WHEREAS, the Hearing Examiner for the City of Yakima issued a recommendation on February 21, 2003, recommending that the City approve the rezoning of certain parcels of property as more fully described herein, which rezone was applied for by Richard Johnson, et al., and WHEREAS, the City Council finds that the considerations of the Hearing Examiner in response to the requirements of Yakima Municipal Code ( "YMC") § 15.23 030(E) are correct and appropriate, and that the same should be adopted by the City Council as its findings herein, and WHEREAS, the Hearing Examiner recommended that as a condition for approval of said rezone the applicant shall enter into an agreement acceptable with the City of Yakima Engineering Department to establish terms by which the applicant will be required to provide for such public infrastructure and right -of -way dedications as may be required at such time as a specific development project occurs; and WHEREAS, the City Council finds that it is in the best interest of the City to enact the following; now therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA, WASHINGTON Section 1. The findings of the Hearing Examiner's recommendation in this matter dated February 21, 2003, are hereby adopted by the City Council as its findings in support hereof pursuant to YMC § 15.23.030(F), and are incorporated by this reference as if fully set forth herein. Section 3. Any and all zoning, land use, and other similar maps maintained by the City of Yakima shall be amended or modified to reflect said rezone. The City Clerk is hereby authorized and directed to file a certified copy of this ordinance with the Yakima County Auditor Section 4. Severability' If any section, subsection, paragraph, sentence, clause or phrase of this ordinance is declared invalid or unconstitutional for any reason, such decision shall not affect the validity of the remaining portions of this ordinance. Section 5. Notices. Notices of the hearmg and the SEPA processes were provided in accordance with the applicable ordinance requirements in the following manner Mailing of SEPA notice January 8, 2003 Mailing of hearing notice January 8, 2003 Posting of property with hearing notice January 20, 2003 Publishing of hearing notice January 23, 2003 Mailing of SEPA decision January 29, 2003 Environmental Review. On January 29, 2003, the City of Yakima issued a Determination of Nonsignificance for Environmental Checklist #27 -02. No comments were received and no appeals were filed. Zoning and Land Use. Suitability of property for uses in proposed zone. Two of the three parcels contain single- family homes and the third contains a legal nonconforming antique shop The existing antique shop would become a conforming use and the existing residences would remain conforming uses if this rezone request is granted. Small commercial uses are located near by When a specific land use is proposed for this property, all applicable development standards will be met or adjustments approved following the prescribed public notice and comment requirements. 3. Recommendations from interested agencies. Other than informational comments, no agencies submitted recommendations to approve or deny the rezone. 4. Compliance with Comprehensive Plan and with Intent of Zoning Ordinance. In October, 2002, the future laid use map designation for this property was changed from moderate density residential to neighborhood commercial. Figure III =3 of the Comprehensive Plan indicates that the B -2 Local Business zoning district is fully compatible with the neighborhood commercial Comprehensive Plan designation. 5. Adequacy of public utilities. All required public utilities are presently available. Sewer is provided by the City of Yakima and water by the Nob Hill Water Company Street access is provided by Tieton Drive and South 56th Avenue which are both classified as minor artenal streets. Bus Routes No 2 and 5, Tieton and Nob Hill West, provide transit service. 6. Compatibility of uses in proposed zone. All Class (1) commercial land uses within the B -2 zoning district will be required to site screen from existing residential uses and all Class (2) and (3) uses may be required to provide additional site screening or buffering as a condition of their approval. 7. Public Need. This rezone fulfills the pubhc need for uses in the area that are consistent with the City's Comprehensive Plan, with the City's B -2 Local Business zoning designation and with existing uses in the area. Right of Way, Infrastructure and Traffic Concurrency. The City engmeermg division recommendation that the nght of way and frontage improvements be deferred subject to recording of an acceptable deferment agreement at this time is reasonable and recommended by the Hearing Exammer Currently, reserve capacity exists on all impacted streets. When specific land uses are proposed, traffic concurrency review will be required prior to development. CONCLUSIONS 1 The hearing examiner has jurisdiction to issue a recommendation to the City Council on this rezone application. 2. New commercial development in this location will result m public benefits from increased mvestment in the local economy, increased tax base with the improvement of the property, and increased employment opportunities RECONIMENDATION Subject to the applicant's obligation to provide an acceptable deferment agreement to the City, the Hearing Exammer recommends this rezone application from R -2 to B -2 be APPROVED. This is a non - project specific request to rezone property from R -2, Two - Family Residential to B- 2, Local Business and, as with all rezone actions, an environmental review is concurrently conducted as a requirement of the Washington State Environmental Policy Act (SEPA). BACKGROUND. This rezone request concerns three unplatted parcels of land, which total approximately 1.6 acres in area. The property is located within the city of Yakima near the intersection of S 56 Avenue with Tieton Drive. Each parcel has direct access onto a minor local arterial street. The land is relatively flat and there are no critical areas located on or