Parcel Numbers: 181322 -21002 & 181322 -21004 II II II 11111111111111 7344-037 Page 1 of 10 YAKIMA CITY an nnn __ 07/93/2003 02 38 ORDINANCE NO. 2003- 27 AN ORDINANCE concerning land use regulation and planning and rezoning certain parcels of property located in the vicinity of 4202 Englewood Ave. from Single- Family Residential (R -1) to Two - Family Residential (R- 2), Richard Kohagen as applicant herein WHEREAS, the Hearing Examiner for the City of Yakima issued a recommendation on February 21, 2003, recommending that the City approve the rezoning of certain parcels of property as more fully described herein, which rezone was applied for by Richard Kohagen, and WHEREAS, the City Council finds that the considerations of the Hearing Examiner in response to the requirements of Yakima Municipal Code ("YMC") § 15.23.030(E) are correct and appropriate, and that the same should be adopted by the City Council as its findings herein; and WHEREAS, the Hearing Examiner recommended that as a condition for approval of said rezone the applicant shall enter into an agreement acceptable with the City of Yakima Engineering Department to establish terms by which the applicant will be required to provide for such public infrastructure and right-of-way dedications as may be required at such time as a specific development project occurs; and WHEREAS, the City Council finds that it is in the best interest of the City to enact the following; now therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA, WASHINGTON Section 1. The following parcels of property located in the vicinity of 4202 Englewood Ave. in the City of Yakima shall be, and the same hereby are, rezoned from Single- Family Residential (R -1) to Two-Family Residential (R -2): 181322 -21002 and 181322- 21004, provided, that as a condition to this approval, the applicant or any successor in interest shall, prior to any future development project at this location, enter into a negotiated agreement with the City and acceptable to the City Engineer whereby Page 1 of 2 7344037 Page 2 of 10 YAKIMA CITY CLERK ,._ 07I03l203 A? �Qc specific impacts due to said development, including with respect to public infrastructure demands and right-of-way dedication requirements, are identified and mitigated. Attached hereto and incorporated herein as Exhibit "A" is a copy of the legal descriptions of said parcels. Section 2. The findings of the Hearing Examiner's recommendation in this matter dated February 21, 2003, are hereby adopted by the City Council as its findings in support hereof pursuant to YMC § 15.23.030(F), and are incorporated by this reference as if fully set forth herein. Section 3. Any and all zoning, land use, and other similar maps maintained by the City of Yakima shall be amended or modified to reflect said rezone. The City Clerk is hereby authorized and directed to file a certified copy of this ordinance with the Yakima County Auditor Section 4. Severability• If any section, subsection, paragraph, sentence, dause or phrase of this ordinance is declared invalid or unconstitutional for any reason, such decision shall not affect the validity of the remaining portions of this ordinance. Section 5. Recommendations regarding rezone applications within the Yakima Urban Area must be based upon the followmg criteria specified in Section 15.23 030 of the Yakima Municipal Code: 1. Testimony at public hearing. The testimony presented at the public heanng consisted of the testimony of Senior Planner Dan Valoff and the applicant's representative Betty Barnes who both spoke in favor of approval of the rezone. 2. Suitability of property for uses in proposed zone. Subsection 15 03 030(3) of the City's Zoning Ordinance states that the Two - Family Residential zoning district is characterized by residential uses having up to fifty percent lot coverage, access via local access streets and collectors, one and two story buildings, some clustering of units, and large front, rear and side yard setbacks. Typical uses in this district are single- family dwellings and duplexes The density in this distract generally ranges from seven to twelve dwelling units per net residential acre. However, development up to eighteen dwellmg units per net residential acre may be allowed in limited situations where the higher density would be compatible with neighboring land uses, the level of public services and the goals and objectives in the Comprehensive Plan. The property in question is suitable for some residential uses m the proposed zone because the property is served with all urban services, is located m an area in general proximity to existing shopping, schools, medical care facilities, and churches, and offers easy access to transportation corridors and public transportation routes. When a specific land use is proposed for this property, all applicable development standards will be complied with or adjusted following the applicable procedures for public notice and comments. All agencies and City departments which reviewed the proposal indicated that public services are available to the site and that this rezone would not create infrastructure problems. 