Central Ave. and 1302 and 1304 Fair Ave. from Two - Family Residential (R -2) to Central Business District Support (CBDS); Terry P. Morton as applicant herein. WHEREAS, the Hearing Examiner for the City of Yakima issued a recommendation on May 8, 2003, recommending that the City approve the rezoning of certain parcels of property as more fully described herein, which rezone was applied for by Terry P. Morton; and WHEREAS, the City Council finds that the considerations of the Hearing Examiner in response to the requirements of Yakima Municipal Code ( "YMC ") § 15.23.030(E) are correct and appropriate, and that the same should be adopted by the City Council as its findings herein; and WHEREAS, the City Council finds that it is in the best interest of the City to enact the following; now therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA, WASHINGTON: Section 1. The following parcels of property as legally described on the attached Exhibit "A" incorporated herein by this reference and located at 906 E. Central Ave. and 1302 and 1304 Fair Ave. in the City of Yakima shall be, and the same hereby are, rezoned from Two - Family Residential (R -2) to Central Business District Support (CBDS): 191330 - 14459, - 14450, and — 14451. Section 2. The findings of the Hearing Examiner's recommendation in this matter dated May 8, 2003, are hereby adopted by the City Council as its findings in support hereof pursuant to YMC § 15.23.030(F), and are incorporated by this reference as if fully set forth herein. 7 Pa 363 1010812802:3031.358P Section 3. Any and all zoning, land use, and other similar maps maintained by the City of Yakima shall be amended or modified to reflect said rezone. Severability: If any section, subsection, paragraph, sentence, clause or phrase of this ordinance is declared invalid or unconstitutional for any reason, such decision shall not affect the validity of the remaining portions of this ordinance. Section 5. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter. This application requests a non - project rezone of three (3) parcels totaling about .69 of an acre in area from R -2, Two - Family Residential, to CBDS, Central Business District Support, at the intersection of East Central and Fair Avenues, and concurrent SEPA environmental review thereof. Notices. Notices for the hearing and the SEPA processes were provided in accordance with applicable ordinance requirements in the following manner: Mailing of SEPA notice of proposal March 7, 2003 Mailing of public hearing notice March 7, 2003 Mailing of SEPA notice of decision March 28, 2003 Publishing of SEPA decision March 28, 2003 Posting of public hearing notice on property April 4, 2003 Publishing of public hearing notice April 4, 2003 State Environmental Policy Act. HO Rezone Review Criteria. Recommendations regarding rezone applications within the Yakima Urban Area must be based upon criteria specified in Section 15.23.030 of the Yakima Municipal Code: 1. Testimony at public hearing. Assistant Planner Mary Lovell and the applicant's representative Bill Hordan spoke in favor of the proposed rezone. Greg Stewart, the Central Washington State Fair Association President and General Manager, submitted two letters and spoke about concerns regarding potential uses of the property which he illustrated by submitting numerous photographs of existing uses in the vicinity of the fairgrounds. He expressed concern specifically that the applicant would use the property in conjunction with his towing business because inoperative cars had been moved onto the lot and at least one such car was seen parked across the street from the property near an entrance to the fairgrounds. He also expressed concern more generally that the property would be used for automotive related uses and other uses permitted in the CBDS zoning district that could involve storage and use of unsightly objects. The applicant Terry Morton dispelled Mr. Stewart's immediate concerns when he testified that he does not intend to use the subject property in connection with his towing business, that vehicles had only temporarily . been stored on his property until he located other property where he now stores them and that he had nothing to do with the vehicle that had been parked across the street from his property. Mr. Hordan indicated that he could not recommend that his client agree to a contract rezone limiting his client's future options for the property. He submitted photographs showing that the fairgrounds property is surrounded by many automotive uses of the type that Mr. Stewart would wish to prevent from being established on the applicant's property and indicated that some automotive uses take place on the fairgrounds. He also pointed out that only Boise Cascade's M -2 zoning designation is less restrictive than the fairgrounds' M -1 zoning designation. • 3 Examiner's Decision Tony Morton Central & Fair Ave UAZO RZ #1 -03; EC #1 -03 1111 1131 1111 736380 003 O ji. 1111 /0866123 0Q 58R • t � Mr. Hordan's inventory of automotive related uses in the vicinity of the fairgrounds included the Yakima Speedway, three gas stations, four mini marts, Cummins, Hyster, Kenworth Northwest truck sales and repairs, All Star Towing, C & J Auto House sales and rebuilders, Baker's Auto Repair, Competitive Engineering race car builders, Pacific Avenue tractor sales, Bowden's Auto Parts, Classic Auto Wash, Peninsula Truck Lines, Paul's Body Shop, Chris' Recovery Shop, Schuck's Auto Supply, EZ Towing, Tiger Oil, M & R Auto Sales and County shops where gravel is stored for road uses. City Planner Mary Lovell explained that uses surrounding the fairgrounds which Mr. Stewart described as unsightly were either started prior to annexation or prior to adoption of existing zoning development standards and that future CBDS uses on the subject property would be subject to existing screening and other requirements that cannot . be imposed upon existing "grandfathered" uses. 2. Suitability of property for proposed use. The property is well suited for the uses permitted within the CBDS zoning district. Its size, location and proximity to other uses allowed in the CBDS zoning district satisfy this criteria. 