ORDINANCE NO. 2002- 09
AN ORDINANCE concerning land use and zoning, rezoning three parcels
(approximately 1.17 acres) addressed 1510 -1526 South 18th
Street from Two-Family Residential (R -2) to Central Business
District Support (CBDS), and amending the Official Yakima
Urban Area Zoning Map accordingly.
WHEREAS, by application dated August 27, 2001, Paul John Koverman on behalf of
Robert W. Elder, the Owner, requested rezone from Two-Family Residential (R -2) to
Central Business District Support (CBDS) and amendment of the Official Yakima
Urban Area Zoning Map of three parcels (approximately 1.17 acres) addressed 1510-
1526 South 18th Street (Yakima County Assessor's Parcel #191329 - 31566, 31569, and
31570), referred to as "Subject Property "; and
WHEREAS, on December 13, 2001, the City of Yakima Hearing Examiner conducted
a duly convened, open- record public hearing regarding the requested rezone (UAZO
RZ #7 -01) and after considering the record issued his Examiner's Recommendation,
Examiner No. IU01 -2 -29, dated December 27, 2001; and
WHEREAS, the Hearing Examiner recommended that, subject to certain conditions
stated on page 4 of the Hearing Examiner's Recommendation, the Subject Property
should be rezoned from Two - Family Residential (R -2) to Central Business District
Support (CBDS); and
WHEREAS, at a closed- record public hearing on February 5, 2002, the City Council
duly considered the requested rezone, including the documents and other evidence
which comprise the record developed before the Hearing Examiner, the Hearing
Examiner's Recommendation, and the statements of interested persons; and
WHEREAS, after considering the Hearing Examiner's Recommendation, the contents
of the file, and the statements of interested persons, the City Council finds with
respect to the requested rezone, and subject to the conditions provided herein and on
page 4 of the Hearing Examiner's Recommendation, that
1. The Subject Property is suitable to be classified Central Business District Support
(CBDS);
2. There exists a public need for the requested rezone;
3. Circumstances have changed since the existing Two - Family Residential (R -2)
zoning was established which now make the requested rezone appropriate; and
4. The requested rezone is consistent with and complies with:
a. The requirements and considerations set forth in chapter 15.23 of the Yakima
Municipal Code;
b. The goals and policies of the Yakima Urban Area Comprehensive Plan;

c. The intent of the Yakima Urban Area Zoning Ordinance;
d. Other applicable land use controls; and
WHEREAS, it is in the best interests of the City to adopt the Hearing Examiner's
findings and conclusions and recommendation to approve the requested rezone;
now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Hearing Examiner's Recommendation Including Conditions Affirmed:
Subject to the specific terms of this ordinance, the Yakima City Council adopts the
findings, conclusions and recommendations of the Hearing Examiner's
Recommendation, Examiner No. IU01 -2 -29, dated December 27, 2001, and
incorporates that Hearing Examiner's Recommendation by reference as part of this
Ordinance. Subject to the specific terms of this ordinance, the conditions stated on
page 4 of the Hearing Examiner's Recommendation shall govern the rezone granted
by this ordinance.
Section 2. Subject Property: Regarding the Subject Property, which is legally
described as:
Lots 5, 6, 7, 8, 9 & 10 of Block 1, FAIRVIEW ADDITION No.2, Recorded in
Book 1 of Plats Page 44, Yakima County, Washington. -•
Assessor's Parcel #191329 - 31566, 31569, and 31570
and subject to conditions stated below, the City Council finds formally that
1. The Subject Property is suitable to be classified Central Business District Support
(CBDS);
2. There exists a public need for the requested rezone;
3. Circumstances have changed since the existing Two - Family Residential (R -2)
zoning was established which now make the requested rezone appropriate; and
4. The requested rezone is consistent with and complies with:
a. The requirements and considerations set forth in Chapter 15.23 Yakima
Municipal Code;
b. The goals and policies of the Yakima Urban Area Comprehensive Plan;
c. The intent of the Yakima Urban Area Zoning Ordinance; and
d. Other applicable land use controls.
Section 3. Amendment of Official Yakima Urban Area Zoning Map: The Official
Yakima Urban Area Zoning Map shall be amended, subject to conditions precedent

