AN ORDINANCE relating to land use and development regulation, and amending
sections 12.01.010, .030, .040, .070, 12.02.010, .020, .050, 12.03.030,
.060, .070, .080, .090, .100, 12.04.010, .050, 12.05.010, .020, 12.06.010,
.020, .030, .040, .060, .070, .090, 8.60.010, .040, 14.30.020, 15.05.020,
.050, and amending the title of Chapter 12.04, repealing sections
12.01.060, 12.02.060, 8.04.010, 8.08.010, 8.60.020, .030, .050, .060, .070,
14.30.030, .040, .050, and adding other new sections to Title 12 of the
Yakima Municipal Code.
WHEREAS, the City Council has considered the recommendations of the
Regional Planning Commission regarding the following amendments to Title 12 of the
Yakima Municipal Code relating to development standards for enactment by the City of
Yakima, and
• WHEREAS, the City Council has requested City staff to review the Yakima
Municipal Code to identify sections codified outside of Title 12 that conflict with or are
otherwise related to matters addressed in Title 12, and has further considered City
staff's report and recommendations regarding such sections and
WHEREAS, the City Council has reviewed the following proposed amendments,
repealers, and additions to the Yakima Municipal Code and finds that it is in the best
interest of the City that they be enacted, now therefore
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA,
WASHINGTON:
1 Section 1. Section 12.01.010 of the Yakima Municipal Code is amended to read as
2 follows:
3 12.01.10 Purpose.
4 The purpose of this chapter is to establish requirements and standards for the
5 design and construction of public works improvements lay--private applicants in
6 conjunction with subdivision, or development, or redevelopment of real
7 property, and to establish fees procedures for the City Engineer's review of
8 design documents for and inspection of public works improvements.

9 Section 2. Section 12.01.030 of the Yakima Municipal Code is amended to read as
10 follows:
11 12.01.030 Design Documents.
12 (1) Design documents for design and construction of public works
13 improvements shall, without limitation, include plan drawings and profile
14 drawings, engineering calculations, and specifications. Design documents shall
15 be submitted by the applicant to the City Engineer before any construction is
16 started. The City Engineer may require the applicant to submit multiple sets of
17 design documents. All drawings shall be of sufficient clarity and detail to
18 indicate the location, nature, and extent of the public works improvements.
19 Design documents shall show in detail that construction work and public works
20 improvements shall conform to applicable laws and regulations including this
21 Title. Plans shall be drawn on substantial velum or mylar or cloth-capable of
22 reproduction on standard engineering reproduction equipment and shall
23 conform to engineering standards satisfactory to the City Engineer. Applicants
24 may request to submit design documents on computer media compatible with
25 the City Engineer's data processing system vcver, an applicant shall have no

29 (2) Design documents shall be prepared by a Civil Engineer licensed by the State
30 of Washington. The City Engineer may waive preparation by a licensed Civil
31 Engineer if the nature of the work contemplated is such that preparation by a
32 licensed Civil Engineer is not necessary to obtain compliance with applicable
33 laws and regulations including this Title. Submittal of appropriate design
34 documents shall not be waived.

35 Section 3. Section 12.01.040 of the Yakima Municipal Code is amended to read as
36 follows:
37 12.01.040 Review Process.
38 (1) The City Engineer shall review design documents for public works
39 improvements. No public works improvements may be constructed before
40 appropriate fees are paid and the City Engineer has provided written approval
41 of the pertinent design documents. If the City Engineer determines that
42 proposed public works improvements and the related design documents
43 conform to applicable requirements including this chapter, then the City
44 Engineer shall mark the original design documents "Approved" and affix his/her
45 . signature thereto, and these actions shall constitute written approval. The
46 approved documents shall constitute the permit for construction of the
47 - .7 ' , n^tents
48 (2) Proposals will ordinarily be reviewed and inspected in the order they are
49 submitted td the City Engineer. An applicant may request expedited review or
50 inspection; however, an applicant shall have no right to such expedited review or
51 inspection. The City. Engineer may- determine the terms and conditions of such
52 expedited review or inspection, including, without limitation, compensation for
53 City employee overtime work.
54 (3) (2) Public works improvements described by approved design documents
55 must be constructed in conformity with the approved design documents and
56 may not be changed, modified or altered without written approval of the City
57 Engineer. •
58 (=I ) (3) The applicant shall, during construction, maintain a neatly marked,
59 full -sized set of record drawings showing the layout and final location of all
60 public works improvements involved in new construction. Prior to final
61 acceptance by the City of Yakima of public works improvements, reproducible
62 record drawings prepared by the Civil Engineer of record and clearly identified

