HomeMy WebLinkAbout2003-037 Appropriation; Wastewater Litigation Defense Expenses ORDINANCE NO. 2003 37 AN ORDINANCE amending the 2003 budget for the City of Yakima, and making appropriations to provide for htigation defense from Unappropriated Fund Balances within various Funds for expenditure durmg 2003 WHEREAS, the various funds mdicated on the attached Schedule I contain Unappropriated Fund Balances available for appropriation and expenditures durmg 2003 in various amounts and for the purposes mentioned m the attached Schedule, and WHEREAS, at the time of the adoption of the 2003 budget it could not reasonably have been foreseen that the appropriation provided for by this ordmance would be required, and the City Council finds that an emergency exists of the type contemplated by RCW 35.33 091 and that it is in the best mterests of the City to make the appropriation herem provided, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA. Section 1. Appropriations are hereby made, for expenditure during 2003, from Unappropriated Fund Balances m the various Funds to the various accounts and m the various amounts, and for the vanous specific purposes, all as specified m the Schedule attached hereto and mcorporated herein. Section 2. An Ordinance Amending the 2003 Budget and Making an Appropriation in the Wastewater Funds to Provide for Litigation Defense SUBMITTED BY Glenn Rice, Assistant City Manager Doug Mayo, Wastewater Manager Cindy Epperson, Financial Services Manager CONTACT PERSON /TELEPHONE Doug Mayo, 575 -6077 SUMMARY EXPLANATION In a separate ordinance, City Council is requested to approve an adjustment to Wastewater rates, in order to generate enough cash flow to continue to defend the City's position in the odor litigation case. This expense is estimated to be about $500,000 more than originally budgeted in 2003 The attached appropriation estimates the revenue to be generated in 2003 from the rate adjustment (about $265,000), and increases the budget for related taxes. It also increases the transfer to the Wastewater Facility Capital Fund and increases the legal professional services account in this fund by $500,000 After considering this appropriation, and the proposed appropriation for biosolid disposal (a separate item for Council action), reserve levels are budgeted to be about $700,000 in the Wastewater Operating Fund. This represents just slightly over 5% of the amended expenditure budget of $13.8 million — maintaining the targeted minimum reserve level. (Reserve estimates in the Capital Fund are unchanged by this transaction.) Staff respectfully submits the attached Budget appropriation for your consideration and approval.
