H • ORDINANCE NO. 2002- 61 AN ORDINANCE concerning land use regulation and planning and rezoning a certain parcel of property located at 2018 E. Viola Ave. from Two- Family Residential (R -2) to Light Industrial (M -1); jim and Alice Klein as applicants herein. WHEREAS, the Hearing Examiner for the City of Yakima issued a recommendation on October 18, 2002, recommending that the City approve the rezoning of a certain parcel of property as more fully described herein, which rezone was applied for by Jim and Alice Klein; and WHEREAS, the City Council finds that the considerations of the Hearing Examiner in response to the requirements of Yakima Municipal Code ( "YMC ") § 15.23.030(E) are correct and appropriate, and that the same should be adopted by the City Council as its findings herein; and WHEREAS, the City Council finds that it is in the best interest of the City to enact the following; now therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA, WASHINGTON: Section 1. The following parcel of property located at 2018 E. Viola Ave. in the City of Yakima shall be, and the same hereby is, rezoned from Two - Family Residential (R -2) to Light Industrial (M-1): 191329-43437. Attached hereto and incorporated herein as Exhibit "A" is a copy of the legal description of said property. Section 2. The findings of the Hearing Examiner's recommendation in this matter dated October 18, 2002, are hereby adopted by the City Council as its findings in support hereof pursuant to YMC § 15.23.030(F), and are incorporated by this reference as if fully set forth herein. • Section 3. Any and all zoning, land use, and other similar maps maintained by the City of Yakima shall be amended or modified to reflect said rezone. Section 4. Severability: If any section, subsection, paragraph, sentence, clause or phrase of this ordinance is declared invalid or unconstitutional for any reason, such decision shall not affect the validity of the remaining portions of this ordinance. Section 5. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter. Proposed Use: No specific use is proposed in association with the rezone application. The applicants earlier received approval of an application for residential mini - storage facility. 6. Notices: Notice for the hearing was provided in accordance with the Urban Area Zoning Ordinance requirements in the following manner: • Application and SEPA notices mailed to adjacent owners August 8, 2002. • Notice posted on property September 6, 2002. • Legal Ad published in the Yakima Herald September 5, 2002. 7. Environmental Review: A Washington State Environmental Policy Act Determination of Nonsignificance was issued on April 29, 2002. No comments were received and no appeals were filed. 8. Analysis: a. Rezone review criteria. YMC 15.23.030.E provides the following criteria to be considered in making a recommendation on a zoning map amendment, which are respectively analyzed below: • The suitability of the property in question for uses permitted under the proposed zoning; • The extent to which the proposed amendments are in compliance with and/or deviate from the goals and policies as adopted in the Yakima urban area comprehensive plan and the intent of Title 15 YMC; HEARING EXAMINER RECOMMENDATION -2 II II II I I II II II I I 7346629. 07 01 : ill .TTY (IF YAKTMA ORO t27 AA Yakima Co, WA • • • The compatibility of the proposed zone change and associated uses with neighboring land uses; • The recommendation from interested agencies and departments; • The adequacy of public facilities, such as roads, sewer, water and other required public services; • The public need for the proposed change; and, • The testimony at the public hearing. • b. Suitability of the property for light industrial use. The property is flat and does not present physical limitations to use for light industrial purposes. It is served by . the traffic grid that already serves the other nearby industrial uses. c. Compliance with and/or deviation from the YUACP and the intent of • zoning ordinance. This rezone is compatible with future land use map III -3 based on the September 20, 2002 effective date of the change to the map applied for in February 2002 by the applicant. As a consequence, all of the surrounding properties have a preferred future industrial use. The M -1, Light Industrial zoning district is within'the range of appropriate zoning classifications for prospective industrial properties. No evidence is available indicating that truck traffic patterns would change appreciably as a result of the proposed rezone. The M -1 intent statement indicates that conflicts with surrounding land uses are to be. minimized. So long as activities on the site do not generate excessive noise, light, odor or fumes interfering with the current residential use to the west, the intent of the zoning district will not be compromised by the rezone. d. Compatibility of associated uses with neighboring land uses. Properties to the north, east, and south