AN ORDINANCE relating to building construction codes and related regulations,
and repealing all existing sections of chapter 11.32 of the
Yakima Municipal Code and enacting, to comprise chapter
11.32 of the Yakima Municipal Code, new sections amending
certain provisions of the Uniform Mechanical Code as adopted
and maintained by the State Building Code Council to establish
the City Mechanical Code.
WHEREAS, chapter 19.27 RCW establishes the State Building Codes, including
the Uniform Mechanical Code including Chapter 13, Fuel Gas Piping, Appendix B,
published by the International Conference of Building Officials, and further establishes
and mandates the State Building Code Council to adopt and maintain certain State
Building Codes; and
WHEREAS, pursuant to RCW 19.27.074 and WAC 51 -42 -003, the State Building
Code Council has, with certain additions, deletions, and exceptions, adopted by
reference the 1997 edition of the Uniform Mechanical Code, including Chapter 13, Fuel
Gas Piping, Appendix B, published by the International Conference of Building
Officials, as the State Mechanical Code; and
WHEREAS, pursuant to RCW 19.27.031 and WAC 51 -42 -008, the Uniform
Mechanical Code as adopted and maintained by the State Building Code Council by
chapter 51 -42 WAC (also referred to herein as the State Mechanical Code) became
effective in the City of Yakima on July 1, 1998; and
WHEREAS, the City of Yakima is authorized by RCW 19.27.040 to amend certain
provisions of the State Building Codes, so long as such local amendments do not
diminish the minimum performance standards and objectives contained in the State
Building Codes or the objectives of RCW 19.27.020; and
WHEREAS, the existing provisions of chapter 11.32 of the Yakima Municipal
Code generally refer to and amend provisions of outdated editions of the Uniform
Mechanical Code; and

WHEREAS, it is in the best interest of the City of Yakima to establish the City
Mechanical Code by enacting the following local amendments to certain sections of the
State Mechanical Code, now therefore:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA,
WASHINGTON:
1 Section 1. Sections 11.32.010, 11.32.015, 11.32.040, 11.32.050, 11.32.060, 11.32.070,
2 11.32.075, 11.32.077, 11.32.080, 11.32.090, 11.32.100, 11.32.120, 11.32.130, 11.32.140,
3 11.32.150, 11.32.170, 11.32.190 of the Yakima Municipal Code are repealed.
4 Section 2. NEW SECTION. A new section is added to the Yakima Municipal Code
5 to read as follows:
6 11.32.010 City Mechanical Code.
7 Pursuant to chapter 19.27 RCW, the 1997 edition of the Uniform Mechanical
8 Code ( "UMC "), including Chapter 13, Fuel Gas Piping, Appendix B, published by
9 the International Conference of Building Officials, as adopted and maintained by
10 the State Building Code Council in chapter 51 -42 WAC (hereinafter "State
11 Mechanical Code "), and as further modified by the amendments, additions,
12 deletions, and exceptions provided in this chapter, shall be the City Mechanical
13 Code. The texts that comprise the State Mechanical Code including the Uniform
14 Mechanical Code, including Chapter 13, Fuel Gas Piping, Appendix B, published
15 by the International Conference of Building Officials and chapter 51 -42 WAC, are
16 incorporated in this chapter by reference and the several sections or numbers of
17 those texts shall constitute, and may be referred to as, the numbers of this
18 chapter. One or more copies of the texts that comprise the City Mechanical Code
19 shall be maintained on file in the office of the building official.

