WHEREAS, the Hearing Examiner for the City of Yakima issued a recommendation on August 29, 2002, recommending that the City approve the rezoning of certain parcels of property as more fully described herein, which rezone was applied for by Shields Bag & Printing Company; and WHEREAS, the City Council . finds that the considerations of the Hearing Examiner in response to the requirements of Yakima Municipal Code ("YMC") § 15.23.030(E) are correct and appropriate, and that the same should be adopted by the City Council as its findings herein; and WHEREAS, the City Council finds that it is in the best interest of the City to enact the following; now therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA, WASHINGTON: Section 1. Severability: If any section, subsection, paragraph, sentence, clause or phrase of this ordinance is declared invalid or unconstitutional for any reason, such decision shall not affect the validity of the remaining portions of this ordinance. Section 5. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter. SUMMARY OF RECOMMENDATION: The requested change in zoning for the subject properties should be approved, subject to conditions. From the site visit, a review of the staff report and other exhibits, information received at the hearing, and a review of Urban Area Zoning Ordinance and the Yakima Urban Area Comprehensive Plan as it pertains to the subject application, the Hearing Examiner makes the following FINDINGS 1. Applicant: Shields Bag and Printing Co., 109 Rock Avenue, Yakima, Washington, 98902 2. Application: Zoning map amendment to change the subject properties from R-2 to M-1. 3. Location and Parcel Numbers: Vicinity of 915 Landon Avenue to 1013 Landon Avenue within the City of Yakima. Zoning and Land Use: The current zoning of the subject property is R-2, Two - Family Residential. It is fenced and vacant, with some site preparation work underway. Proposed Use: Shields Bag & Printing has submitted a rezone application to rezone 12 parcels from R-2, Two -Family Residential to M-1, Light Industrial in the vicinity of 915-1013 Landon Avenue. The rezone is initially intended to facilitate an employee parking lot for 229 vehicles for the Shields Bag & Printing facility. 6. Notices: Notice for the hearing was provided in accordance with the UAZO requirements in the following manner: • Application and SEPA notices mailed to adjacent owners July 15, 2002. • Notice posted on property July 26, 2002. • Legal Ad published in the Yakima Herald July 26, 2002. 7. Environmental Review: A Washington State Environmental Policy Act Determination of Nonsignificance ("DNS") was issued on August 7, 2002. No appeals were filed. 8. Analysis: a. Rezone review criteria. YMC 15.23.030.E provides the following criteria to be considered in making a recommendation on a zoning map amendment, which are respectively analyzed below: HEARING EXAMINER RECOMMENDATION -2 11 1111 11 1 ilii 1 1 iii 11 PITY nr YAKTMA 012171 11 1 1 11 7321757 Page: 5 of 10 03/11/2003 03:16P 428 A0 Yakima Co, WA • The suitability of the property in question for uses permitted under the proposed zoning; • The extent to which the proposed amendments are in compliance with and/or deviate from the goals and policies as adopted in the Yakima urban area comprehensive plan and the intent of [Title 15 YMC]; • The compatibility of the proposed zone change and associated uses with neighboring land uses; • The recommendation from interested agencies and departments; • The adequacy of public facilities, such as roads, sewer, water and other required public services; • The public need for the proposed change; and, • The testimony at the public hearing. b. Suitability of the property for light industrial use. The subject property is immediately adjacent to the applicant's existing industrial facility. The property is flat and does not present physical limitations to use for light industrial purposes, though there is a grade difference between the actual structures on the current industrial property and the subject property. Stormwater management requirements administered by city departments will assure appropriate management arrangements are made for stormwater. c. Compliance with and/or deviation from the YUACP and the intent of zoning ordinance. An amendment (File No. CPA #8-02) to the YUACP future land use map designating the subject properties was approved at a joint meeting of the Yakima City Council and the Yakima County Board of Commissioners on August 20, 2002. The amendment changes the future land use from Medium Density Residential to Industrial. At present, no ordinance has been passed by the city council adopting the changes to the YUACP, but the approval of the amendment by the joint body strongly indicates that the light industrial use of the property will not compromise YUACP objectives and policies. In addition, Policy G8.4 (YUACP p.II-12) and Policy G9.4 (YUACP p.II-13) encourage location and, by inference, expansion of industrial facilities within city limits. The rezoning of the area immediately contiguous to the current industrial property to allow industrial or accessory uses is consistent with such policies. Generally, the intent of the zoning ordinance is aligned with YUACP goals and objectives. One purpose of the ordinance is to promote traffic safety, however. Part of the purpose of designating industrial zones is to direct truck traffic off residential streets. The property in its present configuration does not suggest that truck traffic would be increased on Landon Avenue. Parking use will increase other vehicular traffic on the street, however, and must be accounted for. The SEPA responsible official has determined that no significant environmental impact is associated with the traffic, but any increase must be consistent with the design standard ordinance traffic capacity analysis (Chapter 12.06 YMC) if it