AN ORDINANCE relating to traffic; prohibiting parking on the east side of
South 3 Street and the north side of East Chestnut Street
adjacent to the Federal Court House, and prohibiting parking
on both sides of East Walnut Street from South 1 Street to
a point one hundred sixty feet east of South 3 Street; and
amending Sections 9.48.565, 9.50.050 and 9.50.060 of the
City of Yakima Municipal Code.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Section 9.50.050 of the City of Yakima Municipal Code is
hereby amended to read as follows:
"9.50.050 Parking prohibited at all times on certain streets.
When signs are erected giving notice thereof, no person shall park a
vehicle at any time upon any of the following streets:
(1) Both sides of 3rd Street from its intersection with Arlington Street north to its
intersection with South 2nd Street and the west side of South 3rd Street from the
intersection of South 2nd Street northerly to the intersection of Pacific Avenue;
(2) The east side of 1st Street from Sycamore Street to Tamarack Street and
from Lincoln to "I" Street; and the west side of 1st Street from Tamarack
Street to a point two hundred fifty feet south of "I" Street, and from Race Street
south to Pacific; and both sides of 1st Street from Tamarack Street to Interstate
82; and from Pacific Street to the south city limits except on the west side from a
point three hundred feet south of Arlington to a point five hundred feet south of
Arlington;
(3) The east side of 3rd Avenue from a point seven hundred fourteen feet north
of Division Street south to a point three hundred seventy -three feet north of
Prasch Avenue, and from King Street to Washington Avenue; and the west side
of 3rd Avenue from a point six hundred ninety -two feet north of Division Street
south to the south city limits;
(4) Both sides of 5th Avenue from "B" Street to Lincoln Avenue and the east side
of 5th Avenue from Walnut Street south to a point three hundred feet south of
Spruce Street, and from Pine Street to Queen Anne Boulevard; and the west side
of 5th Avenue from Walnut Street to a point two hundred thirty feet south of
Tieton Drive, and from Division Street to Nob Hill Boulevard; and the east side of
5th Avenue from one hundred feet north of Fruitvale Boulevard to Quince Street,
and from a point two hundred ninety feet north of West "D" Street to a point one
hundred twenty feet south of Cherry Avenue;
(5) The east side of 7th Avenue from Yakima Avenue to Chestnut Avenue, and
from Pine Street to Tieton Drive;
(6) Both sides of 11th Avenue from Walnut Street to Spruce Street and the west
side of 11th Avenue from Tieton Drive north to the Yakima Valley Transportation

