HomeMy WebLinkAbout2001-022 Expansion of Central Business District parking exemption area (CBD) } ORDINANCE NO. 2001- 22 AN ORDINANCE concerning land use and zoning regulation and requirements for off street parking, amending the parking exempt area in the downtown Central Business District as depicted on Figure 6 -1 of Yakima Municipal Code § 15.060.040, amending Yakima Municipal Code § 15.060.040, and amending the requirements for off street parking applicable to commercial agricultural packing processing plants and storage facilities, and to wholesale trade /warehouses as depicted on Table 6 -1 of Yakima Municipal Code § 15.060.040. WHEREAS, the City Council has reviewed the following proposed amendments to existing requirements for off street parking and finds that it is in the best interest of the City to enact the following amendments to the off street parking requirements of Title 15 of the Yakima Municipal Code; now therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA, WASHINGTON: Section 1. Figure 6 -1, which is incorporated in Section 15.06.040(C) of the Yakima Municipal Code, and which depicts the Downtown Business District of Yakima that is exempt from the provisions of chapter 15.06 YMC as they relate to the number of parking spaces required, shall appear substantially equivalent to the area depicted on Exhibit 1, attached to this ordinance. Section 2. Section 15.06.040(C) of the Yakima Municipal Code is amended to read as follows: C. Downtown Business District Exempt. The Downtown Business District of Yakima, as shown in Figure 6 -1 and hereby adopted as a part of this chapter, shall be exempt from the provisions of this chapter as they relate to the number of parking spaces required; except that this exemption shall not apply to property that is zoned for residential use, and further provided that all the other requirements of this chapter shall apply to any parking provided by the applicant. Section 3. The parking standards for the land uses designated "agriculturally related industries" of "packing processing plants" and of "storage facilities" and of "wholesale trade /warehouses" as shown on Table 6 -1, which is incorporated in Section 15.06.040(A) of the Yakima Municipal Code, are amended to read as shown on Exhibit 2, attached to this ordinance. Section 4. Severability: If any section, subsection, paragraph, sentence, clause or phrase of this ordinance is declared invalid or unconstitutional' for any reason, such Page 1 r decision shall not affect the validity of the remaining portions of this ordinance or other provisions of the Urban Area Zoning Ordinance established by this ordinance. Section 5. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter. (See attached Ordinance) At the April 3 meeting, following your adoption of the boundary expansion Bev Luby Bartz addressed the Council to propose a change in the amendment. Council asked that Ms. Bartz's proposal be brought back to Council on April 17, 2001, in the form of a reconsideration of the April 3, 2001 Council action. At the April 17 Council meeting, Council approved staff's recommendation to remove residentially zoned property from the downtown parking exempt area. Please note: The amended boundary line for the parking exempt area will not change (see attached map). The attached resolution will amend the parking exempt area requirements accordingly.
