoining neighborhood.
The existing use is similar to the land use east of the subject property. Site
screening from residential areas to the south and west were required as part of
the B -2 rezone in 1997.
7. Public Need
The proposal is in the best interest of the community to meet the demand for
quality office and retail space on the "west side ". The intent of the rezone is to
reflect the use of the property as accurately as possible.
Development Services Team comments
A design services team meeting was held on October 25, 2000 discuss the technical
aspects of this proposal. The following is a summary of the comments received:
Customer Services — The rezone will not affect utilities.
Engineering — Based upon review of this development proposal the Engineering Divi-
sion finds no engineering issues.
No other written comments were received.
Transportation Capacity Management Ordinance
This non - project rezone was determined to be exempt under the Transportation Capac-
ity Management Ordinance.
State Environmental Policy Act
On December 22 2000, the City of Yakima adopted the MDNS issued on April 4, 1997
for the rezone of this property from M -1 to B -2, file number EC #35 -96. All of the miti-
gating measures of the MDNS have been complied with.

Conclusions
The Division of Environmental Planning for the City of Yakima, Washington has re-
viewed this rezone request and offers the following findings:
1. The subject property was rezoned from M -1, Light Industrial to B -2 in 1997 subject

the SCC zoning district. Game rooms as well as electronic game rooms associated
with "Tim's Basement" area of Glenwood Square are also not allowed in the B -2 zone
but are listed as Class (3) uses in the SCC zoning district. As such, this rezone applica-
• tion will serve as a Master zoning review application to review the Class (3) use of the
electronic game room and movie theatre.
3. This rezone from B -2 to SCC is considered as compatible with adjoining zoning.
4. The proposed rezone is consistent with the future land use map designation of
Neighborhood Commercial.
5. Adequate public services are in place and meeting the utility and access require-
ments of the SCC zoning district.
6. All public notice requirements of YMC Chapters 15 and 16 have been completed.
Recommendation
The Division of Environmental Planning recommends that this rezone from B -2, Local
Business to SCC, Small Convenience Center be approved as well as the Class (3) zon-
ing review for the movie theater and the game room subject to the following condition:
1. The hours of operation for the Glenwood Square shall NOT be restricted to clos-
ing at 11:00 p.m. The Hearing Examiner may consider placing restrictions on
the hours of operation based upon public testimony at the public hearing to ad-

DETERMINATION:
The lead agency for this proposal, after reviewing the Environmental Checklist and
related information, has determined that the project does not have a probable
significant adverse impact on the environment and an environmental impact
statement (EIS) will not be required as provided under RCW 43.21C.030(2c),
provided measures are taken to mitigate potential adverse impacts.
This Mitigated Determination of Nonsignificance (MDNS) is hereby conditioned
upon the following mitigating measures, as authorized under WAC 197 -11 -660 and
YMC 6.88.160 (B)5 as supported by these findings and policies:
FINDING: TRANSPORTATION IMPACTS
The project site has frontage on Tieton Drive, a Minor Arterial street. The
planned land use of mixed retail and office use is projected to create an
additional 1390 daily vehicular trips to the site, with 170 new trips during
peak hour traffic. The City of Yakima's arterial street policy is to
"Improve and maintain all existing arterial street systems for the safe
and economical movement of people and goods within the urban area.
Land Use decisions will consider the impact on adjacent streets and
roads " (Yakima Urban Area Comprehensive Plan, TR -16)

FINDING: TRANSPORTATION CORRIDOR
The project site includes a 16 foot wide strip of land, owned by the City of
Yakima which bisects the subject property. This strip of land is part of a
continuous land holding by the City which extends several miles west of the
project site and was formally the site of the Yakima Valley Trolley line. The
applicant has secured a license from the City of Yakima for use of the land for
the purpose of access and parking, but is restricted from any construction over
the City Owned land.
FINDING: UTILITY IMPACTS
The site is within the Nob Hill Water service area and served off the north
side of Tieton Drive. To accommodate the redevelopment of the structure,
Nob Hill Water states that the preferred way to utilize the available flow is to
install an eight inch looped system with fire hydrants around the building,
and located within an easement.
Public sewer is currently available to the site.
Accordingly, the City of Yakima conditions the environmental review, under the
authority of the State Environmental Policy Act on the following conditions:
Mitigation Measures :
1. The rezone area is limited to a total of two commercial driveways from
Tieton Drive.
2. An 8 inch looped water line shall be installed around the perimeter of the
site, located within an easement and with fire hydrants as determined
necessary by the City of Yakima Building Code Division.
3. No construction shall be allowed over the City of Yakima transportation
corridor which bisects this site. Future use of the corridor by the City of
Yakima may include utility line locations or pedestrian and /or bicycle
pathways.
This decision was made after review of a completed environmental checklist and
other information on file with the lead agency, including a traffic analysis. This
information is available to the public on request.

this proposal for 15 days from the date below. Written comments regarding this
determination will be accepted until 5:00pm on April 18, 1997. Such comments •

