AN ORDINANCE relating to streets and sidewalks; changing the method of
measuring dear view areas for vegetation and amending section
8.80.040 of the Yakima Municipal Code .
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section I. Section 8.80.040 of the City of Yakima Municipal Code is hereby amended to
read as follows:
8.80.040 Restrictions on Obstructions at Intersecting Streets
On property at any corner formed by intersecting streets it is unlawful to install, set out or
maintain, or to allow the installation, setting out or maintenance of, or to permit any sign,
hedge trees, , .. , , : , vegetation, : : , to be
higher than two feet above the level of the center of the adjacent intersection within the
area bounded by -
:. .: - . • • .. . .. ; the centerline of the
approach street and the near curb line or pavement edge of the intersecting street,
extending from such point of intersection to a point along the centerline of the approach
street 15 feet from said point of intersection, and extending to a point along the near curb
line or pavement edge of the intersecting street a distance depending upon the posted
speed of the intersecting street as follows:
(a) Posted speed of 40 mph, the clear -view extends 305 feet to face of curb;
(b) Posted speed of 35 mph, the clear -view extends 265 feet to face of curb;
(c) Posted speed of 30 mph, the clear -view extends 225 feet to face of curb;
(d) Posted speed of 25 mph, the clear -view extends 170 feet to face of curb;
(e) Posted speed of 20 mph, the clear -view extends 130 feet to face of curb;
(f) Posted speed of 15 mph, the clear -view extends 100 feet to face of curb.
Pprovided, at intersections where traffic is controlled by four -way traffic- control lights,
the area within which the unobstructed view shall be maintained shall be bounded by
lines determined by the sight distance from a point representing the normal stopped
position of a car approaching the intersection, as that position is determined by the traffic
engineer, : - • - - ..
the intersection of the two center lines.
Section 2. Effective Date. This ordinance shall be in full force and effect 30 days after
its passage, approval and publication as provided by law and by the City Charter.
PASSED BY THE CITY COUNCIL at a regular meeting and signed and approved this
20th day of August 2002.

SUMMARY EXPLANATION:
This ordinance would implement a change in the method of measuring the clear view area for
vegetation at street intersections, based upon the speed limit of the adjacent street. The Yakima
City Council directed this amendment at their August 6, 2002 study session.