stated in this ordinance, to rezone the Subject Property from Two-Family Residential
(R -2) to Central Business District Support (CBDS).
Section 4. Conditions Precedent: The rezone granted by this ordinance is expressly
conditioned on the Owner's satisfaction of conditions 1 -2 stated on page 4 of the
Hearing Examiner's Recommendation:
1. An additional 15 feet of right of way along the frontage of East Viola
Avenue shall be deeded to the City.
2. An additional 10 feet of right of way along the frontage of South 18th
Street shall be deeded to the City.
Section 5. The City Clerk is hereby authorized and directed to file a certified copy
of this ordinance with the Yakima County Auditor.
Section 6. This ordinance shall be in full force and effect 30 days after its passage,
approval, and publication as provided by law and by the City Charter, and this
action shall be final and conclusive unless within 21 days from the date this
ordinance is passed= by the City Council an aggrieved party commences proceedings
for review pursuant to the provisions of Chapter 36.70C RCW.
PASSED BY THE CITY COUNCIL at a regular meeting and signed and approved
this 19th day of February, 2002.

SUMMARY EXPLANATION:
On February 5, 2002 the City Council conducted a "Closed Record" hearing to consider
the Hearing Examiner's recommendation to approve the rezone request by Paul
Koverman on behalf of Robert Elder, property owner to rezone three parcels from R -2,
Two - Family Residential to CBDS, Central Business District Support. The rezone is
located in the vicinity of 1510, 1518, & 1526 South 18 Street, Yakima.
The Council voted unanimously to uphold the Hearing Examiner's recommendation to
approve the rezone.

The Examiner conducted a public hearing on December 13, 2001.
The staff report presented by Senior Planner Dan Valoff
recommended approval. Property owner Robert Elder attended,
together with Paul Koverman who hopes to operate an espresso stand
on the corner lot. There was no opposition. The Examiner
inspected the property prior to the hearing.
SUMMARY OF RECOMMENDATION. The Examiner recommends approval.
From the view of the site, the matters contained in the
of ficial record, including the staff report, a review of both the
Yakima Urban Area Comprehensive Plan and the Yakima Urban Area
Zoning Ordinance, and from evidence received at the hearing, the
Examiner makes the following:
FINDINGS
1. Applicant. Mr. Paul Koverman, on behalf of Robert
Elder, property owner, 1002 South 21 Avenue, Yakima, WA 98902,
2. Location. Vicinity of 1510 -1526 South 18 Street, at
the northwest corner of South 18t Street and East Viola Avenue.
Assessor's parcel numbers: 191329- 31570, 31566, and 31569.
3. Application. Rezone.
4. Proposed Zone. Rezone three parcels from R -2, Two

lot, at 18t and Viola, may be used as an espresso stand.
6. Current Zoning and Use. The site is currently zoned R-
2 Two- Family Residential. The site currently is vacant.

7. Proiect Description. The rezone will initially
facilitate the construction of a drive thru espresso stand. The
remaining property will be reserved for future commercial
development.

use map during the annual Comprehensive Plan amendment process
from Medium Density Residential to Neighborhood Commercial. The
Regional Planning Commission, Joint Board, and the Joint City
Council and County Commissioner's approved the amendment to
Neighborhood Commercial.
8. Yakima Urban Area Zoning Ordinance. The criteria for
rezones established by YCC 15A.23.030.5 are considered below:
8.1 Testimony. All testimony supported the project.
8.2 Suitability of the Property. The requested zoning
change is suitable with the property in question because the
property is served with all urban services and located along a
collector arterial street. The property is now designated
Neighborhood Commercial by the Urban Area Comprehensive Plan and
is located in a mixed -use area of the city.
8.3 Agency Recommendations. All agencies and city
departments indicate that public services are available to the
site and this rezone would not create any difficulties for
infrastructure.

