ITEM TITLE: Cascade and Senator Apartments Petition for Free Parking in the "Barrel House"
Parking Lot

SUMMARY EXPLANATION:
On October 13, 2010, Mr. Dwight Lewis submitted the attached petition (Pet. # 10 -08) protesting the
current parking situation at the "Barrel House" public parking lot. Residents of the Senator and
Cascade Hotels had traditionally utilized spaces in the public lot. The advent of transitioning the lot
from county use to a "for pay" public lot limits the use of these lots on a "free basis." On October 19,
2010, Mr. Dwight Lewis appeared at City Council to request relief from the situation described above.
The City Council requested that the Parking Commission revisit this issue. On November 10, 2010,
, the Parking Commission discussed the matter. City Councilmember Dave Edler attended as the
Council Liaison. Please see attached agenda for the Parking Commission meeting of November 10,
2010. After deliberation, the Parking Commission voted to not alter the use of the "Barrel House"
public parking lot and reaffirmed their past recommendation to the City Council, which Council acted in
the affirmative on August 3, 2010 (attached). Jeff Cutter, City Attorney, has, via verbal communication,
expressed serious doubt of the legality to provide "free" parking in the public lot as the petitioners
request.

STAFF RECOMMENDATION: Staff recommends City Council make no change from their August 3,
2010 decision to incorporate the Barrel House parking lot into the City's system of lots managed by
CDY.
BOARD /COMMISSION /COMMITTEE RECOMMENDATION: The City Council's Parking Commission
voted on November 10, 2010 to maintain the current recommendation to Council; therefore not
recommending parking relief for the Senator and Cascade residents due to legal, policy and
recedential challenges.

1. Call to Order
• Mike McMurray called the meeting to order at 4:08pm.
2. Cascade & Senator Apartments
• Mike McMurray explained that the reason for the meeting is to
discuss the Cascade and Senator Apartments.
• Chris explained that he spoke with Dwight, the supervisor from the
Cascade & Senator apartments, who is acting as the spokesman for
the two apartment buildings. Chris said that he explained that the
area falls into the $12 on- street parking. A discussion occurred on
various issues surrounding the Senator and Cascade Apartments,
which is owned by Aaron Stewart:
• Larry Hull explained that he spoke with a representative from
Aaron Stewart's lending institution about the parking and why it
hasn't been changed to HUD. They disclosed that they have spoken
to Aaron Stewart on this matter, but at this time, he is not willing
to make changes to his building in order to qualify for HUD funding
for Federal dollars. Larry explained to the Parking Commission that
he knows that there is currently HUD funding available for
upgrades to buildings like his.
• Mike McMurray explained that there is currently 30% of the Barrel
House parking lot that is available for permits at $40 per month,
and the Barrel House parking lot is located on the same black as the
Cascade and Senator Apartments.
• Councilman Dave Edler explained that situations like this come to a
City Council meeting, and it . can get people politically charged, so
he encouraged the Parking Commission to make uniform parking
policies for the City.
• Nick Hughes moved . to recommend addition of parking meters to
the Barrel House parking lot, to maintain the same setup and
operational procedures (% of monthly permits available, cost, and
signage) as the other 3 public parking lots. Jack Cannon 2 The
motion passed unanimously.
3. Good o f the Order
• Chris Waarvick explained that he is working with the City Legal
department to look into the Velosum ticket writing program and
the proposal should go in front of City Council in January.
• Mike McMurray asked Chris Waarvick if the suggested increase for
on- street permit parking was submitted to council to raise rates
from $12 per year to $40 per month. Chris Waarvick explained that
it had not been brought yet, but will be at a future council
meeting.
• Larry explained that the Committee for Downtown Yakima will
come to the Parking Commission with various options and ideas
regarding parking in the core in the near future. A discussion
occurred on the possibilities for the future of downtown parking.

