,ORDINANCE NO. 2003- 56 AN ORDINANCE concerning land use regulation and planning and rezoning, with conditions, a certain parcel of property located in the vicinity of North 34th Ave. and Powerhouse Rd. from Two - Family Residential (R -2) to Multi- Family Residential (R -3) as more fully described herein, and approving, with conditions, the recommendation of the Hearing Examiner for the City of Yakima regarding Class (3) land use for operation of a professional office; Richard E. Ehlers, as applicant herein. WHEREAS, the Hearing Examiner for the City of Yakima issued a recommendation on July 11, 2003 (the "recommendation "), recommending that the City approve the rezoning and use of a certain parcel of property as more fully described herein, which rezone was applied for by Richard E. Ehlers; and WHEREAS, the City Council finds that the findings of the Hearing Examiner set forth in the recommendation in response to the requirements of Yakima Municipal Code ( "YMC") § 15.23.030(E) and § 15.15.040(5) are correct and appropriate, and that the same should be adopted by the City Council as its findings herein; and WHEREAS, the Hearing Examiner recommended that the application for rezone and Class (3) review of the operation of a professional office be approved with conditions set forth in the recommendation; and WHEREAS, the City Council finds that it is in the best interest of the City to enact the following; now therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA, WASHINGTON: Section 1. The following parcel of property located in the vicinity of North 34th Ave. and Powerhouse Rd. within the City of Yakima shall be, and the same hereby is, rezoned from Two - Family Residential (R -2) to Multi- Family Residential (R -3): 181315 - 44422. Attached hereto and incorporated herein as Exhibit "A" is a copy of the legal description of said property. Section 2. The findings of the Hearing Examiner's recommendation in this matter dated July 11, 2003, are hereby adopted by the City Council as i ts findings in support hereof pursuant to YMC § 15.23.030(F), and are incorporated herein by this reference as if fully set forth herein. Section 3. The rezone and proposed Class (3) use of the subject premises for the operation of a professional office are hereby approved subject to conditions set forth in the Hearing Examiner's recommendation, which conditions are incorporated herein by this reference as if fully set forth herein. Section 4. Any and all zoning, land use, and other similar maps maintained by the City of Yakima shall be amended or modified to reflect this rezone. The City Clerk is hereby authorized and directed to file a certified copy of this ordinance with the Yakima County Auditor. Section 5. Severability: If any section, subsection, paragraph, sentence, clause or phrase of this ordinance is declared invalid or unconstitutional for any reason, such decision shall not affect the validity of the remaining portions of this ordinance. Section 6. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter. Based upon a view of the site on June 25, 2003; the application, staff report, exhibits, testimony and other evidence presented at an open record public hearing on June 26, 2003; and a review of both the Yakima Urban Area Comprehensive Plan and the Yakima Urban Area Zoning Ordinance; the Hearing Examiner makes the following: FINDINGS Applicant/Property Owner. Richard E. Ehlers, 506 North 40 Avenue, Yakima, Washington 98908. Location. 718 North 34 Avenue, Yakima, Washington; Tax Parcel No. 181315- 44422. Application. This application requests approval for the establishment of a 5,000 square -foot medical office with up to 28 parking spaces by means of a master application combining a project- specific rezone from Two - Family Residential (R- 2) to Multi- Family Residential (R -3) with a Class (3) application to locate a professional office in an R -3 zoning district, coupled with environmental review. The lot contains several old buildings that have been vacant for some time, including the former Diamond Burger building on the northwest corner of North 34 Avenue and Powerhouse Road. Notices. No comments were received during the 20 -day comment period which ended on June 5, 2003 and a Declaration of Non- significance was issued on June 6, 2003. The DNS was not appealed within the 15 -day appeal period. Zoning and Land Uses. The subject property consisting of one parcel is zoned R -2, Two - Family Residential. Adjacent properties currently have the following characteristics: Location Existing Zoning Existing Land Use North R -2 Two - Family Residential South R -2 Two - Family Residential West R -2 Two - Family Residential East R -2 Two - Family Residential Rezone Review Criteria. Recommendations regarding rezone applications within the Yakima Urban Area must be based upon the following criteria specified in Section 15.23.030 of the Yakima Municipal Code: 1. Testimony at public bearing. Senior Planner Bruce Benson and the applicant both spoke in favor of the proposed rezone and no one spoke against it. 2. Suitability of property for proposed use. The property is well suited for the uses permitted within the R -3 zoning district, including specifically the Richard E. Ehlers Professional Office 718 North 34 Avenue 3 UAZO RZ #2 -03; CL(3) #5 -03; EC #4 -03 INDEX � l medical office building use proposed by applicant which will be a vast improvement over existing conditions on the parcel. 