3. Recommendations from interested agencies and departments. No agencies submitted any recommendations concerning this non - project rezone. No technical problems with this rezone application were noted at the design services team meeting held on March 19, 2003. No written comments were received since this is a non - project rezone. All necessary public services for future property development are readily available. The City Traffic Engineer will defer concurrency review under the Transportation Capacity Management Ordinance until a specific land use is proposed. 4. Compliance with the Comprehensive Plan and Zoning Ordinance. AA �_�. _ r.. amendment process in 2001. The Regional Planning. Commission and the Joint Board comprising the City Council and County Commissioners approved the plan amendment to Arterial Commercial. The Yakima City Council adopted the Ordinance authorizing the change to the future land use map on November 18, 2001. This rezone will bring the subject property into compliance with its comprehensive plan designation and is consistent with the following Policies and Objectives of the comprehensive plan: (a) The Comprehensive Plan Future Land Use Map designates this area as suitable for Arterial Commercial development. The Future Land Use to Zoning Map Consistency Chart, Figure III -3, states that the Arterial Commercial designation is compatible with the CBDS, Central Business District Support zoning district. (b) Objective G1.1 seeks to encourage the physical development of the Yakima urban area in a manner that enhances its image as the cultural and } business center. (c) Policy C8.2 seeks to encourage major commercial, industrial, and multi- family developments to locate within city limits. (d) Policy G9.4 seeks to encourage commercial, industrial, office and multi- family developments to locate in distinct clusters in planned growth areas. Insofar as the of the Yakima Urban Area Zoning Ordinance is concerned, Chapter 15.03.030 states that the purpose of the CBDS zoning district is to accommodate wholesale and retail activities with some high- density residential development. This district is primarily located near the central business district and along the major arterials leading to the central business district. Adequacy of public utilities. This property is currently served by all necessary public utilities. Street access is from East Central Avenue, which is classified as a Local Access Street, and Fair Avenue, which is classified as a Minor Arterial Street. 6. Compatibility of proposed use. This is a non - project rezone. Compatibility will be determined for future uses based upon Table 4 -1 of the Urban Area Zoning Ordinance. Some of the uses permitted in the CBDS zone would need to be effectively screened to prevent them from becoming unsightly to adjoining residents and to patrons of the fairgrounds. Even though the subject parcels are immediately surrounded by residential uses on three sides, the area seems to be more in transition to CBDS uses than to residential uses. CBDS uses are nearby and are the predominant uses surrounding the fairgrounds. The fairgrounds presently is used for mixed recreational uses, including some automotive - related uses. Its M -1 zoning designation allows additional diverse uses which are more compatible with CBDS uses than are some of the present uses of the fairgrounds. Mr. Stewart has made many good points in his letters and testimony regarding the need to present a positive image to visitors and others utilizing the recreational facilities at the fairgrounds. The future uses on the subject property which could otherwise become unsightly will be required to be sight screened. Insofar as Mr. Stewart suggests that current sight screening requirements might not effectively screen such uses, the problem he raised about fences becoming unsightly because of graffiti is already a concern of the City Council which is considering new ordinance provisions to deal with that difficult problem. Any type of sight screening could potentially become ineffective because of vandalism. The evidence presented by the Planning Department and by Mr. Hordan indicates that CBDS uses on the subject property will be compatible with the many other CBDS uses in the vicinity and as compatible as possible with the fairground uses across Fair Avenue to the east so long as future sight screening requirements and steps to control graffiti are effective -- at least as effective as they reasonably can be in view of the practical and legal difficulties involved in adoption and enforcement of ordinance provisions specifically addressing those issues. 7. Public Need. This rezone fulfills the public need for zoning regulations and uses that are consistent with the City's Comprehensive Plan. CONCLUSIONS 1. The Hearing Examiner has jurisdiction to issue a recommendation to the City Council on this rezone application. 