8.4 Compliance with Comprehensive Plan and Zoning
Ordinance. The Comprehensive Plan's Future Land use Map
designates this property as neighborhood commercial. This rezone
is consistent with the plan.
This portion of 18 Street is in transition. Rezoning
this to CBDS will be consistent with the zoning district
definition and reflects the probable future trend for 18
Street.
8.5 Adequacy of Public Facilities. This property is
currently served by all necessary public utilities. Street
access is from. South 18 Street, which is classified as a
Collector Arterial at this location.
8.6 Compatibility of Proposed Use. There is
absolutely no opposition to this proposal, which is a significant
indicator of apparent compatibility.
8.7 Public Need. The project as proposed will
provided a small -scale mixed -use commercial /professional
development within the neighborhood in which it is intended to
serve. One of the changes of circumstance which has occurred is
the redesignation of this property under the comprehensive plan.
9. State Environmental Policy Act. A Determination of
Non- significance was issued on December 7, 2001 and is now final.
10. Public Notice. Public notice of the hearing was
provided in accordance with the ordinance.
From the foregoing Findings, the Examiner makes the
following:
CONCLUSIONS
1. The Examiner has jurisdiction.
2. The proposed rezone conforms to the goals and policies
of the Yakima Urban Area Comprehensive Plan and to the intent of

the Yakima Urban Area Zoning Ordinance; the property is suitable
for uses permitted in the CBDS District; there are no problems
with neighborhood compatibility; and a public need does exist for
the proposed change.
3. All notice provisions of the ordinance have been
complied with.
Based upon the foregoing Findings and Conclusions, the
Examiner submits to the Yakima City Council the following:
RECOMMENDATION
Approve this rezone application, from R -2 to CBDS, subject to
the following conditions, which are required in order to comply
with Title 12 of the Municipal Code, and are not opposed by the
applicant:
1. An additional 15 feet of right of way along the frontage
of East Viola Avenue must be deeded to the City as part of this
rezone.
2. An additional 10 feet of right of way along the frontage
of South 18 Street must be deeded to the City as part of this
rezone.

Mr. Paul Koverman representing Robert Elder, property owner has submitted a rezone
application for three parcels from R -2, Two - Family Residential to CBDS, Central Busi-
ness District Support in the vicinity of 1510 -1526 South 18' Street, the northwest corner
of South 18` Street and East Viola Avenue. The rezone will initially facilitate the con-
struction of a drive thru espresso stand. The remaining property will be reserved for fu-
ture commercial development.
In 2001, the applicant requested a change to the future land use map during the annual
Comprehensive Plan amendment process from Medium Density Residential to
Neighborhood Commercial. The Regional Planning Commission, Joint Board, and the
Joint City Council and County Commissioner's approved the amendment to Neighbor-
hood Commercial.
1997 Yakima Urban Area Comprehensive Plan
The applicant requested a change in the future land use map during the Year 2001
Comp Plan amendment process from Medium Residential to Neighborhood Commer-
cial. The Regional Planning Commission, Joint Board, and the Joint City Council and
County Commissioner's approved the amendment to Neighborhood Commercial.
This rezone is compatible with the following Policies and Objectives of the 1997 Com-
prehensive:
• The 1997 Yakima Urban Area Comprehensive Plan, Future Land Use Map desig-
nates this area as being suitable for neighborhood commercial development. The
Future Land Use to Zoning Map Consistency chart provides a guide to the compati-
bility of land use designations and the zoning districts. The Chart indicates that the
Neighborhood Commercial designation is compatible with the CBDS zoning district.
• Objective G1.1: Encourage the physical development of the Yakima Urban Area in
a manner that enhances its image as the cultural and business center. (1997 Plan)

• Objective G2: Balance individual private property rights with the planning and regu-
latory scheme established for managing growth.
• Policy G2.1 - Strive for an efficient and predictable development process that pro-
vides for ample public discussion of proposals for development.
• Policy G4.2 - New urban development should be encouraged to be contiguous to
existing development to avoid the inefficient "leap - frog" pattern of growth.
Yakima Urban Area Zoning Ordinance
The stated purpose of the CBDS zoning district is to accommodate wholesale and retail
activities with some high- density residential development. This district is primarily lo-
cated near the central business district and along the major arterials leading to the cen-
tral business district. Like the CBD district, a variety of land uses are permitted. How-
ever, the intensity of development is intended to be less than in the CBD district. Citi-
zen preference will be determined by the comments received from surrounding property
owners and by comments made at the public hearing.
Ch. 15.23.030 Rezone criteria
Recommendations for approval of rezone applications are governed by seven criteria
specified in Section 15.23.030 YMC.
1. Testimony at public hearing.
To be considered by the Hearing Examiner.
2. Suitability of property for proposed use.
The requested zoning change is suitable with the property in question because
the property is served with all urban services and located along a collector arte-
rial street. The property is now designated Neighborhood Commercial by the
Urban Area Comprehensive Plan and is located in a mixed -use area of the city.
3. Recommendations from interested agencies.
All agencies and city departments indicate that public services are available to
the site and this rezone would not create any difficulties for infrastructure.
4. Compliance with the Comprehensive Plan.
The Comprehensive Plan's future land use map designates this property as
Neighborhood Commercial. The Yakima Urban Area Comprehensive Plan sets
out certain Goals, Objectives and Policies to help direct growth and change. The
proposal is in compliance with the Goals, Objectives and Policies of the Com-
prehensive Plan.

