AN ORDINANCE relating to building regulations; adopting by reference the
Uniform 'Code for Building Conservation, copyright 1985 by
il the International Conference of Building Officials, setting
minimum standards for change of occupancy, alteration or
repair of existing buildings or structures in the City of
Yakima; and enacting Chapters 11.07 and sections thereof,
all of the City of Yakima Municipal Code.
WHEREAS, R.C.W. 35.21.180 authorizes cities and towns within the State
of Washington to pass ordinances adopting by reference compilations and
codes relating to the construction of buildings, and
WHEREAS, the City Council of the City of Yakima has heretofore exam-
ined and understands the scope and purpose of the regulations of the Uni-
form Code for Building Conservation, copyright 1985 by the International
Conference of Building Officials, and deems it in the best interests of the
City that such Uniform Code for Building Conservation be adopted as the law
of the City of Yakima, and
WHEREAS, one or more copies of such Uniform Code for Building Con-
servation have heretofore been filed and are now on file in the office of
the City. Clerk of the City of Yakima for use and examination by the public,
as required by law, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Chapter 11.07 of the City of Yakima Municipal Code is
hereby enacted as a new chapter to read as follows:
"CHAPTER 11.07
BUILDING CONSERVATION CODE
11.07.010 Adoption of Uniform Code for Building Conservation.
The Uniform Code for Building Conservation, copyright 1985 by the
International Conference of Building Officials, consisting of the
Uniform Building Conservation Code, Appendix Chapter Three thereto
(except Appendices Chapters One, Two and Four), and the Uniform Code
for Building Conservation Guidelines, of which no less than one or
more copies each have been filed and now are on file in the office of
the City Clerk of the City of Yakima, is hereby adopted and incorpor-
ated as fully as set out in full herein, as the building conservation
code of the City of Yakima; except as hereinafter amended, and the
provisions and regulations of the City of Yakima and the several
sections or numbers therein shall constitute, and may be referred to
as, the numbers of this chapter.
k 11.07.015 Amendment to Section 102. Section 102 of the Uniform
'�� Code for Building Conservation, as applied to the City of Yakima, is
hereby amended to read as follows:
'Sec. 102. Purpose. The purpose of this code is to encourage
the continued use or reuse of legally existing buildings and struc-
tures.
Adoption or enforcement of this code shall not be construed for
the particular benefit of any individual person or group of persons,
other than the general public. In the event of a conflict between the
intent of this section and any other section herein, this section
shall govern insofar as applicable.'

11.07.* Amendment to Section 201. Section 201 of the Uniform
Code for Building Conservation, as applied to the City of Yakima, is
hereby amended to read as follows:
'Sec. 201. Wherever the term Building Official is used in this
code it shall be construed to mean the Code Administration Manager or
his designee. The Code Administration Manager or his designee is
hereby authorized to enforce the provisions of this code.'
11.07.025 Amendment to Section 207. Section 207 of the Uniform
Code for Building Conservation, as applied to the City of Yakima, is
hereby amended to read as follows:
'Sec. 207. Appeals. The Uniform Building Code Board of Appeals
shall. provide all final interpretations of the provisions of this Code
and shall hear all appeals provided for in this Code. Such inter-
pretations and appeals shall be heard and decided in the manner and
form provided for in the Uniform Building Code as adopted by the City
of Yakima.'
11.07.030 Amendment to Section 301. Section 301 of the Uniform
Code for Building Conservation, as applied to the City of Yakima is
hereby amended to read as follows:
'Sec. 301. Definitions. For the purpose of this code, certain
terms, phrases, words and their derivatives shall be construed as
specified in this chapter. Wbrds used in the singular include the
plural and the plural the singular. Words used in the masculine
gender include the feminine and the feminine the masculine.
Where terms are not defined, they shall have their ordinary
accepted meanings within the context in Which they are used. Web-
ster's Third New International. Dictionary of the English Language,
Unabridged, copyright 1981, shall be considered as providing ord-
inarily accepted meanings.
ADDITION is an extension or increase in floor area or height of a
building or structure.
ALTER or ALTERATION is any change, addition or modification in
.construction or occupancy.
APPROVED AGENCY is an established and recognized agency regularly
• engaged in conducting tests or furnishing inspection services, when
such agency has been approved by the building official.
BUILDING CODE is the Uniform Building Code promulgated by the
International Conference of Building Officials, as adopted by this
jurisdiction.
BUILDING SERVICE EQUIPMENT refers to the plumbing, mechanical,
electrical and elevator equipment including piping, wiring, fixtures
and other accessories Which provide sanitation, lighting, heating,
ventiliation, cooling, refrigeration, fire-fighting and transportation
facilities essential for the habitable occupancy of the building or
structure for its designated use and occupancy.
COMPLIANCE ALTERNATIVE is conformance with the intent of this
code, using means, materials or design features Which can be derr
onstrated to the satisfaction of the building official to perform in a
nanner equivalent to those specifically required by this code.
DANGEROUS BUILDING is any building or structure deemed to be
dangerous by Section 302 of the Uniform Code for the Abatement of
Dangerous Buildings or such alternate procedures as may have been
adopted by this jurisdiction.
DANGEROUS BUILDING CODE is the Uniform Code for the Abatement of
Dangerous Buildings promulgated by the International Conference of
Building Officials, as adopted by this jurisdiction.
ELECTRICAL CODE is the National Electrical code promulgated by
the National Fire Protection Association, in force in this jurisdic-
tion.

EQUILVALENCY is meeting the intent of this code by means .other
than those detailed in specific code provisions.
EXISTING BUILDING is a building or structure erected prior to the
adoption of the current Building Code of the jurisdiction and has been
issued a Certificate of Occupancy or has been otherwise legally occup-
ied.
HISTORIC BUILDING is a building or structure which has been
'111,10 designated by official action of the legally constituted authority of
this jurisdiction as having special historical or architectural signi-
ficance.
IMMINENT HAZARD is a condition which could cause serious or life
threatening injury or death at any time.
OCCUPANCY is the purpose for which a building, or part thereof,
is used or intended to be used.
REHABILITATE is to return a building or structure to a state of
utility through additions, alterations or repairs. As applied to
historic structures, it includes the preservation of those portions or
features that are of historical, architectural and cultural value.
REPAIR is the reconstruction or renewal of any part of an exist-
ing building.
SHALL
a) With respect to the functions and powers of the Code Admin-
istration Manager, any agents and employees of the City of Yakima and
any hoard authorized hereunder, a direction and authorization to act
in the exercise of sound discretion and in good faith;
b) With respect to the obligations upon owners and occupants of
premises and their agents, a mandatory requirement to act in cam
pliance with this code at the risk of civil and criminal liability
upon failure so to act.
SUBSTANDARD BUILDING is any residential building defined as sub-
standard by the adopted housing code of the jurisdiction.
U.C.B.C. GUIDELINES are the Uniform Code for Building Conserva-
tion Guidelines published in conjunction with this ccde. The build-
ing official may use the information contained in these guidelines to
assist in the application of the provisions of this code. (These
guidelines were developed as the Rehabilitation Guidelines published
by the U.S. Department of Housing and Urban Development.)"
Section 2. This ordinance shall be in full force and effect thirty
days after its passage, approval and publication'as provided by law and by
the City Charter.
