Nob Hill Blvd. from Two - Family Residential (R-2) to Local Business (B-2), and amending the Official Yakima Urban Area Zoning Map accordingly. WHEREAS, Michael J. Durall, the Owner, has submitted a rezone application dated March 7, 2001, requesting: (1) amendment of the Official Yakima Urban Area Zoning Map to rezone two parcels (approximately 11/2 acres) in the vicinity of 2907 and 3001 W. Nob Hill Blvd. (Yakima County Assessor's Parcel #181326-23010 and 181326-23011), referred to as "Subject Property," from Two -Family Residential (R-2) to Local Business (B-2); and WHEREAS, on May 10, 2001, the City of Yakima Hearing Examiner conducted a duly convened, open -record public hearingregarding the requested rezone•(UAZO RZ #2-01, EC #6-01), and after considering the record issued his Examiner's Recommendation, Examiner No. IU01-2-8, dated May 10, 2001; and WHEREAS, the Hearing Examiner recommended that the Subject Property should be rezoned from Two -Family Residential (R-2) to Local Business (B-2); and WHEREAS, at a closed -record public hearing on July 19, 2001, the City Council duly considered the requested rezone, including the documents and other evidence which comprise the record developed before the Hearing Examiner, the Hearing Examiner's Recommendation, and the statements of interested persons; and WHEREAS, after considering the Hearing Examiner's Recommendation, the contents of the file, and the statements of interested persons, the City Council finds with respect to the requested rezone that: 1. The Subject Property is suitable to be classified Local Business (B-2); 2. There exists a public need for the requested rezone; 3. Circumstances have changed since the existing Two -Family Residential (R-2) zoning was established which now make the requested rezone appropriate; and 4. The requested rezone is consistent with and complies with: a. The requirements and considerations set forth in chapter 15.23 of the Yakima Municipal Code; b. The goals and policies of the Yakima Urban Area Comprehensive Plan; c. The intent of the Yakima Urban Area Zoning Ordinance; d. Other applicable land use controls; and WHEREAS, it is in the best interests of the City to adopt the Hearing Examiner's findings and conclusions and recommendation to approve the requested rezone; now, therefore, . Hearing Examiner's Recommendation Affirmed: The Yakima City Council adopts the findings, conclusions and recommendations of the Hearing Examiner's Recommendation, Examiner No. IU01-2-8, dated May 10, 2001, and incorporates that Hearing Examiner's Recommendation by reference as part of this Ordinance. Section 2. Subject Property: Regarding the Subject Property, the legal description of which is attached to this ordinance as Exhibit A, which is incorporated by reference in this ordinance, the City Council finds formally that, for the uses described by the Applicant: 1. The Subject Property is suitable to be classified Local Business (B-2); 2. There exists a public need for the requested rezone; 3. Circumstances have changed since the existing Two -Family Residential (R-2) zoning was established which now make the requested rezone appropriate; and 4. The requested rezone is consistent with and complies with: a. The requirements and considerations set forth in Chapter 15.23 Yakima Municipal Code; b. The goals and policies of the Yakima Urban Area Comprehensive Plan; c. The intent of the Yakima Urban Area Zoning Ordinance; and d. Other applicable land use controls. Section 3. Amendment of Official Yakima Urban Area Zoning Map: The Official Yakima Urban Area Zoning Map shall be amended to rezone the Subject Property from Two - Family Residential (R-2) to Local Business (B-2). Section 4. The City Clerk is hereby authorized and directed to file a certified copy of this ordinance with the Yakima County Auditor. Section 5. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter, and this action shall be final and conclusive unless within 21 days from the date this ordinance is passed by the City Council an aggrieved party commences proceedings for review pursuant to the provisions of Chapter 36.70C RCW. Yakima Urban Area Comprehensive Plan, The Future Land Use Map (Map III -3) designates the subject property as neighborhood commercial and, therefore, suitable for B-2, Local Business, zoning. The Regional Planning Commission and the Yakima City Council changed the designation of this property from Residential to Arterial Commercial in 2000. 