20 Section 3. NEW SECTION. A new section is added to chapter 11.32 of the Yakima
21 Municipal Code to read as follows:
22 11.32.020 Heating and/or Comfort - Cooling Journeyman Certificate —
23 Requirements
24 11.32.020.1 Journeyman Certification. It is unlawful for any person to
25 install or service any heating or comfort- cooling appliance without first
26 having obtained and being the authorized holder of a valid and subsisting
27 City of Yakima Heating and /or Comfort- Cooling Journeyman Certificate,
28 issued pursuant to this section, authorizing the holder to service and
29 install the appliance.
30 11.32.020.2 Journeyman Certification Fee. The fee for each City of
31 Yakima Heating and / or Comfort- Cooling Journeyman Certificate shall be
32 eleven dollars ($11), and eleven dollars ($11) for renewal, per year for each
33 person payable to the City of Yakima Code Administration Division.
34 11.32.020.3 Journeyman Certificate Examinations. No City of Yakima
35 Heating and/ or Comfort- Cooling Journeyman Certificate shall be issued
36 until the applicant has passed an examination administered by the
37 building official, paid all certification and examination fees authorized by
38 this chapter and completed a mechanical journeyman certificate
39 application form. The examination authorized by this section shall test the
40 applicant's knowledge of that portion of the City Mechanical Code
41 applicable to the types of heating and comfort- cooling appliances the
42 applicant intends to install or service.
43 11.32.020.4 Journeyman Certificate Application. Prior to taking such
44 examination, the applicant shall complete an application form provided
45 by the building official. The application shall contain the following
46 information: applicant's name, home address, business address, place and
47 date of birth, whether the applicant has served an apprenticeship in the

48 heating and comfort- cooling appliance installation trade, and if so, which
49 trade, whether the applicant has achieved journeyman status in such
50 trade, and what types of heating and / or comfort- cooling appliances the
51 applicant seeks to be certified to install and/ or service and what related
52 work the applicant seeks to be certified to perform. The building official
53 shall issue a City of Yakima Heating and / or Comfort- Cooling
54 Journeyman Certificate to applicants who pass the examination. The City
55 of Yakima Heating and / or Comfort- Cooling Journeyman Certificate shall
56 specifically state what heating and / or comfort- cooling appliances the
57 Journeyman is certified to install and / or service and what related work
58 the Journeyman is certified to perform.
59 11.32.020.5 Journeyman Certificate Examination Fee. The fee for
60 Heating and / or Comfort- Cooling Journeyman Certificate examination
61 shall be five dollars ($5) payable in advance to the City of Yakima Code
62 Administration Division.
63 11.32.020.6 Appeal of Examination Results. Any applicant who does
64 not pass the Heating and / or Comfort- Cooling Journeyman Certificate
65 examination may appeal to the board of appeals for a review of any
66 irregularity in the administration or scoring of the examination by the
67 building official by filing a written notice of appeal with the building
68 official within ten (10) calendar days of receipt by the applicant of the
69 result of the examination. The notice of appeal shall specify the
70 irregularity on which the appeal is based. The building official shall
71 promptly notify the board of the filing of the appeal.
72 On receipt of an appeal, the board shall promptly give written notice to
73 the building official and the applicant/ appellant of the time, date and
74 place of hearing on such appeal, not less than seven (7) calendar days
75 prior to the date of the hearing. The board shall then hear the appeal and

76 determine whether the examination results at issue should be upheld or
77 modified.
78 11.32.020.7 Suspension or Revocation of Journeyman Certificate;
79 Appeal. The building official may, in writing, suspend or revoke a
80 certificate issued under the provisions of this section whenever the
81 certificate is issued in error, or on the basis of incorrect information
82 supplied in application for the certificate, or the certificate holder either
83 installs or services any heating or comfort- cooling appliance for which
84 he /she is not certified, or otherwise fails to comply with any provision of
85 the City Mechanical Code. The holder of any certificate suspended or
86 revoked by the building official shall have the right of appeal to the board
87 of appeals from such action by filing a notice of appeal with the board of
88 appeals within ten days after receiving notice of the building official's
89 action. At the hearing, the holder of the certificate shall be entitled to be
90 heard in person, to produce witnesses and to be represented by counsel.
91 The action of the board of appeals on the question shall be final and
92 conclusive.
93 Section 4. NEW SECTION. A new section amending, by addition of the underlined
94 language and deletion of the strikethrough language, Section 101 of the Uniform
95 Mechanical Code as adopted and maintained by the State Building Code Council is
96 added to chapter 11.32 of the Yakima Municipal Code to read as follows:
97 11.32.101 Amendment to Section 101 UMC. Section 101 of the Uniform
98 Mechanical Code as adopted and maintained by the State Building Code Council
99 is amended to read as follows:
100 These regulations shall be known as the UniforinCity Mechanical Code,
101 may be cited as such, and will be referred to herein as "this code."