2. The public notice requirements of Chapters 15 and 16 of the Yakima Municipal Code have been satisfied. 3. SEPA review resulted in the issuance of a declaration of nonsignificance on March 28, 2003 and the evidence does not disclose any significant adverse environmental impacts that would result from approval of this rezone request. 4. Adequate public services are in place to satisfy the utility and access requirements of this proposal. 5. The proposed rezone is consistent with the future land use map designation as Arterial Commercial. The property is now designated Arterial Commercial by the Yakima Urban Area Comprehensive Plan and is located in a mixed -use commercial and residential area of the City. 7. This rezone satisfies the seven criteria specified in Section 15.23.030 Yakima Municipal Code for approving the rezone. 8. All agencies and city departments indicate that public services are available to the site and that this rezone would not create any infrastructure problems. RECOMMENDATION The Hearing Examiner recommends that this rezone from R -2, Two - Family Residential, to CBDS, Central Business District Support, be APPROVED. DATED THIS 8 day of May, 2003. He also pointed out that only Boise Cascade's M -2 zoning designation is less restrictive than the fairgrounds' M -1 zoning designation. 3 Examiner's Decision Terry Morton Central & Fair Ave UAZO RZ #1 -03; EC #1 -03 Mr. Hordan's inventory of automotive related uses in the vicinity of the fairgrounds included the Yakima Speedway, three gas stations, four mini marts, Cummins, Hyster, Kenworth Northwest truck sales and repairs, All Star Towing, C & J Auto House sales and rebuilders, Baker's Auto Repair, Competitive Engineering race car builders, Pacific Avenue tractor sales, Bowden's Auto Parts, Classic Auto Wash, Peninsula Truck Lines, Paul's Body Shop, Chris' Recovery Shop, Schuck's Auto Supply, EZ Towing, Tiger Oil, M & R Auto Sales and County shops where gravel is stored for road uses. City Planner Mary Lovell explained that uses surrounding the fairgrounds which Mr. Stewart described as unsightly were either started prior to annexation or prior to adoption of existing zoning development standards and that future CBDS uses on the subject property would be subject to existing screening and other requirements that cannot be imposed upon existing "grandfathered" uses. 2. Suitability of property for proposed use. The property is well suited for the uses permitted within the CBDS zoning district. Its size, location and proximity to other uses allowed in the CBDS zoning district satisfy this criteria. 3. Recommendations from interested agencies and departments. No agencies submitted any recommendations concerning this non - project rezone. No technical problems with this rezone application were noted at the design services team meeting held on March 19, 2003. No written comments were received since this is a non - project rezone. All necessary public services for future property development are readily available. The City Traffic Engineer will defer concurrency review under the Transportation Capacity Management Ordinance until a specific land use is proposed. 4. Compliance with the Comprehensive Plan and Zoning Ordinance. The applicant requested a change to the future land use map from Medium Density Residential to Arterial Commercial during the annual Comprehensive Plan 4 Examiner's Decision Terry Morton Central & Fair Ave UAZO RZ #1 -03; EC #1 -03 amendment process in 2001. The Regional Planning Commission and the Joint Board comprising the City Council and County Commissioners approved the plan amendment to Arterial Commercial. The Yakima City Council adopted the Ordinance authorizing the change to the future land use map on November 18, 2001. This rezone will bring the subject property into compliance with its comprehensive plan designation and is consistent with the following Policies and Objectives of the comprehensive plan: (a) The Comprehensive Plan Future Land Use Map designates this area as suitable for Arterial Commercial development. The Future Land Use to Zoning Map Consistency Chart, Figure III -3, states that the Arterial Commercial designation is compatible with the CBDS, Central Business District Support zoning district. (b) Objective G1.1 seeks to encourage the physical development of the Yakima urban area in a manner that enhances its image as the cultural and business center. (c) Policy C8.2 seeks to encourage major commercial, industrial, and multi- family developments to locate within city limits. (d) Policy G9.4 seeks to encourage commercial, industrial, office and multi- family developments to locate in distinct clusters in planned growth areas. Insofar as the of the Yakima Urban Area Zoning Ordinance is concerned, Chapter 15.03.030 states that the purpose of the CBDS zoning district is to accommodate wholesale and retail activities with some high - density residential development. This district is primarily located near the central business district and along the major arterials leading to the central business district. Adequacy of public utilities. This property is currently served by all necessary public utilities. Street access is from East Central Avenue, which is classified as a Local Access Street, and Fair Avenue, which is classified as a Minor Arterial Street. 