AN ORDINANCE relating to health and sanitation; concerning containers for
and storage of garbage and yard waste for collection by the
City of Yakima, and amending Section 4.16.140 of the City of
Yakima Municipal Code accordingly.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
YAKIMA:
Section 1. Section 4.16.140 of the City of Yakima Municipal Code is
hereby amended to read as follows:
1 4.16.140 Classification of premises — Charges.
A. For the purpose of regulating the collection of garbage and refuse
3 in the city of Yakima there are established two classifications: one to be known as
4 the "residential classification," and the other as the "business classification." The
5 residential classification shall include all premises occupied as a single - family
6 housekeeping unit, either in dwelling houses, apartments, or other multiple
7 residences. "Residential unit" as used herein, is defined as a unit in which all
8 persons reside together as a single family, whether in single or multiple
9 dwellings. The business classification shall include all other premises.
10 Provided, property owned by the city may be served by city equipment
11 and crews independently of the classifications and rates established by this
12 chapter; provided further, the rules and regulations established by this chapter
13 pertaining to receptacles and to the preparation, storage, and collection of
14 garbage, refuse and debris shall be applicable to all property within the city,
15 including that owned by the city.
16 B. The collection of all refuse in the business classification shall be
17 made only by licensed collectors, hereinafter provided for, at rates to be agreed
18 . upon between such collector and the business houses served by him.
19 C. The collection of all refuse in the residential classification shall be
20 conducted by the City of Yakima equipment and personnel and financed by
21 garbage and refuse collection fees hereinafter set forth. The City of Yakima shall
22 not collect refuse from apartments or multiple units in excess of four units except
23 upon the request of the owner or operator thereof. The following collection fees
24 and practices shall apply for all garbage collection services conducted by the City
25 of Yakima.
26 1. There are hereby imposed for refuse collection in the residential
27 classification the following charges for each single - family dwelling and for each
28 residential unit in any multiple dwelling:

29 An overfill fee of one dollar and seventv -seven cents ($1.77) shall be
30 imposed each time an automated cart is filled past its visible full limit or the cart
31 lid will not close due to overfilling.
32 A call -back charge of eightnine dollars and sixty four forty -two cents
33 ($8-649.42) shall be imposed each time a customer requests refuse collection
34 service at a time other than the regularly scheduled time.

36 An overfill fee of nine dollars and twenty -one cents ($9.21) shall be
37 imposed each time a bin is filled past its visible full limit or the bin lid will not
38 close due to overfilling.

40 2. ,In addition to the charges imposed by subsection (C)(1) of this section,
41 a separate charge, to be known as the "yard service charge," is imposed on each
42 residential unit that elects to receive yard material collection service from the city
43 during the nine -month period of each year commencing March 1st and ending
44 November 30th. Such service shall utilize one or more 96- gallon carts owned
45 and provided by the city. The yard service charge shall be nine dollars and
46 twenty sixsixtv -three cents ($9.2663) per month for one 96- gallon cart, plus four
47 dollars and sixty thrceeightv-two cents ($4.6382) per month for each additional
48 96- gallon cart, and shall be billed to each residential unit that elects to receive this
49 service at the time and as a part of the billings rendered for other city services
50 applicable for that nine -month period. A call -back charge of eight-nine dollars
51 and sixty fourfortv -two cents ($87649.42) shall be imposed each time a customer
52 requests yard material collection service at a time other than the regularly
53 scheduled time.
54 Where yard material collection service is performed for multiple
55 dwellings that are carried under a single account number and street address for
56 water department metered services, the multiple dwellings shall be deemed a
57 single residential unit for the purpose of computing the yard service charge
58 imposed by this section.
59 3. All of the charges for garbage and refuse collection provided in
60 subsections (C)(1) and (C)(2) shall be billed for and paid at the same time and for