63 as record drawings shall be delivered to the City Engineer for
64 approvalacceptance.
65 (5) (1) The applicant shall submit for written approval by the City Engineer a
66 detailed summary of the construction cost of approved public works
67 improvements. which may include the contractor's bid, the engineer's estimate,
68 or other items which rnav assist the City- Engineer to determine the cost of
69 construction.
70 (6) (3) The applicant shall, upon the City Engineer's written approval of
71 completed e-- public works improvements, transfer ownership of such public
72 works improvements to the City of Yakima.
73 (7) k=- -Final acceptance by the City of Yakima of the actual public works
74 improvements shall not occur before the applicant has satisfied all applicable
75 requirements, including, without limitation, those of this chapter.
76 Section 4. NEW SECTION. A new section is added to chapter 12.01 of the Yakima
77 Municipal Code to read as follows:
78 12.01.050 Procedures Manual for Construction of Public Improvements.
79 (1) The City Engineer shall establish and maintain a manual describing
80 procedures for the City Engineer's review, permitting and inspection of public
81 improvements constructed by private parties. This manual shall include a
82 schedule of fees for such review, permitting and inspection approved by the City
83 Council.
84 (2) All public improvements financed by Owner /Developer private contracts
85 shall comply with this Procedures Manual.
86 (3) The procedures specified in the Procedures Manual shall apply to Public
87 Improvements within a subdivision or Planned Development or other new
88 development or redevelopment.

114 Section 6. NEW SECTION. A new section is added to chapter 12.01 of the Yakima
115 Municipal Code to read as follows:
116 12.01.060 Phased Improvements.
117 (1) The City Engineer may determine that actual construction of specified
118 improvements is not immediately useful and may be deferred until a period of
119 time has passed, a development milestone has been reached, or some other event
120 makes actual construction of such specified improvement useful.. The person or

121 entity responsible for actual construction of such specified improvements may
122 enter into a written agreement with the City Engineer to complete such specified
123 improvements at some later time when, in the judgment of the City Engineer,
124 actual construction of such specified improvements will become useful.
125 (2) Improvements the City Engineer determines will be useful immediately
126 must be constructed as part of the initial phase of a project or development and
127 may not be included in the written agreement allowing specified improvements
128 to be constructed at some later time, and shall be constructed prior to final
129 approval of the initial phase of the proposed development.
130 Section 7. Section 12.01.070 of the Yakima Municipal Code is amended to read as
131 follows:
132 12.01.070 Severability.
133 If any section, subsection, paragraph, sentence, clause or phrase of this that
134 title is declared invalid or unconstitutional for any reason, such decision shall not
135 affect the validity of the remaining portions of this ch3ptertitie.
136 Section 8. Section 12.02.010 of the Yakima Municipal Code is amended to read as
137 follows:
138 12.02.010 Establishment of easements.
139 Public utility easements shall be established for the location of new and proposed
140 public utility lines serving new land divisions and land development. Public
141 utility easements shall also be established across the front of new lots and
142 e redeveloped lots to provide future utility access as neededas determined
143 necessary by the City Engineer. Public utility easements w41 shall be dedicated
144 (granted) at the time that subdivision and/or land use approval is granted.
145 Section 9. Section 12.02.020 of the Yakima Municipal Code is amended to read as
146 follows:
147 12.02.020 Easement location and width.
148 Eight (8) foot wide utility easements shall be dedicated along the front of each lot
149 in subdivisions and short subdivisions. Easements for new and / or future utility

150 lines shall be a minimum of sixteen eight (168) feet in width, or twice the buried
151 depth of the utility, whichever is greaterprev -id l the width of easements for

153 Section 10. Section 12.02.050 of the Yakima Municipal Code is amended to read as
154 follows:
155 12.02.050 Other private utility facilities.
156 Easements for unusual facilities such as high- voltage electrical transmission lines,

158 may be provided at the direction of the City Engineer.
159 Section 11. Section 12.02.060 of the Yakima Municipal Code is repealed entirely.