6. Compatibility of proposed use. This is a non - project rezone. Compatibility will be determined for future uses based upon Table 4 -1 of the Urban Area Zoning Ordinance. Some of the uses permitted in the CBDS zone would need to be effectively screened to prevent them from becoming unsightly to adjoining residents and to patrons of the fairgrounds. Even though the subject parcels are immediately surrounded by residential uses on three sides, the area seems to be more in transition to CBDS uses than to residential uses. CBDS uses are nearby and are the predominant uses surrounding the fairgrounds. The fairgrounds presently is used for mixed recreational uses, including some automotive - related uses. Its M -1 zoning designation allows additional diverse uses which are more compatible with CBDS uses than are some of the present uses of the fairgrounds. Mr. Stewart has made many good points in his letters and testimony regarding the need to present a positive image to visitors and others utilizing the recreational facilities at the fairgrounds. The future uses on the subject property which could otherwise become unsightly will be required to be sight screened. Insofar as Mr. Stewart suggests that current sight screening requirements might not effectively screen such uses, the problem he raised about fences becoming unsightly because of graffiti is already a concern of the City Council which is considering new ordinance provisions to deal with that difficult problem. The Hearing Examiner is not inclined to conclude that existing sight 6 Examiner's Decision Terry Morton Central & Fair Ave UAZO RZ #1 -03; EC #1 -03 screening requirements for the subject property will necessarily be ineffective because of the present problem with graffiti. Any type of sight screening could potentially become ineffective because of vandalism. The evidence presented by the Planning Department and by Mr. Hordan indicates that CBDS uses on the subject property will be compatible with the many other CBDS uses in the vicinity and as compatible as possible with the fairground uses across Fair Avenue to the east so long as future sight screening requirements and steps to control graffiti are effective -- at least as effective as they reasonably can be in view of the practical and legal difficulties involved in adoption and enforcement of ordinance provisions specifically addressing those issues. 7. Public Need. This rezone fulfills the public need for zoning regulations and uses that are consistent with the City's Comprehensive Plan. CONCLUSIONS 1. The Hearing Examiner has jurisdiction to issue a recommendation to the City Council on this rezone application. 2. The public notice requirements of Chapters 15 and 16 of the Yakima Municipal Code have been satisfied. 3. SEPA review resulted in the issuance of a declaration of nonsignificance on March 28, 2003 and the evidence does not disclose any significant adverse environmental impacts that would result from approval of this rezone request. 4. Adequate public services are in place to satisfy the utility and access requirements of this proposal. 5. The property is now designated Arterial Commercial by the Yakima Urban Area Comprehensive Plan and is located in a mixed -use commercial and residential area of the City. 7. This rezone satisfies the seven criteria specified in Section 15.23.030 Yakima Municipal Code for approving the rezone. 8. The CWFA is not opposed to responsible commercial development along Fair Avenue next to its property. However, for reasons I will explain to you in this letter, the CWFA -and its Board believe - some of the uses allowed in the CBDS zones are not compatible with the image CWFA is trying to convey to the public. At the outset, CWFA believes the City is responsible to insure that any business use is properly maintained, site screened and operated so that is does not become an "eye sore" to adjoining residents and the people of the City of Yakima County using the recreational facilities along Fair Avenue. From the City's Notice, it is clear that the Morton's rezone application is a non - project rezone, meaning that the owner does not know what commercial uses he will place on his property. On behalf of CWFA, I reviewed what uses are allowed outright in the CBDS zone in the City's Urban Area Zoning Ordinance. To my surprise, the CBDS zone appears to allow many intensive commercial and industrial uses without public review which the Board believes would create compatibility conflicts with CWFA's recreational property and the image the Fairgrounds is trying to convey to residents and guests using the facility. Uses CWFA would oppose or have extreme concern would include the storage of gravel and equipment for street construction, machinery and equipment manufacturing (and related storage), waste material processing and junk handling, truck brokerages, utility substations, and probably most importantly, all "automotive uses" (auto repair, body, paint shops, and towing and wrecking services): One only needs to drive around town to see what small automotive repair, paint and body shops can look like when vehicle parts and 'unk are stored Q O PINING t - -. zw ' "Z 00' , P P.O. Along Fair Avenue, no amount of site screening will protect the Fairgrounds and nearby residents from unsightly, noisy or incompatible businesses as I understand that front yard fence heights are limited. Even site screening or slated fences do not protect the views and many fences in the area, including the applicant's, already have been vandalized with graffiti. While CWFA and