Company railroad tracks and the east side of 11th 'Avenue between Walnut
Avenue and Yakima Avenue;
(7) Both sides of 16th Avenue within the city limits except the east side from
twenty feet south of Nob Hill Boulevard to three hundred twenty feet south
thereof;
(8) The east side of 24th Avenue from Nob Hill Boulevard to Viola Avenue, and
from a point one hundred fifty feet south of Logan Avenue to Washington
Avenue; and the west side of 24th Avenue from Nob Hill Boulevard to a point one
hundred feet south of Clinton Way, and from a point twelve hundred feet north of
Washington Avenue to Washington Avenue;
(9) Both sides of "I" Street from 1st Street to 5th Avenue;
(10) Both sides of "F" Street from 8th Street one -half block east to alley;
(11) Both sides of Lincoln Avenue from 4th Street to 1st Street, and from 10th
Street to 8th Street, and from 5th Avenue to 40th Avenue, and from 24th Avenue
to 40th Avenue; and north side of Lincoln Avenue from 44th Avenue to 46th
Avenue; and the south side of Lincoln Avenue from 16th Avenue to 24th Avenue
and from 46th Avenue to Bitterroot Way;
(12) Both sides of "B" Street from 4th Street to Naches Avenue and from 8th
Street to 10th Street; the north side of "B" Street from Naches Avenue to 8th
Street; and both sides of "B" Street from Pierce Avenue to 6th Avenue;
(13) The north side of "A" Street from 16th Avenue to Hall Avenue, and from 4th
Street to the alley one -half block west thereof; and the south side of "A" Street
from Naches Avenue to 3rd Street;
(14) The north side of Summitview Avenue from 7th Avenue to Pierce Avenue,
and from a point two hundred eighty feet west of the west curb of Pierce Avenue
to a point one hundred eighty feet west of Custer Avenue, and from forty feet
west of 15th Avenue to 31st Avenue, and from 32nd Avenue to the west city
limits; and the south side of Summitview Avenue from 7th Avenue to 33rd
Avenue, and from three hundred eighty feet east of 39th Avenue to the west city
limits;
(15) Both sides of Yakima Avenue from 8th Street to 9th Street, and from Front
Street west to the railroad tracks, and from Chicago Avenue to 22nd Avenue; and
the south side of Yakima Avenue from 1st Street to a point one hundred fifty feet
east of 1st Street, and from 12th Avenue to Chicago Avenue;
(16) Both sides of Chestnut Avenue from 12th Avenue to 15th Avenue, and from
16th Avenue to 20th Avenue; and the south side of Chestnut Avenue from 6th
Avenue to 12th Avenue (except for indented angle parking located between 10th
Avenue and the loading zone opposite South 9th Avenue), and except that
parking on both sides of Chestnut will be allowed on Sundays between 6th and
9th Avenues and between 11th and 12th Avenues from six a.m. to one p.m. and
from 20th Avenue to Stanley Boulevard;
(17) The east side of Stanley Boulevard from Chestnut Avenue to 23rd Avenue;
and the west side of Stanley Boulevard from Laban Avenue to a point six
hundred ten feet south;
(18) Both sides of Walnut Street from the alley east of 1st Street to 3rd Avenue,
and from 6th Avenue to 11th Avenue; and the north side of Walnut Street from

6th Street to Naches Avenue and from 3rd Avenue to the alley west of 4th
Avenue, and the south side of Walnut Street from the alley east of 4th Avenue to

(20) Both sides of Tieton Drive from 5th Avenue to the west city limits except the
north side from 8th Avenue to 9th Avenue;
(21) Both sides of Nob Hill Boulevard from the east city limits to the west city
limits;
(22) Both sides of Mead Avenue from 10th Street to Voelker Avenue and from
1st Avenue to 2nd Avenue; and the north side of Mead Avenue from Voelker
Avenue to 1st Avenue, and from 2nd Avenue to 3rd Avenue;
(23) Both sides of Washington Avenue from a point four hundred feet east of 1st
Street to 3rd Avenue; and both sides of Washington Avenue from 16th Avenue to
Spring Creek Road;
(24) The east side of 7th Street from "G" Street to "H" Street;
(25) The east side of Pierce Avenue from Summitview Avenue to West Lincoln
Avenue; and the west side of Pierce Avenue from Lincoln Avenue to Folsom
Avenue;

feet north of Tieton Drive and the west side of Tieton Drive to a point two

(47) Both sides of 6th Street from its intersection with Nob Hill Boulevard to two
hundred seventy feet north of Nob Hill Boulevard;
(48) Both sides of Fair Avenue between North 10th Street and Pacific Avenue;
(49) Both sides of 18th Street between Nob Hill Boulevard and Pacific Avenue;
(50) Both sides of Pacific Avenue between 18th Street and Fair Avenue;
(51) The north side of Pacific Avenue between Fair Avenue and 9th Street;

