AN ORDINANCE concerning land use regulation and comprehensive planning, and:
1) amending the Yakima Municipal Code to establish a new chapter
15.30 YMC to provide an Airport Safety Overlay, instead of the
existing Airport Overlay District; 2) amending Table 5-2,
"Subdivision Requirements," incorporated in YMC 15.05.030(A);
3) amending Table 4-1, "Permitted Land Uses," incorporated in
YMC 15.04.030; 4) amending YMC 15.10.010; 5) amending YMC
14.25.040(B); and amending the Future Land Use Map of the
Yakima Urban Area Comprehensive Plan.
WHEREAS, pursuant to the provisions of the Urban Area Regional Planning
Agreement, the Regional Planning Commission and the Joint Board have reviewed and
issued their recommendations regarding the following proposed amendments to the
City's development regulations and the Yakima Urban Area Comprehensive Plan; and
WHEREAS, the Regional Planning Commission and the Joint Board recommended that
the City adopt Chapter 15.55 of the Yakima County Code by reference; and
WHEREAS, incorporation of Chapter 15.55 of the Yakima County Code by reference
would be problematic because that chapter depends on definitions provided in and
references to other part of the Yakima County Code, and because some terminology
from the Yakima County Code would be ambiguous in the context of the Yakima
Municipal Code; and
WHEREAS, although the Regional Planning Commission and the Joint Board have not
reviewed the text appearing as Section 4 of this ordinance, Section 4 satisfies the intent
of the Regional Planning Commission and the Joint Board by rendering the substance of
Chapter 15.55 of the Yakima County Code as a new chapter in the Yakima Municipal
Code; and
WHEREAS, the City Council finds that it is in the best interest of the City to enact the
following; now therefore
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA,
WASHINGTON:
1 Section 1. Section 15.03.020 of the Yakima Municipal Code is amended to read as
2 follows:
3 15.03.020 Establishment of zoning districts.
4 The following zoning districts are hereby established:
5 Residential Districts
6 -- Suburban Residential District (SR)
7 -- Single -Family Residential District (R-1)
8 -- Two -Family Residential District (R-2)

26 Section 2. Subsection 15.03.030(14) of the Yakima Municipal Code is amended to
27 read as follows:
28 14. Airport Safety Overlay District (ASOD). The Airport Safety Overlay is
29 intended to protect the airspace around state and federal system airports
30 from airspace obstructions or hazards and incompatible land uses in
31 proximity to the Yakima Air Terminal at McAllister Field. In addition to
32 the regulations of the principal use district, the Airport Safety Overlay
33 District includes provisions for:
34 a. Preserving land adjacent to the Yakima Airport Air Terminal at
35 McAllister Field for future commercial and industrial development; and
36 b. Assuring that land uses locating near the airport are compatible with
37 noise and other impacts from the airport operation
38 Section 3. Section 15.09.020 of the Yakima Municipal Code is amended to read as
39 follows:
40 15.09.020 Special development standards for the overlay districts.
41 A. Purpose. The overlay zoning districts are established to coordinate the
42 provisions established in the zoning ordinance with more detailed policies
43 and standards adopted in other plans and ordinances for the Yakima
44 River Greenway, airport, shorelines, and flood hazard areas. The Airport
45 Safety Overlay is established separately pursuant to Chapter 15.30 of this
46 title, and is expressly excepted from the provisions for overlay districts
47 established in other chapters of this title.

48 B. Application. The provisions of this chapter shall apply when all or a
49 portion of a development, or modification thereto, is proposed within the
50 boundaries of an overlay district.
51 C. Project Review in Overlay Districts. In order to assure the appropriate
52 standards are applied, all Class (1) uses in an overlay district unless
53 otherwise specified shall be subject to Class (2) review (Chapter 15.14). All
54 Class (2) uses shall be subject to Class (2) review and Class (3) uses in an
55 overlay district shall be subject to Class (3) review. A reviewing official
56 may condition or deny approval of any use, development, or modification
57 thereto, in an overlay district based on the provisions set forth and
58 adopted by this section.
59 D. Special Development Standards in the Greenway Overlay District. All
60 development in the Greenway overlay district shall conform to the
61 requirements and standards of the underlying zoning district and the
62 policies and intent of the Yakima River regional Greenway plan.
63 E.Special Development Standards in the Airport Overlay District. All
64 development in the airport overlay district shall conform to the
65 requirements and standards of the underlying zoning district and the
66 policies and intent of the airport master plan.
67 F.E. Special Development Standards in the Floodplain Overlay Districts.
68 All development in the floodplain overlay district shall conform to the
69 requirements and standards of the underlying zoning district, and the
70 flood damage prevention ordinance adopted by the county/city.
71 Development within shorelines jurisdiction or the floodplain shall also be
72 consistent with the county or city shorelines master program and/ or the
73 flood damage prevention ordinance.
74 G:F. Coordination with the Shorelines Master Program. If a proposed
75 Class (2) or (3) use, nonconforming use expansion, or other modification is
76 proposed on property within the jurisdictional boundaries of the Yakima
77 County shoreline master program and is subject to permits thereof, then
78 the proposed change shall not be subject to the procedural requirements
79 of this title, but shall be subject to all applicable standards of this title. If a
80 conflict exists between the standards of the shoreline master program and
81 this title, the more restrictive provisions shall apply.