3. Recommendations from interested agencies and departments. No agencies or departments opposed this rezone. 4. Compliance with the Comprehensive Plan and Zoning Ordinance. This rezone complies with future land use Map III -3 and land use compatibility chart 111 -3 of the Comprehensive Plan. Under the moderate - density residential development designation applicable to the site, R -3 high - density zoning may also be considered as compatible, based upon site - specific considerations. The intent of the R -3 zoning district stated in YMC 15.03.030(4)(a) is to establish and preserve high- density residential districts by excluding activities not compatible with residential uses. The proposed use would not interfere with or be incompatible with residential uses. 5. Adequacy of public facilities. Although the subject property is not currently served with utilities, public water and sewer are available. Powerhouse Road is a principal arterial that carries about 1,900 vehicle trips per day. North 34 Avenue is a local access street. Both provide street access to the proposed medical office. The Traffic Concurrency review for this proposal completed on May 23, 2003 determined from the information provided by the applicant that the proposed use will not adversely impact the arterial streets, that reserve capacity exists and that the Level of Service will not be diminished below an acceptable level on any arterial street. Routes 3 and 4 (Mead and Fruitvale) provide transit service to the site. 6. Compatibility of proposed use. The proposed use is compatible with the neighborhood. I NDEX • E j area and the proposed building will buffer existing residential uses north of the property from the traffic on Powerhouse Road. But for a narrow strip of R -2 zoning in a landscaped area on the south edge of Powerhouse Road, this request would be a natural northerly extension of the R -3 zoning already existing where the assisted living facilities are located to the south. 7. Public Need. This rezone fulfills the public need for a medical office in this area where assisted living facilities have been built to the south and professional offices have been built to the west after the R -2 zoning designation was assigned to the parcel in 1998. Class (3) Review Criteria for Proposed Medical Office Use. The Hearing Examiner's findings and conclusions are required to set forth specific reasons and ordinance provisions demonstrating that the decision satisfies the following requirements set forth in YMC 15.04.020(3) and 15.15.040(5): L Compliance and Compatibility with the Objectives and Development Standards of the Comprehensive Plan. The proposed use satisfies this requirement. The Future Land Use Map (map III -3) designates the subject property as suitable for moderate - density residential development. Under this designation, R -3 high - density zoning may also be considered as compatible, based upon site - specific considerations. The proposed use complies with and is compatible with Policy C2.2 which is to encourage office development to locate within the City limits, with Objective S1 which is to encourage the location of public and semi - public facilities in appropriate locations throughout the urban area and Objective S2 which is to require public and semi - public uses to be developed in a manner which does not detract from surrounding uses. Compliance and Compatibility with the Intent and Character of the Multi - Family Residential Zoning District. YMC 15.03.030(4)(a) states that it is the intent of the R -3 zoning district to establish and preserve high- density residential districts by excluding activities not compatible with residential uses. The proposed use will be compliant and compatible with the intent and character of nearby residential districts because it will provide necessary medical services for residents, will help buffer residential uses from traffic noise and will add attractive landscaped open spaces adjacent to residential uses. 3. Compliance with the Provisions and Standards Established in the Zoning Ordinance. The applicable provisions and standards in the zoning ordinance include the following: a) The Development Services Team meeting held for this project on May 21, 2003 resulted in the following comments: i) Engineering: Five additional feet of right -of -way need to be dedicated along North 34 Avenue to provide 25 feet of right -of -way on the west side of the centerline for that Local Residential Access street which requires 50 feet of total right -of -way width. The driveway approach must be moved northward to the northern edge of the site from the location shown on the site plan to maintain maximum distance from the Powerhouse Road intersection and must meet City Commercial Approach Standards. The frontage is also required to meet City Development Standards for this frontage, with asphalt widening to 16 feet from centerline, curb and gutter, 5 -foot sidewalk, controlled drainage and a street light at the intersection. Although Powerhouse Road is a Collector Arterial normally requiring 80 feet of right -of -way width and the City Engineer originally recommended dedication of 20 feet of right -of -way by applicant, the City Richard E. Ehlers Professional Office • 718 North 34 Avenue 6 UAZO RZ #2 -03; CL(3) #5 -03; EC #4 -03 N DEX �`a` Engineer agreed at the hearing that only 10 more feet of right -of -way for a total of 30 feet from the centerline of Powerhouse Road need be dedicated in this location. City Development Standards require this frontage