AN ORDINANCE relating to building codes and related regulation, and amending
certain provisions of the State Building Code to establish the
City of Yakima Building Code.
WHEREAS, chapter 19.27 RCW establishes the State Building Code Council and
mandates that the State Building Code Council adopt and maintain certain codes
including a building code, which, pursuant to chapter 19.27 RCW, are known as the
State Building Codes; and
WHEREAS, pursuant to chapter 19.27 RCW and WAC 51 -40 -003, the State
Building Code Council has, with the certain additions, deletions, and exceptions,
adopted by reference, as part of the State Building Codes, the 1997 edition of the
Uniform Building Code as published by the International Conference of Building
Officials; and
WHEREAS, pursuant to RCW 19.27.031, subject to certain additions, deletions
and exceptions provided in chapter 51 -40 WAC, the 1997 Edition of the Uniform
Building Code, as published by the International Conference of Building Officials, is in
effect in the City of Yakima and supercedes provisions of the Yakima Municipal Code
amending earlier editions of the Uniform Building Code; and
WHEREAS, pursuant to RCW 19.27.040, the City of Yakima is authorized to
amend certain provisions of the State Building Code so long as the minimum
performance standards of the State Building Code and the objectives of RCW 19.27.020
are not diminished; and
WHEREAS, it is in the best interest of the City of Yakima to enact the following
amendments to certain sections of the State Building Code as adopted and maintained
by the State Building Code Council, now therefore:

1 Section 1. Sections 11.04.010, 11.04.015, 11.04.020, 11.04.025, 11.04.027, 11.04.028,
2 11.04.030, 11.04.040, 11.04.050, 11.04.055, 11.04.060, 11.04.065, 11.04.070, 11.04.080,
3 11.04.090, of the Yakima Municipal Code are repealed.
4 Section 2. NEW SECTION. A new section is added to the Yakima Municipal Code
5 to read as follows:
6 11.04.010 City of Yakima Building Code.
7 Pursuant to chapter 19.27 RCW, the 1997 Edition of the Uniform Building Code,
8 Volumes One, Two and Three, together with all appendices thereto except
9 Appendices Chapter Three, Division III and IV, Chapters Nine, Ten, Eleven,
10 Thirteen, Twenty -one, Twenty- three, and Thirty -one, and the Uniform Building
11 Code Standards, all as published by the International Conference of Building
12 Officials, and as adopted and maintained by the State Building Code Council in
13 chapter 51 -40 WAC (hereinafter "State Building Code "), and as further modified
14 by the amendments, additions, deletions, and exceptions provided in this
15 chapter, shall be the Building Code of the City of Yakima. The texts that
16 comprise the State Building Code including the Uniform Building Code and
17 Appendices, Uniform Building Code Standards, and chapter 51 -40 WAC, are
18 incorporated in this chapter by reference and the several sections or numbers of
19 those texts shall constitute, and may be referred to as, the numbers of this
20 chapter. One or more copies of the texts that comprise the Building Code of the
21 City of Yakima shall be maintained on file in the office of the Code
22 Administration Manager of the City of Yakima.

23 Section 3. NEW SECTION. A new section amending, by addition of the underlined
24 language and deletion of the strikethrough language, Section 104.1 of the Uniform
25 Building Code as adopted and maintained by the State Building Code Council is added
26 to chapter 11.04 of the Yakima Municipal Code to read as follows:
27 11.04.104.1 Amendment to Section 104.1 UBC. Section 104.1 of the
28 Uniform Building Code as adopted and maintained by the State Building
29 Code Council is amended to read as follows:
30 104.1 Creation of Enforcement Agency and Identification of Building
31 Official. ThereThe Division of Code Administration in the Department of
32 Community and Economic Development is hereby established in this
33 *is-dist-ion a as the code enforcement agency of the City of Yakima. The
34 Division. of Code Administration which shall be under the administrative
35 and operational control of the Code Administration Manager designated
36 by the appointing authorityBuilding Official. Wherever the term .
37 "Building Official" is used in this code, it shall be construed to mean the
38 Code Administration Manager or the Director of Community and
39 Economic Development Department.
40 Section 4. NEW SECTION. A new section amending, by addition of the underlined
41 language and deletion of the strikethrough language, Section 104.2.8 of the Uniform
42 Building Code as adopted and maintained by the State Building Code Council is added
43 to chapter 11.04 of the Yakima Municipal Code to read as follows:
44 11.04.104.2.8 Amendment to Section 104.2.8 UBC. Section 104.2.8 of the
45 Uniform Building Code as adopted and maintained by the State Building
46 Code Council is amended to read as follows:
47 104.2.8 Alternate materials, alternate design and methods of
48 construction. The provisions of this code are not intended to prevent the
49 use of any material, alternate design or method of construction not
50 specifically prescribed by this code, provided any alternate has been
51 approved and its use authorized by the Building Official.

