HomeMy WebLinkAbout1986-2953 CITY’S ENVIRONMENTAL POLICY & ENVIRONMENTAL IMPACT ORDINANCE NO. 29 5 3 AN ORDINANCE relating to public safety and morals; pertaining to the City's environmental policy; establishing exemptions from requirements pertaining to environmental impact; adopting documents by reference as part of the City's environmental policy; amending Section 6.88.070 and Subsection 6.88.160 (4) (c) of the City of Yakima Municipal Code; and declaring an emergency. WHEREAS, the City of Yakima and Yakima County recently enacted a Yakima Urban Area Zoning Ordinance which will become effective on April 7, 1986; and the City's Environmental Policy, Chapter 6.88 of the City of Yakima Municipal Code, must be amended as provided by this ordinance so that its references to the newly enacted zoning ordinance will be accurate; and the amendments provided by this ordinance must become effective simultaneously with the effective date of that zoning code to prevent inaccuracies in the codes and their administration; and the City Council hereby finds and declares an emergency to exist so that this ordinance shall become effective on April 7, 1986, without the lapse of the thirty day period required for non-emergency ordinances, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 6.88.070 of the City of Yakima Municipal Code is hereby amended to read as follows: "6.88.070 Flexible thresholds for categorical exemptions. (1) Effective April 7, 1986, the City establishes the following exempt levels for minor construction under WAC 197-11-800(1)(b) based on local conditions: (a) For residential dwelling units in WAC 197-11- 800(1)(b)(i): (i) 20 dwelling units in the R-2, R-3, B-1, B-2, SCC, LCC, CBD, and CBDS zoning districts. (ii) 4 dwelling units in all other zoning districts. (b) For agricultural structures in WAC 197-11-800 (1)(bl (i) 30,000 square feet in the SR, M-1 and M-2 zoning districts. (ii) 10,000 square feet in all other zoning 4110 (c) For office, school, commercial, recreational, service or storage buildings in WAC 197-11-800 (1)(b)(iii): (i) 8000 square feet and 40 parking spaces in the B-1 zoning district. (ii) 12,000 square feet and 40 parking spaces in the B-2, SCC, LCC, CBD, CBDS, M-1, and M-2 zoning districts. (iii) 4,000 square feet and 20 parking spaces in all other zoning districts. (d) For parking lots in WAC 197- 11- 800(1)(b)(iv): (i) 40 parking spaces in the R -3, B -1, B -2, SCC, LCC, CBD, CBDS, M -1 and M -2 zoning districts. (ii) 20 parking spaces in all other zoning districts. (e) For landfills and excavations in WAC 197-11 - 800(1)(b)(v): (i) 500 cubic yards in all zoning districts." Section 2. Subsection 6.88.160(4)(c) of the City of III Yakima Municipal Code is hereby amended to read as follows: "6.88.160 Substantive authority. (4)(c) Effective April 7, 1986, the City adopts by reference the policies in the following City codes, ordi- nances, resolutions, plans and other documents: Yakima Urban Area Comprehensive Plan, with amendments and supplements thereof; Zoning Code (Title 15 Yakima Municipal Code); WAC 173 -19 -4706 (Shoreline Management); Solid Waste Management Plan (Chapter 4.76 Yakima Municipal Code); Comprehensive Plan for the Domestic Water System of the City of Yakima; Litter Control (Chapter 6.86 Yakima Municipal Code); Agreement for Wastewater Treatment and Disposal Service (dated February 23, 1976) as amended; Urban Yakima Area Regional Planning Agreement (dated January 25, 1977), as amended; Yakima Urban Area Growth Policy; Annexation Policy; Outside Utility Service Policy (Resolution No. D- 1250, as amended); Greenway Park Development Plan; Flood Damage Prevention (Chapter 11.58 Yakima Municipal Code)." Section 3. The provisions of Section 6.88.070 and Subsection 6.88.160(4)(c) as they exist at the time of the enactment of this ordinance shall remain in full force and effect until April 7, 1986, at which time the amendments enacted by this ordinance shall become effective. Section 4. This ordinance is one to provide for the immediate preservation of the public peace, property, health, safety and welfare of the people of the City of Yakima and an emergency is hereby declared to exist and this ordinance shall be in full force and effect immediately upon its passage, approval and publication as provided by law and by the City Charter.