to be improved with 17 feet of asphalt paving from the centerline to the curb, curb and gutter, a five - foot -wide sidewalk and controlled drainage. The City Engineer also indicated at the hearing that the property line near the intersection at the southeast corner of the parcel should be rounded to a minimum radius of 25 feet rather than only 20 feet previously recommended because of the angle at which Powerhouse Road and North 34 Avenue meet at the southeast corner of the parcel. ii) Building Codes: The building plans will have to be stamped by a licensed structural engineer or architect due to the size of the building and all structural calculations must be submitted with the plans. ' Two of the parking spaces must be available to the disabled, but they may share one striped access aisle and the plans will be reviewed for accessibility. A fire hydrant must be connected to the six -inch main on North 34 Avenue and the north wall of the building must be a one -hour firewall. iii) Traffic: The driveway on North 34 Avenue should be moved as far north as the site permits and a sidewalk should be constructed along both street frontages. iv) Yakima Regional Clean Air Authority: The applicant shall file and gain 'approval of a site dust control plan to address demolition, site preparation, construction and landscaping phases. The applicant is also required to survey for asbestos in the structure scheduled for demolition. Richard E. INDEX k j v) Water/Irrigation: Since there may be private irrigation lines within this area, the applicant should review the title report to determine if there are any irrigation easements that should remain accessible. b) The development standards which apply within the R -3 zoning district are as follows: i) Parking: The proposed new building is 5,000 square feet in floor area. The parking standard for professional offices is one space for every 200 square feet of gross floor area. Based upon this standard the total number of parking spaces required is 25, but three additional parking spaces are being added by the applicant in excess of the number required. ii) Sight screening: Based upon existing land uses and a strict application of the site screening standards of Chapter 15.07, site screening standard A consisting of a ten - foot -wide landscaped planting strip with trees planted on twenty to thirty-foot centers, shrubs and groundcover is required within this zoning district. iii) Setbacks: All proposed building setbacks comply with zoning ordinance standards. iv) Signage: No signs are indicated on the site plan, but any signs will have to comply with the zoning ordinance requirements. v) Lot coverage: According to the site plan, lot coverage is 48.5 %, much less than the 80% lot coverage permitted in the R -3 zoning district. Consistency of the Proposed Uses with Development Regulations and the Comprehensive Plan under the Criteria Required by YMC 16.06.020B is determined by consideration of the following factors: Richard E. Ehlers Professional Office 718 North 34 Avenue 8 UAZO RZ #2 -03; CL(3) #5 -03; EC #4 -03 INDEX • # Pv= i } a) The types of land uses permitted at the site include the proposed medical office which is allowed as a Class (3) use in the R -3 zone where it will be compatible with the area and will be served by adequate pubic facilities. This project - specific rezone request is compatible with the moderate - density residential designation in the comprehensive plan because the proposed use will provide necessary medical services for residents, improve the appearance and utility of the property which is presently unattractive and unused and provide a noise buffer and a park -like setting for the residential neighborhood. b) The density of residential development and the level of development such as units per acre are not affected by the proposed use. The proposed use of the property is much less dense than allowed in the R -3 zone. Lot coverage will be only 48.5% in a zone that would allow 80% lot coverage. The proposed lot coverage is less than the 50% maximum lot coverage allowed in an R -2 Two - Family Residential zoning district and slightly more than the 45% maximum lot coverage allowed in an R -1 Single - Family Residential zoning district. c) The availability and adequacy of infrastructure and public facilities is not an issue here since adequate water and sewer services are available, adequate access via two streets having reserve capacity is available and adequate transit services are available. d) The characteristics of the development are consistent with the development regulations and comprehensive plan considerations as discussed . in detail above. The proposed zoning, but for a narrow strip of property zoned R -2 on the south side of Powerhouse Road, is a natural extension of the R -3 zoning that presently exists to the south where assisted living facilities are located. Professional offices are located westerly of the proposed use. The proposed use Richard E. Ehlers Professional Office 718 North 34 Avenue 9 UAZO RZ #2 -03; CL(3) #5 -03; EC #4 -03 INDEX 1 j will be an attractive development that will buffer residential uses northerly thereof from traffic noise and that will provide a park -like setting on a significant portion of the proposed site. It will comply with all development regulations without the need for adjustments except for the street dedication and improvement adjustment allowed by the City Engineer for the portion of the site that fronts on Powerhouse Road. CONCLUSIONS • 1. The Hearing Examiner has jurisdiction to consider the requested rezone from R -2 to R -3, the application for a Class (3) use and the request for environmental clearance to authorize the placement of a medical office and to recommend approval thereof under circumstances permitted by the zoning ordinance, which circumstances warrant approval of this master application for said use, subject to conditions. 