165 Section 12. NEW SECTION. A new section is added to chapter 12.02 of the Yakima
166 Municipal Code to read as follows:
167 12.02.060 Design approval and adjustment.
168 The engineering design of easements is subject to approval by the City Engineer.
169 The City Engineer may, in his /her discretion, adjust these standards as necessary
170 to facilitate establishment of easements. •
171 Section 13. Section 12.03.030 of the Yakima Municipal Code is amended to read as
172 follows:
173 12.03.030 Sewer line location.
174 Sewer lines shall be located in streets to serve abutting properties. When
175 necessary, sewer lines may be located within public easements. Lines Sewer
176 • mains located in streets shall be offset from the street centerline by six (6) feet
177 and manholes shall not be located within a vehicle tire path. Sewer lines located
178 in easementsl'shall generally be located in the center of the easement, but may,

179 with the approval of the City Engineer, be offset to accommodate the installation
180 of other utilities or to satisfy special circumstances.
181 Section 14. Section 12.03.060 of the Yakima Municipal Code is amended to read as
182 follows:
183 12.03.060 Manholes required.
184 Manholes shall be installed at intervals of no treater than 350 feet and at all
185 vertical and horizontal angle points.
186 Section 15. Section 12.03.070 of the Yakima Municipal Code is amended to read as
187 follows:
188 12.03.070 Side sewer service.
189 Each building containing sanitary facilities shall be served by a separate private
190 side sewer line from a public main. Branched side sewers serving multiple
191 buildings and properties shall not be permitted. Single side sewers serving
192 multi -unit buildings are permitted.
193 Section 16. Section 12.03.080 of the Yakima Municipal Code is amended to read as
194 follows:
195 12.03.080 Side sewer maximum length.
196 The maximum side sewer length within public right shall be 100 feet
197 unless otherwise approved by the City Engineer.
198 Section 17. Section 12.03.090 of the Yakima Municipal Code is amended to read as
199 follows:
200 12.03.090 Gravity flow required.
201 Sewer lines shall be designed for gravity flow operation. Lift stations and force
202 mains (pressurized lines) shall be limited to those locations and circumstances
203 where they are consistent with the Comprehensive Sewer Plan and are the
204 preferable lentshort -term solution to service of the development site and other
205 properties in the vicinity.

206 Section 18. Section 12.03.100 of the Yakima Municipal Code is amended to read as
207 follows:
208 12.03.100 Design approval and adjustment.
209 The engineering design of sewer facilities is subject to approval by the City
210 Engineer. The City Engineer may, in his /her discretion, adjust these standards
211 as necessary to facilitate installation of sewer facilities, in cooperation with the
212 Wastewater Division Manager.
213 Section 19. The title of Chapter 12.04 of the Yakima Municipal Code is amended to
214 read as follows:

21.6 Section 20. Section 12.04.010 of the Yakima Municipal Code is amended to read as
217 follows:
218 12.04.010 Service required.
219 All new lots and development shall be served by a public water supply line
220 maintained by the City of Yakima or Nob Hill Water Company, or other water
221 purveyor, and located adjacent to the lot or development site. The water line
222 shall be capable of providing sufficient flow and pressure to satisfy the fire flow
. 223 and domestic service requirements of the proposed lots and development as
224 approved by the City Engineer in cooperation with the Code Administration
225. Manager and Water /Irrigation Division Manager.
226 Section 21. Section 12.04.050 of the Yakima Municipal Code is amended to read as
227 follows:
228 12.04.050 Design approval and adjustment.
229 The design of water lines and appurtenances is subject to approval by the City
230 Engineer. The City Engineer may, in cooperation with the Water /Irrigation
231 Division Manager, in his /her discretion, adjust these standards as necessary to
232 facilitate installation of water lines and appurtenances.