its Board do not mean to "pick on" this applicant, the City only needs to look at Mr. Morton's property on South First Street as an example of what City sanctioned commercial uses could look like. Mr. Morton's property on South First Street is littered with unsightly building materials, machine parts and garbage that the small fence cannot hide. In fact, the first thing the property owner did after filing his application was to move what appears to be four or five non - working cars onto his property. I had already spoken with Doug Maples whether used cars and parts can be stored on the property. From my phone conversation with Mr. Maples, CWFA's understanding is that no automotive repair or related uses are allowed until or unless they are approved through this rezone process. The Fair Board sincerely hopes that if the City authorizes any commercial uses on the Morton property, the owner and operator will run the business in a clean and sightly manner consistent with applicable law, and that the City will insure through written conditions attached to any rezone or permit application (and by enforcing its nuisance code) that this occurs. CWFA understands that some commercial redevelopment with conditions may be appropriate and there are some commercially zoned properties in the area. However, it also believes that certain uses such as the ones outlined in this letter are not appropriate. Over the past ten years, our understanding is the City, County and Fairgrounds have all been working toward a common goal of redeveloping and improving the Fair Avenue corridor between the Yakima Avenue and Nob Hill Blvd interchanges for the benefit of the Yakima community and the local and regional events hosted by the Fairgrounds. The Fairgrounds and the SunDome are the centerpieces of many of these events and it would be a shame to take a development step "backwards," by allowing small, unsightly commercial uses such as towing or wrecking yards, automobile paint, body and repair shops, or equipment storage, just to name a few, right across the street. CWFA believes the uses allowed in the CBDS zone are too broad and may adversely impact the neighborhood around the Fairgrounds. One solution would be to limit or disallow certain uses currently allowed outright in the CBDS zone. The Fair Board's understanding is that the City and County have done this in the past through written recorded agreements between the City and the applicant. The Board would not take issue with a well- maintained community service or retail business where building materials, machines, car parts and unsightly objects are not stored outside. However, CWFA believes that more intensive manufacturing or commercial uses likely to involve outside storage and use of unsightly objects (including all automotive related uses) simply should not be allowed. In addition, any commercial or business use that is authorized should be conditioned upon compliance with stringent site screening requirements so that unsightly objects and commercial uses cannot be seen from the streets and sidewalks right across from the Fairgrounds. The Fair Board would assume that this would be done to protect nearby residential uses as well. Another condition that would be appropriate would be to limit or eliminate altogether, the ability to store garbage, machinery, equipment, unused or non - operating vehicles or parts, except in an enclosed structure on the property. One alternative the City might consider is whether a "B -2" zone may be more appropriate. In reviewing the Table of Permitted Land Uses, most of the objectionable uses are not allowed in the local business zone and are only allowed with additional review by the City. Therefore, it appears the B -2 zone would strike a better balance between the applicant's need for some commercial uses and the residents' and the Fair Board's concerns that intensive commercial or unsightly uses not be allowed. CWFA and its Board appreciates the City's consideration of the written comments outlined in this letter, and it will try to have a representative present at the April 24th hearing to further express its concerns. Is the requested zoning change suitable with the property in question (subject property)? How so? The requested zone change is suitable with the subject property because the general area lying to the west and south is already zoned Central Business District Support (CBDS) and contains numerous commercial activities. Lands to the east contain the Central Washington State Fairgrounds and are zoned Light Industrial (M -1). Property to the North is zoned Two - family Residential (R -2) and generally contains single - family residences. This area is a classic mixed use neighborhood. The subject property is currently vacant and ready for development once the property is rezoned. The property is served by both Fair Avenue and East Central Avenue, both roadways are constructed to full urban standards. The property can also be served with domestic water, sewer and all other required utilities for commercial development. For these reasons, the requested zoning is suitable with the property. For the record, it should be stated that the properties which adjoin this proposal on the west and south contain residential uses, are zoned R -2 and have an "inconsistent" Arterial Commercial Land Use Designation. The applicant verbally contacted the property owner's on the west and south and requested that they join in this rezone application to make it a better