96 15.30.010 Purpose.
97 The Airport Safety Overlay is intended to protect the airspace around the
98 Yakima Air Terminal at McAllister Field and any other state and federal
99 system airports from airspace obstructions or hazards and incompatible
100 land uses in proximity to the Yakima Air Terminal at McAllister Field or
101 other public airport with defined airspace per Federal Aviation
102 Regulations (FAR) Part 77.
103 15.30.020 Definitions. The following terms are established for the purpose
104 of protecting the airspace of the Yakima Air Terminal at McAllister Field
105 or any other state and federal system airport:
106. (A) Airspace Hazard: Any structure, tree, or use of land which
107 compromises public safety or obstructs the airspace required for the safe
108 operation of aircraft in or around an airport, as determined by the
109 Reviewing Official under this title.
110 (B) Airspace Obstruction: Any structure, tree, land mass, smoke or
111 steam or use of land which penetrates the primary, approach, transitional,
112 horizontal or conical surface of an airport as defined by Federal Aviation
113 Regulations (FAR), Part 77.
114 (C) Avigation Easement: An easement granted for the free and
115 unobstructed use and passage of aircraft over, across, and through the
116 airspace above, or in the vicinity of property.

117 (D) Civil Airport Imaginary Surfaces: The imaginary airspace(primary,
118 approach, transitional, horizontal and conical surfaces) designated by the
119 Federal Aviation Administration and as defined by FAR, Part 77.
120 (E) Established Airport Elevation: The highest point of an airport's
121 usable landing area, measured in feet above mean sea level.
122 (F) Hazard to Air Navigation: An official determination by the FAA
123 that an airspace obstruction constitutes a hazard to air navigation. The
124 FAA determination that an airspace obstruction does not constitute a
125 "hazard to air navigation" under federal regulations does not prevent the
126 Reviewing Official from determining that it is an airspace hazard or
127 potentially incompatible land use under this title.
128 (G) Potentially Incompatible Land Use: Land uses deemed potentially
129 incompatible within the airport safety overlay include:
130 (1) Those land uses located in the primary airport safety
131 overlay, being an area bounded by the limits of the approach
132 surface and the transitional surface within the conical surface area,
133 that are of such intensity as to potentially endanger public health,
134 safety or welfare. Such uses include manufactured or mobile home
135 parks, schools, places of public assembly, and multi -family
136 residential uses;
137 (2) Those land uses within the primary or secondary airport
138 safety overlay constituting airspace hazards, as determined by the
139 Reviewing Official.
140 (F) Runway Protection Zone(s): A trapezoidal area representing the
141 ground level at the innermost portion of the runway approach as defined
142 in the respective airport master plan.
143 15.30.030 Application of Airport Safety Overlay provisions.
144 (A) All zoning districts regulated under this title lying within the
145 airport safety overlay are subject to the requirements of this overlay,
146 except as may be otherwise stated herein.
147 (B) The Airport Safety Overlay (ASO) contains those areas defined by
148 Federal Aviation Regulations (FAR), Part 77 as imaginary surfaces and the
149 Runway Protection Zone(s) as illustrated on the Airport Layout Plan
150 (ALP) and zoning map, and comprised of two parts:

151 (1) The primary airport safety area addresses land use
152 compatibility with airport operations and structure height. It is
153 located in an area bounded by the limits of the Runway protection
154 zone and the FAA defined approach and transitional surfaces
155 within the conical surface area; and,
156 (2) The secondary airport safety overlay principally addresses
157 structure height, particularly where a structure may constitute an
158 incompatible land use under this title. It is bounded by the exterior
159 of the conical surface area and the approach and transitional
160 approach surfaces extending beyond the conical surface.
161 15.30.040 Class (1) uses.
162 (A) The uses listed as Class (1) uses within the underlying zoning
163 district shall be subject to the height restrictions listed in Sections 15.30.070
164 or YMC chapter 15.05, Table 5-1, whichever is the more restrictive. No
165 separate application for a Class (1) use in the airport overlay is required,
166 provided the Reviewing Official can conclusively determine that the
167 proposed structure or use:
168 (1) Does not constitute a potentially incompatible land use; and
169 (2) Will not exceed 35 feet in height; or, if greater than 35 feet in
170 height, will not penetrate the approach, transitional, horizontal, or
171 conical surface zones of the airport for any existing or planned
172 approaches as defined by FAR, Part 77; and
173 (3) Is not within a designated runway protection area or an
174 identified future 65 DNL aircraft noise impacted area within the
175 airport master plan or the FAA approved airport layout plan. Such
176 structures and uses shall in any case be subject to the limitation of
177 Section 15.30.070 and to the recording of an avigation easement.
178 (B) Class (1) uses shall be subject to Class (2) application and review
179 procedures pursuant to Section 15.30.060 where the use is a potentially
180 incompatible land use, or where the Reviewing Official cannot make a
181 conclusive determination as required in subsection (1).
182 15.30.050 Class (2) and Class (3) uses.
183 (A) The uses listed as Class (2) and Class (3) uses within the underlying
184 zoning district are subject to:

185 (1) The height restrictions listed in section 15.30.070 and YMC
186 ch. 15.05, Table 5-1, whichever are the more restrictive;
187 (2) The provisions of Chapter 15.04 and any other review
188 criteria for the use required by the underlying zoning district; and,
189 (3) A determination that the use can be appropriately
190 conditioned to mitigate noise impacts and other airport safety
191 concerns.
192 (B) Where an airspace hazard has been determined to exist by the
193 Reviewing Official, the FAA determination on obstructions and hazards to
194 air navigation shall be balanced with special consideration for unique
195 characteristics of local terrain, reporting points for pilots using VFR,
196 airport operations, and development patterns.
197 15.30.060 Application requirements.
198 (A) Applications for uses within the Airport Safety Overlay established
199 by this chapter shall include the following information:
200 (1) Property boundary lines as they relate to the boundaries of
201 the primary and secondary airport safety overlay.
202 (2) Location, elevation, and height of all existing and proposed
203 buildings, structures, utility lines, and trees taller than 35 feet in
204 height.
205 (3) A description of the proposed use.
206 (4) A statement of compatibility from the airport manager when
207 the use is to be located within the Airport Safety Overlay relative to
208 the impact of the use on airport operations and safety.
209 (B) In consideration of an application for a building, structure, or other
210 use which will exceed 35 feet in height, the Reviewing Official may
211 require the applicant to submit either of the following:
212 (1) A certificate from a registered professional engineer or a
213 licensed land surveyor, which clearly states that no airspace
214 obstruction will result from the proposed use, or
215 (2) Either or both of the following:
216 (a) The maximum elevations of proposed structures
217 based on the established airport elevation and USGS datum.

218 Elevations shall be determined by a registered professional
219 engineer or a licensed land surveyor, accurate to plus or
220 minus one foot shown as mean sea level elevation or other
221 available survey data. The accuracy of all elevations shall be
222 certified by the engineer or surveyor.
223 (b) A map of topographic contours with not more than
224 five foot intervals, showing all land within 100 feet of the
225 proposed structure(s) for which the permit is being sought.
226 This map shall also bear the verification of a licensed land
227 surveyor or registered professional engineer.
228 15.30.070 Height limitations and additional requirements.
229 (A) A building, structure, communication tower, use or tree that
230 penetrates any of the FAA designated imaginary surfaces constitutes an
231 obstruction within the ASO overlay. Therefore, the allowable height of
232 any building, structure, communication tower, use or tree within the
233 airport safety overlay shall conform to the following:
234 (1) The ground level elevation above mean sea level plus the
235 height of any building, structure, communication tower, use or tree
236 at its proposed location shall not penetrate any FAR, Part 77
237 designated imaginary surfaces of an airport.
238 (2) However, structures thirty-five (35) feet or more in height
239 may penetrate the imaginary surfaces when the Reviewing Official,
240 in consultation with Washington State Department of
241 Transportation (WSDOT) Aviation Division or the airport manager,
242 can determine that the structure is not likely to constitute an
243 airspace hazard.
244 (3) The Reviewing Official may require lights or markers as a
245 warning to aircraft on the building, structure, communication
246 tower, use or tree(s), or, to top the tree to reduce its height when
247 recommended by the FAA, WSDOT Aviation Division or the
248 airport manager. Lights and markers shall meet FAA
249 specifications.
250 (4) Notwithstanding any other provision of this title, the
251 Reviewing Official shall not approve any building, structure,
252 communication tower, use or tree when the FAA has designated it
253 a hazard to air navigation.