233 Section 22. NEW SECTION. A new section is added to chapter 12.04 of the Yakima
234 Municipal Code to read as follows:
235 12.04.060 Replacement of Wooden Mains.
236 (1) When development or construction activities cause an existing wooden
237 water main to be covered by impervious surfacing, or to be exposed for other
238 construction activities, the wooden main shall be replaced.
239 (2) When replacement of existing wooden water mains is required, the
240 replacement material shall be PVC pipe, class 200, or cement lined ductile iron
241 pipe, class 50.
242 (3) The replacement pipe shall be the same diameter as the existing pipe.
243 (4) The City shall supply the pipe and fittings. The Developer shall excavate
244 and install the replacement pipe. The City shall supply the labor to connect the
245 replacement pipe to the existing system.
246 (5) The replacement main may be relocated in compliance with the
247 Water /Irrigation Division Standards and requirements as approved by the City
248 Engineer.
249 (6) When existing irrigation water mains are available to a site development
250 or redevelopment, the irrigation mains should be extended to serve the
251 development.
252 Section 23. Section 12.05.010 of the Yakima Municipal Code is amended to read as
253 follows:
254 12.05.010 Sidewalk installation required.
255 Sidewalks shall be installed along both sides of all new, improved, and
256 reconstructed streets. Projects which repair small portions of or maintain
257 existing streets shall not be considered "improvements" for the purposes of this
258 section and shall not trigger the requirements of this section. Sidewalks shall
259 also be installed across the frontage of all newly developed or redeveloped lots

261 Section 24. Section 12.05.020 of the Yakima Municipal Code is amended to read as
262 follows:
263 12.05.020 Sidewalk location, thickness and width.
264 Sidewalks shall be located in the street right -of -way or, when necessary, in a
265 public easement. They shall be constructed of cement concrete and be a
266 minimum of 4 inches thick. Sidewalks at driveway approaches shall be a
267 minimum of 6 inches thick. Sidewalks which are in need of repair or
268 replacement may be reconstructed at their existing width. Otherwise, minimum
269 sidewalk width for all new development shall be:
270 A. Residential streets 5 feet
271 B. Arterial and collector streets 7 feet
272 C. Central Business District streets 12 feet
273 On arterial and collector streets 5 feet of sidewalk may be allowed with 2 feet of
274 buffer such as planter strip.
275 Section 25. NEW SECTION. A new section is added to chapter 12.05 of the Yakima
276 Municipal Code to read as follows:
277 12.05.030 Obstructions.
278 The full width of sidewalks shall be maintained free of any obstructions such as
279 utility poles, meters, or manholes where feasible.
280 Section 26. NEW SECTION. A new section is added to chapter 12.05 of the Yakima
281 Municipal Code to read as follows:
282 12.05.040 Design approval and adjustment.
283 The design of sidewalks and appurtenances is subject to approval of the City
284 Engineer. The City Engineer may, in cooperation with the Streets Manager,
285 adjust these standards as necessary to facilitate installation of sidewalks and
286 appurtenances.

287 Section 27. Section 12.06.010 of the Yakima Municipal Code is amended to read as
288 follows:
289 12.06.010 Street types, functional classification.
290 Map V -1, Functional Classification of the Yakima Urban Area Comprehensive
291 Plan, designates principal arterial, minor arterial and collector streets and
292 establishes their functional classification. All other streets are classified as
293 Busine=ss District Local. Residential Access -er Residential Access based upon the
294 zoning and-se -4-aEljac nt properties.
295 Section 28. Section 12.06.020 of the Yakima Municipal Code is amended to read as
296 follows:
297 12.06.020 Right -of -way and pavement width standards.