102 Section 5. NEW SECTION. A new subsection is added to Section 105 of the Uniform
103 Mechanical Code as adopted and maintained by the State Building Code Council and is
104 added to chapter 11.32 of the Yakima Municipal Code to read as follows:
105 11.32.105.4 Subsection 105.4 is added to Section 105 of the Uniform Mechanical
106 Code as adopted and maintained by the State Building Code Council to read as
107 follows:
108 11.32.105.4 The requirements of the International Mechanical Code
109 (IMC) or the International Fuel Gas Code (IFGC) shall be generally
110 recognized as at least equivalent to the requirements of this code in
111 suitability, strength, effectiveness, fire resistance, durability and safety,
112 and a proposed alternate design that meets the requirements of the IMC
113 or the IFGC shall be approved if the building official finds the proposed
114 design is satisfactory for the intended use and otherwise complies with
115 the provisions of this code.
116 Section 6. NEW SECTION. A new section amending, by addition of the underlined
117 language and deletion of the strikethrough language, Section 110 of the Uniform
118 Mechanical Code as adopted and maintained by the State Building Code Council is
119 added to chapter 11.32 of the Yakima Municipal Code to read as follows:
120 11.32.110 Amendment to Section 110 UMC. Section 110 of the Uniform
121 Mechanical Code as adopted and maintained by the State Building Code Council
122 is amended to read as follows:
123 SECTION 110 — BOARD OF APPEALS
124 110.1 General. In order to hear and decide appeals of orders, decisions or
125 determinations made by the building official relative to the application
126 and interpretations of this code, there shall be and is hereby created a
127 board of appeals consisting of members who are qualified by experience
128 and training to pass upon matters pertaining to mechanical design,
129 construction and maintenance and the public health aspects of mechanical

130 systems and who are not employees of the jurisdiction. There shall be
131 seven members of the board consisting of the following areas: One (1)
132 Architect, One (1) Engineer, One (1) Contractor, One (1) Developer, One
133 (1) Representative from the Public, One (1) Washington State Journeyman
134 Plumber and One (1) Washington State Journeyman Mechanical
' 135 Contractor. The building official, and /or the Fire Chief or his /her
136 designee, shall be an-ex officio members and shall act as secretary to said
137 board but shall have no vote upon any matter before the board. The
138 board of appeals shall be appointed by the governing bod City Council
139 and shall hold office for a term of three (3) yearsat its pleasure. The board
140 shall adopt rules of procedure for conducting its business and shall render
141 all decisions and findings in writing to the appellant with a duplicate copy
142 to the building official.
143 110.2 Limitations of Authority. The board of appeals shall have no
144 authority relative to interpretation of the administrative provisions of this
145 code nor shall the board be empowered to waive requirements of this
146 code.
147 Section 7. NEW SECTION. A new subsection is added to Section 112 of the Uniform
148 Mechanical Code as adopted and maintained by the State Building Code Council and is
149 added to chapter 11.32 of the Yakima Municipal Code to read as follows:
150 11.32.112.4 Subsection 112.4 is added to Section 112 of the Uniform Mechanical
151 Code as adopted and maintained by the State Building Code Council to read as
152 follows:
153 112.4 To Whom Permits May Be Issued
154 112.4.1 A permit may be issued to a person, firm or corporation properly
155 certified under section 11.32.020 YMC who is also complying with
156 applicable contractor registration laws.