near this site. The property is located within the secondary Yakima Airport overlay boundary. Sewer is currently provided by the City of Yakima and water by Nob Hill Water Company. CURRENT ZONING AND LAND USE. The properties are currently zoned R -2, Two - Family ResidentiaL Two of the three parcels contain single- family homes and the third parcel contains a legal nonconforming antique shop. This rezone would bring the antique shop into zoning conformance without affecting the conformancy of the existing residences. Adjacent properties have the following characteristics: Location Zoning Existing Land Use North R -2 Residential East R -1 Church West R -1 Residential South R -1, B -2 Commercial/Residential COMPREHENSIVE PLAN COMPLIANCE. The future land use map designation for this property was changed from moderate density residential to neighborhood commercial in October of 2002. The B -2, Local Business zoning Richard Johnson, and others 2 422 S 56th Avenue, 5607 & 5703 Tieton Drive RZ #9 -02, EC #27 -02 district is, according to Figure III -3 of the comprehensive plan, fully compatible with the neighborhood commercial comprehensive plan designation. URBAN AREA ZONING ORDINANCE. The B -2 Local Business district is intended to provide areas for commercial activities outside the Central Business District that meet the retail shopping needs of the community; and accommodate small scale commercial uses requiring high visibility and easy access to major arterials. Use characteristics of this district include small retail sales and service establishments. ZONING ORDINANCE DEVELOPMENT STANDARDS. The zoning ordinance sets forth specific standards for lot size, maximum lot coverage, minimum building setbacks, parking, building height, sight screening, etc. When a specific land use is proposed for this property all applicable development standards will be met or adjustments approved following the prescribed public notice and comment requirements. REZONE CRITERIA. Within the Yakima Urban Area, recommendations for the approval of rezone applications are governed by seven criteria specified in Section 15.23.030 YMC. 1. Testimony at public bearing. Testimony at a public hearing is one of the pivotal factors in making a determination of compatibility for any proposed rezone. 2. Suitability of property for proposed use. The property is well suited for the range of uses permitted within the B -2 zoning district. 3. Recommendations from interested agencies. Compliance with the Comprehensive Plan. This rezone is compatible with future land use map III -3 and land use compatibility chart III -2 of the Comprehensive Plan. The map indicates future land use for the subject property as Neighborhood Commercial, a designation that includes B -2, Local Business zoning, within its range of appropriate zoning classifications. 5. Adequacy of public utilities. All required public utilities are presently available. Tieton Drive and S 56th Avenue, both of which are classified as minor arterial streets, provide street access. Bus Routes No. 2 and 5, Tieton and Nob Hill West, provide transit service. 6. Compatibility of proposed use. This is a non - project rezone request. Compatibility will be determined for future uses based upon Table 4 -1 of the Urban Area Zoning Ordinance. 7. Public Need /Change in Circumstance. This rezone fulfills the public need for zoning regulations that are consistent with the City's Comprehensive Plan. DEVELOPMENT SERVICES TEAM (DST) REVIEW. A DST meeting was held on January 22, 2003. Representatives from City Planning, Engineering, Water, Utilities, Fire, and Building Codes were in attendance. Without a specific development project for review the DST comments are necessarily generic. Generally, all necessary public services for future property development are readily available. Engineering deferred any Title 12 requirements until such time as a change in use is proposed. TRAFFIC CONCURRENCY. Traffic Concurrency review for this non - project application is premature. When specific land uses are proposed Traffic Concurrency Review will be required prior to development. On January 29, 2003 the City of Yakima issued a Determination of Nonsignificance (DNS) for Environmental Checklist #27 -02. The required 20 -day comment period preceded the issuance of this DNS and there were no comments received during the comment period. PUBLIC NOTICE. Notice for this hearing was provided in accordance with the UAZO requirements in the following manner: Mailing of hearing notice January 8, 2003 Posting of property January 25, 2003 Legal Ad published January 25, 2003 ANALYSIS. The primary issues raised by this application are the appropriateness of rezoning the property from R -2 to B -2 and the compatibility of uses as yet unknown with existing residential development. As for the rezone it is supported by the Comprehensive Plan and by the fact that all infrastructure necessary to support development is available. As to compatibility all Class (1) commercial land uses within the B -2 zoning district will be required to site screen from existing residential uses and all Class (2) and (3) uses may be subject to providing additional site screening or buffering as a condition of their approval. CONCLUSIONS. 1. The hearing examiner has jurisdiction to issue a recommendation to the City Council on this rezone application. 2. No adverse impacts have been identified from granting this approval. Adequate public services are, or will be, in place to meet all utility and access requirements of this proposal. 4. Traffic Concurrency review is postponed until a specific land use is known. Currently, reserve capacity exists on all impacted streets. 5. SEPA review resulted in the issuance of a DNS on January 29, 2003. 6. Public Notice for this hearing was provided in accordance with zoning ordinance requirements. 