309 Section 29. Figure 1, which is incorporated in Section 12.06.030 of the Yakima
310 Municipal Code and which depicts the Construction Design Standards for streets, shall
311 appear substantially equivalent to the attachment named Construction Design
312 Standards, Figure 1, attached to this ordinance.
313 Section 30. Section 12.06.030 of the Yakima Municipal Code is amended to read as
314 follows:
315 12.06.030 Design standards, adjustment of standards.
316 The preferred construction design standards for each class of street are depicted
317 in Figure 1. Final design of street improvements is subject to approval by the
318 City Engineer. The City Engineer, at his discretion, is authorized to adjust these
319 standards as necessary to facilitate the construction of new streets and
320 improvement of existing streets. Projects which repair small portions of or
321 maintain existing streets shall not be considered "improvements" for the
322 purposes of this section.
323 Section 31. Section 12.06.040 of the Yakima Municipal Code is amended to read as
324 follows:
325 12.06.040 ,Bicycle and pedestrian facilities,.
326 Bicycle lanes 'and pedestrian sidewalks shall be provided along all new or
327 reconstructed arterial and collector arterial streets, where feasible.
328 Section 32. Subsection 12.06.060(C) of the Yakima Municipal Code is amended to read
329 as follows:
330 C. Right -of -way boundaries at intersections of access streets shall be rounded
331 with a minimum radius of twenty (20) €eet, or greater when determined by the
332 City Engineer to be necessary. Right of wav boundaries at intersections of
333 arterial or collector streets shall be rounded with a curve concentric with the curb
334 and required or future sidewalk. When determined necessary by the City
335 Engineer, the boundary line intersection shall be truncated with a chord having a
336 nominal deflecting angle of 45 °. The end points of said chord shall be located
337 directly oppdsite the points of tangency of the curb radius:

338 Section 33. Section 12.06.070 of the Yakima Municipal Code is amended to read as
339 follows:
340 12.06.070 Provision of street curbing.
341 Barrier curbs shall be installed along all arterial, collector, and business district
342 acccsspublic streets, except rolled mountable curbs may be permitted along
343 residential access streets. Curb design shall be consistent with the standards of
344 the City Engineer.
345 Section 34. Section 12.06.090 of the Yakima Municipal Code is amended to read as
346 follows:
347 12.06.090 Private access streets.
348 Private streets may be used as sole access to new lots and development and for
349 internal circulation within manufactured home parks and residential planned
350 developments.

455 exists within two hundred feet of the development on the same side of the street.
456 Replacement of existing sidewalk is required only if existing sidewalk presents a
457 safety hazard except that for applications under the jurisdiction of the City of
458 Yakima, the provisions of Title 12 of the Yakima Municipal Code shall prevail
459 over the provisions of this section to the extent of any conflict between such
460 proyision.s.
461 Section 49. Section 15.05.050 of the Yakima Municipal Code is amended to read as
462 follows:
463 15.05.050 Street right - of - way dedication.
464 All new development shall dedicate, where necessary, street right -of -way in
465 conformance with the standards in the county /city subdivision ordinance and
466 the arterial street plan adopted in the Yakima urban area comprehensive plan
467 except that for applications under the jurisdiction of the City of Yakima, the
468 provisions of Title 1.2 of the Yakima Municipal Code shall prevail over the
469 provisions of this section to the extent of anv conflict between such provisions.
Section 50. Severability: If any section, subsection, paragraph, sentence, clause or
phrase of this ordinance, or any provision of the Yakima Municipal Code established by
this ordinance, is declared invalid or unconstitutional for any reason, such decision
shall not affect the validity of the remaining portions of this ordinance, or other
provisions of the Yakima Municipal Code established by this ordinance.

Section 51. This ordinance shall be in full force and effect 30 days after its passage,
approval, and publication as provided by law and by the City Charter.

SUMMARY EXPLANATION:
There have been many public meetings concerning the revisions to Title 12. The attached
document is a compilation of the changes and revisions to the existing document in legislative
format. The revised document should be easier to implement and more versatile for the
developers and contractors that develop within the City. It is a tool to assist developers in
determining which requirements are needed and includes a Procedures Manual for developing in
the City right -of -way. The attached Ordinance also includes amendments and or deletions to
existing code sections which would be in conflict with the proposed amended Title 12 if not
changed.

STAFF RECOMMENDATION: Council should adopt the Title 12 Revisions and take action to
amend or delete inconsistencies between proposed Title 12 language and existing regulations
included in the YMC.