4. Compliance with Comprehensive Plan and with Intent of Zoning Ordinance. The 1997 Yakima Urban Area Comprehensive Plan's Future Land Use Map designates this area as suitable for Low Density Residential development. This rezone would serve the Comprehensive Plan's objective G4 which is to manage the location and design of new development to minumize initial and future pubhc and pnvate costs, policy G5 which is to encourage development that shortens the distance between residential areas, schools, shopping and employment centers, and policy H1 which is to encourage diverse and affordable housing choices. Subsection 15 03 030(3) of the City's Zoning Ordinance states that the purpose of the Two - Family Residential zomng district is to establish and preserve residential neighborhoods for detached single - family dwellings, duplexes and other compatible uses and to locate residential development with densities up to twelve dwelling units per net residential acre m areas receiving a full range of public services, including public water and sewer service, and police and fire protection. Figure III-3 of the Comprehensive Plan indicates that the compatibility of R -2 zone uses in the Low Density Residential designation depends upon site - specific considerations This property has public services, easy access and nearby retail and service uses that comply with the mtent of the R -2 zone. 5. Adequacy of public utilities. The northwest corner of the property is within Nob Hill Water Company's service area. Compatibility of proposed use. There was no testimony or evidence presented at the hearing of any incompatibility between existing uses and the uses allowed in the proposed zone. This area is in general proximity to existing mixed residential, shopping, school, medical care, and church uses. Since this is a non - project rezone request, compatibility of proposed uses will be determmed for future uses based upon Table 4 -1 of the Urban Area Zoning Ordinance. 7. Public Need. The existing pear orchard is no longer economically feasible and has with time become less compatible with the development of the surrounding neighborhood. The property can provide an opportunity for a variety of medium density housmg options that will meet the need for reasonably priced housing, while at the same time preserving the surrounding residential character Right of Way, Infrastructure and Traffic Concurrency. The engineering division and one letter from a service provider in the area suggested that additional street right of way should be deeded as part of the rezone. However, the recommendation of the division of environmental planning to defer both the public infrastructure requirements and right of way dedication requirements until development takes place on the site seems to be a practical approach at this time since the type and timing of any future development will play a crucial role in determining what will be needed. Deferral can be allowed if a deferment agreement acceptable to the City engineering division is provided. When specific land uses are proposed, traffic concurrency review will be required prior to development. CONCLUSIONS 1 The Hearing Examiner has jurisdiction to issue a recommendation to the City Council on this rezone application. The site currently is a pear orchard. There is no development plan being proposed at this time. Adjoining properties have the following characteristics: Location Existing Land Use North R -2 Residential East R -1 Assisted living facility /vacant parcel West R -1 Church South R -1 Residential Project Description The applicant is proposing the rezone this 4.26 -acre pear orchard from R -1, Single - Family Residential to R -2, Two - Family Residential. There is no development plan being proposed at this time. 1997 Yakima Urban Area Comprehensive Plan This rezone is compatible with the following Policies and Objectives of the 1997 Comprehensive: • The 1997 Yakima Urban Area Comprehensive Plan, Future Land Use Map designates this area as being suitable for Low Density Residential development. The Future Land Use to Zoning Map Consistency chart provides a guide to the compatibility of land use designations and the zoning districts. The Chart indicates that the Low Density Residential designation is compatible with the R -2 zoning district. • Objective G4: Manage the location and design of new development to minimize initial and future public and private costs. • Policy G5: Encourage development that shortens the distance between residential areas, schools, shopping and employment centers. • Policy H1 - Encourage diverse and affordable housing choices. Yakima Urban Area Zoning Ordinance Chapter 15.03.030 states that the purpose of the Two - Family Residential zoning district is to: a. Establish and preserve residential neighborhoods for detached single - family dwellings, duplexes and other uses compatible with the intent of this district; and b. Locate residential development with densities up to twelve dwelling units per net residential acre in areas receiving a full range of public services including public water and sewer service, and police and fire protection. UAZO RZ #8 -02; EC # 26 -02 Kohegan @ 4202 Englewood Ave. 2 The district is characterized by up to fifty percent lot coverage, access via local access streets and collectors, one and two story buildings, some clustering of units, and large front, rear and side yard setbacks. Typical uses in this district are single - family dwellings and duplexes. The density in this district generally ranges from seven to twelve dwelling units per net residential acre. However, development up to eighteen dwelling units per net residential acre may be allowed in accordance with Table 4 -1 in Chapter 15.04. This higher density development shall be allowed only on those limited occasions when, after Class 3 review, the reviewing official finds that the location and site plan of the project is such that the higher density would be compatible with neighboring land uses and the level of public services, and is consistent with the goals and objectives in the Yakima urban area comprehensive plan. Chapter 15.23.030 Rezone criteria Recommendations for approval of rezone applications are governed by seven criteria specified in Section 15.23.030 YMC. 1. Testimony at public hearing. To be considered by the Hearing Examiner. 