ORDINANCE NO. 2001 - 34
AN ORDINANCE relating to residential refuse and yard waste collection service
rates, and providing rates for automated collection of 32- and
96- gallon carts, and for call -back service, and amending section
4.16.010, and subsections 4.16.140(C)(1), 4.16.140(C)(2), and
4.16.140(D) of the Yakima Municipal Code accordingly.
WHEREAS, it is in the best interest of the City of Yakima to amend residential
refuse and yard waste collection service rates provide by chapter 4.16 of the Yakima
Municipal Code as follows, now therefore:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA,
WASHINGTON:
1 Section 1. Subsection 4.16.010 of the Yakima Municipal Code is amended to read as
2 follows:
3 As used in this chapter, the following words and phrases shall have the
4 following meanings ascribed to them, unless the context indicates otherwise:
5 1. "Ashes" means residue resulting from the combustion of coal, coke or
6 wood in domestic, industrial or commercial stoves, furnaces or boilers.
7 2. "Cart" means a container for refuse or yard material designed for
8 automated collection.
9 3. "Prepared garbage" means waste materials from kitchens, dining rooms
10 and similar places from which liquids have been drained and solid matter
11 wrapped in paper.
12 4. "Raw garbage" means waste material from kitchens, dining rooms and
13 similar places from which liquids have been drained.
14 5. "Refuse" means all sweepings, trash, rubbish, litter, garbage, industrial or
15 domestic wastes, organic wastes or residue of animals sold as meat, fruit or other
16 vegetable matter from kitchens, dining rooms, markets, or places dealing in or
17 handling meats, fowl, fruits, grain or vegetables, ashes and cinders, offal, animal
18 excreta and accumulated waste materials or substances which may become
19 nuisances.
20 6. "Special haul material" means waste material such as dirt, wood, stone,
21 brick, plaster or materials resulting from the demolition, alteration or
22 construction of buildings or structures, or yard trimmings or material larger than
23 four inches in diameter or too long to fit within a 96- gallon cart when covered by
24 its lid, or discarded fruit.
25 7. "Trash" means waste material containing no putrid matter.
26 8. "Yard material" means waste material from tree and shrub trimmings, yard
27 trimmings, leaves and brush and uprooted trees or shrubs. For the purposes of
28 YMC 4.16.020, yard materials are rubbish, trash, or other refuse.

30 Section 2. Subsection 4.16.140(C)(1) of the Yakima Municipal Code is amended to
31 read as follows:
32 1. There are hereby imposed for refuse collection in the residential classification
33 the following charges for each single - family dwelling and for each residential
34 unit in any multiple dwelling:

37 A call -back charge of seven dollars and fifty one cents ($7.51) shall be

41 Section 3. Subsection 4.16.140(C)(2) of the Yakima Municipal Code is amended to
42 read as follows:
43 2. In addition to the charges imposed by subsection (C)(1) of this section, a
44 separate charge, to be known as the "yard service charge," is imposed on each
45 residential unit that elects to receive yard material collection service from the
46 city during the nine -month period of each year commencing March 1st and
47 ending November 30th. Such service shall utilize one or more 96- gallon carts
48 owned and provided by the city. The yard service charge shall be nine dollars
49 and twenty -six cents ($9.26) per month for one 96- gallon cart, plus four dollars
50 and sixty -three cents ($4.63) per month for each additional 96- gallon cart, and
51 shall be billed to each residential unit that elects to receive this service at the time
52 and as a part of the billings rendered for other city services applicable for that
53 nine -month period. A call -back charge of seven dollars and fifty one cents
54 ($7.51) shall be imposed each time a customer requests yard material collection
55 service at a time other than the regularly scheduled time.
56 Where yard material collection service is performed for multiple dwellings
57 that are carried under a single account number and street address for water
58 department metered services, the multiple dwellings shall be deemed a single
59 residential unit for the purpose of computing the yard service charge imposed
60 by this section.

61 Section 4. Subsection 4.16.140(D) of the Yakima Municipal Code is amended to read
62 as follows:
63 D. The yard material collection service, for which the yard service charge is
64 imposed by subsection (C)(2) of this section, shall include the weekly collection
65 of yard material from automated /semi- automated plastic 96- gallon carts
66 furnished by the city department of public works during the nine -month period
67 for which the yard service charge is billed to any particular premises. For
68 collection purposes, the total weight of each cart including yard material

69 deposited therein may not exceed two hundred pounds. Yard material larger
70 than four inches in diameter or too long to fit within a 96- gallon cart when
71 covered by its lid shall not be placed in a 96- gallon cart for collection, but may
72 upon proper request, be collected as special haul material.
Section 5. Severability: If any section, subsection, paragraph, sentence, clause or
phrase of this ordinance, or any provision of the Yakima Municipal Code established
by this ordinance, is declared invalid or unconstitutional for any reason, such decision
shall not affect the validity of the remaining portions of this ordinance, or other
provisions of the Yakima Municipal Code established by this ordinance.
Section 6. This ordinance shall be in full force and effect 30 days after its passage,
approval, and publication as provided by law and by the City Charter.

SUMMARY EXPLANATION:
After receiving citizen comment regarding proposed changes in refuse service at the
public hearing held on May 15, 2001, the City Council approved a seven -year
implementation of a fully- automated residential refuse collection system from a manual
collection system.
The attached ordinance creates collection service rates for the automated residential
refuse service (32 and 96 gallon carts). Upon Council passage of the ordinance, the
changes will become effective August 2001 within Yakima's residential refuse service
area. Additionally, a rate has been established for each additional yard service cart
beyond the one 96- gallon cart for residential customers electing to participate in the yard
service program. This will encourage the use of yard service collection over regular
refuse service as a more appropriate direction for recyclable yard service materials.

STAFF RECOMMENDATION: Staff respectfully requests Council to pass the attached
ordinance relating to collection service rates for the fully- automated residential refuse
collection service and establish rates for additional yard service carts.