-Do these apartments fall within the scope of allowing esidential Parking
Permits under the YMC? (It certainly appears so, yes)
-Do the residents fall within the scope of an "evening only" privilege in
the public lot? (I have heard anecdotal reports that Council provided this
relief for the Grand Hotel on Yakima Avenue, though no one has taken
advantage of this provision.)
-Are there any other examples of reserving a number of arking spaces in a
4110 public lot? (If appears so, yes. At the public lot east of t 2nd Street
Grill for Liberty Building parking; but they pay for the privilege.)
-Are there any private lots close by to contract with or pay individually?
(Yes, two Tots. The lot north and adjacent to the Cafe Melange and the lot
on the southwest corner of Front and Yakima Ave.)
-Is there a prohibition of the City from offering free parking for the
residents of the Cascade and Senator Apartments as they have requested? (I
am not the attorney but likely it would have problems - Jeff?).
-Are there any programs for the residents to avail themselves of to pay for
monthly parking? U.arry has some experience in this arena.)

ITEM TITLE: Consideration of Citizens Petition No. 10 -08 regarding parking in the North Front
Street Historic District area

SUMMARY EXPLANATION: On October 13, 2010, Mr. Dwight Lewis submitted the attached
petition that protests the current parking situation in the vicinity of the North Front Street historic
block. There are forty signatures that the petition states are tenants of the Cascade and
Senator Apartments.
For the sake of expediting this matter, since the City Council's Parking Commission was
scheduled to meet on Wednesday, October 13, I took the liberty of giving them the petition so
they could review this matter without a three -month delay or calling a special meeting.
The Barrel House parking lot has been returned to City of Yakima control from Yakima County
and the City has expanded the management responsibilities of the Committee for Downtown
Yakima (CDY) to include this lot in their parking management contract. Only warning citations
have been written to this point. The parking requirements for this lot are no different than the
other public Tots under CDY management.
Mr. Lewis has been contacted and advised that this matter is on the Council agenda for petition
acceptance and disposition.

SUMMARY EXPLANATION:
The "Barrel House" parking lot on North 1 Street in the North Front Street Historic Block has now
been returned to the City from Yakima County per the expired use agreement. CDY wishes to
incorporate the lot into the CDY /City Parking Management Agreement (attached). Additional
management duties were contemplated in this agreement (see Page 2, Section 2. A). The City's
Parking Commission voted on July 1, 2010, to forward an affirmative recommendation (see PC
minutes). This is an interim action while ultimate disposition of the property is decided upon by City

Council. The cost of equipment, installation and signage is estimated at $12,000. The Parking Fund
i has sufficient resources to accommodate this expense. The contract contemplates that CDY may
submit for additional .compensation for the management of additional lots beyond the $30,000 per year
($7,500/ quarter) compensation. Also attached is the CDY omnibus downtown maintenance contract
because the parking contract references ft.

Commissi n regarding the Chestnut Manor Apartments at June 15

• Joe Morri i r began the discussion of the CMA, and his opposition in
granting the CMA special on- street parking permits. Larry Hull restated
the CMA's request to include Chestnut Manor , apartments in the area
where on- Street parking permits are available. A discussion occurred
on the special conditions regarding on- street permitted parking. The
CMA's request for special exemption was not recommended by Commission due to lack of a motion to proceed. y the

• Mike McMurray brought up the discussion 'of wanting new
residences created without some provision fo>j parking, which puts
strain on the public, not the building owner. He explained that now is
the time to resurrect the idea with City Council because new
residences are being created and there needs Ito be a provision for
parking. A discussion occurred regarding the need for provisions to
new residgntial parking - either provide parking or have a contract
with existing parking lots that proves you can provide parking for the
residents. ( Mike McMurray moved to ask the Cit� and the City staff to
investigate the feasibility of requiring new multi -unit residences to
make provision for adequate parking for their residents, with emphasis
on the original Central Business District. The objective of this
research is to provide the Parking Commission with data from which a
recommendation to City Council can be made. � Jack Cannon 2n The