2. Public notice requirements have been satisfied. 3. The Determination of Non - significance for this project has become final with no appeal being taken and this project will have no likely significant adverse effects upon the environment, the surrounding area or the community. 4. The proposed use is compatible with the future land use map III -3, the land use compatibility Figure 111 -3 and the goals and objectives of the Yakima Urban Area Comprehensive Plan. 5. R -3 zoning is permitted within the moderate- density residential future land use designation of the Comprehensive Plan in appropriate locations where it will be compatible with residential uses. The proposed . use is much less dense than allowed in the R -3 zoning district, is allowed as a Class (3) use in that zoning district, and is compliant and compatible with the intent and development standards of that zoning district. 7. Adequate public facilities are available to meet all utility and access requirements of this proposal. 8. Traffic Concurrency review indicates that this development will not exceed the PM peak hour capacity of the City Arterial street system and that reserve capacity exists on all impacted streets. Additional right -of -way and street improvements are necessary to comply with Title 12 Development Standards. 9. This request complies with the YMC 16.06.020(B) requirements for making a Determination of Consistency. 10. There have been significant land use changes within the area that support this change from moderate - density residential development to high- density residential/professional business development. 11. Approval of this rezone master application will result in public benefits which include increased investment and tax base resulting from the improvement of the property, increased availability of medical services near assisted living facilities and residential areas, increased employment opportunities, increased aesthetic features, increased buffers for residential areas and increased areas of open space for the surrounding community. 12. Although notice of the proposal and of the . hearing was mailed to numerous residents living in the area, posted on the property and published in the newspaper, no opposition to the proposed use was expressed by letter or by testimony at the public hearing. Site Screening standard A shall be applied to all sides of the property, which standard requires a ten - foot -wide landscaped planting strip with trees at twenty to thirty -foot centers, shrubs and ground cover. 2. Construction will proceed in accordance with all applicable building code and accessibility standards. 3. The driveway access from North 34 Avenue shall be relocated to the northern edge of the proposed site to maintain maximum distance from the Powerhouse Road intersection and shall satisfy City Commercial Approach standards. 4. A final site plan shall show said relocation of the driveway on North 34 Avenue to the northernmost edge of the proposed site and the relaxed street frontage dedication and improvement requirements on Powerhouse Road allowed by the City Engineer and by the Hearing Examiner as a result of the testimony at the public hearing. 5. A fire hydrant shall be connected to the six- inch - diameter water main on North 34 Avenue to satisfy fire flow requirements and the north wall of the proposed building shall be a one -hour firewall. An additional five feet of right -of -way shall be dedicated along North 34 Avenue, with asphalt widening to 16 feet from centerline, curb and gutter, 5- foot sidewalk, controlled drainage and a streetlight at the intersection in accordance with Title 12 Development Standards. 7. An additional 10 feet of right -of -way along the site's Powerhouse Road frontage shall be dedicated to the City of Yakima in order to provide a total of 30 feet of dedicated right -of -way from the centerline of Powerhouse Road in accordance with Title 12 requirements, and this frontage shall be improved to City Development Standards with 17 feet of asphalt paving from centerline to the face of the curb, curb and gutter, a 5 -foot wide sidewalk and controlled drainage. In addition, the southeast corner of the property line at the intersection of Powerhouse Road and North 34 Avenue shall be rounded to a minimum radius of 25 feet. 8. The applicant shall file with the Yakima Regional Clean Air Authority a site dust control plan to address demolition, site preparation, construction and landscaping phases and shall conduct an asbestos survey for the structure scheduled for demolition. The subject lot contains several old buildings, which have been vacant for some time. The R -2 zoned lot has direct access to N. 34 Avenue and Power House Road. Proposed is a 5,000 square foot Medical Office with up to 28 parking spaces. . COMPREHENSIVE PLAN COMPLIANCE. The Future Land Use Map (Map III -3) designates the subject property as suitable for a medium - density residential development. Under this designation R -3 high - density zoning may also be considered as compatible, based upon