2. Suitability of property for proposed use. The requested zoning change is suitable with the property in question because the property is served with all urban services and located in an area in general proximity to existing shopping, schools, medical care facilities, and churches. This location also offers easy access to transportation corridors and public transportation routes. 3. Recommendations from interested agencies. All agencies and city departments indicate that public services are available to the site and this rezone would not create any difficulties for infrastructure. 4. Compliance with the Comprehensive Plan. The 1997 Yakima Urban Area Comprehensive Plan, Future Land Use Map designates this area as being suitable for Low Density Residential development. The Future Land Use to Zoning Map Consistency chart provides a guide to the compatibility of land use designations and the zoning districts. The Chart indicates that the Low Density Residential designation is compatible with the R -2 zoning district. 5. Adequacy of public utilities. This property is currently served by all necessary public utilities, transportation corridors and public transportation routes. 6. Compatibility of proposed use. This area is in general proximity to existing mixed residential, shopping, schools, medical care facilities, and churches. Testimony at the hearing should be considered in determining whether this proposal is compatible with the surrounding land uses. UAZO RZ #8 -02; EC # 26 -02 Kohegan @ 4202 Englewood Ave. 3 7. Public Need The existing pear orchard is not economically feasible any longer, and has become less compatible with the development occurring in the surrounding neighborhood. The property will provide for an opportunity of in -city infill that will provide for a variety of medium density housing options. This would meet the need for reasonably priced housing options, while at the same time preserving the surrounding residential character. Development Services Team comments A design services team meeting was held on January 22, 2003 discuss the technical aspects of this proposal. The following is a summary of the comments received: Wastewater/Utilities Division — No comment Engineering Division - This site fronts on Englewood Ave. classified as a Collector Arterial. This classification is defined as an 80 -foot wide right of way, 40 feet on each side of centerline. The existing right of way fronting this site is 25 feet wide on this side of centerline. To be in compliance with Title 12, Development Standards, an additional 15 feet of right of way should be deeded to the City. This site frontage should be improved with asphalt widening to 27 feet from centerline to face of new curb, curb and gutter, a 5 -foot wide sidewalk and controlled drainage in accordance with the Collector Arterial street standard. This site also fronts on Douglas Dr. classified as a local access street. This classification is defined as a fifty -foot wide right of way, 25 feet on each side of centerline. The existing right of way fronting this site has not been established. As part of this proposal, I recommend 25 feet of right of way be deeded to the City. This site frontage should be improved to a Local Access street standard. North 42 Ave. dead -ends at the southerly boundary of this proposal. This street is classified as a local access street. I recommend that this proposal deed 25 feet of right of way from Douglas Drive to Englewood Ave. aligned with a continuation of 42 Ave. and that this 25 feet be improved to a local access street standard. Street lights should be installed at all street intersections and one mid -block between Douglas and Englewood. There is existing public sewer and water fronting this site in Douglas Drive. There is a water main existing in the extension of 42 Ave. to Englewood. The right of way should be deeded to the City as part of the rezone; the improvements should be deferred until such time as development takes place on site. UAZO RZ #8 -02; EC # 26 -02 Kohegan @ 4202 Englewood Ave. 4 Water /Irrigation — A discussion with Nob Hill Water will need to take place as the northwest corner of the property is in their service area. No other written comments were received. Transportation Capacity Management Ordinance This project was not reviewed under the Transportation Capacity Management Ordinance. The City Traffic Engineer will defer concurrency review at the time a building permit is applied for. State Environmental Policy Act A Determination of Nonsignificance (DNS) was issued by the City of