(55) The east side of South 3rd Street from the northeast corner of East Chestnut

the north side of East Chestnut Street from the northeast corner of South 3rd
Street to a point two hundred feet east of the northeast corner of South 3rd Street;
(56) Both sides of East Walnut Street from South 1st Street to a point one
hundred sixty feet east of South 3rd Street."
Section 2. Section 9.50.060 of the City of Yakima Municipal Code is
hereby amended to read as follows:
"9.50.060 Parking prohibited during certain hours on certain streets.
A. When signs are erected in each block giving notice thereof, no person
shall park a vehicle between the hours specified herein on any day except
Sundays and public holidays within the district or upon any of the streets
described herein:
1. Between three a.m. and five a.m.:
(1) Both sides of Naches Avenue from Chestnut Avenue to "B" Street;
(2) Both sides of 4th Street from "A" Street to Lincoln Avenue and from Yakima
Avenue to Chestnut Avenue;
(3) Both sides of 3rd Street from Walnut Street to Lincoln Avenue;
(4) Both sides of 2nd Street from Spruce Street to Lincoln Avenue;
(5) Both sides of 1st Street from Spruce Street to Lincoln Avenue;
(6) Both sides of Front Street from Chestnut Avenue to "B" Street;
(7) Both sides of "B" Street from Front Street to Naches Avenue;
(8) Both sides of "A" Street from Front Street to a point east of 3rd Street;

(9) North side of "A" Street from 4th Street to Naches Avenue;
(10) Both sides of "A" Street from Naches Avenue to 6th Street;

B. When signs are erected in each block giving notice thereof, no person
shall park a vehicle between the hours specified herein on any day, with the
exception of authorized parking in designated parking places reserved for
physically disabled persons, or parking of vehicles displaying the special card,
decal or special license plate issued by the Department of Licensing to persons
with special parking privileges as provided by Chapter 154, Laws of Washington,
1984, within the district or upon any of the streets described herein:
1. Between nine p.m. and six a.m. of the following day:
(1) Both sides of Yakima Avenue between Front Street and 1st Avenue;
(2) Both sides of Yakima Avenue between 3rd Avenue and 4th Avenue;
(3) Both sides of Yakima Avenue between 6th Avenue and 7th Avenue;
(4) Both sides of Yakima Avenue between 7th Avenue and 8th Avenue;
(5) Both sides of Yakima Avenue between 8th Avenue and 9th Avenue;
(6) Both sides of Yakima Avenue between 9th Avenue and 10th Avenue;
(7) Both sides of South 1st Avenue between Yakima Avenue and Walnut Street;
(8) Both sides of North 1st Avenue between Yakima Avenue and West "B"
Street;
(9) West side of North 2nd Avenue between Yakima Avenue and West "A"
Street;
(10) Both sides of North 3rd Avenue between Yakima Avenue and West "A"
Street;
(11) West side of South 4th Avenue between Yakima Avenue and the first east -
west alley;

2. Between two a.m. and six a.m.:
(1) Both sides of Yakima Avenue between North 1st Avenue and North 2nd
Avenue;
(2) Both sides of Yakima Avenue between North 4th Avenue and North 5th
Avenue;
(3) Both sides of South 2nd Avenue between Yakima Avenue and Chestnut
Avenue;
(4) Both sides of South 3rd Avenue between Yakima Avenue and Chestnut
Avenue.
C. When signs are erected in each block giving notice thereof, no person
shall park an unauthorized vehicle on either side of Third Street between
Chestnut and Yakima Avenues on all Sundays during the months of June
through October, inclusive, from three a.m. until four p.m. excepting that portion
of the east side of Third Street north of Chestnut as specified in YMC 9.50.050
155) wherein parking shall be prohibited at all times. For the purposes of this
subsection, "unauthorized vehicle" includes any privately -owned vehicle which
has not been authorized by the Yakima Farmer's Market Association to be
present that day for purposes of the Yakima Farmer's Market."
Section 3. Section 9.48.565 of the City of Yakima Municipal Code is
hereby amended to read as follows:
"9.48.565 Vehicle impoundment without prior notice.
A. A police officer may impound a vehicle without giving prior notice to its
owner under the following circumstances:
1. When a vehicle is impeding the flow of traffic or entry or exit into any driveway,
including access to city of Yakima property; or
2. When a vehicle poses an immediate danger to public safety including but not
limited to danger arising from mechanical defect(s); or
3. When a police officer has probable cause to believe that the vehicle is stolen;
or
4. When a /law enforcement officer has contact with a vehicle operator on public
property or highway for purposes of arrest, placement into custody, investigatory