To Whom It May Concern:
I want to welcome Glenwood Square to our community It is a very nice place. They have done a great job
remodeling a warehouse into a retail and office building. With a lot of other businesses leaving Yakima,
they are also a good infusion of needed tax dollars.
My concern with the requested zoning change is primarily parking. The original plan for Glenwood Square
included some enclosed parking. The plan was changed to use this space for more business, which should
have increased the parking requirement as the retail floor area increased. I understood that they met the
minimum requirements for parking under their original plan. Does the current plan for the building meet
the parking standards?
I assume continued success of this development is related to adequate parking for their clientele. Some
business traffic would be lost if they could not find a place to park. Recently, some overflow parking has
been added across Tieton Drive in the industrial zone. If they had adequate parking, then why the need for
overflow parking?
Several times over the last few months there have also been traffic accidents in front of Glenwood Square.
Now you add some pedestrian traffic from their overflow parking lot and you could have a very dangerous
situation. There is currently no safe way for pedestrian traffic to cross Tieton Drive.
My second concern is adherence to the zoning ordinance. The zoning ordinance is a joke. Glenwood
• Square is currently not operating within their current zoning category and haven't been for weeks. I am not
sure what restrictions you would impose that they wouldn't disregard anyway. My understanding is that
they were only supposed to operate businesses until 11pm. They are open well past that. They have been
operating businesses that don't fall within their current zoning category as well.
I would request that parking and traffic be reviewed. Clientele and employees should have a safe place to
park. I am not sure the current condition of the overflow parking lot provides that safety. Glenwood
Square doesn't appear to have leased all of its space yet and it already has a parking problem. I am sure no
one wants to see a fatality as a result of a frugal parking standard.
I would also request that any future modifications of the zoning of this property be subject to hearing as
well. It's unfortunate when advantage is taken without due process. It sure lessens the credibility of the
process.
I know that Glenwood Square wants to be a good neighbor and I welcome the business. I just want this
area to continue to be a great neighborhood also I would encourage you to address the following items:
1. Review the parking and traffic circulation of the development. Is there enough parking and is
parking on the opposite side of Tieton Drive a good idea?
2. Don't give a blanket approval of everything in the future. The neighborhood still deserves notice
of significant changes.
3. What about the 11pm closing time requirement which was part of the original proposal?

Dear Mr Valoff:
In the matter concerning a rezone of the property located at 5110 Tieton Drive called Glenwood Square,
consideration must be given to their parking situation or lack thereof. Currently their neighbors across the
street to the north are taking the brunt of their problem. Because of their lack of parking, we have had
them parking on our lots, driveways and lawns.
We understand they have made arrangements to rent the lot to the north of our property for their
"overflow" parking used now both day and night. They are directing both vehicle and pedestrian overflow •
traffic for their events over and across our property. They have even entered our property to clear snow
for their vehicle and pedestrian traffic while we were not here and without our permission. My employees
and customers have had to wait on Tieton to enter our construction yard because of the traffic crossing over
our property Their customer and employee parking on our property, next to our equipment have
interrupted our normal course of business and created safety and security concerns. Barriers placed to
prevent vehicle access across our property have proven ineffective. On December 8, 2000, I spoke to Mr.
Enright about the situation as they attempted to put their overflow direction signs over our property; he told
me they intended to keep snow clear for us as our property would probably be heavy with their pedestrian
traffic. I reminded him that we are a construction company and consider their traffic on or across our
property unsafe and a security problem. The situation has not changed
If they are to continue to use the property on 51" Avenue (181321- 44423) then Glenwood Square needs to
take steps to ensure that 51' Avenue is used as the access for both pedestrian and vehicle traffic. It should
also be noted that 51' Avenue is a rarely maintained, narrow, gravel road that is utilized by a few industrial
businesses for employee and commercial traffic
The lack of parking and its effects on neighboring properties must be a major consideration for rezoning
this property to allow the uses that attract high volume traffic.

On February 15. 2001 the Yakima Heanng Examiner rendered his recommendation on an
application submitted by Tim Monahan /Glenwood Square LP. The applicant proposes to
rezone a 1.9 acre parcel from B -2 (Local Business) to SCC (Small Convenience Center),
and environmental review. The subject parcel is located at 5110 Tieton Drive. Yakima,
Washington. The purpose of the rezone is to develop the existing building into a multi -use
building with retail, entertainment, professional offices and restaurants, along with related
activities. The application was reviewed at a public hearing held by the Hearing Examiner
on January 11, 2001.
A copy of the Hearing Examiner's Findings and Recommendation is enclosed.
The Hearing Examiner's Recommendation will be considered by the Yakima City Council
in a Public Meeting to be scheduled. The City Clerk will notify you of the date, time and
place of the public meeting_

Notice is hereby given that the City of Yakima. Planning Division is processing a rezone application
submitted by Tim Monahan / Glenwood Square Partnership The applicant is proposing to rezone a
single parcel from B -2 (Local Business) to SCC (Small Convenience Center). The subject property
III is located at 5110 Tieton Drive. within the City of Yakima, Washington. The rezone to Small
Convenience Center classification for Glenwood Square is to facilitate the broad use and future
tenants of the building.
This action requires that a Public Heanng be held by the Hearing Examiner. The Hearing Examiner
will then issue a recommendation to the Yakima City Council for its decision The Public Hearing
has been scheduled to be held on Thursday, January 11, 2001 beginning at 9:00 a.m. in the
Council Chambers, City Hall, 129 North 2nd Street, Yakima, WA. Any person desiring to express