is to be consistent with the intent of urban area zoning ordinance (Title 15 YMC). d. Compatibility of associated uses with neighboring land uses. Properties to the north, east, and south are already zoned for industrial use, are owned by the applicant and do not currently present compatibility issues. The properties to the west are in residential use. Light industrial uses do not necessarily generate effects that directly interfere with enjoyment of residential impacts, since noise, dust and chemical emissions are not associated with light industrial uses. It is possible that effects related to traffic (both timing and quantity), bulk and dimensional conflict could arise. No evidence of such conflicts was presented by any persons in the course of public comment. According to the land use table in YMC 15.04.030, uses that may generate traffic and noise impacts are subject to Class (2) and Class (3) review, and the associated compatibility analysis. Bulk and dimensional standards for residential areas are intended to maintain the open character of residential neighborhoods. Development under industrial area standards would conflict with the residential character of the R-2 zone. Accordingly, in absence of legislated change to the future land use map, compatibility between the potential uses of the subject property and neighboring can only be assured if the rezone is conditioned upon the application of R-2 structural height and setback standards. The anticipated parking lot use would be consistent with this limitation. In accordance with Chapter 15.07 YMC, a Sitescreening Standard "A" screen is required where different uses are separated by a street. A Sitescreening Standard "C" buffer strip and slatted chain link fence are already installed on the boundary of the subject property facing the residential area. Subject to the appropriate assessment of traffic capacity effects analyzed earlier, and to the satisfaction of R-2 structural setback and height standards, there appear to be no issues of clear incompatibility raised by the rezor}e. e. Agency and department recommendations. Agencies commented that stormwater management facilities, any parking facilities and lighting ffcilities must be reviewed for design and development standard compliance. Comments also indicated that access to manholes on the property must be maintained to allow maintenance and cleaning. These conditions should be addressed as a matter of course during the zoning review applicable to specific proposed uses. f. Adequacy of public facilities. This property is currently served by all necessary public utilities. Street access is from Landon Avenue, which is a fully developed Local Access Street. g. Public need. There is not a public need that demands the requested rezone. Nevertheless, the proposed rezone is consistent with the Future Land Use Map amendment approved by the City and County joint legislative bodies. There is a public need to implement zoning regulations consistent with comprehensive plans or amendments to plans in accordance with the state Growth Management Act, Chapter 36.70A RCW. In addition, testimony at hearing indicated that the availability of the land for light industrial use is important to the growth of the applicant's business. Local economic development consistent with the YUACP and the zoning ordinance is in the public interest, though such development does not constitute a public need in a strict sense. h. Public comment. No public comment was offered on the rezone application. From the foregoing findings, the Hearing Examiner makes the following CONCLUSIONS HEARING EXAMINER RECOMMENDATION -5 11 11 III 1 III 1 i 1 11 ilii CITY nr YAKIMA ORO 11 1 E II 7321757 Page: 8 of 10 03/11/2003 03:18P 4'28.00 Yakima Co, WA 1. The Hearing Examiner has jurisdiction to conduct an open record hearing on and review the application to change the zoning of the subject property from R-2 to M-1 and to make a recommendation on the proposed rezone to the Yakima City Council. 2. The requirements for public notice of the application and the hearing were satisfied. 3. The subject property is suitable for some of the uses permitted under the proposed zoning so long as the uses comply with applicable design and developmeit standards set out in the Yakima Municipal Code. 4. The proposed amendment complies on balance with the goals and policies as adopted in the Yakima urban area comprehensive plan despite marginal encroachment of industrial use into an area designated for Medium Density Residential use. 5. The proposed amendment is consistent with the amendments to the Future Land Use Map approved by the city and county legislative bodies on August 20, 2002. 6. The proposed amendment complies with the intent of the zoning ordinance so long as the applicant demonstrates the availability of sufficient traffic capacity on the affected streets to support the range of potential uses in the proposed district. 7. The proposed amendment does not present any substantial incompatibility with neighboring land uses so long as actual uses comply with the design, development and review requirements in the Yakima Municipal Code. 8. Public facilities are adequate at the site to support the proposed use and other possible light industrial uses of the property, so long as supported by an appropriate transportation capacity analysis. 9. The rezone is in the public interest and is an appropriate action for implementing comprehensive plan amendments, subject to conditions. From the foregoing Findings and Conclusions, the Hearing Examiner makes the following RECOMMENDATION The application to rezone the subject property from R-2 Two Family Residential to M-1 Light Industrial should be APPROVED, SUBJECT TO THE FOLLOWING CONDITIONS: HEARING EXAMINER RECOMMENDATION -6 11 NTY OF YAK MA 11 1 1 1 11 11 ORO 11 I II 7321757 Page. 9 of 10 03/11/2003 03,16P 429.00 Yakima Co, WA 1. Access to the manholes on the east side of Landon Avenue must be maintained for cleaning and routine maintenance. 