stop, accident scene investigation, or voluntary contact by the operator, and the
officer observes that the operator is physically or mentally incapable of deciding
or refuses to decide upon steps to be taken to protect the vehicle and its
contents; or
5. When a vehicle is left unattended on a highway and it's impeding construction,
maintenance or repair of the highway, in violation of a temporary sign or
barricade prohibiting parking on or entry into the highway, or a portion thereof,
when the sign or barricade has been placed under the direction of the city of
Yakima director of public works, or his designee, to facilitate construction, repair
or maintenance of the public highway and when the sign or barricade notifies that
vehicles parked or left unattended in violation thereof are subject to impound by
inclusion of the words "subject to impound," "tow away zone," or words of similar
import; or
6. When a vehicle is left unattended in violation of Section 9.50.060 of this code
and the vehicle is impeding street cleaning; or
7. When a vehicle is left unattended in a marked loading zone posted with a sign
notifying that vehicles parked in violation thereof are subject to impound by the
inclusion on the sign of the words "subject to impound," "tow away zone," or
words of similar import; or
8. When a vehicle must be removed from a fire zone established in Section
9.50.240 of the City of Yakima Municipal Code, as determined by a commanding
officer; or
9. Whenever a vehicle without a special license plate, card, or decal indicating
that the vehicle is being used to transport a disabled person under RCW -
46.16.381 is parked in a stall or space clearly and conspicuously marked under
RCW 46.61.581 which space is provided on private property without charge or on
public property; or
10. Whenever the driver of a vehicle is arrested for a violation of RCW 46.61.502
or 46.61.504 or of RCW 46.20.342 or 46.20.420; or
11. Whenever a police officer finds a vehicle standing upon the roadway in
violation of any of the provisions of RCW 46.61.560, the officer may provide for
the removal of vehicle or may require the driver or other person in charge of the
vehicle to move the vehicle to a position of safety off the roadway; or
12. Whenever the officer finds a vehicle unattended upon a highway where the
vehicle jeopardizes public safety; or
13. Whenever a police officer finds a vehicle unattended at the scene of an
accident; or
14. Whenever the driver of a vehicle is arrested and taken into custody by a
police officer; or
15. Upon determining that a person is operating a motor vehicle without a valid
driver's license in violation of RCW 46.20.005 or with a license that has been
expired for ninety days or more;
16. Whenever a police officer finds an unauthorized vehicle parked in violation of
YMC 9.50.060(C) and / or YMC 9.50.050 (55), provided the location is posted
with a sign notifying that vehicles parked during the dates and times specified

therein are subject to immediate impound by the inclusion on the sign of the
words "subject to impound," "tow away zone," or words of similar import.
Nothing in this section may derogate from the powers of police officers under the
common law."
Section 4. This ordinance shall be in full force and effect 30 days after
its passage, approval, and publication as provided by law and by the City
Charter.

ITEM TITLE: An ordinance relating to traffic; prohibiting parking on the east side of
South Third Street and the north side of East Chestnut Street adjacent to the Federal
Courthouse, and prohibiting parking on both sides of East Walnut Street from South First
Street to one hundred sixty feet east of South Third Street to allow a left turn lane; and
amending Sections 9.48.565, 9.50.050 and 9.50.060 of the City of Yakima Municipal

SUMMARY EXPLANATION: The attached ordinance amends Sections 9.48.565,
9.50.050 and 9.50.060 of the City of Yakima Municipal Code to prohibit parking at all
times on South Third Street and East Chestnut Street adjacent to the Federal
Courthouse, in accordance with federal safety restrictions; and to prohibit parking on both
sides of East Walnut Street from South 1 Street to one hundred sixty feet east of South
Third Street to permit installation of a center left turn lane on East Walnut Street,
reducing traffic delays caused by left- turning vehicles. City Council initially approved the
East Walnut change on August 21, 2001. The costs associated with enacting these
amendments pertain to installation of signage in the affected locations and repainting the
lane lines on East Walnut Street.