157 112.4.2 No permit shall be issued to any person to do or cause to be done
158 any work regulated by this code except to a person holding a valid
159 unexpired and unrevoked City of Yakima Heating and/or Comfort -
160 Cooling Journeyman Certificate as required by Section 11.32.020 of this
161 chapter.
162 EXCEPTION: A permit for mechanical work regulated by this
163 code may be issued to the owner of a single - family residence, if the
164 following conditions are all satisfied:
165 1. The residence, including buildings or other structures
166 customarily recognized as accessory to such residence, is
167 used exclusively for residential purposes;
168 2. The residence is the residence of the owner;
169 3. The owner shall personally purchase all materials;
170 4. The owner shall personally perform all labor in connection
171 therewith.
172 Section 8. NEW SECTION. A new section amending, by addition of the underlined
173 language and deletion of the strikethrough language, Section 114.1 of the Uniform
174 Mechanical Code as adopted and maintained by the State Building Code Council is
175 added to chapter 11.32 of the Yakima Municipal Code to read as follows:
176 11.32.114.5 Amendment to Section 114.5 UMC. Section 114.5 of the Uniform
177 Mechanical Code as adopted and maintained by the State Building Code Council
178 is amended to read as follows:
179 114.1 Issuance. The application, plans, specifications, computations and
180 other data filed by an applicant for permit shall be reviewed by the
181 building official. Such plans may be reviewed by other departments of
182 this jurisdiction to verify compliance with applicable laws under their
183 jurisdiction. If the building official finds that the work described in an

184 application for a permit and the plans, specifications and other data filed
185 therewith conform to the requirements of the code and other pertinent
186 laws and ordinances and that the fees specified in Section 394115 have
187 been paid, the building official shall issue a permit therefor to the
188 applicant.
189 Section 9. NEW SECTION. A new section amending, by addition of the underlined
190 language and deletion of the strikethrough language, Table 1 -A — MECHANICAL
191 PERMIT FEES of the Uniform Mechanical Code as adopted and maintained by the State
192 Building Code Council is added to chapter 11.32 of the Yakima Municipal Code to read
193 as follows:
194 11.32.115.2.Table 1 - A Amendment to Table 1 - A UMC. Table 1 - of the State

When Chapter 13 is applicable, permit fees for fuel -gas piping shall be:
Gas Piping System

When Chapter 14 is applicable, permit fees for process piping shall be

For each hazardous process piping system (HPP) of

Other Inspections and Fees:

196 Section 10. NEW SECTION. A new section amending, by addition of the underlined
197 language and deletion of the strikethrough language, Section 116.1 of the Uniform
198 Mechanical Code as adopted and maintained by the State Building Code Council is
199 added to chapter 11.32 of the Yakima Municipal Code to read as follows:
200 11.32.116. Amendment to Section 116.1 UMC. Section 116.1 of the Uniform
201 Mechanical Code as adopted and maintained by the State Building Code Council
202 is amended to read as follows:
203 SECTION 116 INSPECTIONS
204 116.1 General. Mechanical systems for which a permit is required by this
205 code shall be subject to inspection by the building official and such
206 mechanical systems shall remain accessible and exposed for inspection
207 purposes until approved by the building official.
208 It shall be the duty of the permit applicant to cause the mechanical
209 systems to remain accessible and exposed for inspection purposes.
210 Neither the building official nor the jurisdiction shall be liable for expense
211 entailed in the removal or replacement of any material required to permit
212 inspection. When the installation of a mechanical system is complete, an
213 additional and final inspection shall be made. Mechanical systems
214 regulated by this code shall not be connected to the energy fuel - supply
215 lines until authorized by the building official.
216 Approval as a result of an inspection shall not be construed to be an
217 approval of a violation of the provisions of this code or of other
218 ordinances of, the jurisdiction. Inspections presuming to give authority to
219 violate or cancel the provisions of this code or of other ordinances of the
220 jurisdiction shall not be valid.