application, however, the property owner's have declined to participate. B. How is the rezone request in compliance with and /or how does the request deviate from the 1997 Yakima Urban Area Comprehensive Plan as amended? The rezone request will bring the zoning into compliance with the Yakima Urban Area Comprehensive Plan, as amended. In 2001, the City approved a Comprehensive Plan Amendment to the Future Land Use Map and added five properties to the Arterial Commercial Land Use Designation (see UAZO CPA #3 -01). By rezoning the properties to Central Business District Support (CBDS), this will bring the land use designation and zoning into compliance with the Yakima Urban Area Comprehensive Plan and Yakima Urban Area Zoning Ordinance as required by State Law. C. Are there adequate public facilities, such as traffic capacity, sewer service, potable water, storm water and other public services and infrastructure existing on and around the subject property? Are the existing public facilities capable of supporting the most intensive use of the new (requested) zone? If not, what mitigating measures are going to be implemented to address any short falls in public services that may exist? All the properties proposed to be rezoned are currently vacant and have access to all urban utilities and services. Since the properties lie at an intersection of two roadways, all urban services are available and have been sized for future development. Adequate water and sewer lines exist, stormwater is currently provided for on -site or within the existing street grid, and traffic capacity is adequate because the property fronts on two urban area roadways. The property is also served with City police, fire and garbage service. D. Is the proposed zone change and associated land use changes compatible with the existing neighboring uses? What mitigating measures are planned to address incompatibility, such as site screening, buffering building design, open space, traffic flow alteration, etc.? The proposed zone change is compatible with neighboring uses because most of the property to the south, west and east currently contain commercial and industrial activities and are zoned for such uses. These activities have been in existence for sometime and are well established uses. The uses are a mixture of governmental uses (fire station and fire training center), recreational uses (fairgrounds), residential uses as well as many small neighborhood commercial uses. Any new use of the property will be required to meet appropriate development standards, such as sitescreening, buffering and traffic considerations etc,. This rezone is a non - project rezone and the property owners currently do not anticipate any immediate changes to the property. E. Is there a public need for the proposed change? There is a public need for the proposed change for several reasons. The primary reason is that there is a lack of available CBDS property in this area. The last available vacant pieces of CBDS property in this area are currently being developed as this application is being submitted (espresso stand and carwash). The property owners have received some interest from developer's looking at their site for future development, but no specific project has been proposed to the owner. This indicates that a need exists for more commercially zoned property in this area. A public need would also be served because the zone change would provide an area for commercial activities outside the central business district that meets the local demands for commercial needs of the East and Southeast Yakima community. Morton rezone File No. UAZO RZ #1 -03; EC # 1 -03 NOTICE OF PROPOSAL On February 4, 2003 the City of Yakima Department of Community & Economic Development received a rezone application from Hordan Planning Services, on behalf of Terry P. Morton, to rezone property located at 906 East Central Avenue, 1302 & 1304 Fair Avenue. The applicant wishes to rezone the properties, from R -2, Two - Family Residential to CBDS, Central Business District Support. This is a non - project rezone, and no development proposal has been submitted. This application is subject to approval. The application was considered complete for processing on March 3, 2003. The complete application is available for public review at the City of Yakima Planning Division, 2nd floor City Hall, 129 North 2nd Street, Yakima, WA. ENVIRONMENTAL REVIEW The City of Yakima Department of Community & Economic Development is lead agency for this proposal under the State Environmental Policy Act (SEPA). The environmental checklist and other information on file with the Planning Division are available to the public upon request. Written comments concerning the environmental impacts for the proposal will be accepted during the 20 -day comment period, which ends March 27, 2003. The threshold environmental determination will be issued under WAC 197 -11 -355, the Optional review process; there will not be an additional comment period. The threshold determination may be appealed to the Hearing Examiner by filing a written notice of appeal with the City Planning Division within fourteen days of the date of mailing of the threshold determination in accordance with the City of Yakima Municipal Code 6.88.170. NOTICE OF "OPEN" RECORD PUBLIC HEARING An open record public hearing will be held before the Hearing Examiner on Thursday, April 24, 2003 at 9:00 a.m. in the Yakima City Council Chambers, 129 North 2nd Street, Yakima, WA 98901.