site - specific considerations. The Comprehensive Plan encourages commercial development and indicates that professional offices and single - family residential development are normally incompatible. However, due to the fact that this piece of property has been abandoned and unattractive to the community for some time, the addition of a modern professional medical building to the community will provide needed services to the community, provide a buffer for vehicular noise and provide a park like setting for the neighborhood. Professional office buildings may be permitted to locate within this zoning district provided that compatibility is not an issue with the surrounding neighborhood and further provided that adequate public utilities are available to serve the site. This proposed development site can be served by public water and sewer; and has access to North 34 Ave a local access street, and Power House Road a Principal Arterial which carries approximately 1,900 vehicles trips per day. The Goals, Objectives and Policies of the 1997 Comprehensive Plan include: Policy C2.2: Office development should be encouraged to locate within city limits. Objective S 1: Encourage the location of public and semi- public facilities in appropriate locations throughout the urban area. Objective S2: Require public and semi- public uses to be developed in a manner, which does not detract from surrounding uses. URBAN AREA ZONING ORDINANCE. The zoning ordinance under Table 4 -1 permits professional offices to locate in the R -3 zoning district if approved following Class (3) Review. Class (3) land uses are considered to be generally incompatible with their neighbors for one or more reasons. Class (3) land uses may be permitted by the hearing examiner if he determines, after holding a public hearing, that any difficulties related to compatibility have been resolved. REZONE CRITERIA. Recommendations for approval of rezone applications are governed by seven criteria specified in Section 15.23.030 YMC. 1. Testimony at public hearing. Testimony at the public hearing is crucial in determining compatibility for any proposed land use change. 2. Suitability of property for proposed use. The property is well suited for the range of uses proposed by developer. 3. Recommendations from interested agencies. No agencies are opposed to this rezone. 4. Compliance with the Comprehensive Plan. This rezone is compatible with future land use Map III -3 and land use compatibility chart III -3 of the Comprehensive Plan. 5. Adequacy of public utilities. Public utilities are available, but the subject property is currently not served. N 34 a local access street and Power House Road, a principal arterial provide street access. Transit service is also provided by Routes #3 and #4 (Mead/Fruitvale). • 6. Compatibility of proposed use. Considering the present condition of the subject property this proposal will improve the current land use situation. The placement of the proposed office building between the street/parking area and residential neighborhood will also help by buffering areas of heavy traffic from the existing residential uses, while at the same time visually improving the neighborhood. 7. Public Need/Change in Circumstance Significant land use changes, such as the development of professional buildings to the west and the assisted living homes built to the south, have occurred within this general area since the subject property was zoned R -2 in 1998. These changes support the requested rezone from moderate density residential development to high- density residential /professional business development. ZONING ORDINANCE DEVELOPMENT STANDARDS. The zoning ordinance sets forth specific standards for lot size, maximum lot coverage, minimum building setbacks, parking, building height, sight screening, etc. This proposal meets all applicable zoning ordinance standards for development. The parking standard for professional offices is one space for every 200 square feet of gross floor area. Based upon this standard the total number of parking spaces required is 25, with additional 3 parking added by the applicant's request. Sight screening. Based upon existing land uses and a strict application of the site screening standards of Chapter 15.07, site screening standard "A" consisting of a ten foot wide landscaped planting strip with trees at twenty -feet to thirty -feet centers, shrubs, and groundcover are required within this zoning district. Setbacks. All proposed building setbacks comply with zoning ordinance standards. Signs. No signs are indicated on the site plan. Lot coverage. According to the site plan lot coverage is 48.5 %. 80% lot coverage is peliiiitted in the R- 3 zoning district. DEVELOPMENT SERVICES TEAM (DST) REVIEW. The DST meeting for this proposal was held on May 21, 2003 at which time the following comments were submitted. 