5. Adequacy of public utilities.
This property is currently served by all necessary public utilities. Street access is
from South 18'" Street which is classified as a Collector Arterial at this location.
6. Compatibility of proposed use.
Testimony at the hearing should be considered in determining whether this pro-
posal is compatible with the surrounding land uses.
7. Public Need
The project as proposed will provided a small -scale mixed -use commer-
cial /professional development within the neighborhood in which it is intended to
serve.
Development Services Team comments
A design services team meeting was held on September 18, 2001 discuss the technical
aspects of this proposal. The following is a summary of the comments received:
Engineering — This proposal fronts on East Viola Avenue and on South 18` Street. Our
Development Standards classify both streets as Collector Arterial. This classification
requires 80 feet of right of way, 40 feet on each side of centerline. The existing right of
way in East Viola is 50 feet, 25 feet on each side of center line. To be in compliance
with our Development Standards, an additional 15 feet of right of way must be deeded
to the City as part of this rezone. The existing right of way in South 18` Street is 60
feet, 30 feet on each side of centerline. To be in compliance with our Development
Standards, an additional 10 feet of right of way must be deeded to the City to be in
compliance with our Development Standards. Existing frontage improvements will be
evaluated in compliance with our Development Standards at the time of the building
permit application.
Codes — Title 12 Development Standards requirements shall be met. Additional right of
way that is required also requires the clear view be measured 100 feet from centerline
in both directions from center of right of way. Obtain necessary building permits. Drive
thru espresso stand could be required to meet ADA regulations. Will be required to es-
tablish restroom facilities for workers. Headlights of Vehicles will be considered if near
residential area.
Water /Irrigation —An 8 -inch water main is located in South 18` Street and a 6 -inch main
in East Viola Avenue. Fire hydrant located in Birch and South 18 Street. 2500 gpm
available fire flow at this location.

Transportation Capacity Management Ordinance
This project is exempt from review under the Transportation Capacity Management Or-
dinance.
State Environmental Policy Act
A Determination of Nonsignificance (DNS) was issued by the City of Yakima on De-
cember 7, 2001. This determination was based on SEPA guidelines (WAC 197 -11-
355). There were no comments received on the environmental review of this rezone
proposal during the 20 -day comment period.
Public Notice
Notice for the hearing was provided in accordance with the UAZO requirements in the
following manner:
Mailing of notices to adjacent owners November 16, 2001
Posting of property November 21, 2001
Legal Ad published November 21, 2001
Conclusions
The Division of Environmental Planning for the City of Yakima, Washington has re-
viewed this rezone request and offers the following findings:
1. The requested zoning change is suitable with the property in question because the
property is served with all urban services and located along a collector arterial street.
The property is now designated Neighborhood Commercial by the Urban Area Com-
prehensive Plan and is located in a mixed -use area of the city.
2. The project as proposed will provided a small -scale mixed -use commer-
cial /professional development within the neighborhood in which it is intended to serve.
3. Recent development on the east side of Yakima lends the current zoning as being
compatible. The expansion of the Valley Mall and the construction of the new Home
Depot have increase traffic along South 18` Street which is becoming a major transpor-
tation route to these east side developments
4. This rezone from R -2 to CBDS is compatible with surrounding residential /commercial
neighborhood. Testimony at the hearing should be considered in determining whether
this proposal is compatible with the surrounding land uses.
5. The proposed rezone is consistent with the future land use map designation of
Neighborhood Commercial.