221 Inspection and approval of gas installations shall be certified by the
222 building official by both notice to the permitee and telephonic verification
223 to the gas utility company.
224 A final inspection approval may, upon notice, be revoked by the building
225 official if he /she finds that the mechanical appliance including associated
226 materials and equipment fails in any respect to comply with the
227 requirements of this code, or that otherwise the installation is unsafe,
228 dangerous or a hazard to life or property.
229 Section 11. NEW SUBSECTIONS. Section 210 -H of the Uniform Mechanical Code as
230 adopted and maintained by the State Building Code Council is amended by addition of
231 the following definitions, which are added to chapter 11.32 of the Yakima Municipal
232 Code to read as follows:
233 11.32.210 - H Amendment to Section 210 - H UMC. Section 210 - of the Uniform
234 Mechanical Code as adopted and maintained by the State Building Code Council
235 is amended to include additional definitions that shall read as follows:
236 HEATING and/or COMFORT - COOLING APPLIANCE, means an
237 appliance which utilizes gas, Liquid, solid fuel or electricity for the
238 purpose of heating and / or cooling, and shall include all necessary piping
239 and duct work, and shall also include piping for all gas appliances
240 including such appliances as gas refrigerators.
241 HEATING and/or COMFORT - COOLING CONTRACTOR, means -any
242 person, firm or corporation who installs, contracts to install or services,
243 repairs, alters or cleans any or all types of heating and cooling appliances
244 and is listed by the Washington Department of Labor and Industries as a
245 Washington State Mechanical Journeyman.
246 HEATING AND /OR COMFORT - COOLING JOURNEYMAN, means any
247 person engaged in the actual work of installing or servicing any heating or

248 comfort- cooling appliance, and who is the authorized holder of a valid
249 and subsisting City of Yakima Heating and / or Comfort- Cooling
250 Journeyman Certificate.
251 Section 12. NEW SECTION. A new section amending, by addition of the underlined
252 language and deletion of the strikethrough language, Section 813.2.1 of the Uniform
253 Mechanical Code as adopted and maintained by the State Building Code Council is
254 added to chapter 11.32 of the Yakima Municipal Code to read as follows:
255 11.32.813.2.1 Amendment to Section 813.2.1 UMC. Section 813.2.1 of the
256 Uniform Mechanical Code as adopted and maintained by the State Building
257 Code Council is amended to read as follows:
258 813.2 Gas Venting into Existing Masonry Chimneys. Existing lined
259 masonry chimneys and unlined chimneys with not more than one side
260 exposed to the outside may be used to vent gas appliances, provided:
261 1. An approved liner shall be installed in an existing unlined masonry
262 chimney when deemed necessary by the building official considering local
263 problems of vent gas condensate. Metal chimney liners shall comply with
264 the requirements of Table 8 -D.
265 Section 13. NEW SECTION. A new section amending, by addition of the underlined
266 language and deletion of the strikethrough language, Section 1310.6 of the Uniform
267 Mechanical Code as adopted and maintained by the State Building Code Council is
268 added to chapter 11.32 of the Yakima Municipal Code to read as follows:
269 11.32.1310.6 Amendment to Section 1310.6 UMC. Section 1310.6 of the Uniform
270 Mechanical Code as adopted and maintained by the State Building Code Council
271 is amended to read as follows:
272 1310.6 Meter Location. All gas meters shall be located outside of
273 buildings, and those meters now installed inside or under buildings shall
274 be moved outside when additional equipment is added or if existing
275 equipment is replaced. Gas meters shall not be located under a show

Section 14. Severability: If any section, subsection, paragraph, sentence, clause or
phrase of this ordinance, or any provision of the Yakima Municipal Code established by
this ordinance, is declared invalid or unconstitutional for any reason, such decision
shall not affect the validity of the remaining portions of this ordinance, or other
provisions of the Yakima Municipal Code established by this ordinance.
Section 15. This ordinance shall be in full force and effect 30 days after its passage,
approval, and publication as provided by law and by the City Charter.

SUMMARY EXPLANATION:
By this ordinance, the City of Yakima would adopt the State Uniform Building Code WAC
51-42 by reference as provided by statutory authority by RCW 19.27.031 and 19.27.074.
Presently before the City Council is the local amendments to the Uniform Mechanical.
Since August of 2000, the Council's Community and Economic Development Committee,
a group of professionals from the community and staff, have been meeting to update the
local amendments to several of the construction codes used in the City of Yakima.
There was a Council Study Session held on February 13, 2001, with Council provided
direction to make some modifications to some of the local amendments. On May 15, 2001
the City Council approved the local amendments to the Uniform Building Code.
Through this process, it was the intent of all parties involved to only have local
amendments that were needed because of climatic weather conditions or conditions
unique to the local area. Several of the local amendments for these Construction Codes
have been eliminated because they were redundant, unnecessary or already addressed
within the State 1997 Uniform Building Code.
