HomeMy WebLinkAbout2001-014 Amending Downtown Parking Exempt Area ORDINANCE NO. 2001- 14 AN ORDINANCE concerning land use and zoning regulation and requirements for off street parking, amending the parking exempt area in the downtown Central Business District as depicted on Figure 6 -1 of Yakima Municipal Code § 15.060.040, and amending the requirements for off street parking applicable to commercial agricultural packing processing plants and storage facilities, and to wholesale trade /warehouses as depicted on Table 6 -1 of Yakima Municipal Code § 15.060.040. WHEREAS, the City Council has reviewed the following proposed amendments to existing requirements for off street parking and finds that it is in the best interest of the City to enact the following amendments to the off street parking requirements of Title 15 of the Yakima Municipal Code; now therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA, WASHINGTON: Section 1. Figure 6 -1, which is incorporated in Section 15.06.040(C) of the Yakima Municipal Code, and which depicts the Downtown Business District of Yakima that is exempt from the provisions of chapter 15.06 YMC as they relate to the number of parking spaces required, shall appear substantially equivalent to the area depicted on Exhibit 1, attached to this ordinance. Section 2. The parking standards for the land uses designated "agriculturally related industries" of "packing processing plants" and of "storage facilities" and of "wholesale trade /warehouses" as shown on Table 6 -1, which is incorporated in Section 15.06.040(A) of the Yakima Municipal Code, are amended to read as shown on Exhibit 2, attached to this ordinance. Section 3. Severability: If any section, subsection, paragraph, sentence, clause or phrase of this ordinance is declared invalid or unconstitutional for any reason, such decision shall not affect the validity of the remaining portions of this ordinance or other provisions of the Urban Area Zoning Ordinance established by this ordinance. Section 4. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter. BUSINESS OF THE CITY COUNCIL YAKIMA, WASHINGTON AGENDA STATEMENT Item No. For Meeting Of April 3, 2001 ITEM TITLE: Consideration of an Ordinance Amending Chapter 15.06.040 by Expanding the Parking Exempt Area in the Downtown Central Business and Table 6 -1 to amend the off - street parking requirements for warehouse /storage facilities SUBMITTED BY: William Cook, Director of Community and Economic Development CONTACT PERSON /TELEPHONE: William Cook, (575 -6113) SUMMARY EXPLANATION: On October 3, 2000, the City Council met in a Study Session to discuss expanding the City's • parking exempt area in the downtown Central Business District. Currently the Zoning Ordinance exempts development from parking requirements within a fifty -four block area in the Yakima downtown area centered along Yakima Avenue. As a result of the Council's discussion, staff was directed to meet with downtown business and neighborhood associations to explain the five additions to the parking exempt area being considered, and to report back to Council. It was agreed that following receipt of this report, Council would conduct a public hearing on the proposed new parking exempt area. In addition, Council directed staff to review the parking requirements for agriculture warehousing and bring back a proposal to size such requirements to more accurately reflect the parking needs of these evolving facilities. On March 6, 2001, Council held a Public Hearing on the proposed enlargement of the downtown parking exemption area. Following the hearing, Council directed staff to prepare legislation to amend the existing boundary to include Area 1 on the Map.