3. Development of the subject property may not be commenced until tle development is determined by the City Traffic Engineer to satisfy the transportation capacity test established in the Transportation Capacity Management Ordinance, Chapter 12.06 YMC. 4. Development on the subject property of uses permitted in the M-1 zone shall comply with R-2 structural height and setback standards until such time as the Yakima City Council has adopted, by ordinance, the comprehensive plan amendment changing the Future Land Use Map designation of the subject property from Medium Density Residential to Industrial. Development under industrial area standards would conflict with the residential character of the R-2 zone Accordingly, in absence of legislated change to the future land use map, compatibility between the potential uses of the subject property and neighboring can only be assured if the rezone is conditioned upon the application of R-2 structural height and setback standards. The anticipated parking lot use would be consistent with this limitation. HEARING EXAMINER RECOMMENDATION -4 Visual impacts are also the basis for sitescreening requirements. In accordance with Chapter 15.07 YMC, a Sitescreening Standard "A" screen is required where different uses are separated by a street. A Sitescreening Standard "C" buffer strip and slatted chain link fence are already installed on the boundary of the subject property facing the residential area. Subject to the appropriate assessment of traffic capacity effects analyzed earlier, and to the satisfaction of R-2 structural setback and height standards, there appear to be no issues of clear incompatibility raised by the rezone. e Agency and department recommendations. Agencies commented that stormwater management facilities, any parking facilities and lighting facilities must be reviewed for design and development standard compliance. Comments also indicated that access to manholes on the property must be maintained to allow maintenance and cleaning. These conditions should be addressed as a matter of course during the zoning review applicable to specific proposed uses f Adequacy of public facilities. This property is currently served by all necessary public utilities Street access is from Landon Avenue, which is a fully developed Local Access Street. g. Public need. There is not a public need that demands the requested rezone. Nevertheless, the proposed rezone is consistent with the Future Land Use Map amendment approved by the City and County joint legislative bodies. There is a public need to implement zoning regulations consistent with comprehensive plans or amendments to plans in accordance with the state Growth Management Act, Chapter 36.70A RCW. In addition, testimony at hearing indicated that the availability of the land for light industrial use is important to the growth of the applicant's business. Local economic development consistent with the YUACP and the zoning ordinance is in the public interest, though such development does not constitute a public need in a strict sense. h. Public comment. No public comment was offered on the rezone application. From the foregoing findings, the Hearing Examiner makes the following CONCLUSIONS HEARING EXAMINER RECOMMENDATION -5 1. The Hearing Examiner has jurisdiction to conduct an open record hearing on and review the application to change the zoning of the subject property from R-2 to M-1 and to make a recommendation on the proposed rezone to the Yakima City Council 2 The requirements for public notice of the application and the hearing were satisfied. 3. The subject property is suitable for some of the uses permitted under the proposed zoning so long as the uses comply with applicable design and development standards set out in the Yakima Municipal Code. 4. The proposed amendment complies on balance with the goals and policies as adopted in the Yakima urban area comprehensive plan despite marginal encroachment of industrial use into an area designated for Medium Density Residential use. 5 The proposed amendment is consistent with the amendments to the Future Land Use Map approved by the city and county legislative bodies on August 20, 2002 6. The proposed amendment complies with the intent of the zoning ordinance so long as the applicant demonstrates the availability of sufficient traffic capacity on the affected streets to support the range of potential uses in the proposed district. 7. The proposed amendment does not present any substantial incompatibility with neighboring land uses so long as actual uses comply with the design, development and review requirements in the Yakima Municipal Code. 8. Public facilities are adequate at the site to support the proposed use and other possible light industrial uses of the property, so long as supported by an appropriate transportation capacity analysis. 9. The rezone is in the public interest and is an appropriate action for implementing comprehensive plan amendments, subject to conditions. From the foregoing Findings and Conclusions, the Hearing Examiner makes the following RECOMMENDATION The application to rezone the subject property from R-2 Two Family Residential to M-1 Light Industrial should be APPROVED, SUBJECT TO THE FOLLOWING CONDITIONS HEARING EXAMINER RECOMMENDATION -6 1. Site Design and Improvement Standards The Yakima Urban Area Zoning Ordinance at Section 15.05.010, establishes basic development requirements as minimum criteria which must be met to assure land use compatibility and promote the public health, safety and general welfare. The following is an overview of the proposal's compliance with the aforementioned development standards: Setbacks - Structure setbacks are required by the UAZO (Table 5-1). Since there are no structures