RoII Call Present: Council: Mayor Micah Cawley, presiding, Assistant Mayor Kathy Coffey, Council Members Maureen Adkison, Dave Edler, Rick - Ensey, Dave Ettl and Bill Lover 2. Executive Session • Collective bargaining • Potential Litigation Executive Session was held and adjourned at 5:47 p.m. 6:00 P.M. — BUSINESS MEETING 1. Roll Call Present: Council: Mayor Micah Cawley, presiding, Assistant Mayor Kathy Coffey, Council Members Maureen Adkison, Dave Edler, Rick Ensey, Dave Ettl and Bill Lover Staff: Assistant City Manager Zabell, City Attorney Cutter and City Clerk Kloster 2. Invocation /Pledge of Allegiance Council Member Ettl gave an invocation and led the Pledge of Allegiance. 3. Open Discussion for the Good of the Order A. Proclamations • Martin Luther King, Jr. Week Assistant Mayor Coffey read a proclamation declaring January 16 -22, 2011 as Martin Luther King, Jr. Week. Reverend Trimble and James Parks were present to accept the proclamation. • National School Board Recognition Month Council Member Adkison read a proclamation declaring January 2011 as National School Board Recognition Month. Walt Ranta was present to accept the proclamation. B. Presentations /recognitions /introductions • Assistant City Manager Zabell Mayor Cawley read a proclamation of commendation and appreciation of Assistant City Manager Dave Zabell for five and one -half years of service to the City. He also received a plaque and an official City watch. • Police Chief Granato Council Member Edler read a commendation of Chief Sam Granato after he gave a personal thank you to the Chief for seven years of service to the City. He received a plaque and an official City watch. C. Status reports on prior meeting's citizen service requests — None D. Appointments to Boards, Commissions and Council Committees • Yakima Housing Authority Board ACTION: Motion carried to reappoint Christine Goodwin to the Yakima Housing Authority Board. VOTE: Unanimous 4. Consent Agenda ACTION: Item No. 9 was removed from the consent agenda. Motion carried to approve the consent agenda as read. VOTE: Unanimous *A. Consideration of approval of City Council Meeting Minutes • Budget Review -- November 30, 2010 • Budget Wrap Up — December 7, 2010 • Business Meeting — December 7, 2010 • Special Meeting — December 10, 2010 ACTION: City Council meeting minutes were approved. *B. Consideration of approval of Council Committee Meeting Minutes 1. Public Safety Committee — November 17, 2010 ACTION: Council committee meeting minutes were approved. 5. Audience Participation Nestor Hernandez spoke in appreciation of Chief Granato's service to Yakima. He distributed a "Save the Date" announcement for the 10 Anniversary of Cinco de Mayo Fiesta in May Luz Gutierrez also encouraged the Council and public to attend the celebration. David Hawkins and Dennis Hawkins encouraged Council to continue their practice of giving an invocation at the beginning of the Council business meetings. Kevin Scheer requested the installation of a street light in the vicinity of his house on Folsom Avenue to deter graffiti to his property. Deanna Pemberton spoke in favor of continuing prayer at Council meetings and City employee benefits. She again requested a written response to her questions regarding the national state average of police officers and the members of the negotiating team for bargaining benefits with the unions. Mike Hunnel demanded changes in City management; alleged code violations and accused City officials of possibly taking bribes from businesses in order to avoid their compliance of regulations. CITY MANAGER'S REPORTS 6. Consideration of a date for a ballot proposition to amend the City Charter to elect Council members from districts City Attorney Cutter advised Council of the research he has done on this issue and explained the differing opinions between state law and the City Charter. He stated the options Council has regarding the timing of an election. Mary Baechler, representing Central Washington Progress, said they are hoping for a special election in April. Ron Bonlender stressed the Council should be consistent in their decisions regarding special elections. Council discussed the options of taking no action at this time and allowing the petition to move ahead on it's own for an election in August or considering to put the issue on the ballot for a special election in April. ACTION: Motion carried to table the discussion and allow the process that is already in place to take place. VOTE: 4 -3, Adkison, Coffey and Cawley voting no. *7. Consideration of Resolutions authorizing bad debt write -off: A. Central Accounts Receivables ACTION: Resolution adopted. RESOLUTION NO. R- 2011 -01 B. Utilities ACTION: Resolution adopted. RESOLUTION NO. R- 2011 -02 C. Parking ACTION: Resolution adopted. RESOLUTION NO. R4011 -03 *8. Consideration of Resolutions authorizing execution of Interlocal Jail Agreement with the City of Union Gap ACTION: Resolution adopted. RESOLUTION NO. R- 2011 -04 9. Consideration of a Resolution authorizing execution of 2010 Collective Bargaining Agreements with: Council Member Edler asked various questions regarding labor benefits. Assistant City Manager Zabell explained deferred compensation benefits, the state retirement plan benefits and contributions to both by employees and the employer. A. Yakima Police Patrolman's Association ACTION: Motion carried to adopt the Resolution. VOTE: Unanimous RESOLUTION NO. R- 2011 -05 B. Teamsters Fire Management ACTION: Motion carried to adopt the Resolution. VOTE: Unanimous RESOLUTION NO. R- 2011 -06 C. AFSCME Municipal ACTION: Motion carried to adopt the Resolution. VOTE: Unanimous RESOLUTION NO. R- 2011 -07 *10. Consideration of a Resolution authorizing execution of an agreement with Conley Engineering, Inc., for electrical engineering design at upper Kiwanis Park ACTION: Resolution adopted. RESOLUTION NO. R -2011 -08 *11. Consideration of a Resolution authorizing execution of agreement with Conley Engineering, Inc., for engineering services at the Wastewater Treatment Plant, not to exceed $100,000 ACTION: Resolution adopted. RESOLUTION NO. R- 2011 -09 • ORDINANCES *12. Consideration of an Ordinance authorizing an amendment to the pay, classification and compensation plan Police Captains and Lieutenants ACTION: Ordinance passed. ORDINANCE NO. 2011 -01 *13. Consideration of Ordinance amending the fee schedule for land use applications: • Zoning Ordinance • Subdivision Ordinance • Environmental Policy • Comprehensive Plan Amendments ACTION: Ordinance passed. ORDINANCE NO. 2011 -02 14. Other Business — None 15. Adjournment — 7:26 p.m. ACTION: Motion carried to adjourn to the next Council business meeting on January 18, 2011. VOTE: Unanimous