are already in industrial use and do not currently present compatibility issues. The properties to the west are in residential use. Light industrial uses do not necessarily generate effects that directly interfere with enjoyment of residential property, since noise, dust and chemical emissions are not associated with light industrial uses. No other party raised issues on incompatibility at the hearing or otherwise. e. Agency and department recommendations. No recommendations regarding the rezone per se were offered agency personnel. f. Adequacy of public facilities. This property is currently served by all necessary public utilities. E. Viola Avenue is classified as a Collector Arterial. Title 12 YMC defines this classification as requiring an 80 -foot wide right of way, 40 feet on each side of centerline. The existing right of way is 70 feet wide, 40 feet on the Klein's side of centerline and 30 feet on the north side. The frontage of this property on E. Viola Avenue is improved with a bituminous surfacing approximately 20 -feet wide. The street has been treated with a chip seal coating. Title 12 requires that this frontage be improved with 27- feet of asphalt paving from street centerline, curb, gutter and a five -foot wide sidewalk. The City Engineer has agreed to a deferment of Title 12 improvements until a street improvement project is formed. At that time, the applicants will participate for their fair share of improvement costs. g. • Public need. There is not a public need that demands the requested rezone. Nevertheless, the proposed rezone is consistent with the Future Land Use Map amendment approved by the City and County joint legislative bodies. There is a public interest in implementing zoning regulations consistent with comprehensive plans or amendments to plans in accordance with the state Growth Management Act, Chapter 36.70A RCW. • h. Public comment. No public comment was offered on the rezone application. From the foregoing findings, the Hearing Examiner makes the following CONCLUSIONS • 1. The Hearing Examiner has jurisdiction to conduct an open record hearing on and review the application to change the zoning of the subject property from R -2 to M -1 and to make a recommendation on the proposed rezone to the Yakima City Council. 2. The requirements for public notice of the application and the hearing were satisfied. The proposed amendment complies on balance with the goals and policies as adopted in the Yakima Urban Area Comprehensive Plan. 5. The proposed amendment is consistent with the amendments to the Future Land Use Map adopteded by the city on September 20, 2002. 6. The proposed amendment complies with the intent of the zoning ordinance. 7. The proposed amendment does not present any substantial incompatibility with neighboring land uses so long as actual uses comply with the design, development and review requirements in the Yakima Municipal Code. 8. Public facilities are adequate at the site to light industrial uses of the property. 9. The rezone is an appropriate action for implementing comprehensive plan amendments and is therefore in the public interest. In September of 2001, the Klein's requested a Class (3) zoning review to operate a residential mini storage facility on their R- 2 zoned property at 2014 E Viola Avenue. Within this application it was stated that if their Class (3) review was approved it was their intent to pursue an amendment to the future land use map followed by a rezone to light industrial. Their CL (3) application was approved by the hearing examiner on September 20, 2001. On February 22, 2002 the Klein's submitted their application for a future land use map amendment to redesignate their property from Medium Density Residential to Industrial. Their request was approved by the Joint Board on August 20, 2002 and became effective on September 20, 2002. ADJACENT ZONING AND LAND USE. Properties adjacent to this rezone have the following zoning and land use characteristics: Location Zoning Existing Use North CBDS Mobile Fleet Service South M -1 Truck Wash East M -1 Wondrack Fueling Facility West R -2 Single- family residential COMPREHENSIVE PLAN COMPLIANCE. The Future Land Use Map (Map III -3) designates the subject property as industrial and, therefore, suitable for M -1, Light Industrial zoning. URBAN AREA ZONING ORDINANCE. The M -1, Light Industrial district is intended to: 2 Jim & Alice Klein 2018 E Viola Avenue UAZO RZ #5 -02, EC# 14 -02 a. Establish and preserve areas near designated truck routes, freeways and the railroad for light industrial uses; and b. Direct truck traffic onto designated truck routes and off residential streets; and c. Minimize conflicts between uses in the light industrial district and surrounding land uses. The light industrial district provides areas for light manufacturing, processing, research and wholesale trade, storage and distribution facilities. Uses permitted in this district should not generate excessive noise, light, odor or fumes that would constitute a nuisance or hazard. REZONE CRITERIA. Recommendations for approval of rezone applications are governed by seven criteria specified in Section 15.23.030 YMC. 1. Testimony at public hearing. Testimony at the public hearing is a very important part of determining the compatibility of any proposed land use change. 