HomeMy WebLinkAbout2002-037 Social Card Rooms Moratoriumr ORDINANCE NO. 2002- 37 AN ORDINANCE of the City of Yakima, Washington, adopting a six- month moratorium on the filing and acceptance of development applications for, and the location of, land uses operating or conducting certain social card games (i.e., house -banked card rooms); exempting land uses for which a development application was pending upon the effective date of this ordinance or which were legally in existence at such time; providing that the moratorium shall be in effect for six months, through January 20, 2003; and providing that violation of the moratorium is a misdemeanor. WHEREAS, the state legislature and the Washington State Gambling Commission have expanded the ability of gambling licensees to conduct social card games as a commercial stimulant for the licensee's business; and WHEREAS, the City Council is concerned about the proliferation of gambling establishments which, under the expanded authority granted by the state legislature and the Washington State Gambling Commission, may now operate up to 15 tables of social card games per establishment; and WHEREAS, the City's current zoning regulations, which were adopted prior to the change in the gambling regulations, do not address said expanded gambling establishments in a comprehensive fashion and the City would benefit from an opportunity to study the location of such establishments where those establishments may be detrimental to the community; and WHEREAS, allowing social card rooms to proliferate, without studying the impacts of such uses throughout the City, is likely to result in probable significant unmitigated environmental impacts on adjacent land uses from parking, traffic, and other secondary effects of such mini -casinos (i.e., house -banked card rooms); and WHEREAS, the City needs time to consider additional zoning regulations which would deal specifically with such expanded gambling establishments, and the City Council has therefore decided to impose a moratorium in order to study the issue as determined by the City Council and to consider adopting appropriate regulations; now, therefore: BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Moratorium Established. From and after the effective date of this ordinance, the City shall not allow the filing of or accept any application for a building permit, tenant improvement, subdivision, short subdivision, site plan review, or any other development, or for any building (including any additions, expansions, or modifications thereto), land, structure or land use, in which a social card game or games are or are proposed to be operated or conducted. From and after the effective date of this ordinance, no new land use which operates or conducts social card games shall be located within the City and no existing land use which does not already operate or conduct such social card games may begin operating or conducting the same. As used in this ordinance, the term "social card game" is defined as provided in RCW 9.46.0282 and is further specifically limited to house -banked card rooms, and is intended to apply to all house -banked card games, regardless of the number of tables per establishment. Section 2. Exemption - Vested Rights. Applications which are legally vested as of the effective date of this ordinance shall continue to be processed as provided in the Yakima Municipal Code and according to the land use regulations in effect on the date of vesting. All land uses operating social card games under licenses which have been issued or which have been applied for from the Washington State Gambling Commission as of the effective date of this ordinance and which are approved by the City pursuant to vested applications as provided in this section, and all land uses operating social card games which are currently in existence within the City, which were legally established under the land use -2- regulations in effect at the time of establishment, and which have current gambling licenses issued by the Washington State Gambling Commission, may continue to operate at the levels, which are or may be authorized by the Washington State Gambling Commission. All such land uses operating social card games shall be considered legal nonconforming uses under this ordinance and shall not be expanded or intensified by the addition of tables at which social card games are played beyond the number which are or may be authorized by the Washington State Gambling Commission. Section 3. Public Hearing. Pursuant to RCW 36.70A.390, a public hearing has been held on Tuesday, June 18, 2002, for the purpose of taking testimony and, if this ordinance is passed, adopting written findings and conclusions justifying the moratorium established by this ordinance, as required by RCW 36.70A.390. Section 4. Effective Period of Moratorium. The moratorium adopted by this ordinance shall become effective 30 days after its passage, approval, and publication as provided by law and by the City Charter, and shall remain in effect for six months, through January 20, 2003, subject to the adoption of findings and conclusions as provided in Section 3 above. This moratorium shall also terminate upon the adoption of permanent regulations governing the location of gambling establishments operating social card games. This moratorium may be extended as provided in RCW 36.70A.390. Section 5. Penalty for Violation. Any person who violates or fails to comply with the provisions of this chapter has committed a misdemeanor, and upon conviction thereof, shall be punished by jail imprisonment for a maximum term fixed by the court of not more than ninety days, or by a fine in an amount fixed by the court of not more than one thousand dollars, or by both such imprisonment and fine. Section 6. Severability. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent -3- jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 7. Effective Date. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter. ATTEST: By 75the-."— City Clerk Publication Date: 6-21-2002 Effective Date: 7-21-2002 -4- Mary Place, Mayor Councilman Barnett's Social Card Room Proposal (Revised 18 June 2002) The following is proposedto amend the Yakima Urban Area Zoning Ordinance (UAZO) to require Class (3) review for Social Card Rooms ( expanded card rooms). Table 4-1 of the UAZO currently lists game rooms, card rooms and electronic game rooms in a single land use category. These three listed uses are then permitted as a Class (1) use on the Large Convenience Center and Central Business District zones, Class (2) use in the Central Business District Support zone and a Class (3) use in the Small Convenience Center zones. Concerning these land use definitions, Chapter 15.02 does not provide a definition for Electronic Game Rooms. The Card Rooms definition directs the reader to see the definition for Game Room and Game Rooms are defined as a "commercial facility, or portion thereof, open to the general public, in which card games, pool, electronic games, bingo, etc., are played. Also see "Meeting Hall." Zoning regulation of social card rooms within the City of Yakima, and also perhaps the GMA Urban Growth Area of the County, might be achieved by amending the current UAZO to include a separate land use category within Table 4-1 for social card rooms as set forth in RCW 9.46.0282. I would propose that this new land use category be listed as a Class (3) land use within all four zoning districts in which Game Rooms are currently permitted. In addition to the amendment of Table 4-1 the definitions of Chapter 15.02 should be rewritten to include separate definitions for Game Rooms and Social Card Rooms. Games Rooms would exclude read as is with an addition, after card rooms, excluding Social Card Rooms. The definition for Social Card Rooms would then be written. to include perhaps mini eias-ities er any other for profit-garbl g busim ss the Council might wish to include. (over) To enact this change would require that the Regional Planning Commission review all modifications, hold a hearing, and prepare findings for submission to the Joint Board. If the RPC recommends approval and if the Joint Board concurs with these zoning text amendment changes they will be brought forward for final consideration and adoption by the Council. I believe that these changes can be enacted within 90 days. Class (3) uses may be permitted by the hearings examiner when he determines, after holding a public hearing, that difficulties related to compatibility, the provisions of public services, and the Yakima'Urban Area Comprehensive Plan objectives have been adequately resolved. Class (1). (2). or (3) Use. Approved. "Approved Class (1), (2) or (3) use" means any use or development approved upon completion of Class (1), (2) or (3) review. Class (1). (2) or (3) Use, or Development. Existing. "Existing Class (1), (2) or (3) use or development" Ill means a use or development legally existing or legally established prior to the effective date of this title has been or would be classified under Chapter 15.04 of this title as a Class (1), (2) or (3) use in a particular district even though the use has not been through Class ( 1 ), (2) or (3) review, and may or ir may not conform to the standards of this title. This definition includes any existing Class (1), (2) or (3) use with an approved modification under Chapter 15.17. Clinic means a structure for the medical examination and treatment of human patients, but without provision for keeping such patients overnight on the premises. Commercial Services means technical services and specialized care services such as tattooing, massage parlors, lawn and garden care, delivery services, except as otherwise regulated. Communication Tower means any tower, pole, mast, whip, or antenna, or any combination thereof used for radio or television transmission or line -of -sight relay. This definition includes towers erected for use in the amateur radio service. 1 Class (2) Uses are those uses set forth and defined in the text and tables of Chapter 15.04 of this title 1 and are generally permitted throughout the district. However, site plan review by the administrative official is required in order to promote compatibility with the intent and character of the district and the objectives of the Yakima Urban Area Corehen ive P N Communication Tower Height means the vertical distance above the ground measured to the highest point of the communication tower. Community Center means a facility owned and operated by a public agency or nonprofit corporation, provided, that the principal use of the facility is for public assistance, community improvement, or public assembly. Community Water System --see "Water System". Compatibility means the characteristics of different uses or development that permit them to be located near each other in harmony. Comprehensive Plan means the Yakima Urban Area Comprehensive Plan and any supplemental plans officially adopted under RCW Chapter 36.70, for the Yakima Urban Area or any portion thereof. Concentrated Animal Feeding Operation means a structure or pens for the concentrated feeding or holding of animals or poultry, including, but not limited to, horses, cattle, sheep or swine. As well, Councilman Barnett developed a proposed amendment to the Urban Area Zoning Ordinance Table 4-1 to require a class 3 review for all social card games (house -banked card rooms). Additionally, Council directed staff to send out notification for a public hearing to, hear testimony on the proposed legislation. The notification was sent to interested parties, and businesses (68) that are licensed by Washington State Gambling Commission.