proposed, structural setback requirements are not an issue. Parking: Chapter 15.06 (Table 6-1) of the Zoning Ordinance sets forth parking requirements for vanous land uses. The proposal will increase the parking needs of Shields Bag & Printing. The parking requirements for industrial manufactures are one parking space per employee, per shift. There has not been a request to inquire about the staffing and shift levels at this facility. The new parking area is intended to meet current and future staff parking needs for Shields Bag & Printing which is excess of the zoning ordinance minimum requirements for the required off- street parking needs of this manufacturing facility.. Site -screening: The Yakima Urban Area Zoning Ordinance at 15 07 establishes site screening standards to provide a visual buffer between uses of different intensity, streets and structures, reduce erosion and storm water runoff, protect property values and eliminate potential land use conflicts by mitigating adverse impacts from dust, odor, fitter, noise, glare, lights, signs, building or parking areas. Sitescreening standard "A" (A ten -foot wide landscaped planting strip with trees at twenty -feet to thirty -feet centers, shrubs, and groundcover.) shall apply wherever sitescreening is required under Table 7-1 and the adjoining land use is separated from the proposed use or development by a collector or local access street. The reviewing official may also require sitescreening standard "A" along an arterial when such action is consistent with the purpose of this chapter. (Ord. 2947 § 1 (part), 1986). After review of Table 7-1 of the UAZO, it has been determined that sitescreemng standard "A" be required along the west property line fronting on Landon Avenue. Public facilities: The site is currently served with public water and sanitary sewer. The extension of sanitary sewer and domestic water mains will not be necessary to serve this site. Compatibility of proposed use. The parking lot will serve as an employee parking area for the Shield's plant located to the east. The lot will be fully landscaped with residential design to enhance the existing neighborhood. The lot will be fenced for security reasons and will be patrolled by a contracted security firm. There is a significant elevation difference between Landon and Rock Avenues therefore, a covered stairways will provide employees direct access to the facility below. Shift changes at Shields are staggered and will not interfere with AM/PM peak hour traffic. Employees will be coming at 5:45 AMand leaving at 6:15 AM during the 6:00 AM shift change. The same will happen 12 hours later dunng the same PM shift change. Traffic will enter from Nob Hill Boulevard and exit onto Landon Avenue allowing for exit via Stewart Street, Landon or Arlington Avenues. Testimony at the hearing should be considered in determining whether this proposal is compatible with the surrounding land uses. 7. The requested zoning change of the property in question is suitable because the land will be used as an employee parking lot for Shields Bag & Printing Co. located to the east. The zone change is suitable to the property to the south, which was also rezoned from R-2 to M-1 in the early 1990's, for employee and customer parking serving the Penny Press facility. B The rezone request is in compliance with the amended Comprehensive Plan because Shields Bag & Printing Co applied for a map amendment on August 6, 2002 with approval granted C Street capacity and all other public services are there to serve the site D. The parking lot will serve as an employee parking area for the Shields plant located to the east. The lot is fully landscaped with residential design to enhance the existing neighborhood. The lot is fenced for security reasons and is patrolled by a contracted security firm. There is a significant elevation difference between Landon Avenue and Rock Avenue. Therefore, covered stairways will allow employees direct access to the facility below. Shift changes at Shields are staggered E. and will not interfere with AM/PM peak hour traffic. Employees will be coming at 5:45 AM and leaving at 6:15 AM during 6:00 AM shift change. The same will happen 12 hours later during the same PM times. A smaller shift change does occur at 2:00 PM and again at 10:00 PM. However, these employees may be parking on Rock Avenue. Traffic will enter from Nob Hill Blvd. and exit onto Landon Avenue allowing for exit via Stewart St., Landon Avenue or Arlington Avenue. F. Shields Bag & Printing Co. is a major employer in the greater Yakima area and the proposed zone change is going to help Shields grow and expand their business and better serve the community with more job opportunities. 6 A Shields Bag & Printing Co. is a major employer in the greater Yakima area operating 24 hours per day The proposed zone change for the 12 lots along Landon Avenue will allow for employee parking so the Company can physically grow The lot is fully landscaped around the parameter and fenced, creating an attractive buffer between the neighborhood and the parking area. File No. UAZO RZ #4-02: EC # 12-02 NOTICE OF PROPOSAL On July 5, 2002 the City of Yakima Department of Community & Economic Development received a rezone application from Shields Bag & Panting Company. to rezone 12 parcels located in the vicinity 915 through 1013 Landon Avenue The applicant wishes to rezone the properties, from R-2, Two - Family Residential to M-1, Light Industna. The proposed rezone will facilitate the construction of a 229 stall employee parking lot for the Shields Bag & Panting operations. This application is subject to approval. The application was considered complete for processing on July 12, 2002. The complete application is available for public review at the City of Yakima Planning Division, 2nd floor City Hall, 129 North 2nd Street, Yakima, Washington.