61 the same period as billings and payments are made for other city utility services;
62 or, in the event a customer is served by the municipal garbage division but is not
63 served with another city utility, garbage and refuse collection charges shall be
64 billed and paid for according to the schedule which would be applicable to such
65 customer were he so served with another city utility service. Accounts shall
66 become delinquent if not paid within the time specified by Section 7.68.025 for
67 pavment of water service charges.
68 4. Garbage and refuse collection charges will be suspended for any
69 customer upon advance notice to the office of the division of utility accounts that
70 a particular premises served will be unoccupied and such charges will be
71 resumed on notice to such office to resume service. No such suspension of
72 charges for garbage and refuse collection service will be made for any premises
73 served with any other city utility unless all city utility service to such premises is
74 likewise suspended.
75 Application for resumption of service to a new customer shall be made
76 to the office of the division of utility accounts on forms provided for that purpose
77 which shall contain the name of the customer and the street address and number
78 of units of the premises to be served.
79 5. Collection service may be suspended for nonpayment of accounts, but
80 such suspension shall not relieve the person owing such account from the duty of
81 complying with the provisions of this chapter or other ordinances pertaining to
82 garbage, refuse, or sanitation. Such suspension of service shall render the
83 premises where such collection service is suspended subject to condemnation for
84 lack of sanitary requirements, and the owner or person in charge or in possession
85 of said premises shall be subject to prosecution for maintaining a nuisance
86 thereon, as well as enforcement of all other applicable laws.
87 6. Upon failure to pay such charges and upon delinquency, the amount
88 thereof shall become a lien against the property from which the garbage
89 collection service shall have been rendered. Such lien shall be made effective by
90 filing a notice thereof specifying the charges, the period covered by the charges
91 and giving a legal description of the premises at which the service was rendered.
92 Such lien shall be filed with the same official and within the time and shall be
93 foreclosed within the time and manner prescribed by law for filing and
94 foreclosing liens for labor and material, and shall be superior to encumbrances
95 filed subsequent to the filing of such lien, but shall be subject to all general taxes
96 and local improvement assessments, whether levied prior or subsequent thereto.
97 D. The yard material collection service, for which the yard service
98 charge is imposed by subsection (C)(2) of this section, shall include the weekly
99 collection of yard material from automated/ semi - automated plastic 96- gallon
100 carts furnished by the city department of public works during the nine -month
101 period for which the yard service charge is billed to any particular premises. For
102 collection purposes, the total weight of each cart including yard material
103 deposited therein may not exceed two hundred pounds. Yard material larger

104 than four inches in diameter or too long to fit within a 96- gallon cart when
105 covered by its lid shall not be placed in a 96- gallon cart for collection, but may
106 upon proper request, be collected as special haul material.
107 E. In addition to the regulations adopted and charges imposed by
108 subsections C and D of this section, further charges are imposed in the following
109 types of service:
110 1. A charge of two dollars and ni^ n thirty -nine cents (S2.4-939), in
111 addition to the regular monthly charge, shall be made each time an extra can or
112 partial can of refuse or yard material is collected from any particular residential
113 premises;
114 2. A charge of one dollar and sixty twoseventv-seven cents ($1.6277), in
115 addition to the surcharge for collecting refuse and yard material, shall be made
116 for each extra container, bag, box or bundle of tree or shrub trimmings, collected
117 from any particular residential premises.
118 3. For a special garbage pickup, actual cost shall be charged to the
119 customer. Actual cost shall include the city's actual cost for labor, equipment
120 rental, and landfill fees. The minimum charge for this service shall be twenty -
121 five dollars.
Section 2. This ordinance shall be in full force and effect 30 days after
• its passage, approval, and publication as provided by law and by the City
Charter.

SUMMARY EXPLANATION:
The 2003 Refuse Division Budget includes a budgeted policy issue to increase residential
refuse rates. At the December 9, 2002 Budget Wrap -up, City Council approved the policy
issue.
The attached ordinance contains revisions to subsections 4.16.140C and 4.16.140E of the
Municipal Code. This ordinance contains a 9% rate adjustment on residential can service,
automated refuse cart service and charges for extra containers; a 7% rate adjustment on bin
services; and a 4% rate adjustment on yard waste cart collection. The increase in refuse rates
is estimated to generation an additional $230,000 in revenue for 2003. This amendment will
become effective February 1, 2003.
