AN ORDINANCE relating to the Yakima Center Advisory Commission, and
repealing chapter 1.88 of the Yakima Municipal Code.
WHEREAS, chapter 1.88 of the Yakima Municipal Code establishes the Yakima
Center Advisory Commission to make recommendations to the City Council regarding
the development and use of the Yakima Convention Center; and
WHEREAS, pursuant to RCW 35.57.010 and an Interlocal Cooperation
Agreement To Form a Public Facilities District (the "PFD Interlocal Agreement ") with
the cities of Union Gap and Selah, the City has formed the Yakima Regional Public
Facilities District (the "PFD ") to assist in the financing, development and operation of
the Yakima Convention Center, including the planned expansion thereof; and
WHEREAS, pursuant to the PFD Interlocal Agreement, the PFD is governed by a
seven - member Board of Directors appointed by the three cities and charged with
overseeing the business of the PFD; and
WHEREAS, to avoid duplication by the Yakima Center Advisory Commission of
functions with respect to the Yakima Convention Center now vested with the PFD
Board, it is in the best interest of the City of Yakima to repeal certain sections of the
Yakima Municipal Code relating to the Yakima Center Advisory Commission, now
therefore:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA,
WASHINGTON:

Sections 1.88.010, 1.88.020, 1.88.030, 1.88.040, and 1.88.050, of the Yakima Municipal
Code are repealed.
This ordinance shall be in full force and effect 30 days after its passage, approval, and
publication as provided by law and by the City Charter.
PASSED BY THE CITY COUNCIL at a regular meeting and signed and
approved this 21 of August, 2001.

SUMMARY EXPLANATION: On June 19, 2001, Council approved the formation, jointly with
the cities of Union Gap and Selah, of the Yakima Regional Public Facilities District. The Public
Facilities District (PFD) is governed by a seven member board of directors, appointed by the three
cities. At the time the PFD was formed, it was understood that once the PFD Board of Directors
was established and functioning, that the Board would assume the responsibilities of the Yakima
Center Advisory Commission.
On Tuesday, July 24, 2001, the PFD Board of Directors held their first meeting; all seven members
were present. At this meeting the board elected their officers, established their corporate business
office, set the date, time and location of their regular monthly meetings, approved the Lease
Agreement and the Development Agreement with the City of Yakima and imposed the .033%
retail sales tax. Thus, the PFD Board of Directors is now fully formed and functioning in their
capacity as the governing body for the Yakima Regional Public Facilities District. In order to
avoid duplication by the Yakima Center Advisory Commission of functions with respect to the
Convention Center which are now vested with the PFD Board, it is in the best interest of the City
of Yakima to repeal certain sections of the Yakima Municipal Code relating to the Yakima Center
Advisory Commission.
