HomeMy WebLinkAbout2002-016 New Construction Plan Review & Fire Inspections ORDINANCE NO. 2002 - 16 AN ORDINANCE relating to fire prevention, and to review of plans and inspection of new construction for compliance with the Fire Code, and adding a new section to Chapter 10.05 of the Yakima Municipal Code. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. NEW SECTION. A new section is added to chapter 10.05 of the Yakima Municipal Code to read as follows: 1 10.05.015 FIRE CODE PLAN REVIEW AND INSPECTION FEES 2 A. General. Fees as set forth in Table 10.05.015A shall be paid to the City for 3 review of building plans for compliance with chapter 10.05 YMC and for 4 inspection of construction for compliance with chapter 10.05 YMC. No 5 inspection fee shall be charged for annual inspection of existing buildings after a 6 certificate of occupancy has been issued. 7 B. Fees Required for Plan Review. For construction projects for which the 8 Fire Code requires submittal documents, the hourly plan review fee indicated in 9 Table 10.05.015A shall be charged for the time to perform the plan review. 10 The plan review fees required by this section are separate from the inspection 11 fees required by this section, and are in addition to any inspection fees. 12 When submittal documents are incomplete or are changed so as to require 13 additional plan review, additional plan review fees shall be charged at the rate 14 shown in Table 10.05.015A. 15 C. Fees Required for Inspection. For construction projects for which the 16 Fire Code requires inspection, the hourly inspection fee indicated in Table 17 10.05.015A shall be charged for the time to perform the inspection. 18 The inspection fees required by this section are separate from the plan review 19 fees required by this section, and are in addition to any plan review fees. Page 1 of 3 . t 20 D. Fees Required for Re- inspections. A fee shall be charged for re- 21 inspection for each inspection that must be made: (1) because work for which 22 inspection is called by the permitee is not complete and ready for inspection; 23 (2) when the inspection record card is not posted or otherwise available on the 24 work site; (3) when the approved plans are not readily available to the inspector; 25 (4) for failure to provide access on the date for which inspection is requested; or 26 (5) when corrections required by an inspector are not satisfactorily made when 27 the permitee calls for a follow -up inspection for corrections. No re- inspection fee 28 shall be incurred for verification of corrections when such corrections are 29 satisfactorily made. 30 To obtain a re- inspection, the permittee must pay the re- inspection fee stated in 31 Table 10.05.015A in advance. Table 10.05.015A Plan Review and Inspection Fees: 1. Plan review for compliance with Title 10.05 YMC and for changes, additions or revisions to approved plans (minimum charge — one hour) $47.00 per hr. 2. Normal Inspection (minimum charge — one hour) $ 47.00 per hr. 3. Re- inspection (minimum charge — one hour) $ 47.00 per hr. 4. Inspections for which no other fee is specifically indicated (minimum charge — one hour) $ 47.00 per hr. Section 2. Severability: If any section, subsection, paragraph, sentence, clause or phrase of this ordinance, or any provision of the Yakima Municipal Code established by this ordinance, is declared invalid or unconstitutional for any reason, such decision shall not affect the validity of the remaining portions of this ordinance, or other provisions of the Yakima Municipal Code established by this ordinance. Cook, Director of Community and Economic Development Department CONTACT PERSON/TELEPHONE: Doug Maples, Code Administration and Planning Manager (509) 575 -6121 SUMMARY EXPLANATION: The City of Yakima has never charged for fire inspection and plan review for new construction. Over the last several months the City Council has reviewed and deliberated the Policy Issue to charge for plan review and inspections relating to new construction projects. At the City Council Public Safety Committee Study Session on March 12, 2002, Council representatives directed staff to prepare legislation for the Code Administration and Planning Divisions Budget Policy Issue relating to new construction plan review and inspections. This ordinance would allow the Code Administration and Planning Division to charge a $47.00 hourly rate for plan review and inspections for new construction. Based on the 153 fire plan review for new construction projects that the Code Administration and Planning Division performed in 2001, it is estimated that $20,000 would be generated as a result of this ordinance change.
