HomeMy WebLinkAbout1986-2949 CONSTRUCTING A PIPE SEWER WITH NECESSARY WYE BRANCHES & MANHOLES oRDINANcirin. 2949 AN ORDINANCE providing for the improvement of certain property by 1/ constructing a pipe sewer with the necessary wye branches and manholes; establishing a Local Improvement District, providing for the method of payment thereof, and creating a special fund. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The following described property situate in Yakima County, Washington, shall be improved by constructing a pipe sewer with the necessary wye branches and manholes: Ptn. of Lot 1 and ALL of Lots 2 through 5, Poplar View Addition, Vol. P, Page 21, Records of Yakima County, Washington (Yakima County Parcel Numbers: 181320-23416, 181320-23444, 181320-23417 through 181320-23419 Incl.) and the W 70 feet of E 290.6 feet of N. 220 feet of the NE% SW1/4 Nigh Exc. N 20 feet to County for Road recorded in Section 20, Township 13 North, Range 18, E.W.M. in Yakima County, Washington (Yakima County Parcel Number 181320- 4111 23004) and Th Portion of NEB SW1/4 NWhi Beg. at a Point on East Right-of-Way of Poplar View Street, Th East 100 Feet, Th S 230 Feet, Th W to E'ly Right-of-Way of said Street Th Northerly and Easterly along said Right-of-Way to Lincoln Avenue West of 76th Avenue (Yakima County Parcel Number 181320-23005); and Yakima County Parent Parcel Number 181320-23448 with reference to Short Plat 85-319, Lots 1 through 4; SSE 124-85, Records of Yakima County Washington and defined on the attached map, Exhibit A A-1. Section 2. There is hereby created a Local Improvement District, to be called "Local Improvement District No. 1041", which said district Shall include all of the above described property. Section 3. The assessments shall be made according to special benefits derived from the improvements without regard to the zone and termini method. 4111 Section 4. All costs and expenses , in connection with the con- struction of said improvements, including the engineering,. inspection, advertising, publication of notices,,andall„pther expenses incident thereto, shall be levied and assessed against all of the property legal- . ly and properly assessable therefor as provided by law and as above described. Section 5. All of the aforesaid construction work shall be in accordance with the plans and specifications, profiles, maps and detail- ed drawings which have been prepared by the City Engineer, filed with the City Clerk, and Which are hereby approved and adopted. Section 6. The work necessary to be done in connection with the making of said improvements shall be done by contract upon competitive bids according to specifications and plans as prepared by the Engineer- ing Division of the Department of Community Development, and the City 4110 shall have the power to reject any and all bids. ORDRES EE2 Section 7. There is hereby created a special fund, to be known as "Local Improvement Rind, District No. 1041", into which shall be placed all sums paid on account of the aforesaid special assessments, including all interest and penalties thereon, and in the event of the sale of local improvement bonds by the City, all premium and interest on said bonds issued for said improvement. Section 8. Bonds shall be issued in payment of the costs and expense of said improvements, which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said district, which assessments, with interest, shall be payable annually under the mode of payment "payment by bonds" as defined by the statutes of the State of Washington and the ordinances of the City of Yakima; provided, this improvement may be financed by the issuance of promissory notes, under the authority of R.C.W. 35.45.150 and Section 8.12.100 of the City of Yakima Municipal Code. The term and interest rate of bonds and special assessments contemplated by this section shall conform to provisions, terms and conditions to be spec- ified by a subsequent ordinance of the City of Yakima. Section 9.