7. This rezone is compatible future land use map III -3 and land use compatibility chart III -2 of the Comprehensive Plan. 8. Approval of this rezone will bring an existing legal nonconforming use into zoning consistency and provide additional area for future commercial development. New commercial development will have the following public benefits: increased investment in the local economy, increased tax base with the improvement of the property, and increased employment opportunities. RECOMMENDATION. The Division of Environmental Planning recommends this rezone application from R -2 to B -2 be approved. The existing right of way fronting this proposal is 60 feet wide, 30 feet on each side of centerline in both streets. This classification necessitates 80 feet of right of way, 40 feet on each side in accordance with title 12, Development Standards. Additional right of way, with this proposal, would be difficult to obtain due to the site being fully developed. Frontage improvements will be addressed as part of a development permit. At this time, the right of way and the frontage improvements shall be deferred subject to the developer completing a deferment agreement, through Engineering, and recorded. Any redevelopment would necessitate a review of this deferment. Proponent is also encouraged to file a Master Construction Dust Control Plan for projects planned now and in the future. The fee for a Construction Dust Control Plan is $205. • We recommend all vehicle travel and parking areas be paved. • If any of the present buildings should require demolition or renovation where asbestos could be disturbed, a Notification of Demolition and Renovation, filed with and approved by YRCAA is required. An asbestos survey must be completed, and all asbestos must be removed prior to demolition, per §3.07.F, G and H of YRCAA Regulations. The fee is set on the quantity of asbestos being removed. Is the requested zoning change suitable with the property in question (subject property)? How so? The requested zone change is suitable with the subject property because portions of the property already contain commercial uses. Two of the properties in this request also abut an existing property with which is currently zoned B -2. Those portions of the property which do not contain commercial uses, adjoin the existing commercial uses. This small commercial node has historically provided retail and service needs in the immediate area. Additionally, the property lies at the intersection of two urban arterial roadways and has direct access to both arterials. The request will also make an existing legal nonconforming use (antique store) located on one of the properties a legal use. For these reasons, the requested zoning is suitable with the property. B. How is the rezone request in compliance with and /or how does the request deviate from the 1997 Yakima Urban Area Comprehensive Plan as amended? The rezone request will bring the zoning into compliance with the Yakima Urban Area Comprehensive Plan, as amended. In 2002, the City approved a Comprehensive Plan Amendment to correct an error in the Future Land Use Map and add three adjoining properties to the Neighborhood Commercial Land Use Designation (see UAZO CPA #7 -02). By rezoning the properties to Local Business (B -2), this will bring the land use designation and zoning into compliance with the Yakima Urban Area Comprehensive Plan and Yakima Urban Area Zoning Ordinance as required by State Law. C. Are there adequate public facilities, such as traffic capacity, sewer service, potable water, storm water and other public services and infrastructure existing on and around the subject property? Are the existing public facilities capable of supporting the most intensive use of the new (requested) zone? If not, what mitigating measures are going to be implemented to address any short falls in public services that may exist? All the properties are currently developed with either a commercial or residential use located on them. The properties are currently served with all urban utilities and services. Since the properties lie at a major intersection of two I ) arterials, all urban services are available and have been sized for future development. Adequate water and sewer lines exist, stormwater is currently provided for on -site or within the existing street grid and traffic capacity is adequate because the property fronts on two urban area arterials. The property is also served with City police, fire and garbage service. Any new use proposed on the property can adequately be served with appropriate services because the area of the rezone is generally small in nature which limits the size of future development. D. Is the proposed zone change and associated land use changes compatible with the existing neighboring uses? What mitigating measures are planned to address incompatibility, such as site screening, buffering building design, open space, traffic flow alteration, etc.? The proposed zone change is compatible with neighboring uses because most of the property currently contains commercial activities. These activities have been in existence prior to zoning, and are either, currently zoned properly or legal nonconforming uses. The Future Land Use Map to Zoning Map Consistency Chart also recognizes that the B -2 Zoning and surrounding R -2 Zoning can be compatible with one another with the implementation of the zoning ordinance. Table 4 -1 will determine which uses are compatible or incompatible through Class 2 and Class 3 Reviews. Any new use will be required to meet appropriate development standards, such as sitescreening etc,. This rezone is a non - project rezone and the property owners currently do not anticipate any immediate changes to the property. The existing uses have proven to be compatible with the surrounding neighborhood and are expected to remain for some time. This request is mainly a house keeping procedure that recognizes the existing uses. E. Is there a public need for the proposed change? There is a public need for the proposed change for several reasons. The primary reason is that there is a lack of available B -2 property in the West Valley Area. The property owners have also received some interest from developer's looking at their site for future development. This indicates that a need exists for more commercially zoned property.