Yakima on January 29, 2003. This determination was based on SEPA guidelines (WAC 197 -11 -355). There were two comment letters received on the environmental review of this rezone proposal during the 20 -day comment period, one from the Department of Ecology and the other from Yakima Regional Clean Air Authority. Public Notice Notice for the hearing was provided in accordance with the UAZO requirements in the following manner: Mailing of notices to adjacent owners January 8, 2003 Posting of property January 23, 2003 Legal Ad published January 23, 2003 Conclusions The Division of Environmental Planning for the City of Yakima, Washington has reviewed this rezone request and offers the following findings: 1. The requested zoning change is suitable with the property in question because the property is served with all urban services and located along a local access street. The property is w designated Low Density Residential by the Yakima Urban Area Comprehensive Plan and is located in a mixed -use commercial and residential area of the city. 2. Testimony at the hearing should be considered in determining whether this proposal is compatible with the surrounding land uses. 3. The proposed rezone is consistent with the future land use map designation as Low Density Residential. 4. All agencies and city departments indicate that public services are available to the site and this rezone would not create any difficulties for infrastructure. 5. All public notice requirements of YMC Chapters 15 and 16 have been completed. This classification is defined as an 80 foot wide right of way, the existing right of way is 25 feet wide. I recommend an additional 15 feet of right of way be deeded to the City. This site frontage should be improved with asphalt widening to 27 feet from centerline . to face of new curb, curb and gutter, a 5 foot wide sidewalk and controlled drainage in accordance with the Collector Arterial street standard. This site also fronts on Douglas Dr. classified as a local access street. This classification is defined as a fifty foot wide right of way, 25 feet on each side of centerline. The existing right of way fronting this site has not been established. As part of this proposal, I recommend 25 feet of right of way be deeded to the City. This site frontage should be improved to a Local Access street standard. North 42 Ave. dead ends at the southerly boundary of this proposal. This street is classified as a local access street. I recommend that this proposal deed 25 feet of right of way from Douglas Drive to Englewood Ave. aligned with a continuation of 42 Ave. and that this 25 feet be improved to a local access street standard. Street lights should be installed at all street intersections and one mid -block between Douglas and Englewood. There is existing public sewer and water fronting this site in Douglas Drive. There is a water main existing in the extension of 42 Ave. to Englewood. We have reviewed the application and have the following comment. Toxics Clean up Based upon the historical agricultural use of this land, there is a possibility the soil contains residual concentrations of pesticides. Ecology recommends that the soils be sampled and analyzed for lead and arsenic and for organochlorine pesticides. If these contaminants are found at concentrations above the MTCA clean up levels Ecology recommends that potential buyers be notified of their occurrence. Water Resources Any ground water development proposal that will withdraw water in excess of 5,000 gallons per day for single or group domestic supply, or for industrial purpose, or for the irrigation of more than Y2 acre of lawn or non commercial garden will require a permit from the Department of Ecology. On March 28, 2002 the Washington State Supreme Court ruled that permit exemption of RCW 90.44.050 does not apply "where a developer of a residential subdivision proposes multiple wells that will individually serve each lot in the development" which in combination exceed the exemption criteria. Proponent is also encouraged to file a Master Construction Dust Control Plan for projects planned now and in the future. The fee for a Construction Dust Control Plan is $205. • We recommend all vehicle travel and parking areas be paved. • If any of the present buildings should require demolition or renovation where asbestos could be disturbed, a Notification of Demolition and Renovation, filed with and approved by YRCAA is required. An asbestos survey must be completed, and all asbestos must be removed prior to demolition, per §3.07.F, G and H of YRCAA Regulations. The fee is set on the quantity of asbestos being removed. Is the requested zoning change suitable for the property, and how so? Yes, it is suitable because of the property's: • Physical Characteristics - The site has level topography, rectangular configuration, and at 4.26 acres offers one of the last easy -to- develop infill sites, very well suited to meet future residential demand within the City of Yakima. • Location in an existing, fully built -out, desirable residential area with close proximity to existing shopping, schools, medical care, and churches. This location also offers easy access to transportation corridors and public transportation routes. B. How is the rezone request in compliance with and /or how does it deviate from the 1997 Yakima Urban Area Comprehensive