6. All agencies and city departments indicate that public services are available to the
site and this rezone would not create any difficulties for infrastructure. Adequate public
services are in place and meeting the utility and access requirements of the CBDS zon-
ing district.
7. All public notice requirements of YMC Chapters 15 and 16 have been completed.
Recommendation
The Division of Environmental Planning recommends that this rezone from R -2 to
CBDS be approved subject to the following suggested condtions:
1. An additional 15 feet of right of way along the frontage of East Viola Avenue must be
deeded to the City as part of this rezone.
2. An additional 10 feet of right of way along the frontage of South 18 Street must be
deeded to the City as part of this rezone.

NOTICE OF PROPOSAL
On August 27, 2001 the City of Yakima Department of Community & Economic
Development received a rezone application from Mr. Paul Koverman on behalf of Mr.
Robert Elder to rezone three parcels located in the vicinity 1510 — 1526 South 18`
Street Assessor's parcel numbers 191329-31570, 31566 & 31569, from R -2, Two -
Family Residential to CBDS, Central Business District Support. This application is
subject to approval. The application was considered complete for processing on
September 19, 2001. The complete application is available for public review at the City
of Yakima Planning Division, 2nd floor City Hall, 129 North 2nd Street, Yakima,
Washington.
ENVIRONMENTAL REVIEW
The City of Yakima Department of Community & Economic Development is lead agency
for this proposal under the State Environmental Policy Act (SEPA). The environmental
checklist and other information on file with the Planning Division are available to the
public upon request. Written comments concerning the environmental impacts for the
proposal will be accepted during the 20 -day comment period which ends December 6,
2001. The threshold environmental determination will be issued under WAC 197 -11-
355, the Optional review process; there will not be an additional comment period. The
threshold determination may be appealed to the Hearing Examiner by filing a written
notice of appeal with the City Planning Division within five days of the date of mailing of
the threshold determination in accordance with the City of Yakima Municipal Code
6.88.170.

An open record public hearing will be held before the Hearing Examiner on Thursday

1. There would be two sources of water coming from the development of this property. One would
be the run off from rain. This will be handled either through a dry sump retention and dispersal
system or dispersed into landscaping on the site which ever recommendation is made. Second
would be the water used within the business which would be minimal and would be dispersed by
city sewer system. Being that the business would not use any chemicals in operation or burning
of materials emissions into the air would be negligible. The business not being any type of
manufacturing or a business operated in the open air which could emit sound it will not have any
production of noise.
2. There will be plants for landscaping which will be specifically chosen for the site. These will be
added since there is no vegetation on the property at this time and will be maintained. Animals
would only be neighborhood pets and not a factor. The property is located within the city and
not adjacent to and stream, river, lake or shoreline.
3. The business will use electrical power to operate the few electrical appliances needed
for the business. Also water for the landscaping, brewing coffee, cleaning, and the
lavatory. For the minimal landscaping grass and plants will be watered at night by timer to
reduce evaporation. The structure will be built with latest technology. For prevention of heat
loss in winter and efficient cooling in summer care will be taken to use quality materials with high
insulation qualities.
4. The property is located in a mixed area of land use having tight industrial across the street.
Central Business District Support to the north. And residential behind and to the south.
Unfortunately there are no parks in the vicinity. Being located on an established street within
the city, and not being rural, it will not impact any areas listed in question 4.
5. This area of Eighteenth Street through evolution by growth has become a high density traffic
area. There is noise from passing vehicles and the turning of commercial trucks on Viola that
illegally use their compression brakes to slow themselves in route to the truck stop in Union Gap.
The neighborhood has become less desirable for residential dwelling The change from
residential to commercial types of properties will be a natural progression for this area. No
shoreline is applicable.
6. All utility services are available at the site. Being the nature and type of business, the size it will
have a minimal impact on utilities for reasons also stated above. There is public transportation
by public busses along Viola. It is my understanding that the bus system is operating at
capacities which will allow for future use without expanding
7. With research completed at this time there are no conflicts with federal, state, or local laws.
As the project progresses it is our desire to strict adherence of all laws and codes that will be

Notice is hereby given that the City of Yakima, Planning Division is processing a rezone
request submitted by Mr. Paul Koverman. The applicant is proposing to rezone 3 parcels
from R -2, (Two Family Residential) to CBDS, (Central Business District Support). The
subject property is located in the vicinity of the Northwest corner of South 18 Street and
East Viola Avenue, Yakima, Washington.
This action requires that a public hearing be held by the Hearing Examiner. The Hearing
Examiner will then issue a recommendation to the Yakima City Council. The public hearing