52 The building official may approve any such alternate, provided the
53 building official finds that the proposed design is satisfactory and
54 complies with the provisions of this code and that the material, method or
55 work offered is, for the purpose intended, at least the equivalent of that
56 prescribed in this code in suitability, strength, effectiveness, fire resistance,
57 durability, safety and sanitation.
58 The building official shall require that sufficient evidence or proof be
59 submitted to substantiate any claims that may be made regarding its use.
60 The details of any action granting approval of an alternate shall be
61 recorded and entered in the files of the code enforcement agency.
62 The International Building Code (IBC) shall be recognized as equal to or
63 greater than the equivalent of that prescribed in this code in health, life,
64 suitability, strength, quality, effectiveness, fire resistance, fire safety
65 requirements, durability, safety and sanitation.
66 Section 5. NEW SECTION. A new section amending, by addition of the underlined
67 language and deletion of the strikethrough language, Section 105.1 of the Uniform
68 Building Code as adopted and maintained by the State Building Code Council is added
69 to chapter 11.04 of the Yakima Municipal Code to read as follows:
70 11.04.105.1 Amendment to Section 105.1 UBC. Section 105.1 of the Uniform
71 Building Code as adopted and maintained by the State Building Code Council is
72 amended to read as follows:
73 105.1 General. In order to hear and decide appeals of orders, decisions or
74 determinations made by the building official relative to the application
75 and interpretation of this code, there shall be and is hereby created a
76 board of appeals consisting of seven members who are qualified by
77 experience and training to pass on matters pertaining to building
78 construction and who are not employees of the jurisdiction, and who shall
79 be appointed from the following areas: one architect; one engineer; one
80 building and construction contractor; one developer; one representative

81 from the general public; one Washington state journeyman plumber; and
82 one Washington state journeyman mechanical contractor. The building
83 official and /or the Fire Chief or a designee shall be an ex officio member
84 of and shall act as secretary to said board but shall have no vote on any
• 85 matter before the board. The board of appeals shall be appointed by the
86 - . - : Yakima. City Council and shall hold office at its
87 pl asurefor a term of three years. The board shall adopt rules of
88 procedure for conducting its business, and shall render all decisions and
89 findings in writing to the appellant with a duplicate copy to the Building
90 Official.
91 Section 6. NEW SECTION. A new section amending, by addition of the underlined
92 language and deletion of the strikethrough language, Section 105.2 of the Uniform
93 Building Code as adopted and maintained by the State Building Code Council is added
94 to chapter 11.04 of the Yakima Municipal Code to read as follows:
95 11.04.105.2 Amendment to Section 105.2 UBC. Section 105.2 of the Uniform
96 Building Code as adopted and maintained by the State Building Code Council is
97 amended to read as follows: •
98 105.2 Limitations of Authority. The board of appeals shall have no
99 authority relative to interpretation of the administrative provisions of this
100 code nor shall the board be empowered to waive requirements of this
101 code. The board of appeals shall hear and decide appeals of orders,
102 decisions, or determinations made by the building official relative to the
• 103 application and interpretation of this code.

104 Section 7. NEW SECTION. A new section amending, by addition of the underlined
105 language and deletion of the strikethrough language, Section 109.6 of the Uniform
106 Building Code as adopted and maintained by the State Building Code Council is added

111 109.6 Revocation. The building official may, in writing, suspend or revoke
112 a certificate of occupancy issued under the provisions of this code, after a
113 thorough investigation of the evidence, whenever the certificate is issued
114 in crrormistakenly, or on the basis of incorrect information supplied, or
115 when it is determined that the building or structure or portion thereof is
116 in violation of any ordinance or regulation or any of the provisions of this
117 code.
118 Section 8. NEW SECTION. A new section amending, by addition of the underlined
119 language and deletion of the strikethrough language, Section 109.7 of the Uniform
120 Building Code as adopted and maintained by the State Building Code Council is added •
121 to chapter 11.04 of the Yakima Municipal Code to read as follows:
122 11.04.109.7 Amendment to Section 109.7 UBC. Section 109.7 of the Uniform
123 Building Code as adopted and maintained by the State Building Code Council is
124 amended to read as follows:
125 109.7 Public Nuisance. It is a public nuisance to use or occupy a building
126 or structure, or any part thereof, of the groups enumerated in s=sen
127 Section 109 (a) herein without there having been issued a valid Certificate
128 of Occupancy for such building, structure or part thereof. Such public
129 nuisance shall be subject to prevention or abatement by injunction or other
130 appropriate legal remedy in the Superior Court of Washington in Yakima
131 County.