1. City Engineer This site fronts on N. 34 Ave., which is classified as a Local Residential Access street. This classification requires a 50 -foot right -of -way, 25 feet on each side of centerline. The existing right -of -way which fronts upon 34 is only 20 feet and an additional 5 feet of right -of -way will need to be dedicated along this frontage. Additionally, the driveway access from 34 should be relocated to the northern edge of the proposed site to maintain maximum distance from the Powerhouse intersection and is required to meet City Commercial Approach Standards. This frontage is also required to meet City Development Standards for this frontage, with asphalt widening to 16 feet from centerline; curb and gutter, 5 foot sidewalk, controlled drainage and a streetlight at the intersection. This site also fronts on Powerhouse Road, classified as a Collector Arterial. This classification indicates a need for 80 feet of right -of -way, 40 feet on each side of centerline. UAZO Master Application r INDEX applicant is required to deed an additional 20 feet of right -of -way from this site frontage to be in compliance with the City Development Standards. This frontage is required to be improved, by our City Development Standards, with 27 feet of asphalt paving from centerline to the face of the curb, curb gutter, a 5 foot wide sidewalk and controlled drainage The property line intersection should be rounded to a minimum radius of 20 feet. Water/Irrigation There may be private irrigation lines within this area. The title report should be reviewed to determine if there are any irrigation easements. Building Codes 1. The Building plans for this site will be required to be stamped by a licensed structural engineer or architect due to the size of the building and all structural calculations shall be submitted for review along with the building plans. 2. Two of the parking spaces on the site will be required to be available to the disabled. These two spaces may share one striped access aisle and the plans will be reviewed for accessibility. 3. The fire flow requirements for this site can be achieved with the installation of a hydrant connected to the 6" main on 34 Ave. The north wall of the building is required to be a one -hour firewall. Traffic 1. The proposed driveway on 34th Avenue should be located as far away from the intersection of 34th Avenue with Powerhouse Road. While 34th Avenue is a Local Access Street, Powerhouse Road is classified as a Collector Arterial Street, which carries approximately 1,900 vehicles daily. Both streets are currently two - lanes. Sidewalk exists north of the intersection on 34th Avenue and the Canal Pathway is located directly across Powerhouse Road from this development site. 2. Traffic Engineering supports the construction of a sidewalk along the frontage of both street frontages. 3. Both Powerhouse Road and North 34th Avenue are identified on the City of Yakima Bicycle Plan as recommended cycling routes. Accommodations for cyclists should also be considered by constructing wide outside lanes (14 feet) for shared use. Yakima Regional Clean Air Authority (YRCAA) 1. The proponent shall file with, and gain approval from YRCAA, a site dust control plan to address demolition, site preparation, construction and landscaping phases. The proponent is required to survey for asbestos in the structure scheduled for demolition. No other comments were received TRAFFIC CONCURRENCY. The Traffic Concurrency review for this project was completed on May 23, 2003. Based upon the information provided by the applicants this development will not adversely impact the arterial streets, reserve capacity exists and this development did not diminish the Level of Service for any arterial street below an acceptable level. STATE ENVIRONMENTAL POLICY ACT. On June 6, 2003 the City of Yakima issued a Declaration of Non - significance for environmental checklist #4 -03. The 20 -day comment period, which precedes the issuance of this DNS, ended June 5, 2003 with no comments received during the 20 -day comment period. The 15 -day appeal period for this DNS ended on June 23, 2003. PUBLIC NOTICE. Notice for the hearing was provided in accordance with the UAZO requirements in the following manner: Mailing of notice May 9, 2003 Posting of property June 6, 2003 Legal Ad published June 6, 2003 No comments were received during the comment period. ANALYSIS. There are two primary issues raised by this application. The first issue concerns the appropriateness of rezoning the property from R -2 to R -3 and the second issue concerns the compatibility of permitting professional offices to locate within the R -3 zoning district. As far as the rezone is concerned it is well supported by the future land use map and by the fact that all infrastructure necessary to support the requested development is or soon will be available. There have been numerous significant changes in the area that trend towards high- density residential and commercial type developments. Concerning the Class (3) request to permit professional offices. For precisely the same reasons that support the rezone, recent changes in area land use, their approval is equally appropriate. Additionally, the location of the office building will tend to buffer the residential portions of this project from possible vehicular noise emanating from Power House Road. Adequate public services are available to meet all utility and access requirements of this proposal. 4. Traffic Concurrency review indicates that this development will not exceed the PM peak hour capacity of the City Arterial street system and reserve capacity exists on all impacted streets. 