Plan? It complies in that the requested rezone maintains the residential character of the neighborhood. It deviates by requesting that duplexes (R -2), as well as single family homes (R -1), be allowed. This request mirrors existing duplex (R -2) development directly across the street from the subject, on the north side Englewood; and also one -half block south of the subject, on the south side of Richey Rd. C. Are there adequate public facilities capable of supporting the most intensive use of the new (requested) zone? Yes. Existing city roadways include secondary arterial Englewood on the north side of the subject site, and residential access street Douglas on the south side. An existing city water and sewer line run along Douglas in front of the subject property, and also there appears to be a trunk running north off Douglas along the subject's property line. Gilbert school is located one block south of the subject, while Gilbert Park is 3 blocks southwest. Chesterly Park and playfields are about a mile north. Neighborhood shopping is one mile north at Fletcher and N. 40th (Fred Meyers and strip retail), and also one -half mile south at Summitview and N. 40th Chalet neighborhood shopping center). Public transportation is available along N. 40th in the Englewood vicinity. D. Is the proposed change compatible with existing neighboring uses? Yes. The overall residential character of the neighborhood will not change, and in fact, granting the proposed R -2 zone will make an ideal transition buffer between the B -.1 professional office use immediately adjacent on the east, and existing single family homes 200+ ft. west across 44th Avenue. A church is currently sited immediately to the subject's west, providing a buffer between any future duplexes and the existing SFR's. The more intense uses boarding the subject site on the east include a 3 -story assisted living center and several medical clinics /professional offices. The vacant lot between the subject and the medical clinics has just been rezoned from R -1 to B- 1, demonstrating recognized need for more intensive land use in the subject's immediate vicinity. I 4 The change to R -2 will mirror existing, fully built -out R -2 zones immediately across the street from the subject, on the north side of Englewood; and also one -half block south, along Richey Road. The only single family residence immediately bordering the subject site is the old homestead associated with the subject property, which was segregated off from the pear orchard and sold by the Kohagens years ago. This single home -- surrounded now by institutional uses on the west and east (churches and a 3 -story high- density assisted living complex), and duplex - zoned development on the north -- is an artifact left over from the previous orchard use of the area. It does not represent current development trends and needs. E. Is there a public need for the proposed change? Yes. The existing pear orchard use of the site is not economically feasible any longer, and orchard use is really less compatible with the existing neighborhood than eventual duplex development would be, due to the routine use of toxic chemicals in the orchard. From a private market standpoint, the fact that all the existing R -2 land in the immediate vicinity is built out suggests economic feasibility for more duplex units. More recent duplex developments along Castlevale have received good market support. From a civic standpoint, facilitation of duplex development on in -city infill lots results in new housing opportunities in the city without a corresponding requirement for expensive extension of municipal services. There is also a public need for a variety of housing options, which eventual duplex development of the subject site could provide. This would help meet the public need for reasonably priced housing options, while at the same time preserving the subject neighborhood's residential look and feel much better than alternative option might, i.e. rezone to B -1 or R -3. The applicant wishes to rezone the property, from R -1, Single - Family Residential to R -2, Two - Family Residential. This is a non - project rezone, no development proposal has been submitted. This application is subject to approval. The application was considered complete for processing on January 2, 2003. The complete application is available for public review at the City of Yakima Planning Division, 2nd floor City Hall, 129 North 2nd Street, Yakima, Washington. ENVIRONMENTAL REVIEW The City of Yakima Department of Community & Economic Development is lead agency for this proposal under the State Environmental Policy Act (SEPA). The environmental checklist and other information on file with the Planning Division are available to the public upon request. Written comments concerning the environmental impacts for the proposal will be accepted during the 20 -day comment period which ends January 28, 2003. The threshold environmental determination will be issued under WAC 197 -11 -355, the Optional review process; there will not be an additional comment period. The threshold determination may be appealed to the Hearing Examiner by filing a written notice of appeal with the City Planning Division within five days of the date of mailing of the threshold determination in accordance with the City of Yakima Municipal Code 6.88.170.