132 Section 9. NEW SECTION. A new section amending, by addition of the underlined

136 11.04.904.2.1 Amendment to Section 904.2.1 UBC. Section 904.2.1 of the Uniform
137 Building Code as adopted and maintained by the State Building Code Council is
138 amended to read as follows:
139 904.2.1 Automatic Fire - extinguishing Systems. Where required. An
140 automatic fire - extinguishing system shall be installed in the occupancies
141 and locations as set forth in this section.
142 For provisions on special hazards and hazardous materials, see the Fire
143 Code.
144 EXCEPTION: Automatic sprinkler systems shall not be required for
145 controlled atmosphere storage rooms in which refrigeration apparatus is
146 installed to control. the temperature in the storage rooms and gas -tight
147 seals are incorporated in the construction of the rooms. In addition, gas
148 tight seals must be used to facilitate the maintenance of an atmosphere
149 within the storage rooms that is lower in oxygen content and higher in
150 nitrogen and carbon dioxide content than normal atmosphere.

171 building permit fees listed in UBC 1997 Table 1 -A is applicable: (1) Each single- family
172 residence: ten dollars ($10), (2) each multifamily residential building: ten dollars ($10) for
173 each ground floor unit.

181 1607.4.4 Special roof loads. Roofs to be used for special purposes shall be
182 designed for appropriate loads as approved by the Building Official.
183 Greenhouse roof bars, purlins and rafters shall be designed to carry a one
184 hundred (100)- pound- minimum (444.8 N) concentrated load, L r , in
185 addition to the uniform live load. Residential greenhouses, residential
186 patio structures, and agricultural buildings shall be designed for a vertical
187 live load of not less than fifteen (15) pounds per square foot.

195 SECTION 1614 - SNOW LOADS
196 Buildings and other structures and all portions thereof that are subject to
197 snow loading shall be designed to resist the snow loads, as determined by
198 the building official for the City of Yakima, which is thirty (30) pounds per
199 square foot, in accordance with the load combinations set forth in Section
200 1612.2 or 1612.3.
201 Potential unbalanced accumulation of snow at valleys, parapets, roof
202 structures and offsets in roofs of uneven configuration shall be considered.

229 11.04.1806.1 Amendment to Section 1806.1 UBC. Section 1806.1 of the Uniform

232 1806.1 General. Footings and foundations shall be constructed of
233 masonry, concrete or treated wood in conformance with Division II and
234 shall extend below the frost line, which is established as twenty - four (24)
235 inches (610 mm) below finished grade. Footings of concrete and masonry
236 shall be of solid material. Foundations supporting wood shall extend at
237 least 6 inches (152 mm) above the adjacent finish grade. Footings shall
238 have a minimum depth as indicated in Table 18 -I -C, unless another depth
239 is recommended by a foundation investigation.
240 The provisions of this section do not apply to building and foundation
241 systems in those areas subject to scour and water pressure by wind and
242 wave action. Buildings and foundations subject to such loads shall be
243 designed in accordance with approved national standards. See Section
244 3302 for subsoil preparation and wood form removal.
245 Definitions:
246 Section 1806.1.1 Undisturbed soil — Soil or soil profile, unaltered by
247 removal or other man - induced changes, except for agricultural activities,
248 that would adversely affect the in -situ or operation of on -lot systems. This
249 soil material and the in -situ soil mass have not been disturbed.
250 Section 1806.1.2 Soil — Any uncemented or weakly cemented •
251 j accumulation of material particles formed by the weathering of rocks, the
252 void space between particles containing water and /or air.
253 Section 1806.1.3 In -situ— Soil in the natural or original position.
254 Section 1806.1.4 Soil Compaction — The process of increasing the density
255 of a soil by packing the particles closer together with a reduction in the

256 volume of air. The higher the degree of compaction the higher will be the
257 shear strength and lower will be the compressibility of the soil.
258 Section 15. NEW SECTION. A new section amending, by addition of the underlined