2. Suitability of property for proposed use. In writing his decision for the Klein's Class (3) land use application, hearing examiner Phil Lamb stated; "This is an intensely industrial neighborhood. This portion of R -2 property, including several lots immediately west of this lot, will probably be rezoned to Light Industrial at some time in the future." 3. This rezone is compatible with future land use map III -3 and land use compatibility chart II1 -2 of the Comprehensive Plan. The map indicates future land use for the subject property as Industrial, a designation that includes the M -1, Light Industrial zoning district within its range of appropriate zoning classifications. 5. Adequacy of public utilities. All required public utilities are presently available and E. Viola Avenue provides street access. 6. Compatibility of proposed use. To once again quote from hearing examiner Phil Lamb's 2001 Class (3) decision; "The unique facts of this situation, given surrounding development and agreement by adjacent R -2 zoned property owner Doug Lemon, strongly indicate that this proposal will be compatible. This decision is based on unique facts and the specific characteristics of surrounding property." 7. Public Need /Change in Circumstance In addition to the future land use map amendment changing the Comprehensive Plan's designation of this property from medium density residential to industrial; other significant land use changes have occurred within this general area since the subject property was originally zoned R -2. The majority of surrounding property is already zoned either CBDS or M -1 and to the west, which remains R -2, property owner Doug Lemon joined with the Kleins in requesting a comprehensive plan map change to industrial 4 Jim & Alice Klein 2018 E Viola Avenue UAZO RZ #5 -02, EC# 14 -02 ZONING ORDINANCE DEVELOPMENT STANDARDS. The zoning ordinance sets forth specific standards for lot size, maximum lot coverage, minimum building setbacks, parking, building height, sight screening, etc. Whenever new construction or a different land use is proposed for this property all - applicable development standards will be met or adjustments of these standards will be requested and reviewed as is required by Chapter 15.10 of the Urban Area Zoning Ordinance. TITLE 12 DEVELOPMENT STANDARDS. E. Viola Ave. is classified as a Collector Arterial. Title 12, Development Standards defines this classification as requiring an 80 -foot wide right of way, 40 feet on each side of centerline. The existing right of way is 70 feet wide, 40 feet on the Klein's side of centerline and 30 feet on the north side. The frontage of this property on E. Viola Avenue is improved with a bituminous surfacing approximately 20 -feet wide. The street has been treated with a chip seal coating. Title 12 requires that this frontage be improved with 27 -feet feet of asphalt paving from street centerline, curb, gutter and a five -foot wide sidewalk. The City Engineer has agreed to a deferment of Title 12 improvements until a street improvement project is formed. At that time, the applicants will participate for their fair share of improvement costs. DEVELOPMENT SERVICES TEAM (DST) REVIEW. A DST meeting was held on August 8, 2002. Representatives from City Planning, Engineering, Traffic Engineering, Water, Fire, and 5 Jim & Alice Klein 2018 E Viola Avenue UAZO RZ #5 -02, EC# 14 -02 Building Codes were in attendance. No additional comments were added to those previously received during last years CL (3) review. TRAFFIC CONCURRENCY. The process of rezoning property is, in itself, exempt from concurrency review. The 2001 mini- storage application was exempt from concurrency review because it did not generate ten p.m. peak hour trips. Other uses in the future may require additional review. STATE ENVIRONMENTAL POLICY ACT. On April 29, 2002 the City of Yakima issued a Declaration of Nonsignificance for environmental checklist #13 -02. The 20 -day comment period preceded the issuance of this DNS and there were no comments received during the comment period. PUBLIC NOTICE. Notice for the hearing was provided in accordance with the UAZO requirements in the following manner: Mailing of notice August 8,2002 Posting of property September 6,2002 Legal Ad published September 5,2002 CONCLUSIONS. 1. The hearing examiner has jurisdiction. 2. Adequate public services are available to meet all utility and access requirements of this proposal. 3. Properties bordering on three sides are zoned M -1. B. The Yakima City Council has approved the request to a land use change of the zoning map. C. The property has direct access to E Viola Avenue.