254 (B) Whenever the height limitations of this section differ from those of
255 any other section of this ordinance, or that adopted by another local
256 ordinance or regulation, the more restrictive limitation shall apply.
257 (C) No use or activity shall take place within the airport safety overlay
258 in such a manner as to: make it difficult for pilots to distinguish between
259 airport lights and others; create electrical interference with navigational
260 signals or radio communication between the airport and aircraft; result in
261 glare in the eyes of pilots using the airport; impair visibility in the vicinity
262 of the airport; create birds -strike hazards; or otherwise create a hazard
263 which may in any way endanger the landing, takeoff, or maneuvering of
264 aircraft intending to use the airport.
265 (D) The regulations prescribed by this chapter shall not be construed to
266 require a property owner to remove, lower, or make changes or
267 alterations to any structure which legally existed prior to the effective date
268 of this ordinance, except as may be compelled by state or federal
269 regulation. However, such structures shall be considered nonconforming
270 if such structure is in conflict with these regulations.
271 (E) An avigation easement and deed declaration, which recognizes the
272 preexistence of the airport and the right of over flight, shall be recorded
273 for all uses within the approach and transitional surfaces of the conical
274 surface area.
275 15.30.080 Special provisions for new airports, heliports and landing
276 fields.
277 All new airports, heliports, or landing fields shall be designed so that the
278 incidence of aircraft passing in the vicinity of preexisting dwellings or
279 places of public assembly is minimized. They shall be located so that air
280 traffic shall not generate more than 55DNL as measured at the property
281 line and shall not be located in close proximity to incompatible land uses
282 as defined in this title. The proponents shall show that adequate controls
283 or measures will be taken to reduce noise levels, vibrations, dust, or bright
284 lights, as required by federal, state, county, and city regulations.
285 Section 5. Table 5-2 "Subdivision Requirements" incorporated in YMC 15.05.030(A),
286 of the Yakima Municipal Code Urban Area Zoning Ordinance is amended to read as
287 shown in Attachment A:
288 Section 6. Table 4-1, "Permitted Land Uses" incorporated in YMC 15.04.030 of Urban
289 Area Zoning Ordinance is amended to read as shown in Attachment B:
290 Section 7. Section 15.10.010 of the Yakima Municipal Code is amended to read as
291 follows:.

292 Purpose
293 The purpose of this chapter is to specify and outline the authority of reviewing
294 officials to impose special conditions of approval on any permit or approval
295 issued under the provisions of this title and to establish the authority of certain
296 reviewing officials to administratively adjust some of the development standards
297 set forth in section 15.04.115 and Chapters 15.05 through 15.08 of this title.
298 Section 8. Subsection 14.25.040(B) of the Yakima Municipal Code is amended to read
299 as follows:.
300 B. One lot may front on a private street or be allowed to access a
301 public street by an easement. Otherwise, every lot shall have direct access
302 to and frontage upon a dedicated public street except lots in approved
303 planned developments pursuant to Chapter 14.35 Yakima Municipal
304 Code. Minimum street frontage shall be twenty feet. Lots intended for
305 residential use should not front upon a major or secondary arterial.
306 Section 9. The document labeled "Map III -3, Future Land Use, February 6, 2001"
307 attached to this ordinance is adopted as the Future Land Use Map of the Yakima Urban
308 Area Comprehensive Plan, and any previous Future Land Use Maps are removed from
309 the plan.
Section 10. Severability: If any section, subsection, paragraph, sentence, clause or
phrase of this ordinance, or any provision of the Yakima Urban Area Comprehensive
Plan established by this ordinance, is declared invalid or unconstitutional for any
reason, such decision shall not affect the validity of the remaining portions of this
ordinance, or other provisions of the Yakima Urban Area Comprehensive Plan
established by this ordinance.
Section 11. This ordinance shall be in full force and effect 30 days after its passage,
approval, and publication as provided by law and by the City Charter.