5. Additional right -of -way and street improvements are necessary to comply with Title 12 Development Standards as follows. a) An additional 5 feet of right -of -way shall be dedicated along 34 Ave, with asphalt widening to 16 feet from centerline; curb and gutter, 5 -foot sidewalk, controlled drainage and a streetlight at the intersection in accordance with Title 12 Development Standards. b) The driveway access from 34 shall be relocated to the northern edge of the proposed site to maintain maximum distance from the Powerhouse intersection and is required to meet City Commercial Approach standards. c) An additional 20 feet of right -of -way from the Powerhouse Road frontage shall be dedicated to the City of Yakima to meet Title 12 Requirements, and this frontage is required to be improved to City Development Standards with 27 feet of asphalt paving from centerline to the face of the curb, curb, gutter and a 5 -foot wide sidewalk, controlled drainage. In addition the property line intersection shall be rounded to a minimum radius of 20 feet. 6. During project review it has been determined that this request is in compliance with YMC 16.06.020(B) for making a Determination of Consistency as follows: a) The density of the development is not a factor with this application. b) Professional offices are a Class (3) permitted use in the R -3 zoning district. c) Adequate public facilities are available to serve this site. d) The proposal is consistent with development standards of the zoning ordinance. 7. SEPA review resulted in the issuance of a DNS on June 6, 2003. The appeal period for this determination ended, June 21, 2003. 9. This development will not exceed the PM peak hour capacity of the City Arterial street system and reserve capacity exists on all streets impacted by this development. 10. No adverse impacts have been identified from granting this approval. 11. Public Notice for this hearing was provided in accordance with zoning ordinance requirements. 12. This rezone and Class (3) Review are compatible with the future land use map III -3 and land use compatibility Figure III -3 of the Comprehensive Plan. 13. There have been significant land use changes within the area that support this move from moderate density residential development to high- density residential /professional business development. 14. The proponent shall file with, the YRCAA, a site dust control plan to address demolition, site preparation, construction and landscaping. 15. The proponent shall be required to conduct a survey for asbestos for the structure scheduled for demolition. 16. Approval of this rezone master application will have the following public benefits: increased investment, increased tax base with the improvement of the property, and increased employment opportunities as well as increased ascetic values and recreational opportunities for the surrounding community. • RECOMMENDATION. The Division of Environmental Planning recommends that this master application be approved subject to the following conditions. 1. Site Screening standard A shall be applied to all sides of the property, which is a ten -foot wide landscaping planting strip with trees at a twenty —feet to thirty -feet centers, scrubs and ground cover. 3. That an approved plan for dust control during site preparation, construction, and landscaping, phases be obtained from the Yakima Regional Clean Air Authority. 4. .A final site plan shall be required showing any changes or conditions that might be required by the hearing examiner. 5. All structural calculations shall be submitted for review along with building plans. Two of the parking spaces are required to be available to the disabled. Two spaces may share one striped access aisle. The plans will be reviewed for accessibility. The fire flow required can be achieved with the installation of a hydrant from 34 Avenue (per Dave Brown). Right now there aren't any hydrants in the area. There is a huge main in Powerhouse and Dave stated we didn't want to tap that main for just a hydrant. The main in 34 Avenue is 6" and can provide the necessary fire flow required for this project. And the building is close enough to 34 Avenue to be adequately served from the street. A portion of the north side of the building is 10 ft from the north property line. This wall is required to be rated one -hour (openings are ok). A single medical office at the edge of the residential area would not be intrusive or disruptive. B. The comprehensive plan is for this area to stay residential and this request is consistent with the plan. C. Traffic capacity — current roads are sufficient in this moderate to low traffic area. Following your submittal of the amended site plan information, your application was determined to be complete for further processing May 6, 2003. Continued processing of your request will include, but is not limited to, the following actions: 1. A Notice of Application is to be sent to all property owners within 500 feet of your site. This notice will include a request for public comments during a 20 -day comment period as is required by the City of Yakima. Notice of Application is scheduled to be issued on May 9, 2003 and the comment period will end on May 29, 2003. 2. Following the comment period a SEPA Threshold determination will be issued. This is followed by a 15 day SEPA Appeal period. If not appealed a staff report will be prepared by the Planning Division, which will include a recommendation to the hearing examiner as well as any recommended conditions of approval. 3. An open record public hearing is scheduled before the City of Yakima's hearing examiner for June 26, 2003 at 9:OOAM in the City Council's hearing chamber at City Hall. The hearing examiner will issue a recommendation to the City Council. 4. Following the receipt of the Hearing Examiner's recommendations, a closed record public hearing will be scheduled for a City Council decision of your Master Application.