6. Yakima Urbn Area Zoning Ordinance. The Local Business district is intended to provide areas fo'r commercial activities outside the Central Business District that meet the retail shopping needs of the community, and to accommodate small scale commercial uses requiring high -.visibility and easy access to major arterials. Use characteristics of this district include small retail sales and service establishments. 7. Rezone Criteria. Recommendations for approval of rezone applications are governed by seven criteria specified in Section 15.23.030 YMC. 7.1 Testimony. This is a non -project rezone, with no pending sale, according to realtor Fred Witham. The property has been listed for sale for about 18 months. Ms. Landi Marquis, of 1010 S. 30th, testified. Mr. Benson, Mr. Callow from Engineering, and I indicated that the odds of extending 30th to the south are slim to none. Mr. Benson reviewed the sitescreening criteria, and uses that are permitted as a Class 1 use in the B-2 zone. Ms. Marquis appreciated the information, and has a better understanding that in all probability significant sitescreening will be required. These issues will be reviewed when the property is actually redeveloped. 7.2 Suitability of the Property. The property is well suited for the range of uses permitted within the B-2 zoning district. 7.3 Agency Recommendations. to this rezone. No agencies are opposed 7.4 Compliance with Comprehensive Plan and Zoning Ordinance. This rezone is compatible with future land use map III -3 and land use compatibility chart III -2 of the Comprehensive Plan. The map indicates future land use for the subject property as Arterial Commercial, a designation that includes B-2, Local Business zoning, within its range of appropriate zoning classifications 7.5 Adequacy of Public Facilities. All required public utilities, including sewer, water, streetlights, and fire hydrants are presently available. Street access is provided by Nob Hill Boulevard, a major arterial with 72 feet of right-of- way, approximately 55 feet of pavement, and curbs, gutter and sidewalk. Route No. 5, Nob Hill West, provides transit service. 7.6 Compatibility. Compatibility is primarily determined by usage, which is affected by zoning. Should this application be approved, all Class (1) permitted land uses of the B-2 zoning district would be permitted at this location. At the time of development additional review would be required to assure compliance with the zoning standards set forth in YMC Chapter 15, building codes at YMC Chapter 11, development standards at YMC Chapter 12, and any -development exceeding the environmental thresholds set forth in YMC Chapter 6.88 would be required to undergo environmental review. This property is separated from residential property to the north by an irrigation canal, which provides an additional buffer. These two parcels are large enough that they can be easily developed for commercial or retail use. Many of the B-2 zoned lots on Nob Hill Blvd. are so small that redevelopment to B- 2 uses is very difficult. This property will, depending on the use, be more able to accommodate parking and vehicle circulation. 7.7 Public Need/Change in Circumstance. Significant land use changes have occurred within this general area since the subject property was zoned R-2. Since 1986, retail development along Nob Hill has utilized nearly all -vacant B-2 property in the area. This has created a need/demand for additional B-2 zoned land. These changes support the requested rezone from moderate density residential development to local business development. The change in circumstance was recognized last year when both the Regional Planning Commission and the Yakima City Council changed the comprehensive plan designation of this property from Residential to Arterial Commercial. 8. Public Notice. Public notice of the hearing was provided in accordance with the ordinance. No proposed project leads us to believe that this action is not well thought out. Why change zoning without a plan? There must be a project Mr. Durall has in mind, and as neighboring homeowners we would like to know what it is. The second concern we have relates to the economic well being of Yakima. We are concerned that city land not Oreveloped for commercial use beyond the level of need. It is apparent from driving around our city streets that e is plenty of vacant business space in Yakima. In fact, there are several vacant businesses located on Nob Hill Boulevard. The action proposed by Mr. Durall could potentially add to this problem of "supply exceeding demand" especially if he doesn't have a well thought out plan for the property. Our last concern is regarding traffic flow in our neighborhood. Would a business located on the property in question potentially be accessed via South 30th Avenue?