262 11.04.3303.9 Amendment to Section 3303.9 UBC. Section 3303.9 of the Uniform
263 Building Code as adopted and maintained by the State Building Code Council is
264 amended to read as follows:
265 3303.9 Demolition. The work of demolishing any building shall not
266 commence until the required pedestrian protection structures are in place.
267 The building official may require the applicantpermit-tee to submit plans
268 and a complete schedule for demolition. Where such are required, no
269 work shall be done until such plans or schedule, or both, are approved by
270 the Building Official.
271 A site assessment checklist shall be completed and returned to the
272 building inspector upon the final inspection.
273 The demolition site shall be cleaned of material, including without
274 limitation petroleum tanks, septic tanks, septic drain fields, utilities pipes,
275 wires and conduit, unless in the right- of -wav or easement, from the
276 subterranean surface. Basement walls, footings, foundations may be
277 required to be broken into pieces less than twenty -tour (24) inches (610
278 mm) in size. Any excavation shall be filled with clean fill material, covered
279 with vegetation to prevent erosion as approved by the building official
280 within 90 days after completion unless extended by the building official
281 for reasonable cause. The site shall be graded to prevent runoff from the
282 site to other adjacent property.
283 Section 16. NEW SECTION. A new section amending, by addition of the underlined

287 11.04.3304 Amendment to Section 3304 UBC. Section 3304 of the Uniform

290 SECTION 3304 - PURPOSE
291 The purpose of this appendix is to safeguard life, limb, property and the
292 public welfare by regulating grading on private property., to enable the
293 most suitable type of foundation for a proposed structure to be selected
294 and to indicate if special problems are likely to arise during excavation.
295 Section 17. NEW SECTION. A new section amending, by addition of the underlined
296 language and deletion of the strikethrough language, Sections 3306.2 of the Uniform
297 Building Code as adopted and maintained by the State Building Code Council is added
298 to chapter 11.04 of the Yakima Municipal Code to read as follows:
299 11.04.3306.2 Amendment to Section 3306.2 UBC. Section 3306 of the Uniform
300 Building Code as adopted and maintained by the State Building Code Council is
301 amended to read as follows:
302 3306.2 Exempted Work. A grading permit is not required for the
303 following:
304 1. When approved by the Building Official, grading in an isolated,
305 self- contained area if there is no danger to private or public property.
306 2. An excavation below finished grade for basements and footings of
307 a building, retaining wall or other structure authorized by a valid building .
308 permit. This shall not exempt any fill made with the material from such
309 excavation or exempt any excavation having an unsupported height
310 greater than 5 feet (1524 mm) after the completion of such structure.
311 3. Cemetery graves.
312 4. Refuse disposal sites controlled by other regulations.
313 5. Excavations for wells or tunnels or utilities.

314 6. Mining, quarrying, excavating, processing or stockpiling of rock,
315 sand, gravel, aggregate or clay where established and provided for by
316 law, provided such operations do not affect the lateral support or increase
317 the stresses in or pressure upon any adjacent or contiguous property.
318 7. Exploratory excavations under the direction of soil engineers or
319 engineering geologists.
320 8. An excavation that (1) is less than 2-3 feet (64t -915 mm) in depth or
321 (2) does not create a cut slope greater than 5-6 feet (1524 1829 mm) in
322 height and steeper than 1 unit vertical in 1 units horizontal (66.7%
323 slope).
324 9. A fill less than 1 foot2 feet (305610 mm) in depth and placed on

SUMMARY EXPLANATION:
By this ordinance, the City of Yakima would adopt the State Uniform Building Code WAC
51-40 by reference as provided by statutory authority by RCW 19.27.031 and 19.27.074.
Presently before the City Council is the local amendments to the Uniform Building Code.
The amendments to the Uniform Fire, Plumbing, Mechanical, Electrical, Housing,
Abatement of Dangerous Buildings, and Building Conservation Codes will be forthcoming
at a future City Council meeting.
During the last 10 months, the Council's Community and Economic Development
Committee, a group of professionals from the community and staff, have been meeting to
update the local amendments to several of the construction codes used in the City of
Yakima.
There was a Council Study Session held on February 13, 2001, with Council provided
direction to make some modifications to some of the local amendments.
Through this process, it was the intent of all parties involved to only have local
amendments that were needed because of climatic weather conditions or conditions
unique to the local area. Several of the local amendments for the 1991 Uniform Building
Code have been eliminated because they were redundant, unnecessary or already
addressed within the State 1997 Uniform Building Code.
