HomeMy WebLinkAbout2002-003 Condemnation of Property (Buchanan Trust)/ Beech Street Lift Station ORDINANCE NO. 2002- 03 AN ORDINANCE authorizing and directing the City's outside legal counsel, Lyon Weigand & Gustafson PS, to institute and prosecute legal proceedings for the condemnation and acquisition of certain real property for the Waste Water Lift Station Upgrade at East Beech Street and Chalmers Street; providing for the condemnation and taking of such real property and declaring the condemnation and taking thereof to be necessary for a public use required by public interests; directing that compensation for such taking be paid from Fund Number 476, Waste Water Collection System Project Fund of the City of Yakima BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The law firm of Lyon Weigand & Gustafson PS is hereby authorized and directed to institute and prosecute actions in the Superior Court of the State of Washington, in and for Yakima County, for condemnation and acquisition of .certain real property which is described on Exhibit "A" attached hereto, for the Waste Water Lift Station Upgrade at East Beech Street and Chalmers Street, in the City of Yakima, Washington. Section 2. The acquisition of said real property for the purposes herein mentioned is required for the interests of the public .and .of the City of. Yakima, .and the uses and purposes herein mentioned do constitute a public use of said property, and said real property is necessary for the use and purposes mentioned herein. Section 3. The compensation for said real property to be taken shall be payable from Fund 476, Waste Water Collection System Project Fund of the City of Yakima. Section 4. This ordinance shall be in full force and effect thirty (30) days after its passage, approval and publication as provided by law and by the City Charter. EXHIBIT "A" Legal Description The South 45 feet of Lots 8 and 9 of "CHALMERS GARDEN TRACTS" adjacent to Yakima, according to the official plat thereof recorded in Volume "H" of Plats, page 25, records of Yakima County, Washington, Tying West of a line lying 25 feet Westerly, when measured at right angles, from the FB Center Line Survey of Primary State Highway No. 3, Yakima Avenue to Union Gap (Chalmers Street) and Northeasterly of a line which is 110 feet Northeasterly, when measured at right angles, from the "L" Center Line Survey of Primary State Highway No. 3, East Yakima Avenue to Union Gap (Interstate 82). Consideration for this property will be made payable from the #476 fund. Staffs recommendation is to authorize condemnation of this property. Assistant Wastewater Manager Re: Land Acquisition for Beech Street Lift Station Upgrade Enclosed with this memorandum are documents concerning a proposed land acquisition for the enhancement and upgrade of the existing Beech Street Lift Station. Three factors are driving this upgrade: excessive lift station maintenance demands. difficulties in lift station part procurement. and growth in the area outstripping station design capacity. Currently, the lift station sits upon a parcel of land that allowed adequate space and access in 1983 when the station was installed. Today. this is no longer the case as modern electrical panels make the plot of inadequate size. As can be seen from the schematic. the acquisition of land (shaded area will allow the City to modernize and address future space concerns around the station. An in -house assessment of land required for the future was determined and a survey and land appraisal (see enclosed) took place for the shaded area. We have offered the Landholder (Buchanan Trust. LLC) 56.500 for land extending away from the original easement. The total area is 1.749 square feet. We have not received a response from this entity as of vet. but expect to do so in the very near future. We are requesting authority and approval of this land acquisition and cost not exceed 10 over the high -end appraisal (Total $7.500). The funding source will be allocated from the Wastewater Collection System Project Fund. 476. City Project #1962. Please consider granting your approval to this needed request. The purpose of this appraisal was to establish a sale /purchase price for your property at Beech and Chalmers. The appraisal was based upon the assumption we were to purchase only twenty feet north of the existing easement (approximately 1,103 sq ft). The price shown on the appraisal represents a range of $3.50 to $3.90 per square foot. We have reconsidered, and wish to purchase thirty (30) feet north of the existing easement (a total of 45.02 feet). Based upon scaled drawings, and including the area for which we already have an easement, this equals approximately 1,749 square feet. We hereby offer $3.70 X 1,749 = $6,471.30. Call it $6.500 for the property indicated as area A, B, and C on Attachment A. This should be the Southern 45.02 feet of Lot 8 and Lot 9. We will do any necessary fence relocation in conjunction with discussions with Central Pre -Mix. As we discussed, if this is acceptable, I will prepare the required documents for City Council. Their approval is required for completion of this transaction.
